SUBJECT: REACH initiative - Five European states call for evidence on broad PFAS restriction

The European Technical Committee (EFCTC) would like to call your attention that the national authorities of Germany, the Netherlands, Norway, Sweden and Denmark have invited interested parties to send in evidence and information on the use of per- and polyfluoroalkyl substances (PFAS) by 31 July 2020. For further information see the ECHA website, PFAs section.

The call for evidence request includes producers, suppliers and distributors.

Why is this relevant to HFCs, HFOs and HCFOs? The definition for PFAS used by the survey includes any substance that has a CF2 group or a CF3 group. We take the view that this definition far exceeds the traditional definition of PFAS, but is still important to submit evidence in this respect.

The survey is a very broad, covering a wide range of substances and polymers, and seeks to establish as one of its objectives how these substances are used and if workers come into contact with them. We all know that through the F-Gas Regulation1, there is already considerable information available to the authorities, but it is essential to communicate the important role of HFCs, HFOs and HCFOs due to their safety and technical properties.

As the European trade association for the producers of HFCs, HFOs and HCFOs, EFCTC is preparing and will be submitting a detailed reply to the call for evidence which details the environmental properties of HFCs, HFOs and HCFOs, and providing high level information on quantities and uses. We have recently published a position paper “Per- and Polyfluoroalkyl Substances: HFCs and HFOs a distinct subset” which is available here in the EFCTC website, position paper section.

EFCTC would ask you to reply to this call for evidence and would ask you to complete the relevant questions for your activities in the online survey. As an aid to this we have drafted general answers to the most relevant questions (attached). We have also attached a spreadsheet that lists the relevant individual substances and CAS/EINECs numbers.

The survey can be completed online here. It is listed as PFAS under current consultations.

In conclusion, this is the first stage in a process and this is our first opportunity to comment. We believe that it is essential that the authorities should be made aware of the important role of HFCs, HFOs and HCFOs, and the care taken by industry using them responsibly to take advantage of their safety and technical properties.

• More importantly, although workers handle the substances, they do not come into direct contact with the substances which are in closed containers, as they are liquified gases or low boiling point liquids. Any transfers are undertaken in closed systems with careful engineering controls to complete vapor or liquid transfer to either minimize or completely eliminate emissions. When the substances are recovered from systems, recovery equipment ensures that emissions are minimized or eliminated. Recovered substances may be returned to the distributor for either reclaim or destruction. Following chemical analysis for purity, the returned substance may be reclaimed to a required industry specification for reuse. If the substance is not suitable for reuse, then it is sent for destruction. This cycle of use and recovery aligns with the circular economy and modern handling equipment. Therefore, use and handling systems are designed to minimize or eliminate emissions.

NOTE: Specific input from your experience on contributing to and managing this circular economy, and procedures and processes that you have in place to manage these materials, would be of particular value to the review process.

Free Text – Recommendation: The substances are required by customers as they provide the necessary technical and safety properties as required as refrigerants, working fluids for organic Rankine cycle systems, insulation foam blowing agents, or propellants and solvents to meet applicable standards and customer requirements. The majority of substances or their mixtures are designed to be non-flammable or lower flammable (EN378 Safety Class 2L) and have a low order of toxicity. The substances are selected based on their technical properties, safety characteristics and performance properties that cannot in many cases be provided by other alternatives. The substances are used in equipment and systems throughout the cold chain to reduce food loss and food waste. Similarly, these substances are used in the refrigerated production and distribution of pharmaceuticals. Their use in heat pumps contribute to the increased use of renewable energy. These substances support the drive to reduce energy consumption in buildings while maintaining a comfortable indoor environment. Furthermore, energy efficiency is enhanced through waste heat recovery systems that rely on these substances.

Free Text – Recommendation: All sectors of the cold chain for refrigeration, air-conditioning, heat pumps, industrial process cooling, organic Rankine cycle systems, insulation foams, consumer and technical aerosols, solvents. The technical and economic lifetime of the equipment containing HFCs/HFOs is often decades and conversion to other fluids will be technically very difficult, also from a regulatory (safety) point of view. Therefore, access to these substances will be required for a long period as is recognised under the EU F-Gas Regulation.

I. Reasons and aims of this analysis

The competent authorities for REACH of several member states, namely the Netherlands, Germany, Denmark, Sweden and Norway are currently preparing an analysis of restriction options for the PFAS group of substances (per- and polyfluoroalkyl substances) described below (as defined under Section II. Substances) since all these substances are considered to be persistent.

The consequences of this persistence include that the presence of these substances in the environment is practically irreversible, and pose an unacceptable risk to the environment and humans. All uses of PFAS (professional and industrial uses, consumer uses of mixtures and articles) result in emissions into the environment and contribute to the overall concentrations of PFAS in the environment. Many members of this group already occur ubiquitously in the environment and contaminate the ground- and untreated water due to their high mobility. In addition, some of these substances accumulate in biota and/or are suspected to be toxic.

In view of these properties, the above mentioned competent authorities for REACH are considering proposing EU-wide measures covering all PFAS (as defined under Section II. Substances) to reduce those risks.

This questionnaire is intended to generate data and knowledge with regard to PFAS and their uses in order to decide on the initial chemical scope as well as the use scope of a restriction proposal. The questionnaire further aims at understanding for which of the PFAS in scope chemical alternatives or technical replacements exist, voluntary measures or substitution processes etc. are onging. Based on that basic information appropriate options for a restriction proposal will be taken forward in the development of a REACH Annex XV Restriction Dossier.

II. PFAS in scope

As indicated by the name, per- and polyfluoroalkyl substances (PFASs) comprise a group of organic substances containing alkyl groups on which all or many of the atoms have been replaced with as structural fragments.

Hence, as the scope of the current Call for Evidence have been selected:

Substances that contain at least one aliphatic -CF2- or -CF3 element.

Although all PFAS will be considered for regulation, a non-exhaustive list of the most frequently used substances and substance groups may be found in the supplementary document accompanying this questionnaire and consultation which can be downloaded under following link: Supplementary document.docx III. Questions are addressed to the whole supply chain including manufacturers, importers, distributors and downstream users (please see supplementary document for further explanation).

Of interest is information on PFAS and alternatives to PFAS. PFAS and PFAS contained in mixtures and articles are of relevance. Alternatives include chemical (non-fluorinated) as well as technical replacements for PFAS.

This questionnaire contains the possibility to redirect through blocks of questions depending on your type of information or data. Hence, you are able to specifically respond to the questions relevant to you.

The -fluorine bonds are one of the strongest chemical bonds in organic chemistry. This means substances containing this chemical bond resist degradation when used and also in the environment. All PFAS subject to the description above (as defined in Section II.) are, or ultimately transform into,are therefore persistent substances. Perfluorinated chemicals are thermally, chemically and biologically highly inert. Due to the very strong carbon-fluorine bound, these substances can resist degradation by acids, bases, oxidants, reductants, photolytic processes, microbes and metabolic processes (Parsons et al., 2008; Schultz et al., 2003; Siegemund et al., 2000).
