Chapter- 1.1

AREA & GEOGRAPHY

Location and Area :

Latehar is located 105 km north-west of the state capital, . Latehar “A Land of Garden and Forest” is an important district of the Jharkhand state . This district was created on 4th April in the year 2001. It is bounded on the north by Palamu and , on the south by Lohardaga & , on the east by and on the west by district.

Latehar is a famous for its forest and natural resources. It is situated at a height of 1,073 ft.above sea level. It has an excellent climate and beautiful scenery all around it in the midst of dense forest. It is rich in flora and fauna too.

The district of Latehar is situated in the 23°45′N 84°30′E / 23.75°N 84.50°E / 23.75; 84.50. It has an average elevation of 327 m (1,073 ft). The district headquarter is a part of medium plateau, which is situated at the height of about 1,073 ft from the sea level. Except the western part of the medium plateau, the whole area is surrounded by the dense forest. The height of lower plateau is about 802 ft above the sea level.

Geography and Physical Features:

The district forms a part of the Chotanagpur plateau. It is a region of plateaus, residual hills and valleys, which occupy the north-western half of the state of Jharkhand. The district may be divided into the following broad natural divisions:  The Central Plateau  The Lower Plateau,

The central plateau, averaging 1,073 feet high, is situated in the centre of the district and contains the town of Latehar. Around the central plateau, there are the lower plateaus on all sides except the west where a high ridge connects the central plateau to the Daltonganj District. The lower plateaus are average 802 feet in height, their surface being undulating. In

the north and northwest, the lower plateaus form fairly level tablelands until they reach the ghats when they drop to about 700 feet. On the east, the general elevation is lower and the descent gradual. Along the southern part of the district, the chief hills in central Latehar are Chandwara and Jillinga which rise above the central plateau to 2816 ands 3057 feet respectively above the mean sea level. To the south of the central plateau there is the Sugu hill which rises to 3203 feet and is separated from the Jillinga by the river Bokaro. Maran Burn hill lies south of the Damodar Valley between and Ranchi districts attaining a height of 3445 feet. Latehar is a predominantly forest district and nearly half of the total area is covered by forests which are distributed almost uniformly throughout the district.

Climate:

Annual Rainfall 1433 mm. Temperature - Max 42.20 and Min. 4.00 degrees Celsius. The district comes within the Tropical Monsoon Regions of the world. Three broad seasons can be recognized: The cool season, November to February. The hot season, of district is March to May. The rainy season, June to October.

In general the climate of Latehar plateau is much the same as that of Ranchi, average temperature of Latehar is 25.6 which is differing from the other neighboring districts not only in lower average temperature, but also in the comparative dryness of the air in the rainy season. After the break of the rains in June, the first three months are usually quite pleasant and by the middle of September the mornings offer cold weather. In contrast with , October is a delightful month. From November to the middle of February the only drawback is the occasional excessive cold which follows rain. If there is a good fall of rain in February it remains cool till the middle of March. From April to May, the day temperature, though high, is always below that of the neighboring districts and it is rare for the nights to be oppressive. The prevailing winds are, during the rains from the south- west, in the cold weather from the west, and in the hot weather from the north-west. The hot weather winds are sometimes dust-laden.

Water Condition:

The Latehar is only moderately supplied with perennial rivers and springs. The forest areas are strictly speaking deficient in water supply beyond the rainy seasons. Generally, all the streams and rivers begin to dry up shortly after the rainy months. During April &May, even the big rivers like the Auranga and Deonad look more or less like sands of desert rather than courses of water. Drinking water generally gets scarce during summer months and when there 6

is a prolonged hot spell, real misery about drinking water is experienced over most of the places in Latehar

Natural calamities:

Serious natural calamities are not common. Damage by flood is unknown in the area. Storms are local and do not cause any appreciable damage.

Forest:

The district is forest domination district. The total area under forest is 2245 sq.km (about 47.22%). Forest is rich in coal, limestone, fireclay and other minerals. The forest area of this district is full of medicinal plants and trees. Due to negligence and lack of awareness they are on the verge of extinct. The main trees found are Bamboo, Khaire, Mahua, Kusam, Kendne, Chiranji Asam, Piar and Vetwa. The economic significance of forest lies in their being producers of fuel wood, fodder, timber, kendu leaf. Leopards, bears, elephants, jackals and foxes etc. freely move in these forests. In the winter season several foreign birds visit these forests areas.

