2. The Project is new/ redevelopment- New 3. Earlier clearance details, Construction status, if any- Consent to Establish and Consent to Operate has been obtained. FSI area is 24,671.106 sqm and total construction area of 24,671.106 sqm. The project has been comprised of 1 hotel building. Total 122 rooms have been developed. Maximum height of building is 27.31 m. 4. During construction phase, total water demand of the project was 3,828 KLD Water requirement met by private water tanker during the construction phase, soak pits and septic tanks were provided for disposal of waste water. Temporary sanitary toilets were provided during peak labor force. 5. During operation phase, total water demand of the project is 155 KLD and the same is being met by the ground water and recycled water. Wastewater generated (95 KLD) and waste water treated in STPs of total 95 KLD capacity 150 KLD of treated wastewater is being recycled(for flushing 41 KLD for gardening 38 KLD ) 6. About TPD solid waste will be generated in the project. The quantity of the waste is approx. 327 kg/day. The solid waste generated is being properly collected & segregated into biodegradable (waste vegetables and foods etc.) and recyclable (papers, cartons, thermocol, plastics, glass etc.) components and collected in separate bins. Recyclable and non-recyclable wastes are being disposed through Karnal Solid waste Management plant. 7. The total demand load is approx. 1500 KVA. Power is being supplied by Haryana Bijli Vitran Power Nigam (UHBVN). Power back up is being met through 3 number of DG sets of total capacity 1500 KVA (3×500 KVA each) for power back up. 1 DG set of 500 kVA will be taken as standby & 2 DG sets of 500 kVA each is operational. 8. The project proponent had been installed 7 Rain water harvesting pits to harness and reuse of storm water as per the CGWB and BIS standards for various applications. 9. Parking facility- Total Parking area available at the project site is 404 E.C.S and required parking at the project site is 390 E.C.S. 10. Proposed energy saving measure would save about 15% of power. 11. There is no Eco sensitive areas are present in 10 km of the project site. 12. There is no/court case pending against the project.- Case no. 3/15 U/S, Environmental Protection Act 1986. In the court Sh. Minutes of the 58th meeting of State Environment Impact Assessment Authority held on 4th & 5th Oct. 2013 under the Chairpersonship Mrs. Saroj Siwatch IAS (Retd.), Chairperson, SEIAA held in the conference room of Haryana State Guest House, Chankyapuri, New regarding Environmental Clearance under EIA otification dated 14.9.2006.

The full Authority is present. The 20 Cases recommended by SEAC/EAC for Environmental Clearance or otherwise and as listed in the Agenda item circulated vide letter No. 802 to 804 dated 30-09-2013 were discussed. Following decisions were taken:- On 04-10-2013 Item No. [1] Environmental Clearance for W.R.T. Commercial Colony Project at Village Badshapur, Sec-66, Distt. , Haryana by M/s NCR Business park Pvt. Ltd (formally known as M/s Kay Kay Buildtech Pvt. Ltd.) The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed construction Commercial Colony Project at Village Badshapur, Sec-66, Distt. Gurgaon, Haryana on a plot area of 22864.703 sqmt (5.65 Acres). The total built up area shall be 40010.034 sqmt. The Commercial complex shall have 3 Towers; Tower-1(G + 9 floors), Tower-2 (G + 7 floors), Tower-3 (G + 11 floors)). The maximum height of the building shall be 49.95 meter. The total water requirement shall be 334 KLD. The fresh water requirement shall be 200 KLD. The waste water generation shall be 260 KLD, which will be treated in the STP of 400 KLD capacity. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent and consultant. Detailed discussions were held regarding water requirement, quality of water, green belt development plan, Ambient Air Quality, NOC of Deputy Commissioner, regarding non applicability Aravalli notification, recycle and reuse of water etc. The representative of the project proponent submitted the NOC of Deputy Commissioner, Gurgaon regarding non applicability of Aravalli notification, NOC from AAI regarding height clearance and assurance of HUDA for supply of water. It was noticed that the project proponent has not kept water requirement for DG cooling/HVAC make-up. The representative of the project proponent assured to submit revised water calculation and water balance diagram. The representative of the project proponent was also directed to submit a plan earmarking site for solid waste management and also to submit a plan. The representative of the project proponent submitted the plan showing site for solid waste management. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The solid waste generated should be properly collected and segregated as per the requirement of the MSW Rules, 2000 and as amended from time to time. The bio-

degradable waste should be treated by appropriate technology at the site ear-marked within the project area and dry/inert solid waste should be disposed off to the approved sites for land filling after recovering recyclable material. [2] STP outlet after stabilization and stack emission shall be monitored monthly. Other environmental parameters and green belt shall be monitored on quarterly basis. After every 3 (three) months, the project proponent shall conduct environmental audit and shall take corrective measure, if required, without delay. [3] The project proponent shall provide one refuse area till 24 meter and one till 39 meter as per National Building Code. [4] The project proponent shall provide fire control room and fire officer for building above 30 meter as per National Building Code. [5] The project proponent shall obtain permission of Mines and Geology Department for excavation of soil before the start of construction. [6] Water supply shall be metered among different users of utilities. [7] The project proponent shall seek fresh Environmental clearance if at any stage there is change in the planning of the proposed project. [8] The project proponent shall ensure the compliance of Forest Department, Haryana Notification no. S.O.121/PA2/1900/S.4/97 dated 28.11.1997. [9] The project proponent shall provide water sprinkling system in the project area to suppress the dust in addition to the already suggested mitigation measures in the Air Environment Chapter of EMP. [10] The project proponent shall seek specific prior approval from concerned local Authority/HUDA regarding provision of storm drainage and sewerage system including their integration with external services of HUDA/ Local authorities beside other required services before taking up any construction activity. [11] The site for solid waste management plant be earmarked on the layout plan and the detailed project for setting up the solid waste management plant shall be submitted to the Authority within one month. [12] The project proponent shall submit NOC from airport authority regarding height clearance. [13] The project proponent shall submit revised water requirement by including water for DG cooling/ HVAC make-up and shall also submit revised water balance diagram before the start of construction. [14] The project proponent shall submit copy of licence transferred in the name of M/s NCR Business park Pvt. Ltd before the start of construction. [15] Vertical fenestration shall not exceed 40% of total wall area. [16] The project proponent shall correct water supply requirement for domestic and flushing within the total supply. Subsequent changes shall be made accordingly.

