C4/04 It was moved that an amendment to C60/03 be adopted “. That if gloves are not worn then rings must be taped” to read as follows.

“The only jewellery permitted to be worn by riders when mounted are studs in the ears and wrists (medical alerts are permitted). If gloves are not worn then rings must be taped”. Also refer to C4/04

C6/04 It was moved that PCA adopt the following EFA/FEI Showjumping rule.

“1 penalty for every 4 seconds commenced over the time allowed in all rounds except the final jump off.” This motion has been superseded by C69/04.

C7/04 It was moved that the One Day Event rules for the Showjumping Phase be altered in line with the current EFA Horse Trials rules as below.

C8/04 It was moved that the following (EFA Horse Trials) rule be adopted

“At obstacles or elements with height (exceeding 30cm) a horse is considered to have refused if it stops in front of the obstacle to be jumped.

At all other obstacles (i.e. 30cm or less in height) a stop followed immediately by a standing jump is not however penalized, but if a halt is sustained or in any way prolonged, this constitutes a refusal. The horse may step sideways but if it steps back this is a refusal.

After a refusal, if a competitor redoubles or changes his efforts without success, or if the horse is represented at the obstacle after stepping back and stops or steps back again, this is a second refusal; and so on.”

C23/04 It was moved that the ‘Stayput Seat’ is not permitted at pony club.

AGM9/04 That the following sub-clause shall be added to Schedule "A" of the Association Rules.

'5.8.5. Notwithstanding clause 5.7. hereof a Professional who is a parent or guardian of a Junior or Associate riding member of a club may apply to become a member of that club and if elected to membership in accordance with these rules will enjoy the same rights and privileges and be subject to the same obligations as any other member.

EXCEPT THAT: -

(i) Such Professional shall not be eligible to hold the position Club Senior Instructor or Zone Chief Instructor; and

(ii) Such Professional’s membership shall immediately cease when he or she is not a parent or guardian of a Junior or Associate Riding Member.' " This motion has been incorporated into the current Constitution

C35/04 It was moved that C7/04 be rescinded with respect to the penalties for exceeding the time allowed in the showjumping phase of a one day event and be replaced with ¼ penalty for every second commenced over the time allowed. This motion has been superseded by C69/04

C38/04 It was moved that E grade showjumping competitions and the showjumping phase of a one day event be conducted at a maximum of 325m/min.

C44/04 It was moved that Zone Chief Instructors be required to send in a list of attendees at their Zone Instructors Schools together with notification of the school including the details of any first aid lecturer.

C46/04 It was moved that the minimum age for Showjumping Course Design Schools is 17 years or riders with a C* or K certificate maybe considered dependent upon numbers.

C49/04 That the Bounce Pony event be removed from the PCA Handbook.

C51/04 That the penultimate paragraph on page 7-7 of the handbook of the Pony Club Association of New South Wales (Blue Book – 2004 Edition) be amended by deleting the following: -

(Supported by a medical certificate) and ‘Either suitable’

So that the paragraph will read as follows: -

“Prescription spectacles, or ASA standard safety sunglasses are the only spectacles or glasses to be worn whilst riding.”

C68/04 It was moved that teams be named a colour if there is more than one team from a club or zone.

C69/04 It was moved that C35/04 be rescinded with respect to the penalties for exceeding the time allowed in the showjumping phase of a one day event.

Noted that the penalties for exceeding the time allowed in the Showjumping phase of a One Day Event are as per the PCA Handbook (fifth edition) being 1 penalty for every commenced second over the time allowed.

C82/04 It was moved that Rowel type Spurs be allowed for Sporting events in all age groups. Also see motions C59/10 and C88/04

C83/04 It was moved that following words be added to the PCA Handbook 3-10, 18 Championship Advisory Committees, “with the power to co-opt”.

C88/04 It was moved that the following definitions be adopted. Definition of rowel spurs – The length of the shank not to exceed 4.5cm from the shank to the centre of the rowel. The rowel at its tip or outside edge to be as thick as a $2 coin. Definition of dummy spurs – as per PCA Handbook

C89/04 It was moved that rubber bit guards are not permitted for .

C90/04 It was moved that the following be added to the Bit Dictionary additions – Waterford bit, KK Training bit, Split reins (rounders) be included i.e. two reins from the bit to a single rein allowing adjustment of individual reins.

C91/04 It was moved that the following be accepted. Dressage Judge Accreditation – recommended that there be three levels of PC Dressage judges as under: PC Level 1 Preliminary level PC Level 2 Novice level PC Level 3 Elementary level

C92/04 It was moved that that riders in Jumping Equitation be categorised as under – Novice Intermediate Advanced Under 13 years 45cm 60cm 75cm 13 & Under 15 years 60cm 75cm 85cm 15 & under 17 years 75cm 85cm 90cm 17 & under 25 years 75cm 85cm 95cm

Noted that the above can be used for club and zone competition, the state championships will remain the same.

C93/04 It was moved that the following be adopted. – That, with the exception of the State Championship, riders who are eliminated on a technical point may continue the competition. Riders who are eliminated for falling off or any other breach of the rules, which may compromise either the safety of the rider or horse, may not continue.

