..1.. EXPRESSION OF INTEREST FOR OUT SOURCING OF BUDGET ACCOMMODATION AT KUD

Expression of Interest (EOI) is invited from Financially Sound, reputed and experienced Hoteliers/ Hotel Management professionals/ Individuals having support of professional staff for Operation and Management cum Outsourcing to provide excellent services to guests and public for Budget Accommodation at Kud, District Udhampur, and Kashmir State.

Interested parties may submit their proposal with credentials and all relevant details. Short listed agencies will be called for further proceedings. The complete detailed document can be had from the office of Chief Executive Officer, Patnitop Development Authority, Kud District Udhampur, J&K from 20.06.2019 on office hours i.e. 10.00 AM to 4.00 PM on a Non refundable cash/Cheque Payment of Rs. 10000.00 or can be downloaded from our website www.patnitop.nic.in and the document fee of Rs. 10000.00 in that case can be submitted along with the EOI in shape of Demand Draft in favour of Accounts Officer, Patnitop Development Authority from any Nationalized Bank .

Last date of submission of proposal shall be 10.07.2019 upto 02.00 PM by Courier/Regd. Post Only.

Proposal should be sent in sealed envelope to super scribe as EOI for Operation and Management Cum outsourcing of Budget Accommodation, Kud to Chief Executive Officer, Patnitop Development Authority, Kud District Udhampur, J&K.

The Committee, reserves the right to reject any or all of the proposals without assigning any reasons.

..2.. Instructions and Conditions to Proposer/Bidders

1. Sealed proposals are invited from the reputed and experienced Hoteliers/ Hotel Management professionals / Individuals with proven track record of operation and maintenance of minimum three (***) star hotels for at least three years in Jammu and Kashmir.

2. The EOI should be send in sealed cover super scribed as Expression of Interest for Operation and Management of Budget Accommodation to the office of Chief Executive Officer, Patnitop Development Authority, Kud and should reach by or before 10.07.2019 by Regd. Post/Courier.

3. The proposal downloaded from website must be accompanied by non-refundable document fee of Rs. 10000/-by DD of Nationalized bank in favour of Accounts Officer, Patnitop Development Authority, Kud.

4. The eligibility criterion of the EOI is at Annexure I.

5. The EOI will be opened in the office of Chief Executive Officer, Patnitop Development Authority Kud on 11.07.2019at 02.00 PM or any other date convenient to the committee members.

8. During evaluation of proposal the Evaluation and Tender Opening Committee may at its discretion ask the Proposer/Bidder for clarification of its proposal. The request for clarification and its response shall be in writing.

9. The Evaluation and Tender Opening committee reserves all rights either to accept or reject any or all the proposal at any time without assigning any reason.

10 The agencies representative(s) may visit the Budget Accommodation Kud for inspection of site and appraisal of work involved, between 10.00 am to 3.00 pm on any working day between Monday to Saturday.

TERMS AND CONDITIONS

Building:- The details of accommodation etc is as under:-

1. The property/s will be handed over to SUCCESSFUL BIDDER on „AS IS WHERE IS CONDITION‟. The word „AS IS WHERE IS CONDITION” means that the “land and building” available as on date of the Tender only. No improvements/modifications/additions/alterations will be carried out in the land or building without approval of the Patnitop Development Authority. Arresting leakages, all type of maintenance work such as building, sanitary installations, water supply, electrical, horticulture operations etc including eviction of encroachments will be the responsibility of the Successful Bidder only.

2. The Successful bidder should utilize the property only for the purpose of running of Hotel business/resort type used etc and not for any other purposes.

3. The food should be prepared and served in hygienic manner by the Successful bidder. The Successful bidder should also take steps to provide safe protected drinking water.

4. The Successful bidder should produce documentary proof of their residence like State Subject Certificate/Voter identification card.

5. No additions, alterations, modifications to the existing building shall be made in any manner without the written consent of the Patnitop Development Authority and the Successful bidder shall maintain the building and services in good condition.