Item No. [2]Environmental Clearance for development of Group Housing Colony “Highland Park” in the Revenue Estate of Village Tikampur, Sector- 103, Gurgaon, Haryana by M/s Identity Buildtech Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed construction of Group Housing Project at Village Tikampur, Sector-103, Gurgaon, Haryana on a plot area of 47348.145 sqmt (11.7 Acres). The total built up area shall be 109761.272 sqmt. The group housing complex shall have 4 Building blocks (2 BHK, 3 BHK, 3 BHK & 4 BHK), EWS 110 units, Convenient Shopping and Nursery School. The Building shall comprise 1 Basements + Stilt + GF +Maximum 17 Floors. The maximum height of the building shall be 54.950 meter. The total water requirement shall be 565 KLD. The fresh water requirement shall be 335 KLD. The waste water generation shall be 411 KLD, which will be treated in the STP of 500 KLD capacity. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent. Detailed discussions were held regarding water requirement, quality of water, green belt development plan, existence of revenue rasta, Ambient Air Quality, NOC of Deputy Commissioner, regarding non applicability Aravalli notification, helipad facility etc. The representative of the project proponent submitted the NOC of Deputy Commissioner, Gurgaon regarding non applicability of Aravalli notification and NOC from AAI regarding height clearance. The representative of the project proponent was directed to revise the water requirement @ 5 persons for EWS instead of @ 2 persons as proposed and also to submit revised water balance diagram. The representative of the project proponent submitted the revised water calculation and water balance diagram. The representative of the project proponent also submitted an undertaking declaring that they will not encroach revenue rasta. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The project proponent shall ensure that no construction activity is undertaken either on surface or below or above surface of revenue rasta passing through the project area. [2] The project proponent shall indicate the width and length of revenue rasta passing through the project area on sign board and shall display the same at both the ends of revenue rasta stretch, for awareness of public. Sign board shall also display the message that this is public rasta/road and any citizen can use it. There shall not be any gate with or without guards on revenue rasta. [3] The project proponent shall develop complete civic infrastructure of the Group Housing colony including internal roads, green belt development, sewerage line,

Rain Water recharge arrangements, Storm water drainage system, Solid waste management site and provision for treatment of bio-degradable waste, STP, water supply line, dual plumbing line, electric supply lines etc. and shall offer possession of the units/flats thereafter. licence/CLU has been granted by the Town & Country Planning Department, Haryana. [16] The project proponent shall submit NOC from airport authority regarding height clearance.

[17] The project proponent shall ensure that the plinth level of the building block to be 1.5 meter above 100 years flood level of the said Najafgarh Jheel. [18] The project proponent shall obtain NOC from HUDA as well as Irrigation Department before the start of construction, regarding possible adverse effect of project proposal on the said Najafgarh Jheel. Item No. [3]Environmental Clearance for proposed commercial colony projects in Sector-62, Village- Ullahwas, Gurgaon by M/S S.U. Estate Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed construction of commercial complex project at Sector-62, Village- Ullahwas, Gurgaon. The recommendation of SEAC was considered in the today’s meeting in the presence of representative of the project proponent. Detailed discussions were held regarding existence of revenue rasta, approach to building block through 6 meter wide road, solid waste management plan, provision for services across the nallah, Ambient Air Quality, NOC from Deputy Commissioner, Gurgaon regarding non-applicability of Aravalli notification, water supply assurance during operation phase, permission for discharge of excess of treated water in the public sewer etc. representative of the project proponent submitted an undertaking declaring that they will provide helipad facility. It was noticed that the project proponent has proposed access to Tower B through 6.075 meter revenue rasta and has also proposed to lay the services lines under the revenue rasta. The representative of the project proponent was asked to seek clarification from Town and Country Planning Department regarding access to the Tower B through 6.075 meter revenue rasta as well as seek permission of competent Authority for laying of services lines under the revenue rasta. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit NOC from Deputy Commissioner, Gurgaon regarding non applicability of Aravalli notification. [2] The project proponent shall submit assurance of water supply from HUDA. [3] The project proponent shall submit revised RWH calculations @ 45 mm/hr instead of @ 35 mm/hr.

[4] The project proponent shall submit permission of competent Authority for laying of services lines under the revenue rasta.

[5] The project proponent shall submit permission of Town and Country Planning Department regarding access to the Tower B through 6.075 meter revenue rasta. Item No. [4]Environmental Clearance for the development of Residential Group Housing Colony located at Sector-64, - Kundli, Multifunctional Urban Complex, Haryana by M/s P.S.Realtors Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed construction of Residential Group Housing Colony at Sector-64, Sonipat- Kundli, Multifunctional Urban Complex, Haryana. The recommendation of SEAC was considered in the today’s meeting in the presence of representative of the project proponent. Detailed discussions were held regarding existence of revenue rasta/village road, solid waste management plan, Ambient Air Quality, water supply assurance during operation phase, permission for discharge of excess of treated water in the public sewer, water calculation, etc. The representative of the project proponent submitted water supply assurance of HUDA. The representative of the project proponent was asked to revise the water calculation for EWS @ 5 persons instead of @ 2persons as well as revised the water calculation @ 135 lpcd instead of @ 111 lpcd. The representative of the project proponent assured to submit revised water calculation and water balance diagram. The representative of the project proponent was also asked to seek the permission of competent Authority for laying of services lines

under the revenue rasta. It was noticed that the values of parameter of PM10 is exceeding the prescribed limits. The representative of the project proponent was advised to adopt water sprinkling system in order to suppress the dust generation. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit the revised water requirement @ 135 lpcd (EWS @ 5 persons) and revised water balance diagram. [2] The project proponent shall submit NOC from DFO regarding non-involvement of forest land.

[3] The project proponent shall submit permission of competent Authority for laying of services lines under the revenue rasta. [4] The project proponent shall submit assurance of HUDA for discharge of excess of treated waste water in public sewer. Item No. [5]Environmental Clearance of namely “Essel Towers” Group Housing Complex at village- Sukhrali & Sarhaul, Sec-28, Gurgaon, Haryana. Under Category 8(b) project by M/S ESSEL Housing Projects Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed construction of of

Expansion of Group Housing Complex at village- Sukhrali & Sarhaul, Sec-28, Gurgaon, Haryana on a plot area of 139920.634 sqmt (Existing 122636.439 sqmt + Proposed 17284.195 sqmt). The total built up area shall be 413686.056 sqmt (Existing 370355.712 sqmt + Proposed 43330.344 sqmt). The Group Housing complex shall comprise of total 1220 dwelling units (Existing 1138 + Proposed 82), Primary School, EWS units, Nursery School Community building etc. The maximum height of the building shall be 57 meter. The total water requirement for the Expansion project shall be 166 KLD. The fresh water requirement for the Expansion project shall be 92 KLD. The waste water generation for the Expansion project shall be 109 KLD, which will be treated in the STP of 130 KLD capacity. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent. The recommendation of SEAC was examined on the basis of prevalent procedure as prescribed in the MoEF GoI amended notification dated 22-08-2013. Detailed discussions were held regarding water requirement, quality of water, green belt development plan, existence of revenue rasta, Ambient Air Quality, NOC of Deputy Commissioner, regarding non applicability Aravalli notification, helipad facility etc. It

was noticed that the values of parameter PM10 is exceeding the prescribed limits. ItemNo. [6] Environmental Clearance for Expansion of Proposed Residential Plotted Colony Project krom 108.068 acres to 126.674 acres at Sector- 102 & 102A, Village- Kherkimajra & Dhankot, Gurgaon, Haryana (under Category 8(b) project by M/S Countrywide Promoters Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed construction of Residential