C94/04 It was moved that the following be adopted.

Eventing – That horses that are marked by the Dressage judges as being either lame or uneven shall be examined by a Veterinarian (at the expense of the competitor) before continuing in the competition. Updated July 2020 3

C51/05 It was moved that Zones are required to give two (2) weeks notice of cancellation of Instructors Schools otherwise they are liable for one (1) day of the instructors fees.

C57/05 It was moved that the following amendment that “the Scudahoe event, subject to changes be included in the Sporting section of the handbook • Under 5 second penalties alter to knocking barrel ‘down’, ‘dislodging rail’. • Under elimination knocking peg ‘down’, touching barrel with hand. • Alter description to read 20l drum on side ‘or similar’.

C58/05 It was moved that the “Straight Barrel Race, see attachment, be included in the Sporting Section of the PCA Handbook.

C60/05 It was moved that all persons must wear an approved AS/NZS 3838 Equestrian Helmet whilst lunging a horse/pony at any Pony Club fixture. Part of the motion has been superseded by C27/12.

C61/05 It was moved that for the Under 12 years Bondfield Bounce: Plastic drums to be used at State Sporting Championships, be of 205 litre plastic drums cut down so that the height of the obstacle does not exceed 40cms. Motion has been superseded by C75/13

C62/05 It was moved that all riders 17 years and over be permitted to wear Roper or Dogger type boots with riding trousers for Sporting and Campdrafting. Motion has been superseded by C24/12

C67/05 It was moved that in future at all state championships there should be a helmet parade for all competitors after the fitness check where permitted helmets will be suitably tagged as such. The tag shall be maintained in situ until after the parade.

C8/06 It was moved that open sided stirrups are not permitted for use in pony club.

C15/06 That clause 2 (page 5-1) of the PCA Handbook shall be deleted and in lieu thereof the following shall be inserted: -

2. Closing dates for applications to host State Championships are as follows: -

Each application shall be in writing in accordance with Clause 1 hereof and include the information in accordance with Clause 3 hereof and must be received at the Association office: -

a) For Sporting and Campdrafting, Jumping Equitation and Showjumping State Championships at least seven (7) days prior to the March/April meeting of the Council in the year prior to the State Championships to which the application refers; b) For Mounted Games, One Day Event and Showriding State Championships at least seven (7) days prior to the July/August meeting of the Council in the year prior to the State Championships to which the application refers; c) For Dressage State Championships at least seven (7) days prior to the November/December meeting of the Council in the penultimate year prior to the State Championships to which the application refers; d) If there is only one valid application to hold a State Championship provided that the Council considers that application to be satisfactory the Zone making such application shall be appointed to hold the subject State Championship. If there are more than one (1) valid application to hold a State Championship which the Council considers satisfactory the application which is accepted to hold the subject State Championship may be decided by the Council by a simple majority;

e) If there are no valid applications received for a State Championship or if only one is received or more than one and the Council declares that the one or all of them are unsatisfactory for any reason whatsoever, applications to host such State Championships shall be called for the ensuring meeting of the Council (the “second meeting”) to be received in writing in accordance with this section at least seven (7) days before the second meeting; f) At the second meeting applications shall be considered in the following priority: - i) Written valid applications received at least seven (7) days before the second meeting; ii) Written otherwise valid applications received prior to the second meeting; g) If there are one or more applications pursuant to the sub-clause (f)(i) above considered by the Council at the second meeting to be satisfactory that one or it more than one the one of them chosen by the Council by simple majority shall be accepted to host the subject State Championships; h) If at the second meeting there has been no appointment pursuant to sub- clause (g) above the Council may accept an application in accordance with sub-clause (f)(ii) if more than one by simple majority; i) If there has been no appointment at the second meeting to host any State Championship the Executive may appoint a Zone or Zones in conjunction to host the subject State Championships.

Sporting C24/06 It was moved that a fall of horse and/or rider incurs elimination from that event.

Campdrafting C25/06 It was moved that the PCA adopt the ABCRA rules in the case of a rerun if one or more beasts break the camp the lowest cut-out score will be used.

Jumping Equitation C26/06 It was moved that the height of fences in the Associate division at the State Jumping Equitation Championships be increased to 95cm.

Showjumping C27/06 It was moved that PCA adopt the following EFA rule changes • Third (3rd) refusal incurs elimination in all grades • Restart – after a knockdown/refusal that the time is restarted when the horse’s front feet leave the ground and six (6) seconds is added to the time for the round. • Penalties are incurred if the rider passes the extended line of the fence to be jumped.

C28/06 It was moved that the Pony Club Association of New South Wales Inc adopt the Syllabus of Instruction (PCA).

C29/06 It was moved that any person attending an instructors school, if they can only attend one day of a school then that person must attend the first day unless prior arrangements have been made with the Zone Chief Instructor

C30/06 It was moved that Club Examiners be required to attend at least one (2-day) state examiners workshop in each three (3) year period to begin from 1st July 2007.

