Article 4 SCOPE OF WORK

The Contractor shall furnish all materials, labor, reports, travel time, equipment and all other work incidental thereto necessary or required to provide maintenance of HVAC chemical feed equipment and servicing of water treatment systems in cooling towers & boilers located at seventeen (17) Parks and Recreation buildings, Citywide, for the City of New York Parks & Recreation (“Agency”).

The Contractor shall appropriately address external influences. Including encounters with rats, hornets, wasps, yellow jackets or other animals and insects that could interfere with the services covered under this Agreement. The Contractor shall remove all signs, boards, hoops, bags, guide wires, fences, poles or other foreign objects. If the Contractor encounters problems during emergency operations, he/she is responsible for addressing and solving these problems at no additional cost to the Agency. Contractor shall follow the “NYC DPR Cooling Tower Management Program & Plan”, particularly section concerning roles and responsibilities of water treatment vendor, owner, and in-house personnel (see excerpt below). I. WATER TREATMENT PROTOCOL AND MONTHLY/QUARTERLY ADDITIONAL MAINTENANCE (Part A; bid items 1-17)

A. Water Treatment Protocol

The Contractor shall develop a site-specific water treatment protocol for all cooling towers, boilers, and closed circuit systems (including, but not limited to, hot water heating loops, chilled water loops, brine loops and glycol loops) at no additional cost to the agency. The protocol must specify the chemicals to be used, the dosage, frequency of feeding, time of feeding, chemical residuals that will circulate in the system and how the chemical residuals are expected to vary between chemical feeds, and acceptable ranges for all water quality parameters, including but limited to: Oxidation- Reduction Potential (ORP), free chlorine residual, pH, and conductivity. For cooling towers, the water treatment protocol must include at a minimum two biocides, one oxidizing and one non-oxidizing, and a corrosion inhibitor. Each protocol must be in compliance with Chapter 8 of the NYC Health Code, must be consistent with standard industry practice, and must be approved by the Project Manager prior to implementation.

The Contractor must provide a Program Administration Manual for each site which shall include, but not be limited to, the following:

1. Agency-approved water treatment protocol. 2. Vendor contact information and emergency contact information. 3. Product descriptions for each product used. 4. Daily, weekly and monthly test procedure instructions. 5. Blank test reporting forms. These forms must include recommended ranges for each parameter tested, and follow up actions to be taken by the stationary engineers on-site. Emergency action levels requiring a call to the 24-hour hotline shall be clearly stated on the forms. 6. Equipment operating manuals for any equipment provided.

The Contractor must provide Material Safety Data Sheets (MSDS) for all chemicals delivered to the site, and an MSDS binder shall be maintained at each site, with MSDS for all products delivered to that site.

B. MONTHLY MAINTENANCE

Monthly maintenance service shall include the testing of treated water to confirm efficacy of the equipment and treatment modality. The Contractor shall inspect, maintain and adjust chemical feed equipment on a monthly basis.

The Contractor shall maintain equipment to achieve system cleanliness of cooling towers, boilers, and closed circuit systems (including, but not limited to hot water heating loops, chilled water loops, brine loops and glycol loops). The Contractor shall adjust equipment and make recommendations to modify the systems to improve the quality of treated water.

The equipment maintained by the Contractor shall include, but not be limited to, the following:

a. System Controls b. Chemical Feed Pump(s) c. Chemical Holding Tank(s) d. Bleed Solenoid Valve(s) e. Water Meter with Pulse Out f. Injection Nozzle(s) g. Brine Filtration Systems h. Softeners in cases where boiler feedwater routinely exceeds 5PPM hardness i. Chemical bypass feeders j. Chemical inventory – Contractor shall ensure that an adequate supply of each chemical outlined in the approved Water Treatment Protocol is on each site listed in Attachment A

Provide monthly service visits for each site listed in Attachment A. The Agency reserves the right to add additional sites or remove sites. The monthly service shall include, but not be limited, to the following:

 Contractor shall inspect all chemical feed equipment as described above.

 Contractor shall collect and analyze samples of the treated water. Testing shall include, but not be limited to, the following:

1. Standard deposit and water analysis. Adjust feed equipment as necessary to maintain cleanliness of the system.

2. Open (cooling tower/evaporative condenser) loops – testing for residual free chlorine and ORP, pH, conductivity, residual inhibitor levels, and heterotrophic plate count (HPC).

3. Steam boiler loops – testing for pH, conductivity, TDS, chlorides, hardness, and residual levels of treatment chemicals used for corrosion and deposit/scale control.

4. Closed (hot water, chilled water, glycol, and brine) loops – testing for pH, iron, copper, conductivity, alkalinity, turbidity, freeze point/specific gravity (glycol/brine loops), corrosion, microbiological growth, and residual levels of treatment chemicals for corrosion and deposit control.

5. All test results must be provided to the Agency within five (5) days of the sampling. Any results found to be out of control range shall be brought to the attention of on-site Engineer and adjustments to chemical feed equipment shall be made during visit.