Plotted Colony Project at Sector-102 & 102A, Village- Kherkimajra & Dhankot, Gurgaon, Haryana. The recommendation of SEAC was considered in the today’s meeting in the presence of representative of the project proponent. The recommendation of SEAC was examined on the basis of prevalent procedure as prescribed in the MoEF GoI amended notification dated 22-08-2013. Detailed discussions were held regarding, solid waste management plan, existence of nallah, provision for services across the nallah, Ambient Air Quality, NOC from Deputy Commissioner, Gurgaon regarding non-applicability of Aravalli notification, water supply assurance during operation phase, permission for discharge of excess of treated water in the public sewer etc. The representative of the project proponent submitted a plan earmarking site reserve for solid waste management, STP locations and showing a revenue rasta. The representative of the project proponent also submitted an undertaking that the licencees pertaining to the proposed project are valid as on date and shall be got renewed from time to time. On enquiry, regarding existence of nallah in the project area the representative of the project proponent clarified that the nallah shown in the zoning plan has been converted into STP channel (approximately 2 km length) including 3 no of bridges by HUDA. The representative of the project proponent also submitted copies of letters. The representative of the project proponent failed to submit certificate from DC Gurgaon regarding non-applicability of Aravalli Notification. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit NOC from Deputy Commissioner, Gurgaon regarding non applicability of Aravalli notification. [2] The project proponent shall submit write up on STP channel constructed by irrigation/HUDA along with letters. The project proponent shall ensure that the arrangement made shall not obstruct the natural/ proposed flow in the Nallah. Item No. [7]Environmental Clearance for Proposed Expansion of Group Housing Colony measuring 19.744 acres at Sector-37 D, Village-Basai, Gurgaon by M/S Countrywide Promoters Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed construction of Group Housing Colony at Sector-37 D, Village-Basai, Gurgaon on a total plot area of 174215.30 sqmt (Existing 94312.37 sqmt + Expansion 79902.93 sqmt). The total built up area shall be 475575.118 sqmt (Existing 212693.78 sqm. + Expansion 262881.338 sqmt). The Group Housing complex shall have 33 no of Towers and 02 EWS Towers. The Group Housing project shall have 2276 no of Dwelling Units (Existing 248 + Expansion 1228)

10 and 412 no of EWS DU’s (Existing 185 + Expansion 227), Primary School, Nursery School, Creche, Dispensary, Religious Building, Post office etc. The maximum height of the building shall be 75 meters. The total water requirement shall be 2347 KLD. The total fresh water requirement will be 1423 KLD (Existing 550 KLD + Expansion 873 KLD). The waste water generation shall be 1749 KLD, which shall be treated in the STP 2100 KLD capacity. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent. The recommendation of SEAC was examined on the basis of prevalent procedure as prescribed in the MoEF GoI amended notification dated 22-08-2013.Detailed discussions were held regarding water requirement, quality of water, green belt development plan, existence of revenue rasta, HT line, Ambient Air Quality, NOC of Deputy Commissioner, regarding non applicability Aravalli notification, helipad facility etc. It was noticed that the values of parameter PM10 is exceeding the prescribed limits. The representative of the project proponent was asked to revise the water calculation for EWS @ 5 persons instead of @ 2persons. The representative of the project proponent was directed to adopt water sprinkling system to suppress the dust generation. The representative of the project proponent was submitted the NOC of Deputy Commissioner, Gurgaon regarding non applicability of Aravalli notification. It was noticed that the killa no. 228 mentioned in the NOC certificate issued by Deputy Commissioner, Gurgaon, do not conform to that of killa no. indicated in the licence. The representative of the project proponent clarified that the application for obtaining NOC from Deputy Commissioner, Gurgaon, was submitted on the basis of khsra no. given in LOI i.e. killa no. 228. He further clarified that the area of killa no 228 (5.75 Acres) indicated in the NOC is the same as indicated in against the killa no. 228/1, 228/2, 228/3 and 228/4. The representative of the project proponent also submitted an undertaking in this regard. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The project proponent shall ensure that no construction activity is undertaken either on surface or below or above surface of revenue rasta passing through the project area. [2] The project proponent shall indicate the width and length of revenue rasta passing through the project area on sign board and shall display the same at both the ends of revenue rasta stretch, for awareness of public. Sign board shall also display the message that this is public rasta/road and any citizen can use it. There shall not be any gate with or without guards on revenue rasta.

[3] The project proponent shall develop complete civic infrastructure of the Group Housing colony including internal roads, green belt development, sewerage line, Rain Water recharge arrangements, Storm water drainage system, Solid waste management site and provision for treatment of bio-degradable waste, STP, water supply line, dual plumbing line, electric supply lines etc. and shall offer possession of the units/flats thereafter. [4] The solid waste generated should be properly collected and segregated as per the requirement of the MSW Rules, 2000 and as amended from time to time. The bio- degradable waste should be treated by appropriate technology at the site ear-marked within the project area and dry/inert solid waste should be disposed off to the approved sites for land filling after recovering recyclable material. [5] STP outlet after stabilization and stack emission shall be monitored monthly. Other environmental parameters and green belt shall be monitored on quarterly basis. After every 3 (three) months, the project proponent shall conduct environmental audit and shall take corrective measure, if required, without delay. [6] The project proponent shall provide one refuse area till 24 meter, one till 39 meter and one after every 15 meter as per National Building Code. [7] The project proponent shall provide fire control room and fire officer for building above 30 meter as per National Building Code. [8] The project proponent shall obtain permission of Mines and Geology Department for excavation of soil before the start of construction. [9] Water supply shall be metered among different users of utilities. [10] The project proponent shall seek fresh Environmental clearance if at any stage there is change in the planning of the proposed project. [11] The project proponent shall ensure the compliance of Forest Department, Haryana Notification no. S.O.121/PA2/1900/S.4/97 dated 28.11.1997. [12] The project proponent shall provide water sprinkling system in the project area to suppress the dust in addition to the already suggested mitigation measures in the Air Environment Chapter of EMP. [13] The project proponent shall seek specific prior approval from concerned local Authority/HUDA regarding provision of storm drainage and sewerage system including their integration with external services of HUDA/ Local authorities beside other required services before taking up any construction activity. [14] The site for solid waste management plant be earmarked on the layout plan and the detailed project for setting up the solid waste management plant shall be submitted to the Authority within one month. [15] The project proponent shall provide helipad facility as required under NBC norms and shall seek permission of helipad from AAI accordingly.