C31/06 It was moved that hacking canes (with or without a flap) not exceeding 75cm in length overall are permitted in Riding and Hacking classes only. Updated July 2020 6

C40/06 It was moved that the State Dressage Championships shall be held during the last full weekend in August in lieu of the third week end in January in each year and that the handbook should be amended after the word August in clause 1.g on page 4-2 thereof by deleting the words after ‘Dressage’ and before ‘Sporting’ and in lieu thereof by inserting the following: -‘end of June in the year prior to the championship. This motion has been superseded.

C41/06 It was moved that for State Sporting Championships the age groups should be amended as follows: -Under 11 years, 11 years and under 13 years, 13 years and under 15 years, 15 years and under 17 years and finally, Associates.

C56/06 It was moved that planks should not be used for securing balloons in the Balloon Bursting Race.

C57/06 It was moved that the rings in the Sword Race should be the same colour in each lane and to be an easily visible colour.

C66/06 It was moved that the fourth paragraph on 7-6 of the PCA Handbook be amended with the addition of “or long sleeved” after ‘short’ to read:

C68/06 It was moved that after paragraph three on 7-5 of the PCA Handbook the following be added.

Riding Trousers may be worn when competing in all Flat work events as Club and Zone level only (the exception being Dressage, Showjumping and Eventing competitions).

Please note that at Club level riding trousers may be worn in competitions and rally days in all disciplines as per motion C25/12.

C69/06 It was moved that a fall of horse and/or rider during a dressage competition, between the time of entry and the time of exit at A, will be eliminated.

C7/07 It was moved that applications for selection into the Mounted Games squad at the State Mounted Games Championships be submitted with entries for the State Championships on the State Camp application form attached to the entry schedule. Part of the motion has been superseded by C14/12

C10/07 It was moved that PCA allow EFA members to attend its showjumping course design, showjumping judges and jumping equitation judge’s schools.

C15/07 It was moved that rider’s aged 13, 14 and 15 years be eligible for selection of the Mounted Games squad at the State Mounted Games Championships. Motion has been superseded by C24/08.

C17/07 It was moved that the Square Yard Race event be included in the PCA Handbook section 11 – as per attached diagram Updated July 2020 7

C58/07 It was moved that the seventh paragraph of page 7-7 of the PCA Handbook be amended to read: - “Riders under 17 years wear short jodhpur boots defined as elastic sided, reasonably smooth soled and uppers that may incorporate a zipper, but no laces or buckles.” Motion has been superseded by C53/08.

C59/08 It was moved that riders selected to represent the State be permitted to display State approved logos on their saddlecloths.

Eventing C60/07 It was moved that medical armbands be worn at State Championships during the cross country phase and that clubs and zones encourage riders to wear them during the cross country phase of the Zone and Club events.

Eventing C61/07 It was moved that an emergency radio channel be designated to be used only by the Technical Delegate, the Course Controller, the ambulance and the crash crew.

SPCD C62/07 It was moved that the State Sporting Championships and the State Campdrafting Championships be considered as two separate events and a different horse be allowed for each Championships with only one entry fee applicable. Stabling for the second horse is to be paid.

SPCD C63/07 It was moved that riders, having completed their race (bending, flag, three mug etc) must leave the area of play in a straight line from the their starting box and not cut across other lanes even if the riders in those lanes have finished.

Dressage C65/07 It was moved that only plastic/polythene or similar material (not metal) be used for letters and/or numbers.

Dressage C67/07 It was moved that the Advisory Committee for the discipline is the Ground Jury with the power to co-opt if insufficient members of the Advisory Committee are present at the event.

C68/07 It was moved that all Clubs must appoint a Member Protection Officer.

C71/07 It was moved that an overall ground fee be charged at State Championships covering camping & stabling, for the weekend with a stabling fee separately noted for an additional horse for Campdrafting where applicable.

That ground fees are refundable where scratching’s are notified no later than 14 days prior to the event, nomination fees will be refunded upon production of a doctors or veterinarian certificate.

C3/08 It was moved that a fall in mounted games be defined as: -

If the riders head hits the ground as judged by the Technical Delegate, if the rider doesn’t get up in a reasonable time, if the rider has been kicked or trodden on by the horse or if for any other reason that the Technical Delegate believes the rider is not able to continue then the team is eliminated from that race and the rider is required to be assessed by the first aid officer before being able to continue in the competition. This motion had been amended by C76/12 and the Associations Concussion Policy.

C19/08 It was moved that any rider applying to attend a regional school must commit to two days of the school, on the same horse for the duration of the school and under no circumstances can they attend the second day only.

C22/08 It was moved that FEI approved breakaway cups be used on the back of rail of any spread fence 90cm and over from 1 January 2010.

C24/08 It was moved that the (age) eligibility criteria be amended for the Junior Mounted Games training squad (including State Camp), that it be open to riders who will turn 14 years in the year of the competition until the year they turn 17 years inclusive.

