61 Indemnification The ESC Region 8 and TIPS is a Texas Political Yes Subdivision and a local governmental entity; therefore, is prohibited from indemnifying third parties pursuant to the Texas Constitution (Article 3, Section 52) except as specifically provided by law or as ordered by a court of competent jurisdiction. A provision in a contract to indemnify or hold a party harmless is a promise to pay for any expenses the indemnified party incurs, if a specified event occurs, such as breaching the terms of the contract or negligently performing duties under the contract. Article III, Section 49 of the Texas Constitution states that "no debt shall be created by or on behalf of the State ... 75 Texas Education Code Chapter 22 Contractor Introduction: Texas Education Code Chapter 22 requires Some Certification for Contractor Employees entities that contract with school districts to provide services to obtain criminal history record information regarding covered employees. Contractors must certify to the district that they have complied. Covered employees with disqualifying criminal histories are prohibited from serving at a school district. Definitions: Covered employees: Employees of a contractor or subcontractor who have or will have continuing duties related to the service to be performed at the District and have or will have direct contact with students. The District will be the final arbiter of what constitutes direct contact with students. POTENTIAL HAZARDS • Toxicity: polyethylene is chemically unreactive and is generally regarded as being biologically inert. According to the information available to us, the product is not harmful to health providing it is correctly handled and processed according to the given recommendations. • Inhalation o Fume evolution: there is no release of any noxious fumes from polyethylene at ambient temperature. o Dust generated in processing polyethylene yarns and tapes presents no special hazard but atmospheric dust levels should be kept below the TLV of 10gm/m³ for nuisance dusts.

INGESTION Although polyethylene is inert and can be regarded as harmless, certain additives could be harmful and ingestion is not recommended.

PHYSICAL CONTACT Polyethylene yarns and tapes are not considered to be a skin irritant, but where lubrication has been applied as a processing aid, this may cause irritation, particularly to the eyes. Eyes affected by lubricant should be washed with cold water for fifteen minutes with eyelids held open.

Burns caused by molten material require hospital treatment.

FLAMMABILITY Polyethylene is flammable but difficult to ignite. Store in a safe area. Water, foam CO₂ and dry extinguishing media are suitable. The following can be given off in a fire: CO, CO₂.

The product contains combustible polymers therefore relevant fire protection measures apply.

HANDLING PROCEDURES Practice normal industrial hygiene. Sweep up to prevent slipping. Gaseous products of degradation can be given off if the product is greatly overheated.

WASTE DISPOSAL To be carried out in accordance with Local Authority Regulations. UK Environmental Protection (Duty Of Care) regulations (EP) and amendments should be noted (United Kingdom).

Bonar Yarns endorses the recent work done by the Synthetic Turf Council (STC) regarding the investigation into the use of lead in synthetic turf, and welcomes the US Consumer Products Safety Commission (CPSC) statement confirming that synthetic turf is not harmful for all users from athletes to young children.

HEAVY METALS STATEMENT

To determine the impact of our yarns in the environment, we recently carried out a test- program with a well-established German institute. The test program determined the content of heavy metals in our yarns, and to what extent heavy metals could end up in the environment during (acid) showers, searing heat and sunlight.

The table below lists the "concentrations" of heavy metals in our grass yarns, as tested at the institute for ecological building products, headed by Dr. Grunder.

Conclusion – Bonar grass yarns may be used anywhere without restriction, even in sensitive areas. Bonar grass yarns may also be recycled, dumped or burnt as normal waste.

For all elements except Mercury - small pieces of the synthetic grass blades were dissolved in concentrated nitric acid using a hot block or hot plate digestion. The digested sample solutions were then analyzed for element content using inductively coupled plasma atomic emission spectroscopy. This analysis tests for the total amount of the element that can be extracted from the material.

Mercury is analyzed by acid preparation and reaction to generate a Cold Vapor Atomic Absorption Analysis via EPA 7471A

DESCRIPTION SUMMARY All grass or UV stabilised samples are tested in an Atlas Ci4000 Weather-O-Meter.

The machine above is a xenon arc weather-o-meter (WOM); this differs from the standard QUV as it tests the samples over the full light wavelength, rather than the UVA or UVB wavelength. This gives us a more accurate picture of how the yarn would behave under real life conditions.

All samples are tested according to the international standard ISO 4892-2:2006(E), Plastics-Methods of exposure to laboratory light sources- Part 2: Xenon-arc lamps.

This test method specifies the temperature at which the samples are subjected, the length of rain cycle and the humidity cycle.

The samples are tested before weathering for strength and extension at break. This is the reference point to which subsequent samples are compared against.

The samples are put on holders and slotted onto the globe shaped rack.

The retained strength samples are tested according to British Standard BS 4611:1989 Methods of tests for Polyolefin tape yarns. The colour fastness samples are tested according to International Standard ISO 105-A02 Textiles- Tests for colour fastness- Part A02: Grey scale for assessing change in colour.

Not all grass yarns are tested in the WOM, the reason for this is because we have limited space and a full WOM test takes a very long time.

What we try and do is test each colour, and each polymer at the lowest thickness and the most common thickness.

The dtex and the fibrillation pattern do not affect the outcome of the WOM test; it is the thickness that is critical. If a yarn passes the test at the lowest thickness it will certainly pass at a higher thickness.

This is because the pigment, UV stabiliser and polymer concentrations are the most critical parameters. The thinner the film the more light can pass through and attack the colour and the polymer.

All colours and polymers degrade over time, some faster than others, no colour or polymer is “bullet proof”, what we try to do with our WOM is determine how our fibres will perform under the harshest conditions, so we can give our client an accurate UV warranty.

All colours are tested to 6000 hours in the WOM, they must be no lower than 3 on the grey scale in order to pass. A 1 being the worst and a 5 being no change in colour. See explanation of grading system on next sheet.

For retained strength the sample is tested for tensile properties before weathering and then 6 sample holders are put in the machine and one holder is removed at several intervals and tested for tensile properties, this result is compared to the un-aged sample until the sample reaches 50% retained strength, then the test is complete.

The retained strength test differs for each of the colours, some more exotic colours as you may imagine have shorter life spans than say the standard sports green. In general we like to see the exotics get to at least 6000 hours, and the standards get to 10 000 hours, so we can be comfortable giving our warranty to the yarn.

COMPARISON WOM/OUTDOOR EXPOSURE The average global radiation-energy in South Florida is almost 2 times as high as in the UK. In addition the sunlight in South Florida contains approx. 6.1% UV radiation and the sunlight in the UK approx. 5% this means:  1 kLy in South Florida has the same ageing effect as 1.22 kLy in the UK  The acceleration factor of the WOM against the 150kLy area (e.g. South Florida) = 5 times.  The acceleration factor of the WOM against the 80 kLy area (e.g. UK) = 9.4 times

In the WOM the “sun” is shining always straight and perpendicular onto the exposed sample and the maintained test- chamber temperature, is always as high like the maximal temperature in South Florida.

In reality (pitch situation) the angle of the sun is only for part of the day directly on top of the pitch surface, and the temperature varies throughout the day, so depending on the construction and yarn types the yarn is not fully exposed to the sun at all times.

Calculations outdoor: The radiation energy (dosage) per year in an area of 150 kLy is:  150 kLy x 41.84 MJ/m2 = 6276 MJ/year

Relation or correlation between WOM and outdoor exposure:  The radiation in the area is 150 kLy or 6276 MJ/year  The radiation in the WOM is 3.6 MJ/hour  To match 1 year (=8760 hours) outdoor exposure we need 6276:3.6 o = 1743 hours or 10.3 weeks in WOM