[16] Besides the developer/applicant, the responsibility to ensure the compliance of Environmental Safeguards/conditions imposed in the Environmental Clearance letter shall also lie on the licencee/licencees in whose name/names the licence/CLU has been granted by the Town & Country Planning Department, Haryana. [17] The project proponent shall not raise any construction activity in the ROW reserved/acquired for High Tension Wire passing through the project area and shall maintain horizontal and vertical ROW as required under Indian Electricity Rules, 1956/DHBVN latest instructions.

The SEAC referred this case to the SEIAA with the recommendation for initiating further legal action. The SEAC has considered the project proposal in its 82nd meeting held on 27-05-2013 and noticed that the project proponent has started construction of the Institutional project building without obtaining prior Environmental Clearance which amounts to violation of EIA Notification dated 14-09-2006. The project proponent on 12- 09-2013 also submitted a copy of resolution passed by Administrative head, Registrar on 08-05-2013 ensuring that violation of provisions of the Environment (Protection) Act, 1986 will not be repeated in future. The Resolution also resolved that University admits its error of Judgment for carrying out construction without obtaining prior Environmental Clearance. The recommendation of SEAC in this case was examined in the light of MoEF, GoI OM no. J-11013/41/2006-IA.II (1) dated 12-12-2012. After detailed deliberations it was decided that:- [1] The Principal Secretary Environment may be requested to initiate credible action on the violation by invoking powers under Section 19 of the Environment (Protection)Act,1986, for taking necessary legal action under Section 15 of the Act for the period for which the violation has taken place, against the M/S Chaudhary Devi Lal University, Barnala Road, Sirsa – 125055 (Haryana) for commencing construction Institutional project “Chaudhary Devi Lal University campus” at Sirsa, Haryana without obtaining prior Environmental Clearance under EIA notification 14-09-2006. The Project Proponent has proposed construction of Residential Group Housing Colony located at Village-Daulatabad, Sector-103, Distt. Grugaon. The recommendation of SEAC was considered in the today’s meeting in the presence of representative of the project proponent. Detailed discussions were held regarding existence of HT line, solid waste management plan, Ambient Air Quality, NOC from Deputy Commissioner, Gurgaon regarding non-applicability of Aravalli notification, water supply assurance during operation phase, permission for discharge of excess of treated water in the public sewer etc. The representative of the project proponent was advised to revise the layout plan by replacing water body proposed under HT line with the green belt. The representative of the project proponent was also advised to submit NOC of Deputy Commissioner, Gurgaon regarding non applicability of Aravalli notification, assurance of HUDA for supply of water and disposal of excess of treated waste water in the public sewer. The representative of the project proponent was asked to revise the water calculation for EWS @ 5 persons instead of @ 2persons as well as revise the water calculation @ 135 lpcd instead of @ 111 lpcd. The representative of the project proponent assured to submit revised water calculation and water balance diagram. It was noticed that the values of parameter of PM10 is exceeding the prescribed limits. The representative of the project proponent was advised to adopt water sprinkling system in order to suppress the dust generation. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed construction of Residential Plotted Colony, located at Sector-11 & 14, Village- Sohna & Raipur, District- Gurgaon,

Haryana on a plot area of 436450 sqmt (107.85 Acres). The total built up area shall be 296146.18 sqmt. The plotted colony shall have 750 Residential plots, Commercial plots, Nursery School and Primary School. The total water requirement shall be 1548 KLD. The fresh water requirement shall be 781 KLD. The waste water generation shall be 959 KLD, which will be treated in the STP of 1500 KLD capacity. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent. The recommendation of SEAC was examined on the basis of prevalent procedure as prescribed in the MoEF GoI amended notification dated 22-08-2013. Detailed discussions were held regarding water requirement, quality of water, green belt development plan, existence of revenue rasta, Ambient Air Quality, NOC of Deputy Commissioner, regarding non applicability Aravalli notification, helipad facility etc. It was noticed that the values of parameter PM10 is exceeding the prescribed limits. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed construction of Group Housing Project at Village-Budha Khera, Sector-32, Karnal Haryana. The recommendation of SEAC was considered in the today’s meeting in the presence of representative of the project proponent. Detailed discussions were held regarding existence of revenue rasta, solid waste management plan, Ambient Air Quality, NOC from DFO Forest Department regarding non-involvement of Forest land, water supply assurance during operation phase, permission for discharge of excess of treated

16 water in the public sewer etc. The representative of the project proponent submitted the assurance of HUDA for water supply, NOC from Forest Department but failed to submit permission of competent Authority for laying of utility services under revenue rasta. The representative of the project proponent assured to submit the permission to use revenue rasta within 2 days but the same has not been received till finalization of the proceedings. The representative of the project proponent also submitted revised water calculation @ 135 lpcd and revised water balance diagram as was directed by the Authority. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit permission of competent Authority for laying of utility services under revenue rasta. [2] The project proponent shall submit an affidavit from consultant that no adverse judgment against his registration with NABET has been passed by any court subsequently. Item No. [12]Environmental Clearance for the Residential Group Housing Colony Located at Sector 112-113, Bajghera Road, Distt. Gurgaon.(category 8(b) project) by M/s Lemon Tree Land & Developers Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed construction of Residential Group Housing Colony Located at Sector 112-113, Bajghera Road, Distt. Gurgaon on a plot area of 85161.03 sqmt comprising of plot no.I and plot no.II The total built up area shall be 206029.404 sqmt. The Group Housing project shall have 14 Towers (665 General DU’s+117 EWS+67 service personnel), Community building, EWS, Nursery School, Shopping Complex etc. The maximum height of the building shall be 82.17 meters. The total water requirement shall be 598 KLD. The fresh water requirement shall be 302 KLD. The waste water generation shall be 370 KLD, which will be treated in the 2 STPs of 440 & 340 KLD capacities. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent. [19] The project proponent shall obtain NOC from HUDA as well as Irrigation Department before the start of construction, regarding possible adverse effect of project proposal on the said Najafgarh Jheel. Item No. [13]Environmental Clearance for “Expansion of Industrial Building Project” at plot no 7, Sec-8, Phase-III, Growth Centre, Bawal, Distt. Gurgaon by M/s EEL Pvt. Ltd. The SEAC referred this case to the SEIAA with the recommendation for according Environmental Clearance by imposing stipulations stated therein. The SEAC has considered the project proposal in its 83rd meeting held on 07-06-2013 and noticed that the building plan was approved by HSIIDC on 07-09-2011 for 67355 sqmt of built up area. The project proponent has constructed 16219 sqmt after obtaining consent to establish from Pollution Control Board. The recommendation of SEAC and the details of the project were considered in the today’s meeting in the presence of representative of the project proponent. The