Due to mountains, forests, hills, rivers and valleys etc. the communication by road and rails are tedious and tiresome in this district. Much time is consumed for the travel. People of this area live in fear and terror due to extremist activities. Administration is trying its best to cope with this problem.

Many village forest management and protection committees have been formed in different block of district for forest protection. Out of the total land area of 2698.86 sq. K.M. of the Latehar Forest Division only about 1309.64sq K.M. are occupied by forests constitution only about 48.41 percentage of the land surface. The forests are more or less compact. .The forests of Latehar division comprise the reserved forests, Khasmahal Reserved or Khalsa Reserved forests, old protected forests and the (new) protected forests The forests are more compact in the southern, northern and western portions of the district. The forest vegetation as consequence gets inferior and thinner and less in value. The quality of forests is better in south of the Daltonganj Ranchi Road.

Mineral:

There are several ores and minerals in the naturally rich and beautiful district of Latehar. Iron, Coal is the main minerals. These minerals are very important from industrial point of view. China clay, fire clay, quartz, granite and limestone are also found in this district Occurrence of coal limestone iron-ore lead fireclay bauxite is known in the Latehar. A complex series of highly calcareous gneissose Schist with impure granular crystalline limestone lenticels and nodules of iron-ore are present in the Latehar

Energy :

Damodar Valley Corporation and Jharkhand State Electricity Board are two main power producer and supplier in the district. A 1215 MW thermal power plant is being constructed by the Abhijeet group (Corporate Group) at village Hempur block Chandwa. Power supply in Latehar is very poor in condition. Only 3 to 4 hr power is available out of 24 hr in the district town. In rural area the condition is not good.

IMPLEMENTATION OF THE SCHEDULE TRIBES AND OTHER TRADITIONAL FOREST DWELLERS (RECOGNITION OF FOREST RIGHT) ACT- 2006

Latehar is extemely backward district and covered with extensive hills and forest. Population of Schedule Cast & Schedule Tribes is more than 70% of total population and most of people under this category live inside forest areas. In Latehar, District Administration is trying hard to extend maximum benefit of Forest Rights Act to all eligible people. In order to spread information / awareness about Act, Camps/ Workshops are being organized at District / Block/ Panchayat Level. We are also making publicity by distribution of Phamplats/ Posters during Camps/ Public meeting and by putting up hoardings at Public Places. So far, 486 Village Level Committees, Sub Divisional Level Committee and District Level Committee have been constituted in the District. 3017 individual claims and 18 community claims have been received by Village Level Committee. All Revenue Personnel, Circle Inspector, Amin, Forest Officers are providing extensive support to Forest Committees for verifying the received claims and we are also involving NGO's in creating awareness & neccesary verification. We are engaging Private Amins in verification of claims & preparation of maps. Due to such extensive publicity & work culture, 1676 claims have been verified by Village Level Committee and after obtaining approval from Gram Sabha under chairmanship of Gram Pradhan, these claims have been recommended to Subdivisional Level Committee and after neccesary screening, 1319 claims have been recommended for patta by Subdivisional Level Committee to District Level Committee. 1319 pattas involving 2783.41 acers Forest Land have already been sanctioned by District Level Committee. Now we are focussing on verification of rest of the claims and expecting that by the end of July 2010, all the claims will be verified and disposed off. Patta to claiments will be distributed on 15th August 2010. In order to make these Pattas as Negotiable Instruments, necessary exercise has begun. All Circle Officers have been directed to make necessary correction in records of rights & to issue rent receipt & maps alongwith Patta. After distribution of patta, District Administration is going to associate all the Patta holders with MGNREGA schemes like Water Harvesting Tank/ Pond/ Irrigation Well/ Plantation/ Land Development as per need. Such kind of works will be taken in extensive manner. 14

