13 MESSAGE FROM THE LEGISLATIVE COUNCIL
The Deputy Speaker reported a message from the Legislative Council dated 19 June 2019, returning the Crimes (Administration of Sentences) Amendment (Inmate Behaviour) Bill 2019, without amendment.
14 NOTICES OF MOTIONS SOUGHT TO BE ACCORDED PRIORITY
(1) Mr Alister Henskens made a statement in support of his notice being accorded priority over the other business of the House.
(2) Mr Jihad Dib also made a statement in support of his notice being accorded priority—
That this House:
(1) Acknowledges that in March 2019, the Premier claimed that the people of New South Wales could 'have it all', but that the 2019-20 Budget has failed to commit any money to support the full Gonski Funding model.
(2) Denounces the Government's decision to push New South Wales public schools down the failed path of an outcomes-based funding model.
(3) Highlights, that whilst the Government pays lip service to high professional standards, at the time of an unprecedented curriculum change and increased teacher accreditation process, they have cut the New South Wales Education Standards Authority's budget by over $25 million.
(4) Calls on the Government to rule out any further cuts to specialist frontline teacher support in the New South Wales public education system and takes offence at these professionals being dismissed as dispensable back office staff.
(5) Notes the cynical and non-transparent approach used by the Government in announcing 117 school builds and upgrades with absolutely no detail regarding the scope of work, the budget, or the timeframe.

15 MOTION ACCORDED PRIORITY—OPPOSITION LEADERSHIP
Mr Alister Henskens moved, pursuant to notice, That this House:
(1) Notes that after 86 days, the Opposition still do not have a leader.

(6) Mr Gareth Ward moved, That the following message be sent to the Legislative Council:
MR PRESIDENT
The Legislative Assembly having considered the message dated 18 June 2019 in which the Legislative Council requested the concurrence of the Legislative Assembly with amendments to the Ageing and Disability Commissioner Bill, informs the Legislative Council that the Legislative Assembly agrees with amendments 1 – 3, 5 – 12, 15 – 31 and 35, but disagrees with amendments 4, 13, 14, 32 and 34 because:
1. The Bill already ensures that the Commissioner is not subject to the control or direction of the Minister, which is the intent of Opposition amendment on Legislative Council Amendment 4, and therefore is unnecessary. Consistent with other independent statutory officers, the Commissioner is accountable to the responsible Minister who is in turn accountable to the Parliament and the people of New South Wales.
2. Legislative Council Amendment 13 would provide stronger powers than are available to the Ombudsman or the NSW Police Force. No safeguards are provided for in the Bill to appropriately limit the exercise of this power. It is likely to disproportionately affect disadvantaged and vulnerable people.
3. The penalties which are increased by Legislative Council Amendments 14, 32 and 33 are disproportionate to the offences to which they relate and lack parity with similar offences across the statute book. 182 VOTES AND PROCEEDINGS OF THE NEW SOUTH WALES LEGISLATIVE ASSEMBLY Wednesday 19 June 2019
4. The Government strongly opposes Legislative Council Amendment 34 as its intention appears to be to redirect appropriated funds for a specific purpose. This would make the bill an appropriation or 'money' bill and therefore unconstitutional or in the alternative, has no legal effect.