C28/08 It was moved that it be recommended to Council that the following sentence of the PCA Handbook, page 3-9, section 14 Professional Instructing at Pony Club be deleted “and carry their own public liability and professional indemnity insurance coverage (Proof to be sighted)” to read: - Section 14 Professional Instructing at Pony Club

Persons who are ineligible for membership of the association because they are deemed professional as defined by the association, may instruct at pony club rally days providing that the approval of the zone chief instructor has been gained in each instance and they instruct under the same regulations as pony club instructors, receive no remuneration for instructing. During instruction all pony club guidelines, rules and regulations are to be adhered to in all respects.

C29/08 It was moved that it be recommended to Council that the PCA Handbook, page 3-8, section 13 Guest Instructors, fifth paragraph be deleted “Guest Instructors must carry their own public liability and professional indemnity insurance coverage. Proof to be sighted by the club committee.” to read: -

Section 13 Guest Instructors “Clubs are at liberty to invite guest instructors who are not members of the association, to give specialised instruction to club members. The zone chief instructor must be consulted before the invitation is extended as it is required that the person is acceptable as an instructor in the zone. NO REMUNERATION FOR INSTRUCTING CAN BE PAID TO THE GUEST INSTRUCTOR. The club is at liberty to reimburse the guest instructor for travelling expenses at a rate determined by Council.”

C32/08 It was moved that the Pony Club Association of NSW Inc adopt the NCAS Pony Club program.

C53/08 It was moved that the 7th paragraph of page 7-7 of the PCA Handbook be amended to read: -

Riders under 17 years have the option of wearing short jodhpur boots defined as elastic sided, reasonably smooth, fully soled, solid leather upper riding boots. Part of this motion has been superseded by C64/09.

Or short Jodhpur boots and gaiters which must be made of solid leather and be full grain leather on the exposed side and the same colour as the boots.

Gaiters will not be permitted for riders under 17 years of age where a particular competition has a rule preventing junior riders from wearing gaiters. Also refer Motion C50/09

C58/08 It was moved that the following be adopted: - 1. C32/09 It was moved that the renewal requirements for Pony Club Instructors certificates be as per 3-5, 6 Renewal of Certificates of the PCA Handbook with amendment to the 3rd paragraph deleting “or issue” to read: -

Renewal of instructors’ certificates at the required dates is on the recommendation of the club to the zone chief instructor who will review the applications and may recommend renewals to the association.

Instructors seeking renewal of certificates at the expiry of their three year term (or part thereof) are required to have attended a minimum of two full days of instructors’ school (or the equivalent) during that period including appropriate first aid lecture/s conducted by qualified persons.

A special form will be used for renewal of instructor’s certificates.

Applications are required to sign a statement verifying their amateur status and stating that they have not and do not intend to receive any remuneration whatsoever for the instruction of riding. (Legitimate travelling expenses accepted, however on no account are these to be inflated or misrepresented.)

The cross country course for State ODE Championships cannot be ridden or competed on by entered horse and rider combination or in any other combination for 28 days prior to the cross country phase of the event.

C46/09 It was moved that composite club teams within a zone be permitted at the State Mounted Games Championships provided that, at both the Championship and the event where the respective composite club team obtained times that enabled it to qualify for the Championship that : -

Each of the clubs from which the riders in the composite club team belong could not cater for the respective rider in any competing club team (i.e. the number of competing riders from that club was not divisible by five) and 2. C83/10 The selection process for recipients of the Keith Lowe award be as follow  The criteria for selection should be given on the nomination form and should exactly match the criteria used by the committee.  A checklist that is to be ticked should be used to ensure that required details are not inadvertently overlooked.  Support from the previous club should only be required if the nominee’s membership changed within the last 3 years.  In a nomination form contains omissions or errors, the nominating zone should be contacted and given an opportunity to rectify the omissions or errors.

PCA NSW Day Membership

Persons who wish to participate in a NSW Pony Club rally day, who are not registered riding members of a NSW Pony Club, can do so by the way of PCA NSW Day Membership. The following rules apply: 1. The person or their guardian (for person’s under 18 years of age) must sign the PCA NSW Non Member Waiver. 2. The person or their guardian (for person’s under 18 years of age) must complete the PCA NSW Day Membership Form. 3. The person must pay the appropriate fee. 4. The person must abide by the rules of PCA NSW for the duration of the Day Membership. For the period of the rally day the non-member is deemed to be a member of the host pony club during such activities for the purposes of participation only. Protection is afforded to the participant under the PCA NSW insurance policy for the rally day’s duration of activities. The completed waiver is to be kept by the host pony club and in the event of a claim, provided upon request by the insurer as proof of attendance. The completed Day Membership form must be kept by the host pony club and a copy forwarded to the PCA NSW State Office with payment upon completion of the rally day.

The format of the waiver and membership forms for this type of membership be decided by the PCA NSW Executive.

C24/12 That Roper or Dogger type boots are permitted to be worn with riding trousers for Sporting and Campdrafting.

C25/12 That any competitor be allowed to wear beige/fawn stockman cut trousers in any discipline at Club Level competitions.

4. SAFETY

It is the responsibility of gear check stewards to decide if a retention harness on an approved equestrian helmet is correctly in place and securely fastened.