19 representative of the project proponent informed that they got the building plan approval for 67355 sqmt built up area and restricted the construction of the Factory building up to 16219 sqmt and obtained occupation certificate from HSIIDC and now they intend to expand the Industrial building as per the approved drawing. The Authority clarified that the building plan was approved for built up area of 67355 sqmt thus the Environmental Clearance under EIA Notification 14-09-2006 was to be obtained before the start of construction. The representative of the project proponent admitted that they were not aware of the applicability of EIA Notification 14-09-2006 and started construction of the “Industrial Building Project” building. The Authority inform the representative of project proponent that the starting of construction without obtaining prior Environmental Clearance has amounts to violation of EIA Notification dated 14-09-2006. The project proponent also submitted a copy of resolution admitting that they inadvertently started the construction of Industrial building without knowing the applicability of EIA Notification and also ensured that the violation of provisions of the Environment (Protection) Act, 1986 shall not be repeated in future. This case was examined in the light of MoEF, GoI OM no. J-11013/41/2006-IA.II (1) dated 12-12-2012. Gurgaon without obtaining prior Environmental Clearance under EIA notification 14-09-2006. The Principal Secretary Environment may also be requested to provide the evidence of credible action taken against the project proponent. Item No. [14]Environmental Clearance for expansion of Factory Building at plot No. 1, Sector-14, Phase-II, Growth Centre, Bawal by M/S Polylace India Pvt. Ltd. The SEAC referred this case to the SEIAA with the recommendation for according Environmental Clearance by imposing stipulations stated therein. The SEAC has considered the project proposal in its 83rd meeting held on 06-06-2013 and noticed that the project proponent has already constructed 18955.83 sqmt of Industrial building on the plot allotted by HSIIDC the total plot area is 22.8 Acres (92335.335 sqmt). The total built up area after expansion of the Industrial building shall be 41095.75 sqmt (Existing 18955.83 sqmt + Expansion 22139.92 sqmt). The recommendation of the SEAC and project details was taken up for consideration in the today’s meeting in the presence of representative of the project

20 proponent. The representative of the project proponent placed the copies of Allotment letter, zoning plan, building plans. The examination of records submitted by the project proponent revealed that the project proponent has completed the construction of Industrial building as per approve plan for 41095.75 sqmt. Thus it was apparent that the project proponent has violated the provisions of Environment (Protection) Act, 1986 by commencing construction of Industrial building without getting the prior Environmental Clearance. This case was examined in the light of MoEF, GoI OM no. J-11013/41/2006-IA.II (1) dated 12-12-2012. After detailed deliberations it was decided that:- [1] The Principal Secretary Environment may be requested to initiate credible action on the violation by invoking powers under Section 19 of the Environment (Protection)Act,1986, for taking necessary legal action under Section 15 of the Act for the period for which the violation has taken place, against the M/s Polylace India Pvt. Ltd. A-107, Wazirpur Industrial area, Delhi for commencing construction of expansion of Factory Building at plot No. 1, Sector-14, Phase-II, Growth Centre, Bawal without obtaining prior Environmental Clearance under EIA notification 14-09-2006. The Principal Secretary Environment may also be requested to provide the evidence of credible action taken against the project proponent. [2] The matter relating to violation shall be put up by the project proponent to the board of Directors for consideration of its environmental related policy/plan of action as also a written commitment in the form of a formal resolution to be submitted to SEIAA Haryana to ensure that violations will not be repeated within a period of 60 days from the date of issuance of this letter failing which it will be presumed that the project proponent is no longer interested in pursuing the project further and the project file will be closed. [3] To delist the case. Item No. [15]Environmental Clearance for the development of “Group Housing Project” located at plot No. GH-02, Sector-41, in the revenue state of Village Sarai Khawaja, District Faridabad, Haryana by M/s Rise Projects Pvt. Ltd. (Formally M/s B2C Buildwell Pvt. Ltd.) The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed construction of Group Housing Project at plot No.GH-02, Sector-41, Faridabad in the revenue state of Village Sarai Khawaja, District Faridabad, Haryana. The recommendation of SEAC was considered in the today’s meeting in the presence of representative of the project proponent. Detailed discussions were held regarding solid waste management plan, existence of nallah, provision for services across the nallah, Ambient Air Quality, NOC from DFO regarding non-involvement of Forest land, water supply assurance during operation phase, permission for discharge of excess

21 of treated water in the public sewer etc. The representative of the project proponent submitted assurance of Municipal Corporation for supply of water and also submitted revised water calculation @ 135 lpcd (EWS @ 5 persons) instead of @ 111 lpcd and revised water balance diagram as was directed by the Authority. The representative of the project proponent also submitted layout plan earmarking site for solid waste management plant. It was noticed that the values of parameter PM10 is exceeding the prescribed limits. The representative of the project proponent was directed to adopt water sprinkling system to suppress the dust generation. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit NOC from the Forest Department regarding non-involvement of Forest land. Item No. [16]Environmental Clearance for “Group Housing Project – Expansion under Cluase 7 (ii) of EIA Notification (SO 1533), Dated 14.09.2006 located at Sector 66, Village- Maidabas, Gurgaon, Haryana by M/s SU Estates Pvt. Ltd. The Authority was informed that project proponent vide letter no. SU Estate/EC/1531 dated 24-09-2013 has requested to postpone the appraisal of their project in the next meeting of SEIAA (59th meeting) as they are unable to attend the 58th meeting due to unavoidable reasons. The request of the project proponent was acceded to by the Authority and it was decided to take up this case in the 59th meeting of SEIAA. Item No. [17]Environmental Clearance for Proposed Expansion of the Institutional Project “Deenbandhu Chottu Ram University of Science & Technology” located at Murthal (Sonepat) Haryana. .(category 8(b) project) by M/S International Foundation for Research & Education.

The SEAC referred this case to the SEIAA with the recommendation for according Environmental Clearance by imposing stipulations stated therein and initiating further legal action. The SEAC has considered the project proposal in its 72nd meeting held on 27-12-2012 and 84th meeting held on 17-06-2013 and noticed that the project proponent has started construction of the “Expansion of Deenbandhu Chottu Ram University of Science & Technology” building without obtaining prior Environmental Clearance which amounts to violation of EIA Notification dated 14-09-2006. The project proponent on 11- 10-2012 also submitted a copy of resolution ensuring that the violation of provisions of the Environment (Protection) Act, 1986 shall not be repeated in future. The Registrar of the University also admitted the mistake for commencing construction without obtaining prior Environmental Clearance. The recommendation of SEAC in this case was examined in the light of MoEF, GoI OM no. J-11013/41/2006-IA.II (1) dated 12-12-2012. After detailed deliberations it was decided that:-

[1] The Principal Secretary Environment may be requested to initiate credible action on the violation by invoking powers under Section 19 of the Environment (Protection)Act,1986, for taking necessary legal action under Section 15 of the Act for the period for which the violation has taken place, against the M/S International Foundation for Research & Education, Regd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed construction of “Hotel Noor Mahal” (Hotel, Restaurant and Banquet Hall) at village Phusgarh, Karnal District Karnal, Haryana. The recommendation of SEAC was considered in the today’s meeting in the presence of representative of the project proponent. It was noticed that the project proponent has proposed Expansion of Hotel, Restaurant and Banquet hall “Noor Mahal”. It was noticed that the project proponent in the submission has indicated the completion of Health Club having built up area 1521.55 sqmt for which CLU was granted on 10-02-2009, completion of Recreational park having built up area 231.253 sqmt for which CLU was granted on 10-02-2009 and now the project proponent intents to expand the Existing Hotel, Restaurant and Banquet hall building having Existing build up area 19537.296 sqmt (including basement) and after Expansion the built up area would be 24671.106 sqmt. It was noticed that the project proponent has not given proper details of the Existing built up area and propose built up area under Expansion. It was also noticed that the CLU granted for Hotel, Restaurant and Banquet hall “Noor Mahal” was granted on 24-01-2007 and validity of CLU was up to 23-01-2009. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit revised Form-I giving proper details of Existing built up area and proposed built up area under Expansion for Hotel, Restaurant and Banquet hall only.