Chapter- 1.5

IMPLEMENTATION OF PESA ACT (PANCHAYAT EXTENSION TO SCHEDULED AREAS) IN LATEHAR

43% of total population of Latehar District comes under category of Scheduled Tribes. And it makes the district as Scheduled Area District, which comes under Tribal Subplan. Latehar district is also home to many Primitive Tribes- Parahia, Birhor, Asur, Korba and Brijia. The main Tribes inhabiting in Latehar are Chero, Oraon and Kharwar. Under this backdrop, the Panchayats EXTENSION TO SCHEDULED AREAS Act (PESA) is also a key legislation that legitimizes the self- governing system already existing among the tribes. It also empowers the self- governing tribal system and the gram shaba with powers and responsibilities to decide the matters related to local governance.

Though, the pious intension of the act is good still a long way is to cover to make objective of the act into concrete reality. In this respect, the Latehar District Administration is taking genuine efforts in empowering the trible self- governing system to play key role in implementation of various governemt schemes especially Mahatma Gandhi National Rural employment Grantee programme (MGNREGP). The Latehar administration has legitimized many of the tribal self- governing bodies by engaging them to play pro- active role in deciding and determining the community structures/ assets required for them on basis of their practical needs. We are encouraging them to prepare micro plan for their panchayats through their active participation. It nurtured and infused democratic practices by encouraging them to take decision collectively by the Gram Sabha themselves on matters pertaining to their pachyayats. We have also entrusted the collective responsibility on them to execute, monitor, maintain and own the MGNREG physical structures by themselves. This is a beginning of a new era of tribal self- governance in the district.

In line with the recent Hon'ble Supreme Court Ruling on the panchayat, Latehar District administration is actively engaged in the preparation of holding elections to the panchayats/ legally constituting panchayats to give new life to the panchayats in schedule areas of Latehar District.

In the past, every village in the district had been allotted a fund of Rs 50,000 for development work. The released fund has been utilized for initiating development through 15

village schemes, which include works such as construction and repair of roads, improving drainage system. etc. The projects undertaken are executed under the guidance of Gram Pardhan.

We are committed to extend more power and authority to tribal Panchayts as per the spirits of the PESA Act. Days are not far off in which tribal panchayats will bloom by gaining greater strength and vitality in making grassroots democracy work for them to make significant impact in the life of the tribal families.

Chapter - 1.6

LAW AND ORDER SCENARIO IN LATEHAR DISTRICT

The existing law and order scenario in Latehar district as of now can be said to be partially under control. The district is a witness to the power struggle of various naxal outfits who are involved in a struggle for territorial hegemony. There are principally five splinter naxal outfits who have managed to carve out their respective spheres of influence namely the CPI (Maoist), the TSPC (Tritiya Samellan Prastuti Committee), the JPC (Jharkhand Prastuti Committee), the SJMM (Sangharsh Jan Mukti Morcha) and the JJMP (Jharkhand Jan Mukti Parishad).Barring occasional if rare skirmishes with the other splinter groups only CPI(Maoist) is involved with a direct confrontation with the district police forces often engaging in full all out exchange of fire and getting away with inflicting casualty on the forces. In these EOFs the police also make them suffer losses but more often than not like in other places and incidents in Jharkhand as the naxals manage to get away with the bodies of their cadre members the police cannot claim their successes which are a major psychological detriment.

The CPI (Maoist) is mainly active in the southwestern part of Latehar along with concentrations in the north central and north western parts of the district. The TSPC is active in the eastern part of Latehar, the JPC is limited to the south eastern part of Latehar , the SJMM