9. UNIFORM

The only acceptable approved equestrian helmets for use at Pony Club are those that carry the ASNZS 3838, ASTM F1163 or standard accreditation and are specifically designed for equestrian use.

The approved equestrian helmet must be correctly fitting (it must not fall forward on to the rider’s nose, rotate on the head or obstruct sight in time of emergency) and must have effective retention harness attached and in place under the chin whenever the rider is mounted. A small amount of comfort padding may be added to improve the fit. If a rider’s helmet has lost the approved equestrian label the helmet cannot be used. Retention harness should not be detachable.

THE FOLLOWING ARE NOT PERMITTED: a) Hard chin cups fitted to retention harness; b) Helmets not having an outer shell (i.e. made only of polystyrene) whether or not the same carries a standard accreditation label for an ASNZS 3838, ASTM F1163 or approved equestrian helmet.

All mounted personnel, whether juniors, associates, seniors, instructors, competitors, or helpers are required to wear an approved equestrian helmet with retention harness in place and approved riding boots. This also applies to helpers at championships or other fixtures (whether members or not). (Refer section 5.)

22.1 The instructors in the Club shall meet and elect a Senior Instructor.

11.2 If any member shall fail to pay this annual subscription within two (2) calendar months after applying for membership or where renewal of membership is applicable, from the beginning of the financial year, the Committee may strike the name of such member from the roll and such member shall cease to be a member of the Club, subject to the same conditions as Clause 5.6.2.

The Members acknowledge that if the above motion is passed that it will take effect immediately and the Company Secretary is authorised to prepare and execute all necessary documents and take all necessary actions as are required to give effect to the resolutions.

Guidelines have been prepared to help Clubs through the above processes as below:

CLUB MEMBERSHIP APPLICATIONS AND RENEWALS GUIDELINES FOR CLUB COMMITTEES

The following guidelines should be considered and followed by your club (Club) and its committee (Committee) when considering any new applications for membership of the Club as well as any applications to renew existing memberships of the Club. The following guidelines, if followed, will increase the likelihood that any decision to reject or fail to renew a membership is made lawfully and limits the risk such decision may be subjected to a legal challenge by the declined applicant. For the purposes of these guidelines, unless indicated otherwise, an application refers to both an application to become a new member of the Club as well as an application to renew an existing membership of the Club.

1. Requirements for a lawful rejection of membership application

For the lawful rejection of a membership application by the Club, the position at law in Australia requires: (a) the rules (i.e. Constitution) of the Club to allow for rejection of membership applications;

(b) that the decision to reject is taken strictly in accordance with the rules;

(c) that the decision to reject is made in good faith; and

(d) that the decision to reject is made in accordance with the objects of the Club.

2. Rules of the Club must allow rejection

As the Club, under clause 5.6 of its rules (Rules), has absolute discretion in relation to memberships, (which includes the power to refuse memberships), this requirement will be satisfied. 3. Decision to refuse must be in accordance with the Club's Rules

The Rules do not provide a procedure for making decisions on membership, except for requiring the refusal of any renewal applications to be made in good faith. Therefore, as long as the good faith requirement (see paragraph 4) is fulfilled, this requirement will also likely be fulfilled.

4. Decision to refuse must be made in good faith

It is a requirement under the law in Australia that membership applications be considered by the Club in good faith. Consideration 'in good faith' means that the Committee must act honestly and without malice or fraud in making its decision. The exact requirements of 'good faith' in any situation will be guided by the circumstances, however provided a Club can show that it was fair when considering a membership application, assessed the application on its merits and was open to accepting the application then the good faith requirement will generally be satisfied.

5. Decision to refuse must be made in accordance with the objects of the Club

The objects of the Club are provided in the Rules and are as follows: TO ENCOURAGE young people to ride and to learn to enjoy all approved kinds of sport connected with horses and riding. TO PROVIDE instruction in horsemanship and to instil in members the proper care of their animals. TO PROMOTE the highest ideals of fellowship, citizenship and loyalty and to cultivate strength of character and self-discipline in the members. TO SUBSCRIBE to become a member of an affiliate with the Pony Club Association of New South Wales Incorporated. TO DO all such other things as are expedient or conducive to the attainment of all or any of the above objects. When refusing a membership application, the Club must be able to show how a refusal is in some manner consistent with the objects of the Club. Examples of circumstances where the rejection of a membership application is likely to be consistent with the above objects include:

(a) where an applicant has previously failed to comply with the objects; and

(b) where admission of the applicant would hinder (or prevent) the Club achieving one or more of the objects.

6. Anti-discrimination legislation

Anti-discrimination legislation (both NSW and Commonwealth) also prevents a Club from rejecting a person's membership application based solely or substantially on a prescribed attribute of the person as defined under the specific legislation (i.e. a person's race, gender, disability etc.). Clubs should never make a decision solely or predominantly on the basis of such an attribute or they risk exposure to legal challenge by the unsuccessful applicant and in some instances penalties.