[2] The project proponent shall submit copy of validated CLU.

[3] The project proponent shall give assurance of water supply from HUDA.

[4] The project proponent shall submit NOC from DFO regarding non-involvement of Forest land.

Item No. [19] Extension of validity of Environmental Clearance letter issued for proposed commercial complex at Sector-62, Gurgaon, Haryana by M/s Pioneer Urban Land & Infrastructure Ltd. The Authority was informed that the SEAC has forwarded the case for taking further appropriate action for granting Extension of validity of Environmental Clearance letter issued for proposed commercial complex at Sector-62, Gurgaon, Haryana by M/s Pioneer Urban Land & Infrastructure Ltd. It was noticed that the SEAC has not appraised the Form-I, Form-IA and conceptual submitted by the project proponent in the light of latest instructions, guidelines issued by MOEF, GOI for appraisal of construction projects. It was also found that the SEAC has not given clear cut recommendation in this case. After detailed deliberations it was decided to refer back this case to SEAC with the advice to study the old Environment Clearance record and appraise the project proposal in the light of latest instructions, guidelines issued by MOEF, GOI and send its recommendation on merit with in stipulated period. Item No. [20]Environmental Clearance for proposed construction of commercial colony at village Miadawas, Sec-65, Gurgaon Haryana by M/s Marconi Infratech Pvt. Ltd.

The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed construction of commercial colony at village Miadawas, Sec-65, Gurgaon Haryana. The recommendation of SEAC was considered in the today’s meeting in the presence of representative of the project proponent. The representative of the project proponen was asked to submit memorandum of article of association and resolution of the board for authorization. Detailed discussions were held regarding solid waste management plan, Ambient Air Quality, NOC from Deputy Commissioner, Gurgaon regarding non-applicability of Aravalli notification, water supply assurance during operation phase, permission for discharge of excess of treated water in the public sewer

etc. It was noticed that the values of parameter PM10 is exceeding the prescribed limits. The representative of the project proponent was directed to adopt water sprinkling system to suppress the dust generation. The representative of the project proponent failed to submit assurance for water supply from HUDA however he informed the Authority that they have already deposited EDC/IDC charges which Town and Country Planning Department for ensuring the supply of water. The Authority asked the representative of the project proponent to submit copy of receipt in the SEIAA. It was found that the

24 project proponent has proposed basement of 4800 sqmt which was found exceeding zoned area. The representative of the project proponent informed the Authority that the HUDA allows using area under the road for parking and traffic movement. The Authority also directed the representative of project proponent to revise the layout plan by replacing the proposed water body with green area. The representative of the project proponent was asked to submit the revised basement plan and restrict the basement area of the proposed project within zoned area and also submit permission of HUDA for allowing underpass below the internal roads of the sector for connection of different blocks of the project proponent for parking and vehicle movement. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit revised plan earmarking site for green belt in place of proposed water body and shall justify the requirements. [2] The project proponent shall submit revised basement plan restricting the basement area of the proposed project within zoned area. The project proponent shall plan third level basement if required parking could not be achieved by making necessary changes. [3] The project proponent shall submit permission of HUDA for allowing underpass below the internal roads of the sector for connection of different blocks of the project proponent for parking and vehicle movement. [4] The project proponent shall submit revised plan earmarking site for solid waste management. [5] The project proponent shall submit receipt of EDC/IDC paid or assurance for water supply/sewerage and storm drainage. [6] The project proponent shall submit an undertaking with the declaration that they will provide helipad and also multi stage pumping. [7] The project proponent shall submit plan approved by DGTP. [8] The representative of the project proponent was asked to submit memorandum of article of association and resolution of the board for authorization. [9] The project proponent shall correct water supply requirement for domestic and flushing within the total supply. Subsequent changes shall be made accordingly. [10] The project proponent shall submit NOC from DC Gurgaon regarding non- applicability of Aravalli Notification. [11] The project proponent shall submit NOC from DFO regarding non- involvement of Forest land.

The recommendation of SEAC to accord Environmental Clearance was lastly considered in the 57th meeting of SEIAA held on 24-09-2013 wherein it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations. [1] The project proponent shall submit assurance of competent Authority for use of revenue rasta or shall submit revised layout plan showing that revenue rasta is not intercepted. [2] The project proponent shall submit an undertaking with the declaration that they will seek permission of HUDA for disposal of excess of treated waste water into main sewer of HUDA. In the meeting today the representative of the project proponent submitted the desired information as indicated above. It was found that the project proponent in no way encroaching the revenue rasta as per plan submitted before the Authority. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The project proponent shall ensure that no construction activity is undertaken either on surface or below or above surface of revenue rasta passing through the project area. [2] The project proponent shall indicate the width and length of revenue rasta passing through the project area on sign board and shall display the same at both the ends of revenue rasta stretch, for awareness of public. Sign board shall also display the message that this is public rasta/road and any citizen can use it. There shall not be any gate with or without guards on revenue rasta. [3] The project proponent shall develop complete civic infrastructure of the Group Housing colony including internal roads, green belt development, sewerage line, Rain Water recharge arrangements, Storm water drainage system, Solid waste management site and provision for treatment of bio-degradable waste, STP, water supply line, dual plumbing line, electric supply lines etc. and shall offer possession of the units/flats thereafter. [4] The solid waste generated should be properly collected and segregated as per the requirement of the MSW Rules, 2000 and as amended from time to time. The bio- degradable waste should be treated by appropriate technology at the site ear-marked

[13] The project proponent shall seek specific prior approval from concerned local Authority/HUDA regarding provision of storm drainage and sewerage system including their integration with external services of HUDA/ Local authorities beside other required services before taking up any construction activity. [14] The site for solid waste management plant be earmarked on the layout plan and the detailed project for setting up the solid waste management plant shall be submitted to the Authority within one month. [15] Besides the developer/applicant, the responsibility to ensure the compliance of Environmental Safeguards/ conditions imposed in the Environmental Clearance letter shall also lie on the licensee/licensees in whose name/names the license/CLU has been granted by the Town & Country Planning Department, Haryana. Item No. [22]Environmental Clearance for proposed Institutional Project “BML Munjal University” at Village: Sidhrawali, Tehsil: Manesar, District Gurgaon, Haryana by M/s BML Educorp Services. This case was lastly considered in the 57th meeting of SEIAA held on 24-09-2013 wherein the representative of the project proponent submitted a letter dated 20-09-2013 issued by Hydrologist, Ground Water Cell Gurgaon issuing NOC for abstraction of 85 Lt/minute of ground water by the project proponent for drinking and domestic purpose.