 The Contractor shall review the daily and weekly water quality and bacteriologic indicator tests performed by the Agency Stationary Engineers and assess the efficacy of the water treatment protocol based on the recorded results and the water sampled by the Contractor.

C. QUARTERLY ADDITIONAL MAINTENANCE NOT COVERED UNDER MONTHLY MAINTENANCE

Please note: this additional work shall only take place at the same time Parks is requesting a monthly inspection as outlined in Item B above.

In addition to Monthly Maintenance, the Contractor at the request of the Project Manager will be asked to perform additional work as outlined below. It is anticipated that this additional work will be requested every 90 days to comply with NYC Health Codes and Local Laws.

1. Legionella testing As per Chapter 8 – Title 24 of Rules of the City of New York (RCNY), Legionella testing must be performed by a CDC ELITE (Centers for Disease Control Environmental Legionella Isolation Techniques Evaluation) lab. As such, this requirement must be met. In addition, Legionella testing performed in NYS must be done by an ELAP (Environmental Laboratory Approval Program) certified lab. Therefore, the lab must have both certifications to conduct legionella testing.

All Legionella test results must be submitted to the Agency within sixteen (16) working days of taking sample.

Please note: Legionella testing that occurs outside of this quarterly additional maintenance provision shall be paid on a per test basis as Revised: 6/20/19

outlined in Article 5, Measurement and Payment, bid item 18, “Site Specific Legionella Testing (Stand-Alone Test)”.

2. Comprehensive Visual Inspection For Each Cooling Tower or Evaporative Cooler.

The Contractor shall provide inspection and testing at least every 90 days in compliance with Chapter 8 of the NYC Health Code and Local Law 77 of 2015. The service shall include, but not be limited to, the following:

 The Contractor shall visibly inspect and evaluate the cooling tower or evaporative condensers and all chemical feed equipment. The inspection must be comprehensive, include all visible and wetted surfaces, not the presence of visible contaminant, the general condition of the tower, basin, packing material and drift eliminator, note the quality of the water make-up connections and controls, check for proper functioning of all chemical feed and automated bleed controls and components, and review routine maintenance records kept by Agency Stationary Engineers.

 Corrective actions shall be suggested for inspection findings. Corrective actions related to chemical feed systems and conductivity controls, shall be performed by the Contractor at no additional cost to the Agency, unless the cost of replacement parts exceeds $100.00.

The Contractor shall collect and analyze samples of the treated water as detailed in “B: Monthly Maintenance”. All samples must be sent to a Centers for Disease Control and Prevention (“CDC”) Elite laboratory for analysis.

The bid price for Monthly/Quarterly Additional Maintenance shall include all sampling and testing necessary to comply with the “every 90 days/quarterly” testing and inspection requirements mandated by Local Law 77 of 2015 and Chapter 8 of the NYC Health Code.

Under this work, the contractor shall submit an Inspection report, certifying that the equipment was inspected and signed by a Licensed Professional Engineer, Licensed Water Technologist, Licensed Industrial Hygienist, or Environmental Consultant. The report MUST be in a format acceptable by and MUST include all information required by the NYC DOB, NYC DOHMH, and NYS.

The bid price for Monthly/Quarterly Additional Maintenance shall include all sampling and testing necessary to ensure the cleanliness of the HVAC equipment as per the DOHMH and industry standards. In addition:

 Report any abnormal conditions, as determined by the Department of Health and Mental Hygiene, in accordance with Local Law 77 of 2015, to the Agency. Revised: 6/20/19

 Provide annual technical training for Parks’ operators at each site. Training topics shall include, but not be limited to, the following: the use and troubleshooting of the installed chemical feed equipment, chemical handling safety, program parameters, testing, reporting, and log-keeping. All training shall be documented with Parks’ sign-in sheets and course outlines. Training shall be provided at no additional cost to the Agency.

D. REPORTING

The Contractor shall create reporting forms every month or when requested by the Project Manager. The service shall include, but not be limited to, the following:

 Contractor shall provide all Heterotrophic Plate Count (HPC) dip slides and reporting forms necessary for stationary engineers to perform daily water chemistry tests and weekly HPC tests, and record test results at no additional cost to the Agency. The forms shall include notes on allowable test results, and define test results that require a call to the 24-Hour contractor hotline.

Following each monthly service, the Contractor shall submit monthly reporting of all findings to the Parks’ Senior Stationary Engineers and Director of Facilities digitally in Excel/Word format, and in a hardcopy report signed by a Licensed Professional Engineer, Licensed Water Technologist, Licensed Industrial Hygienist or Environmental Consultant with more than two years of experience in the field.

 All reports must be submitted within five (5) days of the collection of forms.

II. SITE SPECIFIC LEGIONELLA TESTING (STAND ALONE TEST) – (Part B; bid item # 18)

At the request of the Project Manager the Contractor shall perform a stand- alone legionella test at any Parks location.

As per Chapter 8 – Title 24 of Rules of the City of New York (RCNY), Legionella testing must be performed by a CDC ELITE (Centers for Disease Control Environmental Legionella Isolation Techniques Evaluation) lab. III. REPAIRS (Part B; bid items 19-20)

During the duration of the contract, the Agency may request Unscheduled Maintenance and Repairs. The Contractor shall provide non-scheduled service as may be required whenever requested by the Project Manager.