7. Further requirements that exist when refusing applications to renew an existing membership

If the Committee considers a renewal application and decides it should be rejected, the member must first be afforded an opportunity to lodge written submissions to the Committee regarding their renewal Updated July 2020 29 of membership prior to the Committee confirming its decision. The Committee must consider the submissions (if any) and subsequently reach a final decision on whether to accept or refuse the renewal application, whilst complying with all other requirements contained in these guidelines.

8. Record keeping of disapproved membership applicants

We recommend that the Club keeps records of the Committee's consideration of disapproved membership applicants to evidence its compliance with the requirements above and to refute any allegation by a disapproved candidate that it has breached general law requirements or anti- discrimination legislation. Ideally, the records of the Committee's consideration of disapproved applicants should contain the reasons for the Committee's decision. In circumstances where the Club's refusal was challenged in court, it would be entitled to rely on the minutes/records as evidence that the Committee had exercised the decision in good faith, in accordance with the objects of the Club, and in accordance with anti-discrimination legislation.

EXAMPLES OF LEGITIMATE GROUNDS FOR REFUSAL OF A MEMBERSHIP

1. Safety - maximum membership reached

Pony clubs need to ensure that the safety of their participants is never jeopardised by increased membership numbers. Where a club is operating at maximum capacity, an increase in members may lead to a dangerous amount of riders riding at any given time. Where a club's facilities are unable to safely handle an increase in riders, a denial of membership on this basis is likely to be a reasonable and good faith refusal to grant a membership.

2. Safety - Instructors per rider

Another safety factor clubs need to consider when admitting members is the club's ability to retain a safe and suitable number of instructors per rider. If the number of riders increases to a point where instructors are not able to adequately supervise all of the riders, then safety risks could arise (particularly where inexperienced riders are present). Clubs should strive to ensure the membership is limited to ten riders per instructor (and aim for eight riders per instructor where inexperienced riders are involved).

3. Facilities at capacity

Some clubs may be limited by the size of their facilities. A club may find itself restricted due to the size of yards, number of suitable carparks and available horses. In these situations, clubs may need to restrict admission of membership due to its facilities being at capacity. If a club's resources are unable to cater for an increase in membership, then refusal on this basis is likely to be a legitimate reason to deny membership.

Note: Decisions to refuse to grant a membership to a rider on any of the above grounds must still be made in good faith, in accordance with the club's objects and actually made for the stated reason (i.e. a denial stated to be made for one of these reasons cannot be used as a veil to hide a denial of a membership that was actually made for another, improper reason).

If a discrepancy between the rules of Pony Club NSW and E.A of a technical nature only is discovered, upon recommendation from the relative discipline Advisory Committee the Executive may approve a change to that rule. That change may be updated in the relevant Blue Book Section immediately. This is not to apply to any rules regarding gear or safety. Examples may include a change in scoring systems, refusals, errors of course, update of tests etc. If the Executive is not satisfied the change is of a technical nature the decision is to be held over to next meeting of the State Council.

Balanced Support reins are a normal set of riding reins with Billet hooks to connect to the approved pony club bit. They have a second rein (elasticised support rein) on each side that is connected to the main reins via a buckle, the other end is connected to the D Ring at each side of the saddle. The elastic support rein should lie slack when the rider has a contact on the reins. The support rein will take over the contact if the pony tries to pull the reins from the riders’ hands, naps, tries to put its head down to buck etc. Balance reins should not be used for jumping under any circumstances.

a) Run-Out: Horses is considered to have run out (20 penalties) if, having been presented at an element or obstacle on the course, it avoids it in such a way that the body of the Horse (head, neck, shoulders and pelvis – legs are not included) fail to pass between the extremities of the element or obstacle as originally flagged. Continuing on course without representing will incur elimination. b) Missing a flag: A Horse is considered to have missed a flag (15 penalties) if the Horse jumps the dimension of the obstacle and the majority of the Horse’s body (as defined above) passes through the flags. This means that some part is not inside the flags (e.g. one shoulder, or one shoulder and part of one hip). c) The Horses will have successfully negotiated the fence, if the body of the Horse (as defined above) has passed the fences as originally flagged (i.e. the body but not all the legs are inside the flag as considered clear).

Time Faults – The length of the course and the speed demanded determines the time allowed. Completing the course in less than the time allowed is not rewarded, but exceeding the time allowed, the Athletes are penalized with 0.4 penalty per commenced second. Exceeding the time limit involves elimination.

NSW is permitted to lunge a horse for riders under 17 years of age at all Pony Club competitions, with the permission of the Senior Instructor, Zone Chief Instructor or Team Manager. Competitors may not ride on or near any part of the cross country or Showjumping course before competition. Riders disregarding this rule may incur disqualification from the event.

C44/19 18. CHAMPIONSHIP ADVISORY COMMITTEES

Championship advisory Committees consist of five members elected from expressions of interest from suitably qualified persons with delegated authority to assist in the running of the respective championship with the power to co-opt. The Association President and the Chairperson of the Chief Instructors’ Committee are ex officio. The Executive Director and/or Secretary and the State Coaching Director shall attend meetings when practicable. Term for these Committees is for three years or part thereof.