The Authority was of the view that the Deputy Commissioner, Gurgaon is competent Authority to grant permission for abstraction of ground water for drinking and domestic purpose therefore the NOC issued by Hydrologist; Ground Water Cell Gurgaon is not acceptable. The representative of the project proponent was directed to submit NOC from Deputy Commissioner, Gurgaon regarding abstraction of ground water from the existing bore wells for drinking and domestic purposes. Accordingly the case was deferred with the decision that the project proponent should submit NOC issued by Deputy Commissioner, Gurgaon for withdrawal of ground water drinking and domestic purposes. In the today’s meeting the representative of the project proponent submitted the NOC issued by DC Gurgaon. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The solid waste generated should be properly collected and segregated as per the requirement of the MSW Rules, 2000 and as amended from time to time. The bio- degradable waste should be treated by appropriate technology at the site ear-marked within the project area and dry/inert solid waste should be disposed off to the approved sites for land filling after recovering recyclable material. [19] The project proponent shall not raise any construction activity in the ROW reserved/acquired for High Tension Wire passing through the project area and shall maintain horizontal and vertical ROW as required under Indian Electricity Rules, 1956/DHBVN latest instructions. Item No. [25]Environmental Clearance for W.R.T Group Housing Colony at Vill Fazilpur, , Sec-70, Gurgaon by M/s Capital Builders. This case was lastly considered in the 57th meeting of SEIAA held on 24-09-2013 wherein it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations: [1] The project proponent shall submit revised layout plan showing location of Nursery School in the main group housing complex as per assurance given in the meeting. [2] The project proponent shall submit assurance of water supply from HUDA. [3] The project proponent shall submit and undertaking with the declaration that:

(i) They will not raise any construction activity in the ROW of HT line passing through the project area. (ii) They will provide helipad facility as per NBC norms. (iii) They will seek permission of HUDA for disposal of excess of treated waste water and storm water. (iv) They have not raised any construction at the site till date. In the today’s meeting the representative of the project proponent submitted the desired document/information. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [16] Besides the developer/applicant, the responsibility to ensure the compliance of Environmental Safeguards/conditions imposed in the Environmental Clearance letter shall also lie on the licencee/licencees in whose name/names the licence/CLU has been granted by the Town & Country Planning Department, Haryana. [17] The project proponent shall not raise any construction activity in the ROW reserved/acquired for High Tension Wire passing through the project area and shall maintain horizontal and vertical ROW as required under Indian Electricity Rules, 1956/DHBVN latest instructions. Item No. [26]Environmental Clearance for revision and Expansion of Proposed Residential Group Housing Complex (Pear) at Sector-87, Faridabad, Haryana by Ms. SRS Real Estate Ltd. This case was lastly considered in the 57th meeting of SEIAA held on 24-09-2013 wherein it was decided to defer this case with the decision that the project proponent may be asked to submit copy of validated licenses and also submit signed application In the today’s meeting the representative of the project proponent submitted the signed application and clarified that the licence for additional area for which Environmental Clearance under expansion has been sought is valid and for the existing project they have submitted application for revalidation of licence and submitted proof of the same. Detailed discussions were held regarding existence of HT line, water

34 requirement, quality of water, green belt development plan, Ambient Air Quality, NOC from Forest Department regarding non-involvement of Forest land, recycle and reuse of water etc. It was noticed that the project proponent has made changes in the existing planning for EWS quarters etc. The representative of the project proponent was directed to revise the water requirement and water balance diagram @ 135 lpcd instead of proposed @86 lpcd. It was also found that the parking plan is not sufficient to cater the need of residents. The representative of the project proponent was advised to provide Multi Level Car Parking in the project area. The representative of the project proponent was also advised to submit NOC from Forest Department regarding non-involvement Forest land. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit NOC from Forest Department regarding non- involvement Forest land. [2] The project proponent shall submit revised water requirement @135 lpcd and revised water balance diagram. [3] The project proponent shall submit NDC in respect of IDC/EDC or assurance of HUDA for supply of water. [4] The project proponent shall submit revalidation of the existing license. Item No. [27]Environmental Clearance for construction of of Group Housing Project “EUROPA” at Sector-62, Distt. Sonipat by M/S Ansal Properties & Infrastructure Ltd.

This case was lastly considered in the 57th meeting of SEIAA held on 24- 09-2013 wherein it was decided to defer this case with the decision that the project proponent may be asked to submit reply/information to the below mentioned observations within a week or before the next meeting. [1] The project proponent shall submit self contained note on the total no. of licenses granted for the plotted development colony/township, total area for which environmental clearance has already been obtained. The project proponent shall also submit details of previous environment clearance with respect to infrastructural facilities such as water supply, sewerage, storm water drainage STP, and Power etc. The project proponent shall submit a plan showing area of each license with different colours. [2] The project proponent shall submit a plan showing already environmental cleared area and proposed group housing project area in different colours along with detail of changes made in the planning. [3] The project proponent shall submit approved layout plan of the entire plotted colony and all the necessary approvals obtained.

[4] The project proponent shall submit details regarding integration of services of water supply, sewerage and storm drainage with HUDA/ relevant authority. In the today’s meeting the representative of the project proponent appeared the Authority and submitted details of previous Environmental Clearance letter. The representative of the project proponent submitted copy of the layout plan submitted for seeking Environmental Clearance from MOEF, GOI by the project proponent for an area of 250 acres. It was also noticed that at the time of the grant of Environmental Clearance by the MOEF, GOI the 250 acres of land was in the possession of project proponent but licence was not granted by Town and Country Planning Department at that time. More over the layout plan for 250 acres was also not approved by the Town and Country Planning Department. It was noticed that the present proposal of Group Housing over and area 5 Acres (part of 27 Acres licence) is part of 250 acres plotted development Colony to which Environmental Clearance was granted by MOEF, GOI. The details regarding no. of plots as on today and built up area for which Environmental Clearance was granted by MOEF, GOI was not clear as the same is required to consider the present project proposal of Group Housing which is also part of environmentally cleared area. Accordingly the case was deferred with the advice to project proponent to give the details of no. of plots its status, already built up area of 250 acres of land for which environmental clearance was granted by MoEF, GoI.

