Honorable Members:

Transmitted herewith are the certified results of the votes cast in the City of Los Angeles Primary Nominating and Consolidated Elections held Tuesday, March 3, 2009, on the following matters submitted to the voters:

• For the various candidates for the Offices of Mayor, City Attorney and Controller.

• For the various candidates for the Offices of Member of the in District Numbers 1,3,5,7,9, 11, 13 and 15.

• For the various candidates for the Offices of Member of the Board of Education of the Los Angeles Unified School District in District Numbers 2, 4, and 6.

• For the various candidates to fill the Offices of Member of the Board of Trustees of the Los Angeles Community College District for Seat Numbers 2, 4, 6, and 7.

• For and against City of Los Angeles Charter Amendments A, C, D, and E; and Charter Amendment and Ordinance Proposition B.

In addition to the votes tabulated and certified by the Los Angeles City Clerk, summaries of the certified results from those cities conducting portions of the election for the Offices of Member of the Board of Education of the Los Angeles Unified School District in District Numbers 2, 4 and 6 and for the Offices of Member of the Board of Trustees of the Los Angeles Community College District for Seat Numbers 2, 4, 6 and 7 are also transmitted herewith.

The above set of certified results are accompanied by seven Resolutions, one for the City of Los Angeles and Los Angeles Unified School District Offices, one for City of Los Angeles Charter Amendment A, one for City of Los Angeles Charter Amendment and Ordinance Proposition B, one for Charter Amendment C, one for Charter Amendment D, one for Charter Amendment E, and one for the Los Angeles Community College District Offices/Seats, declaring the results of the election.

Recommendation

That the City Council adopt the seven accompanying Resolutions declaring the results of the City of Los Angeles March 3, 2009, Primary Nominating and Consolidated Elections.

Fiscal Impact Statement

Adopting the Resolutions declaring the results of the City of Los Angeles Primary Nominating and Consolidated Elections will have no impact on the General Fund as the funds necessary to conduct the 2009 municipal elections are already included in the City Clerk's operating budget for Fiscal Year 2008-09.

WHEREAS, the Los Angeles City Clerk, in accordance with City of Los Angeles Charter Section 404, did canvass the returns of the Primary Nominating and Consolidated Elections held in the City of Los Angeles and the Los Angeles Unified School District on March 3, 2009, and certified them to the City Council; and

WHEREAS, the City Clerks of those cities conducting a portion of the Primary Nominating and Consolidated Elections with respect to the nomination and election of candidates for the Board of Education of the Los Angeles Unified School District have transmitted their certified results of the votes cast; and

WHEREAS, it appears to the City Council that the canvass of votes is true and correct.

NOW, THEREFORE, the City Council of Los Angeles hereby finds, determines, and declares that the total number of ballots tabulated by the Los Angeles City Clerk for the Primary Nominating and Consolidated Elections was 309,048; that the total number of ballots tabulated by the Los Angeles City Clerk within the City of Los Angeles at the election was 285,658; that the total number of ballots tabulated by the Los Angeles City Clerk for the territory outside of the City of Los Angeles annexed to the City for school election purposes was 23,390; that the certified vote totals received from cities conducting a portion of the Board of Education election have been properly added to the vote totals tabulated by the Los Angeles City Clerk; and that the following persons received a majority of votes cast for all candidates for the respective offices for the term ending June 30, 2013, and are hereby declared to be elected at the Primary Nominating and Consolidated Elections.

FIRE DEPARTMENT INDEPENDENT ASSESSOR. CHARTER AMENDMENT A.

Shall the Charter be amended to empower the Board of Fire Commissioners to appoint and remove an Independent Assessor, exempt from Civil Service, who shall be responsible for auditing, assessing and reviewing the Fire Department's handling of complaints against sworn and civilian employees?