IV. CHEMICALS (Part B; bid items 21-27)

The Contractor shall supply chemicals necessary to provide treatment to cooling tower loops, steam boiler loops, and closed circuit HW, chilled water and brine/glycol loops as defined by the approved Water Treatment Protocol. Chemical products shall be delivered as needed only; inside each building to the point of use in five (5) gallon drums, as directed by the Project Manager.

V. Working Hours and Work Orders & Estimates

WORKING HOURS All work under this contract shall be performed during the five- (5) day, forty- (40) hour week, from Monday to Friday, inclusive between the hours of 9:00 A.M. and 5:00 P.M., except for legal holidays. (When using prevailing wage contracts – make sure the hours correlate to the prevail wage schedule.)

EXTERNAL SITUATIONS The Contractor shall appropriately address external influences. The Contractor shall remove all signs, boards, hoops, bags, guide wires, tree grates, tree guards, fences, poles or other foreign objects. If the Contractor encounters problems during emergency operations, he/she is responsible for addressing and solving these problems at no additional cost to the Agency.

WORK ORDERS The Contractor shall perform work only upon issuance of work orders. These work orders will be provided to the contractor in writing or via email. Revised: 6/20/19

The Contractor shall comply with every order, which shall be given by the Project Manger including any withdrawal, modification or reversal of any previous order given by him. The Contractor shall notify the Project Manager at least twenty-four (24) hours prior to the start of work at any location.

The Contractor shall start work within forty-eight (48) hours after receipt of a work order. For emergencies, the Contractor shall be required to respond within one (1) hour from the placement of the call.

The Contractor is expected to work each consecutive business day until the work is completed.

The number of workers employed on any work order shall be the minimum required to perform the work adequately and safely and will be subject to approval by the Project Manager before work is started. (ONLY USE FOR TIME AND MATERIAL CONTACT THAT HAS AN HOURLY LABOR RATE)

The time spent on each work order will be verified by the Agency.

In case of multiple work orders, the Contractor will be advised by the Project Manager as to the priority of each work order.

The Contractor's employees must wear identification while on the Agency property, which must be approved by the Project Manager. Contract shall submit a cost proposal for approval by Agency Project Manager for any work that is requested. This cost proposal shall be itemized and show each Item, Quantity, and the Unit Price as per the Bid Page. Once the Agency Project Manager approves this cost proposal, a Work Order will be issued.

WORK TICKET The Contractor's designee shall leave a Work Ticket with the Project Manager at the job site. This Work Ticket will give a brief description of the work performed, date, time, hour(s) at the job site, parts used and the name of the service person(s) who performed such work. This Work Ticket shall be signed by the Agency on site, upon completion and approval of the work. A COPY OF THE COMPLETED WORK TICKET MUST BE SUBMITTED WITH THE CONTRACTOR'S MONTHLY INVOICE. Failure to submit a Work Ticket with your invoice will result in a delay in payment.

ESTIMATES At times, the Contractor shall be required to supply Parks with a free estimate prior to the issuance of a work order. The Contractor shall not proceed with the work until the estimate is approved by the Project Manager, and a work order has been issued.

The Agency may instruct the vendor to provide & perform all services in any borough of NYC and in any Parks & Recreation Facilities. The locations for service are stated in “Attachment A”.

Article 5 MEASUREMENT AND PAYMENT

For all bid items listed below, the bid prices shall include all materials, labor, travel time, equipment and all other work incidental thereto necessary or required to provide the complete servicing of chemical treatment equipment located at various Parks and Recreation buildings, Citywide, for the City of New York Parks & Recreation (“Agency”).

Items 1-17, Water Treatment Protocol, Monthly and Quarterly Additional Maintenance (includes all reporting requirements)

Under these items, the Contractor shall bid one unit price per month under “Monthly Maintenance Price”(see bid pages Part A – Column D) and one unit price per “Quarterly Additional Maintenance Not Covered Under Monthly Maintenance Price”, per site (see bid pages Part A- Column G), to furnish all materials, labor, sampling, testing, studies, analysis, travel time, equipment, and all other work incidental thereto necessary or required to provide the complete monthly maintenance and additional maintenance for chemical treatment equipment located at various Parks buildings located Citywide, for the City of New York Parks & Recreation. The Quarterly Maintenance requirements include both Legionella testing and an inspection for each cooling tower.

The bid price for Monthly Maintenance shall include all sampling and testing necessary to assure the cleanliness of the HVAC equipment as per the DOHMH and industry standards.

All chemicals listed in the water treatment protocols must be approved by the Agency and shall be furnished on a monthly basis as needed.

B. Quarterly Additional Maintenance (Column D and E on Part “A” of the Bid Pages)

This bid item shall include all sampling and testing necessary to comply with the testing and reporting requirements mandated by Local Law 77 of 2015 and Chapter 8 of the NYC Health Code, to be submitted every 90 days.