is active in pockets of eastern part of the district and the latest splinter group the JJMP is trying to carve out a sphere of influence in the central and south eastern part of Latehar ditrict. Of the various naxal outfits the CPI (Maoist) in terms of firepower, cadre strength and area of influence is the most virulent seconded only by the TSPC. The other splinter groups are limited to small pockets of influence. The JJMP which was headed by Sanjay Yadav is on a recruitment drive and the group is garnering a sizable support base of the Yadavas. However the death of Sanjay Yadav, the self proclaimed supremo of the outfit has left the organization riven with an ongoing internal power struggle within the group. Post-Sanjay Yadav the group is in tatters with three separate power factions emerging within the group itself, each faction leader claiming to be Sanjay Yadav’s successor. The district police is keeping a close watch on the developments. Apart from the JJMP which is on the verge of disintegrating or fracturing because of internal power struggle and dissension, other marginal LWE factions in the district are splinter groups like the TSPC I or TSPC Bindass(sic) headed by Bharat Ganjhu and the PLFI which is trying to carve out a territorial influence in pockets of Manika PS area and Balumath PS area under Diwakarji and Ravinderji respectively. Latest intelligence also suggest that the splinter group TSPC I / TSPC Bindass is trying to align with one of the factional leaders of JJMP. The TSPC I itself is as per latest intelligence divided into two factions with Bharat Ganhju and Kishore Ganju heading separate groups each claiming to be the leader of TSPC I.

The demographic profile of the district is wholly contiguous with the cadre base of the various LWE active in the district. The Yadavs and the Kherwars, Oraons form the backbone of the CPI (Maoist), even JJMP which broke off from the CPI (Maoist), their area of influence is consistent with the Yadav belt of south – central Latehar. The Ganjhus and the Bhuinyans are based in the areas of Balumath PS and Chandwa PS and they provide the support base to JPC and SJMM. The TSPC in Latehar has a mixed support base of the Ganjhus , the Bhuinyas and the Kherwars. This polarization of the LWE factions along the caste lines further intricates the internecine violence amongst the various groups resulting in a particularly bloody strife. This polarization while allowing for an opening to generate intelligence by the exploitation of inherent inter-rivalry, in the long run has not proved fruitful as caste factors more often than not prevent flow of qualitative intelligence against the LWE.

The Sikni coalliery area under Chandwa PS and the outlying areas in Balumath PS where illegal mining and transportation of coal takes place is witness to intermittent internecine violence amongst the LWE for levy. Illegal cultivation of opium is another cause of concern, which again has the support of the LWE factions and a source of internecine friction and a law and order flashpoint. The district police is particularly focused on the cessation of illegal trafficking in coal and opium to check flow of levy money to the LWE factions.

The presence of large mineral deposits in Latehar district and adjoining districts of Lohardagga and Gumla , the vast forested tracts in Latehar district (49% of the total district acreage) coupled with non employment scopes in Latehar district as well as lopsided employment profile in comparison with the bordering districts where mining concerns like the Hindalco offer better employment absorption of the populace and the fact that the freightage of the mined minerals pass through Latehar district allow for the flourishing of LWE outfits through the physiographic and topological make up of the district which provide concealment to the LWE outfits, the employment vacuum which provide for resource tapping of the LWE both physical and ideological, and through the mining concerns both legal and illegal which provide for easy money through extortion for levy.

The Sikni coalfield area under the aegis of Jharkhand State Mineral Development Corporation and the Tetariyakhand coalfield area run by CCL both are roughly contiguous with the areas of Chandwa and Balumath PS area respectively. Both these coalfields along with the varied illegal coal mining blocks that lie intermittently provide rich pickings for the various LWE elements that specifically for the easy money from the area are in a continuous struggle for control of the area. All the splinter groups including the CPI (Maoist) are striving for a share of the pie. Even the local police to be perfectly candid are not above suspicion in dipping their fingers in the honey jar that is the illegal coal trafficking in the area. Inspite of close monitoring of senior officers this has been the bane of the Chandwa and Balumath PS. There is even intelligence that a large number of transportation trucks being used in the coalfields are owned and run by the LWE leaders.

Apart from illegal trafficking in coal and opium, road crimes and kidnapping for ransom is another major cause of concern. Road robbery/looting is primarily prevalent in the Mahuadand – Garu axis where because of the naxal threat regular road patrolling cannot take place. The heavy forestation in between and the long distance between Mahuadand PS

and Garu PS prevent effective patrolling along the stretch which are used by the criminals to their advantage. The rate of road crime along Latehar PS and Manika PS has come down with the establishment of Patki picket on the road. Rise in road crime on the Manika PS – Barwadih PS – Satbarwa OP (Palamau District) border is a cause of concern. In January 2009 the police party of Manika PS was blown up in an IED bomb blast set off by the naxals on the Highway, preceding which an ambush was also laid on 02 previous occasions along the Barwadih road and the Manika – Satbarwa road respectively following which regular road patrolling along the highway was discontinued. This situation again is being exploited by the criminals. Although road sanitization exercises are being executed from time to time but in absence of regular road patrolling road crimes do occur along this axis especially in the border areas.

