COMMON ORDER

Note of the Orders of the Tribunal Registry Order No. Date : 1st September 2015

The 12th respondent has filed status report. It is seen that in respect

of Ganapathipuram (Pallavapuram Transfer Station) entire work has been

completed and the entire garbage collected from Pallavapuram Town is

being transferred to Vengadamangalam on and from 18.8.2015. It is also

stated that the study to assess as to whether the method of transfer of

garbage by means of transfer station and its necessity is also referred to

Anna University for its evaluation and necessary fees has been paid on

31.8.2015 and on receiving the report further process will be decided.

In respect of Kannadpalayam (Tambaram Transfer Station) it is stated

that the entire transfer station work has been completed and the transfer of

garbage from Tambaram was started from 30.6.2015 and it is now in full

fledged transfer and there is no accumulation in Kannadapalayam.

Even though this statement is objected to by the learned counsel appearing

for the applicant, the officers who are appearing before this Tribunal have

stated that they will see that no garbage will be dumped in

Kannadapalayam and full fledged transfer will be effected.

It is always open to the applicant to file appropriate affidavit on the next date of hearing. It is also stated that in respect of the existing transfer station the study regarding the construction had been handed over to Centre for

Environmental Studies of the and necessary fees has been paid and the said respondent is awaiting the report from the Anna

University. As soon as the report is received, necessary action will be taken.

Regarding Venkatamangalam MSW Plant it is stated that the entire machinery upto the stage of manufacturing of the refuse derived fuel has been completely erected. Consent to operate has been obtained on

29.5.2015 and the plant is in the trial run from 14.5.2015 and has reached its full capacity of 300 Tons by 15.7.2015. It is also stated that in respect of the emission of odour the said work has been entrusted to the Anna

University and the report is awaited.

Regarding Sembakkam Municipality it is stated that Tambaram

Municipality has passed a resolution to accept the garbage of Sembakkam municipal area in its transfer station at Kannadapalayam. It is also stated that the transfer of garbage collected from Sembakkam area will be commenced from 4.9.2015. Further for the study on the necessity for a separate transfer station the matter has been again entrusted to Anna

University and report is awaited. It is also stated that the alternate site for dumping is being considered. The learned counsel for the applicant has submitted that he will also suggest an alternate site to the authorities concerned. We make it clear that the authorities shall consider the alternate site that would be suggested by the learned counsel for the applicant and pass suitable orders. It is stated that as far as the day to day garbage is concerned that will be transferred forthwith. As far as the

garbage already in existence, after the receipt of the report from the Anna

University suitable action will be taken.

Regarding the restoration of Periya Eri, we have directed in our earlier order that the Government should pass appropriate orders within three weeks from the date of said order viz., 4.8.2015. The learned counsel appearing for the 12th respondent has submitted that they are awaiting for the Government order and as soon as the order is passed the restoration work will be carried out. We direct the State Government to pass such orders expeditiously in any event within a period of two weeks from today.