..4.. 6. The Successful bidder will have to remit the annual Lease contract fees in advance every year in full within the due date as prescribed, failing which Patnitop Development Authority has the right to cancel acceptance without any intimation to the successful bidder. Further relaxation of due date will not be entertained at any cost. 7. The successful bidder should take over the franchised unit within one month time from the date of receipt of allotment orders, failing which the Patnitop Development Authority shall have the right to cancel allotment order and forfeit earnest money deposit.

8. The Outsourcing contract is for a period of 5 years.

9. If there is any necessity for repairs, alterations, additions in the franchised unit by the Successful bidder at the time of taking over the unit, leave period will be given after handing over the unit to the Successful bidder based on his written request subject to a maximum of 3 months from the date of taking over or the date of commencement of commercial operations by the Successful bidder whichever is earlier.

10. The successful bidder has to enter into yearly agreement within a period of 30 days from taking over the possession of the building which shall be renewed every and if contractor fails to keep /maintain the terms and conditions of the agreement or if at any point of time any complaint is received from the tourists / customers the contract/agreement so signed shall deemed to be cancelled ab initio. 11. The base price of the lease contract will be Rs. 15.00 Lacs (Rs. Fifteen lacs) only per annum.

12. The Successful bidder should operate the Unit on continuous basis throughout the Lease Contract period. If the Successful bidder fails to run the Unit for a period of three months continuously the Patnitop Development Authority shall issue a notice to Successful bidder and if the Successful bidder fails to operate the Unit even after one month on receipt of the notice the PDA shall re- enter in to the premises and resume the possession and the operation of the unit without further notice. In such case PDA will forfeit the advance money deposited.

13. The Successful bidder shall maintain the building and movable properties like electrical installations, equipments, Sanitary Items etc. in good condition and shall compensate the Patnitop Development Authority for any damages to such properties with replacement value.

14. All rates, taxes as applicable on the Lease Contract amount, claims, consent fee levied by the Pollution Control Board, demands and outgoings shall be borne by the successful bidder. The successful bidder should obtain the necessary licenses for operation of the complex.

15. After the expiry of Lease Contract period, the Successful bidder shall surrender possession of all movable and immovable properties franchised, including leased superstructure and also constructed by the successful bidder with due consent of the PDA.

16. The Successful Bidder shall not claim any title to the superstructure already put up and to be put up by him or claim any compensation at the time of surrendering possession after the expiry of the Lease Contract.

17. All sanctions, permissions, no objections, letters of intent, consent, licenses, clearance, approvals etc. shall be obtained by the Successful bidder at his cost and such document shall be kept effective and in force at all times.

18. The building and other properties franchised shall be insured against fire, rioting and possible losses and the insurance policy to be taken in the joint names of the Patnitop Development Authority and the successful bidder and the insurance premium will be borne by the successful bidder.

19. The Committees have the right to inspect the premises and also the book of accounts etc. at any time.

20. The Successful bidder shall submit verified statements, reports, accounts, documents and any other particulars as required by the Patnitop Development Authority, from time to time.

21. The Successful bidder shall not encumber the Patnitop Development Authority, properties by way of pledge, hypothecation, mortgage, charge, lien, lease, leave and license or in any other manner.

22. The Successful Contractor has to confine his activities only within the specified area handed over to him.

23. The Successful bidder shall not permit his clients to use the open space available within the premises, which has not been allotted to him.

24. No unlawful activities like betting and gambling etc. shall be allowed inside the campus.

25. Illegal activities shall not be allowed inside the premises.

26. In case the successful bidder commits any breach of any of the terms and conditions and stipulations herein content on the part of the successful bidder to be observed and performed, then in such cases the Committee shall be at liberty to give a notice in writing to the successful bidder to set right or rectify the

..6.. breach or omission of any of the terms , conditions and stipulations of this agreement and in case of noncompliance on the part of successful bidder within 30 days of the receipt of such notice , the agreement at the option of the Committee may be terminated and upon such termination the agreement shall become null and void and all the rights of the successful bidder shall immediately ceased and determined. The agreement may also be terminated for any criminal acts on the part of the successful bidder which not be referred to arbitration. 27. The Patnitop Development Authority shall have the right to re-enter the premises and terminate the Lease contract agreement, in-case of default or any type of malpractice noticed on the part of the Successful bidder. 28. The Successful Contractor should take possession of all the movable articles belonging to him at the time of handing over the unit to the Patnitop Development Authority, failing which the properties will be disposed off by Patnitop Development Authority, as deemed fit without further notice to Successful bidder. 29. The Patnitop Development Authority will not be vicariously liable for any act of the Successful bidder and the Successful bidder shall alone be liable for violation of any law and the Successful bidder agrees to indemnify the Patnitop Development Authority, from all claims. 30. All cost, charges, including stamp and registration charges etc. shall be borne by the successful bidder. 31. All charges, on account of electricity, water, sanitation, etc. shall also be borne by the successful bidder. 32. On the expiry of the lease contract, the successful bidder shall handover all article which were entrusted in good condition. 33. The Committee reserves the right to renew or otherwise the Lease contract after expiry of 5 years. On approval the charges will be at 15% increase after 5 years in every two years upto the period agreed mutually. 34. Any additional terms and condition will be incorporated as and when required as per the instruction of Government of J&K issued from time to time other than the mentioned terms and conditions in the tender. This will be binding to the bidders. 35. All the properties will be handed over to the successful bidders as per inventory which will be signed by both the parties with all details of the properties. 36. All the above terms and conditions are intended only for initial proposal and the same may be altered/modified at the time of Bidding for management contract. 37. The Earnest Money @ 2% of Bid amount in shape CDR/FDR pledged in favour of Accounts Officer, Patnitop Development Authority should be deposited with the Bid Document.

ANNEXURE -I

TECHNICAL BID

1. The Proposer/Bidder (Bidder) should have a minimum of 3 years experience in the running/operation and management of three star hotel in Jammu & kashmir. (Documentary proof to be enclosed) OR if he is not having required experience he can have tie up arrangements with leading companies and firms having minimum 3 years experience in this field for which tenderer has participated in the tender – (Information to be submitted in separate sheet as “Annexure A” with documentary proof i.e. copy of agreement etc. to be furnished).

2. The Proposer/Bidder should submit the Audited Annual Accounts of his firm for the preceding three years in separate sheet as “Annexure B”.

3. The Proposer/Bidder should submit the Current business of his firm in hand with details and proof in separate sheet as “Annexure C”.

4. The Proposer/Bidder should submit the details of professionals engaged with his firm in separate sheet as "Annexure-“D”.

5. The Proposer/Bidder should furnish PAN, VAT Registration Certificate, Service tax No., PF & ESI Registration if any with other statuary documents required for the subject Lease Contract.

6. Each and every page of tender document should be signed by the Proposer/Bidder and submitted along with the Technical Bid only.

7. Proposer/Bidder should submit his proposal with detailed working plan (like deployment of human resources, equipment, facilities etc.) for operation and management of Budget Accommodation to give excellent services to guests and public in separate sheet as “Annexure E”.

..9.. ADDITIONAL TERMS AND CONDITIONS

1. The premises allotted including the kitchen dining areas should be kept neat and clean and hygienic always.

2. Pest control should be carried out at periodical intervals, stipulated on behalf of Patnitop Development Authority.

3. The staff should be supplied Uniforms. The staff should be given identity cards, showing that they are the employees of the Successful bidder and the identity cards should be displayed on those persons.

4. Goods suppliers should also be given identity cards to avoid unauthorized persons entering and creating nuisance/ annoyance / trouble to tourists. However the Patnitop Development Authority reserves its rights to restrict and regulate the entry and exit of suppliers and staff.

5. In case of Policy decision the Secretary, Tourism Department, Government of Jammu and Kashmir shall be the deciding authority.

6. The decision of the Secretary, Tourism Department, Jammu and Kashmir Government is final and binding on both the parties.

7. In case of any dispute or difference regarding the terms of contract, interpretation or implementation performance, default of the terms and to the implementation any of the conditions, the Secretary to Government, Tourism Department will be Arbitrator whose decision shall be final.

8. The successful bidder shall ensure due observance compliance with relevant laws, rules and regulations applicable to the business from time to time.

9. Any loss or damage if caused to properties either by the successful Contractor or his agents or servants, either willfully / inadvertently, the cost/extent of loss / damage will be recovered from the successful contractor.