Section 8 Clause 8 Uniform

C47/19 The use of approved Body Protectors for all disciplines is permitted. They may be worn over or under Pony Club uniform with preference to wearing under the shirt or the jumper. Back numbers must be worn on the outside.

Cross Country – the use of a Body Protector is mandatory at all levels for competition and training for Cross Country at all PCA NSW activities and events. A body protector manufactured after 2009 and labelled as complying with one of the following standards is mandatory effective 1st January 2020.

AGM6/20 That the change to the State Constitution Item clause 4.1 to 4.10 inclusive as above.

4. MEMBERSHIP

4.1 MINIMUM NUMBER OF MEMBERS The Association must have at least 5 Members.

4.2 CATEGORIES OF MEMBERS Members of the Association shall fall into one of the following categories: (a) Life Members; (b) Zones; (c) Clubs; (d) Individual Members; An Individual Member is entitled to any benefits of Membership prescribed to apply to Individual Members in the By-Laws. Junior Members are under 17 years of age in the relevant Membership year. Associate members are between 17 and 25 years of age in the relevant membership year. Senior members are over 25 years of age in the relevant membership year. (e) such new or other categories of members as may be established by the Executive. Any new category of member established by the Executive must not be granted voting rights without the approval of the Association in general meeting.

4.3 ADMISSION TO MEMBERSHIP Subject to clause 4.2, a person will become a Member, and the Executive Committee will direct the Executive Officer to record their name in the register of Members kept by the Association, only upon meeting the criteria applicable to the relevant category of membership set out in this Constitution and/or the By-Laws and provided the person has signed an application in which they undertake to: (a) be bound by this Constitution and the By-laws of the Association (including By-laws specific to the relevant category of membership) and the PCA constitution; (b) pay the fees and subscriptions determined by Council to apply to the relevant membership category; and (c) support the Association in the encouragement and promotion of the purposes.

4.4 LIFE MEMBERS (a) Life Membership is the highest honour which can be bestowed by the Association for longstanding and valued service to Pony Club in the State.

(b) On the nomination of the Executive, any individual may be elected as a Life Member at any AGM by special resolution, subject to clauses 4.3, and 4.4(d).

(c) Honorary Life Membership may be granted to natural persons for outstanding service to the Association over a period in excess of Ten (10) years. Nomination for Life Membership shall be made to the Secretary/Executive Officer and be signed by at least Five (5) Councillors. b) On receipt of such nomination, the Executive of the Association will consider it and if approved by a two-thirds majority of the Executive will recommend such appointment to the next Annual General Meeting of the Association as special business.

(d) The by-laws will set out: (i) current Life Members; (iii) the privileges and benefits of Life Membership. Updated July 2020 41

(f) Subject to clause 4.3, at the time of adoption of this Constitution, the Life Members of the Association shall be those persons currently recognised by the Association as Life Members.

4.5 CLUBS (a) Subject to clause 4.3 and 4.5(b), at the time of adoption of this Constitution, the Clubs of the Association shall be those incorporated entities recognised by the Association as Clubs.

(b) Where an applicant for Club Membership is not incorporated but otherwise meets the criteria for that membership, the Council may recognise that entity as a Club. Where the Council do recognise an entity as a Club under this clause, that entity must incorporate within 12 months of recognition otherwise its Membership lapses.

(c) Clubs will: (i) be incorporated and have purposes that align with the Association's purposes and do all that is reasonably necessary to enable the Association's purposes to be achieved; (ii) effectively promulgate and enforce this Constitution; (iii) at all times act for and on behalf of the interests of the Association, the Members and Pony Club; (iv) be responsible and accountable to the Association for fulfilling its respective obligations under the Association’s strategic plan as revised from time to time; (v) provide the Association with copies of its audited accounts, annual report and associated documents if requested; (vi) provide the Association with copies of its business plans and budgets from time to time and within 14 days of request by the Executive Committee; (vii) be bound by this Constitution; (viii) act in good faith and loyalty to maintain and enhance the Association and Pony Club, its standards, quality and reputation for the collective and mutual benefit of the Members and Pony Club; (ix) at all times operate with, and promote, mutual trust and confidence between the Association and the Members, promoting the economic and sporting success, strength and stability of each other and work cooperatively with each other in the pursuit of the Purposes; (x) maintain a database of all Individual Members registered with it in accordance with this Constitution and provide a copy to the Association upon request from time to time by the Executive Committee in such means as may be required; (xi) not do or permit to be done any act or anything which might adversely affect or derogate from the standards, quality and reputation of Pony Club and its maintenance and development.

(d) Each Club must: (i) advise the Association as soon as practicable of any serious administrative, operational or financial difficulties the Club is having; (ii) assist the Association in investigating those issues; and (iii) cooperate with the Association in addressing those issues in whatever manner, including by allowing the Association to appoint an administrator to conduct and manage the club's business and affairs, or to allow the Association itself to conduct itself all or part of the business or affairs of the Club and on such conditions as the Association considers appropriate. The Association is not obliged to act under this clause.

4.6 ZONES (a) Unless otherwise determined by resolution of the Council, only an incorporated association may become a Zone.

