Independence brought to an end one of the most intractable and wasteful conflicts in the region. With independence, the people of Namibia not only gained political freedom, but set out on the challenging task of building a nation and defining their relations with the world. From the perspective of mediation, the role of the international community in bringing about Namibia's independence in general, and that of the United Nations in particular, was of a deep structural nature. -

Institute for Public Policy Research Political Party Life in Namibia: Dominant Party with Democratic Consolidation * Briefing Paper No. 44, February 2009 By André du Pisani and William A. Lindeke Abstract This paper assesses the established dominant-party system in Namibia since independence. Despite the proliferation of parties and changes in personalities at the top, three features have structured this system: 1) the extended independence honeymoon that benefits and is sustained by the ruling SWAPO Party of Namibia, 2) the relatively effective governance of Namibia by the ruling party, and 3) the policy choices and political behaviours of both the ruling and opposition politicians. The paper was funded in part by the Danish government through Wits University in an as yet unpublished form. This version will soon be published by Praeger Publishers in the USA under Series Editor Kay Lawson. “...an emergent literature on African party systems points to low levels of party institutionalization, high levels of electoral volatility, and the revival of dominant parties.” 1 Introduction Political reform, democracy, and governance are centre stage in Africa at present. African analysts frequently point to the foreign nature of modern party systems compared to the pre-colonial political cultures that partially survive in the traditional arenas especially of rural politics. However, over the past two decades multi-party elections became the clarion call by civil society (not to mention international forces) for the reintroduction of democratic political systems. This reinvigoration of reform peaked just as Namibia gained its independence under provisions of the UN Security Council Resolution 435 (1978) and the supervision of the United Nations Transition Assistance Group (UNTAG). -

PREFACE In August 1989 Geoffrey Bindman, an English solicitor, was asked by the International Commission of Jurists to attend the hearing of an application by the Legal Assistance Centre to the Supreme Court of Namibia.The application sought to dismiss a challenge by the Government to the freedom of the Centre to represent litigants in proceedings alleging human rights abuses by the police and security forces. As the application was decided quickly in favour of the Centre, Mr. Bindman spent the remainder of his time in Namibia looking into the role of the law in Namibia's transitional period from being a dependency of South Africa to becoming an independent state. He came to the conclusion that the dominant role of the South African-controlled Government endangers the prospect of a free and fair election. Accordingly,this document, in addition to being a report of the legal proceedings before the Supreme Court, recounts disturbing features of the run-up to the independence election which is due to be held in November 1989. In view of the urgency, the International Commission of Jurists has decided to publish his report in this form. It is a unitary country divided into three spheres of government comprising of central, regional and local governments. The President of Namibia is elected to a five-year term and is both the head of state and the head of government. Namibia has a bicameral Parliament with the National Assembly as lower house, and the National Council as the upper house, whose members are chosen by regional councils. Namibia’s decentralization process began with its independence in 1990, starting from deconcentration and then evolving into delegation and later on devolution. Chapter 12 of the 1990 Constitution creates provisions for regional and local government. -

The Constitution of Namibia
CHAPTER 20 The Law in Force and Transitional Provisions Article 133 The First National Assembly Notwithstanding the provisions of Article 46 hereof, the Constituent Assembly shall be deemed to have been elected under Articles 46 and 49 hereof, and shall constitute the first National Assembly of Namibia, and its term of office and that of the President shall be deemed to have begun from the date of Independence. Article 134 Election of the First President (1) Notwithstanding the provisions of Article 28 hereof, the first President of Namibia shall be the person elected to that office by the Constituent Assembly by a simple majority of all its members. (2) The first President of Namibia shall be deemed to have been elected under Article 28 hereof and upon assuming office shall have all the powers, functions, duties and immunities of a President elected under that Article. Article 135 Implementation of this Constitution This Constitution shall be implemented in accordance with the provisions of Schedule 7 hereof. Article 136 Powers of the National Assembly prior to the Election of a National Council (1) Until elections for a National Council have been held: (a) all legislation shall be enacted by the National Assembly as if this Constitution had not made provision for a National Council, and Parliament had consisted exclusively of the National Assembly acting on its own without being subject to the review of the National Council; (b) this Constitution shall be construed as if no functions had been vested by this Constitution in the National Council; (c) any reference in Articles 29, 56, 75 and 132 hereof to the National Council shall be ignored: provided that nothing contained in this 64 Sub-Article shall be construed as limiting in any way the generality of Sub-Articles (a) and (b) hereof. -

The Hon USUTUAlJE MAAMBERUA MP, President of SWANU 1. INTRODUCTION Honorable Speaker and Honorable Members of Parliament I rise to make my third budget maiden speech in this august house. Last year in my contribution to the budget disucussions, I said that political parties are products of their own experiences and ideas if not ideological perspectives with which they have been confronted in the past. In the Namibian context the two oldest liberation movements namely SWANU and SWAPO adopted a socialist ideological stance because of the imperatives of the liberation struggle. We, thus, stood shoulder-to- shoulder, shared poliltical platforms together, languished in and shared prison cells together, defied the Apartheid policies and programmes individually and collectively, we all mobilized the international community for various resources endeavouring to liberate our country for the common good of all our people. As refugees and liberation cadres we faced attacks by the common enemy and had to endure untold sufferings. As a mother of all the political parties in Namibia, SWANU would like to take this opportunity to implore all her offsprings in Parliament to receive 1 t' this marathon submission with patience and deep reflection of the role that this still active mother has played to shape the past and future of this country. Currently there are several socialist oriented parties in the country, some also represented here today. It is evident that our struggle was not in vain and thus our socialists ideological decision was to benefit all Namibians upon attaining independence. This is a stark reminder that ideology is not confined to liberation struggle times only but is a continuum even beyond attainment of the aspirations of the people, for continous fullfilment of the needs of the grass-roots is an imperative. -

Bicameralism in the Namibian legislature Tania Wiese This is the second of two briefing papers on the debate around the continued existence of a second chamber in the Namibian legislature. The first paper gives an overview of the theoretical arguments surrounding bicameralism and also gives an indication of its global and African position. It concludes that the only way to determine whether bicameralism is in fact the best alternative for a specific legislature, is to examine its existence within that particular country – its suitability can only be judged according to the degree of fit with the idiosyncrasies of a given environment. This paper examines the development of bicameralism within the Namibian context and also provides some practical insights into its functioning gained from Namibian members of parliament. 1. Introduction O’Brien, in an article written for the Canadian Parliamentary Review (1997) quotes Edward Sail, who remarked that legislatures usually evolve without specific, previously-agreed purposes or goals. This means that legislative development is less the product of constitutional or institutional engineering, and more the product of constitutional and institutional evolution. Namibia is no exception – it seems that the disagreements regarding the structure of the legislature that existed at the time of independence, still exist today. This paper will thus examine bicameralism’s development and implementation within the Namibian context to determine whether its existence and suitability is based on an evaluation of its purpose and value.