Kidnapping for ransom is another crime head that has seen a spurt in the past few months. Since October 2009 till date the district has seen three instances of kidnapping for ransom and one attempt to kidnap which was timely foiled because of immediate information to the police in which one kidnapper was apprehended and the kidnapped person rescued. It must be mentioned that in the three instances of kidnapping that have recently occurred the indirect support of Sanjay Yadav and the JJMP cannot be ruled out. As per partially verified reports criminal gangs owing allegiance or providing tacit support to JJMP have been involved in the recent crimes of kidnapping for ransom. JJMP may have been providing outside support for the fact that the neutralized JJMP leader Sanjay Yadav was desperate to enlarge his support base at any cost and also was desperately in need of financial buttressing to strengthen his fledgling outfit.

Apart from the crime heads enlisted another law and order situational flashpoint in the district is the anti-administration public demonstrations staged at the behest of the naxals against any arrest/apprehension made by the police. The Badhania incident for which there was a sustained public outcry under explicit instigation of the CPI (Maoist) is a glaring example. Even arrests/apprehensions of middle level LWE activists have led to public protests and staging of dharnas in front of the police stations.

The CIC section of the South Central Railway runs through the district and there are altogether twelve railway stations in the jurisdiction of the Latehar district. Railways being a declared soft target by the naxals , there have been a spate of violence directed against the railways in the district during the bandhs called by the LWE organizations. The CIC section is the life line of coal freightage in the South Central Railway Division and the fact that it

passes through the densely forested tract of Latehar , vis `a vis the naxal menace the section becomes a very soft target for the LWE . The violent naxal attacks focused on the section in the past and recent present testify to the fact. During bandhs the protection of railway property is a cause of major concern for the district police given the fact that two thirds of the railway stations along the CIC line lie in heavily forested areas providing good cover to the naxals to approach and escape after committing violence with impunity. Lack of approach routes to the CIC section prevents quick and effective deployment of forces to counter this perpetual threat. The total length of rail track from Nindra Halt to Barwadih Railway station is around 102 kms. This distance in conjunction with the forestation along the intermittent stretches of the railway stations and the absence of approach roads creates a very difficult tactical deployment scenario.

The LWE concentration points in the districts being far and between, the evacuations of police camps from schools which are situated at ideal places as per tactics has also limited the strike capabilities of the police. As on today there are no permanent police pickets established in any school building in Latehar. However with the funds allocated for fortifications, seven pickets have been set up in the district with proposals readied for more. The district of Latehar has witnessed naxal violence in a large scale. The most recent being that of the Hehegarha railway station being blasted by the CPI(Maoist) in which a police constable lost his life in the exchange of fire and the daylight ambush and IED blasting on the Barwadih mainroad in which five policemen lost their lives with five injured. To negate the naxal threat of IEDs and planned ambushes, the police forces in the district manning the pickets and the police stations and the CPMF camps have from time been issued detailed written instructions to follow in the movement of forces during operations and sanitization exercises. Dos and Don’ts regarding receipt of information and reaction to various informations have been drilled into the men. The officers have been instructed to analyze inputs received and only on proper supervision of senior officers to ensure movement. The officers and men are routinely sensitized on the threat of casual movement by orders both written and oral. Every officer in charge has been instructed to intimate to superior officers of any movement that requires going into the hinterlands. Routine ROP duties are from time to time monitored at a senior level. ROP check points are shifted from time to time especially on the highway. All elements of tactical movement are being tried to be adhered to in operations and routine movements with special focus to avoid set pattern of movement. All posts especially manned by non- CPMF/SAP are regularly made to exercise stand to drills with briefing monitored at senior levels on fire drills and perimeter sanitization drills.