(b) Zone Membership status may be granted by the Council on such terms and conditions as they may see fit following formal application for such status accompanied by an up-to-date copy of the applicant’s constituent documents and such other information as may be required by the Directors.

(c) Zone membership may be suspended or cancelled by the Council.

(d) The By-laws may set out: (i) the categories of Zone Membership which exist; (ii) the criteria to be met by each category of Zone Member; and (iii) the privileges and benefits of each category of Zone Member.

4.7 CLUB AND ZONE CONSTITUTIONS (a) Each Club and Zone shall take all steps necessary to ensure its constitution (and any amendments) conforms, to this Constitution.

(b) Any subsequent amendments to a Club or Zone's constitution shall be subject to the approval of the Association.

(c) The Executive of the Association shall approve, as soon as is practical, any subsequent amendments to a Club or Zone's constitution as may be submitted by a Club or Zone provided the amendments conform to this Constitution.

(d) If the documents do not conform to this Constitution, the Club or Zone shall, without delay, take all steps necessary to address the inconsistency so that the documents conform to this Constitution.

(e) For the avoidance of doubt, if any inconsistency remains between the Club or Zone's constitution and this Constitution, this Constitution shall prevail to the extent of that inconsistency.

(f) Each Club and Zone acknowledges that the Association may develop and implement By-Laws which may set out: (i) the Membership criteria (of the Association) to be met by the Club or Zone; and (ii) the privileges and benefits of Club and Zone membership.

4.8 GENERAL (a) The Association must keep and maintain a register of all members in which shall be entered such information as is required under the Act from time to time. Having regard to privacy considerations, an extract of the register, excluding the address of any life member, individual member or Director shall be available for inspection (but not copying) by members, upon reasonable request.

(b) No member whose membership ceases has any claim against the Association or the Members of the Executive for damages or otherwise arising from cessation or termination of membership.

(c) A right, privilege or obligation of a member by reason of their membership of the Association is not capable of being transferred or transmitted to another member. No member shall, or Updated July 2020 43

purport to, assign the rights comprising or associated with membership to any other person and any attempt to do so shall be void.

(d) Members must treat all staff, contractors, guests and representatives of the Association and all other Members with respect and courtesy at all times.

(e) Members must not act in a manner unbecoming of a member or prejudicial to the Purposes and/or interests of the Association or Pony Club.

4.9 LIMITED LIABILITY Members have no liability except as set out in clause 27.

4.10 EFFECT OF MEMBERSHIP AND MEMBERSHIP VOTING RIGHTS (a) Members acknowledge and agree that: (i) this Constitution constitutes a contract between each of them and the Association and that they are bound by this Constitution and the By-laws; (ii) they shall comply with and observe this Constitution and the By-laws and any determination, resolution or policy which may be made or passed by the Council or any duly authorised committee; (iii) by submitting to this Constitution and the By-laws they are subject to the jurisdiction of the Association; (iv) this Constitution is made in pursuit of a common purpose, namely the mutual and collective benefit of the Association, the Members and Pony Club; (v) this Constitution and By-laws are necessary and reasonable for promoting the Purposes and particularly the advancement and protection of Pony Club; and (vi) they are entitled to all benefits, advantages, privileges and services of Association membership.

(b) A Club is a voting member of the Association. A Club must from time to time nominate one of its financial members as its representative (Club Voting Representative) who shall have the right to attend and debate and vote at a General Meeting for and on behalf of the Club. All nominations for a Club Voting Representative must be in writing and lodged with the Secretary/Executive Officer at least one (1) month prior to a General Meeting of the Association.

(c) Individual members may attend and debate but not vote at AGM/SGM of the Association. (d) A voting member of the Association has the right: (i) to receive notice of general meetings and of proposed special resolutions in the manner and time prescribed by this Constitution; (ii) to submit items of business for consideration at a general meeting; (iii) to attend and be heard at general meetings; (iv) to vote at a general meeting; (v) to have access to the minutes of the general meetings and other documents of the Association; and (vi) subject to clause 4.8(a), to inspect the register of members.

Objective 1. Graded jumping was introduced into pony club in N.S.W. during 1980. Grading the combination of horse and rider for showjumping has enabled children of all ages to compete at a standard which suits their ability. Before graded jumping, many children were unable to participate because the size of courses was well beyond their capability. There are 6 grades for juniors (i.e. Under 17yrs) — Championship, A, B, C, D, E and Introductory grade and 5 grades for associates —Championship, A, B, C, D and E grade. Riders may be graded on more than 1 horse and a separate grading card is issued for each combination. Points are accumulated separately for each combination. With the exception of Introductory Grade, once the combination has been graded, they progress through the grades by accumulating points in competition. When they reach the required number of points they go up to the next grade. Introductory Grade to be Graded to E grade following How to Grade section below.

E Grade riders - (Maximum starting height 45cms and width 50cm for 1st round of competition). The most important thing for E grade in addition to the above is that the riders can control his/her pony at the canter (even though they will often trot around the course) as ponies will often canter after a jump.