WHEREAS, the Los Angeles City Clerk, in accordance with City of Los Angeles Charter Section 404, did canvass the returns of the Primary Nominating and Consolidated Elections held in the City of Los Angeles on March 3, 2009, and certified them to the City Council; and

WHEREAS, it appears to the City Council that the canvass of votes is true and correct.

SOLAR ENERGY AND JOB CREATION PROGRAM. CHARTER AMENDMENT AND ORDINANCE PROPOSITION B.

Shall the Charter and Administrative Code be amended to authorize creation of a Los Angeles Department of Water and Power program to require production of at least 400 megawatts of solar power energy by 2014; provide for voluntary participation in the program by commercial, industrial, and institutional customers to allow installation of solar power systems on their property which would be operated and maintained by the Department in exchange for potential incentives; establish a jobs program and training academy to meet program participation demand; provide contract bid preferences for local solar power equipment manufacturers; require quarterly oversight committee reports and annual City Controller audit; and utilize a variety of funding mechanisms?

WHEREAS, the Los Angeles City Clerk, in accordance with City of Los Angeles Charter Section 404, did canvass the returns of the Primary Nominating and Consolidated Elections held in the City of Los Angeles on March 3, 2009, and certified them to the City Council; and

WHEREAS, it appears to the City Council that the canvass of votes is true and correct.

NOW, THEREFORE, THE LOS ANGELES CITY COUNCIL hereby finds, determines, and declares that the total number of votes cast for and against City of Los Angeles Charter Amendment and Ordinance Proposition B at the Special Election by the qualified voters was 262,494 as set forth in the certification of the Los Angeles City Clerk, and that the measure as proposed by Resolution of the City Council is hereby declared not to have been approved by a majority of the voters voting thereon.

Shall the Charter be amended to allow disabled children of deceased members of the Fire and Police Pension Plan to marry or be adopted without losing their Dependent Child benefits and to provide additional options for the payment of benefits belonging to disabled children of deceased members that do not increase the amount of the benefits being paid?

WHEREAS, the Los Angeles City Clerk, in accordance with City of Los Angeles Charter Section 404, did canvass the returns of the Primary Nominating and Consolidated Elections held in the City of Los Angeles on March 3, 2009, and certified them to the City Council; and

WHEREAS, it appears to the City Council that the canvass of votes is true and correct.

NOW, THEREFORE, THE LOS ANGELES CITY COUNCIL hereby finds, determines, and declares that the total number of votes cast for and against City of Los Angeles Charter Amendment C at the Special Election by the qualified voters was 251,920 as set forth in the certification of the Los Angeles City Clerk, and that the measure as proposed by Resolution of the City Council is hereby declared to have been approved by a majority of the voters voting thereon.

WHEREAS, it appears to the City Council that the canvass of votes is true and correct.

WHEREAS, the Los Angeles City Clerk, in accordance with City of Los Angeles Charter Section 404, did canvass the returns of the Primary Nominating and Consolidated Elections held in the City of Los Angeles on March 3, 2009, and certified them to the City Council; and

WHEREAS, the City Clerks of those cities conducting a portion of the Primary Nominating and Consolidated Elections with respect to the nomination and election of candidates for the Governing Board (Board of Trustees) of the Los Angeles Community College District have transmitted their certified results of the votes cast; and

WHEREAS, it appears to the City Council that the canvass of votes is true and correct.

NOW, THEREFORE, the City Council of Los Angeles hereby finds, determines, and declares that the total number of ballots tabulated by the Los Angeles City Clerk for the Los Angeles Community College District election was 309,048; that the certified vote totals received from cities conducting a portion of the Governing Board (Board of Trustees) election have been properly added to the vote totals tabulated by the Los Angeles City Clerk; and that the following persons received a majority of votes cast for all candidates for Member of the Board of Trustees-Seat No.4 for the term ending June 30, 2013 and for Member of the Board of Trustees-Seat No.7 for the term ending June 30, 2011 and are hereby declared to be elected at the Primary Nominating and Consolidated Elections:
