The undersigned is directed to refer to his Memo. No. 392/ORG dated 09/03/2017 and to say that the proposal for setting up of a new GRPP at Plassey Railway Station under Krishnagar GRPS of Sealdah GRP District and creation of 27 (twenty seven) regular posts of different categories under West Bengal Police for the purpose, was under active consideration of the Government for some time past.

2. Now, the undersigned is directed to say that the Governor after careful consideration of the matter, has been pleased to accord sanction to the setting up of a new GRPP at Plassey Railway Station under Krishnagar GRPS of Sealdah GRP District and creation of 27 (twenty seven) regular posts of different categories under West Bengal Police for the purpose, on the usual rate of pay & allowances of the post as detailed hereunder :

4. This order issues with the concurrence of the Finance Department vide their U.O. No. Group P2/2017- 2018/0489, dated 11/08/2017 and approval of the Cabinet vide its meeting held on 18/01/2018.

Sub :- Creation of 46 (forty six) regular posts of different categories in West Bengal Police for manning Police Station in the district of Nadia.

In terms of this Department’s Notification No. 343-PL dated 31/01/2018 read with Notification No. 342- PL dated 31/01/2018 a new Police Station at Palashipara in the district of Nadia has been created by bifurcation of the existing Police Station in that district.

2. Now, the undersigned is directed by the order of the Governor to say that the Governor is pleased to accord sanction to the creation of 46 (forty six) regular posts of different categories on temporary basis under West Bengal Police for a period of one year on the usual rate of pay and allowance for manning the said new Police Station at Palashipara in the district of Nadia, created vide Notification No. 343-PL dated 31/01/2018 as detailed hereunder. 5. The charge is debitable to the appropriate Head of Account in the State Police Budget.

6. This order issues with the concurrence of the Finance Department vide their U.O. No. Group P2/2017- 2018/0448, dated 04/08/2017 and has also been approved by the Cabinet meeting held on 19/12/2017.

Sub. :- Revised Proposal for creation of a new GRPP at Plassey Railway Station under Krishnagar GRPS of Sealdah GRP District – reg.

Kindly find enclosed vide memo. No. 381/C dated 07/12/2016 of Superintendent of Police, Railway Police. Sealdah regarding proposal for creation of a new Government Railway Police Post at Plassey Railway Station under Krishnagar GRP of Sealdah GRP District along with financial implication and crime statement of the proposed GRPP.

2. On scrutinizing the proposal the undersigned is in complete agreement with the necessity of creation of Police Post at Plassey Railway Station as proposed by SRP, Sealdah.

3. Previously the said proposal was sent to Spl. IG & DIG (HQ), West Bengal under the signature of the then DIGP, Railways, West Bengal vide his office memo. No. 1140/F.66-07 dated 12/11/2017. No information has been received so far about its status or fate. As more than nine (09) years have elapsed the financial implication of the creation of proposed GRPP have changed and hence the proposal is sent afresh.

4. As per the existing norms, the proposal has to be first agreed to by the State Government in principle before it is sent to the Railway Board by the General Manager concerned for sharing g 50% of the expenditure. The copy of memo. No. 70-SEC)HPG)/50-51/SC-Pt. Dated 16/03/79 of Railway Board, Govt. of and 8821 dated 04/06/80 of South Eastern Railway are enclosed for your kind perusal and ready reference.

5. In view of the above, it is requested to kindly move the Govt. of West Bengal in Home Department for creation of new GRPP at Plassey Railway Station under Krininagar GRPS of Sealdah GRP District.

Using mobile phone while driving a motor vehicle constitutes nuisance or danger to the public under Rule 21 of the Central Motor Vehicles Rules, l989, and the provisions of clause (f) of Sub-section (1) of section 19 of the Motor Vehicles Act, 1988 empower a licensing authority to disqualify such offender from holding a driving licence or revoke such licence. It is found that such act of distracted driving is often reported as one of the causes of road accidents, even while such matters often and skip the notice of enforcement authorities as well the f¢ÕQjh‰ Blr¡ A¢d L¡l, ih¡e£ ihe, B¢mf¤l, LmL¡a¡ - 27

coverage of CCTV installed at major junctions. It is felt important to book those offenders with evidence of violation of law in order to take actions with a view to minimize accidents. The matter has been considered carefully in view of the steps required for road- safety and it has been decided by the Government of West Bengal to adopt following measures in the respect. (i) In General considering the safety of passengers and other road users, the offence of using mobile phone while driving a vehicle, may also attract the penal provisions under section 184 (driving dangerously) of Motor Vehicles Act, 1988 and may be compounded under section 200 of the Act in terms of Notification No. 3205-WT/3M-15/2007 dated 30/06/2017. (ii) Further considering the potential danger to public and resultant fatality arising particularly out of accidents of heavy motor vehicle, both passenger and goods [i.e. buses and trucks], the offence of using mobile phone while driving may be punished with disqualification of the driver from holding driving licence and/or revocation of his driving licence in terms of Section 19 of Moto Vehicles Act, 1988 read with rule 21 (25) of Central Motor Vehicle Rules l989 by the appropriate authority, if deemed fit. (iii) Similar actions/punishment, as noted under para (ii) above may also be taken in case of the drivers of categories of vehicles, other than mentioned above, for any second or subsequent similar offence, if the appropriate authority deems fit. (iv) Any photographic and/or electronic evidence, as is admissible in the Indian Evidence Act. depicting a clear Picture of the driver using mobile phone while driving will be taken as a sufficient proof of the offence.

(v) Submission of such photograph and/or electronic evidence with details of place of occurrence by any authority or citizen may be accepted by Licensing Authority or Police Authority for taking action against the accused driver as per law. Information on details of the driver which is required to be provided by the owner in terms of Section 133 of Motor Vehicles Act, l988 may be used to identify the driver and taking action against him. All concerned authorities are directed to take necessary action in this regard.