It was noticed that the TOR were approved by SEAC on 12.10.2012 and the project proponent conducted the study for preparation of EIA/EMP on the basis of TOR during November 2012 to January 2013.Detailed 2 discussions were held regarding existence of revenue rasta, water requirement, quality of water, green belt development plan, Ambient Air Quality, NOC regarding non- involvement of Aravalli Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic circulation plan, status of construction of existing project. The representative of the project proponent submitted the assurance of HUDA for supply of water along with proof of EDC/IDC paid to HUDA for the services for supply of water, sewerage connection and drainage system, NOC of airport Authority regarding height clearance and NOC from DC Gurgaon regarding non applicability of a Aravalli Notification. It was noticed that the project proponent has submitted NOC from AAI for the height of 63.60 meters where as the maximum height of the proposed Tower after revision shall be 71.890 meter.Accordingly the representative of the project proponentwas asked to submit the revised NOC of AAI. It was observed that the Environmental Clearance to the existing project for an area of 41.755 Acres was granted to the project proponent for construction of group housing colony having built up area 190521.025 sqmt and by addition of 7.063 acre of land the project proponent has now submitted application for expansion of project for total built up area of 488981.914 sqmt. The representative of the project proponent informed the Authority that the FAR of the existing project has not been achieved as well as due to increase in the FAR the built up area has increased. The Authority was of the unanimous view that this case is of revision of already granted environment clearance and expansion of group housing project therefore the project proponent should submit composite plan of revision of existing project and its expansion and also submit revised concept plan giving details of revised water requirements, waste water generation, STP capacity, solid waste generation, power requirement, parking requirement and green belt development plan.It was also noticed that village Wazirpur falls in the list of villages declared as Eco-Sensitive Zone around and notified by MoEF, GoI on 27.01.2010. The representative of the project proponent informed that their project is located at a distance of 4.5 Km from the boundary of the Sultanpur National Park and submitted copy of application submitted to District Wildlife Warden.The representative of the project proponent was also directed to revise the calculation of water requirement for EWS @ 5 persons instead of @ 2 persons and 3 also seek the permission of competent Authority for laying of services lines for proposed dispensary under the revenue rasta or revise the plan ensuring that the revenue rasta is not intercepted. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days or before next meeting. [1] The project proponent shallsubmit revised NOC of AAI regarding height clearance. [2] The project proponent shallsubmit composite plan along with concept plan for revision of existing project and its expansion giving details of revised water requirements, waste water generation, STP capacity, solid waste generation, power requirement, parking requirement and green belt development plan. [3] The project proponent shall submit NOC from District Wild Life Warden Gurgaon. [4] The project proponent shall submit the revised calculation of water requirement for EWS @ 5persons instead of @ 2 persons. [5] The project proponent shall seek the permission of competent Authority for laying of services lines for proposed dispensary under therevenue rasta or revise the plan ensuring that the revenue rasta is not intercepted. Item No. [2] Environment Clearance for Construction of Commercial Colony at Village Badha, Sector-85-86, Gurgaon Manesar Urban Complex, Gurgaon, Haryana by M/s TS Realtech Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed the Construction of Commercial Colony at Village Badha, Sector-85-86, Gurgaon Manesar Urban Complex, Gurgaon, Haryanaon a plot area of 11331.244 sqmt (2.85 acres). The total built up area shall be 38274.52 sqmt. The project shall comprise of 04 Plots (A to D); Plot A (3 basements + GF + 7 Floors), Plot B (2 basements + GF + 7 Floors), Plot C (1 basement + GF + 2 Floors) and Plot D (1 basement + GF + 1 Floor). The height of the building shall be 40 meters. The total water requirement shall be 256.27 KLD. The fresh water requirement shall be 146.4 KLD. The waste water generation shall be 115.87 KLD, which will be treated in the STP of 140 KLD capacity. The total power 4 requirement shall be 3642.3 KW which will be supplied by DHBVN. The Project Proponent has proposed to develop green belt on 19.26% of project area (15% tree plantation + 4.26% landscaping). The Project Proponent proposed to construct 04 rain water harvesting pits. The solid waste generation will be 1177 kg/day.The bio- degradable waste will be treated in the project area by adopting appropriate technology. The total parking spaces proposed are 478 ECS. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent and consultant. Detailed discussions were held regarding water requirement, quality of water, green belt development plan, Ambient Air Quality, NOC regarding non-involvement of Aravalli Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic circulation etc. The representative of the project proponent submitted the assurance of HUDA for supply of water along with proof of EDC/IDC paid to HUDA for the services for supply of water, sewerage connection and drainage system, NOC of airport Authority regarding height clearance and NOC from DC Gurgaon regarding non applicability of a Aravalli Notification. It was noticed that the service layout plan submitted by the project proponent does not intercept the revenue rasta.The parking plan and traffic circulation plan for pocket B was not found satisfactory and the representative of the project proponent was directed to provide 3rd basement to accommodate vehicles or redesign the ramp for exit and entry for smooth movement of vehicles. The representative of the project proponent submitted the revised traffic circulation plan. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] Vertical fenestration shall not exceed 40% of total wall area. [2] The project proponent shall not use fresh water for HVAC and DG cooling. Air based HVAC system should be adopted and only treated water shall be used by project proponent for cooling, if it is at all needed. 5

[3] The project proponent shall ensure that no construction activity is undertaken either on surface or below or above surface of revenue rasta passing through the project area. [4] The project proponent shall indicatethe width and length of revenue rasta passing through the project area on sign board and shall display the same at boththe ends of revenue rasta stretch, for awareness of public. Sign board shall also display the message that this is public rasta/road and any citizen can use it.There shall not be any gate with or without guards on revenue rasta further project proponent shall not encroach revenue rasta and shall not cross internal roads over revenue rasta. [5] The project proponent shall install solar panel for energy conservation. [6] The project proponent shall provide green area on terrace and roof top. Item No. [3] Environment Clearance for development of the Group Housing Colony located at Village , Sector-70, Tehsil & Dist. Gurgaon, Haryana by Santur Infrastructure Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed the Construction ofGroup Housing Colony located at Village Badshahpur, Sector-70, Tehsil & Dist. Gurgaon on a plot area of 44388.68 sqmt (10.9687 acres). The total built up area shall be 103353.18 sqmt.The Group Housing project shall have 09 Towers having 1 basement + Stilt + maximum 18 Floors, community hall, commercial building, EWS, School etc. The height of the building is 70 meters. The total water requirement shall be 475 KLD. The fresh water requirement shall be 265 KLD. The waste water generation shall be 326 KLD, which will be treated in the STP of 500 KLD capacity. The total power requirement shall be 6070 KVA which will be supplied by DHBVN. The Project Proponent has proposed to develop green belt on 32.57% of project area (22.57% tree plantation + 10% landscaping). The Project Proponent proposed to construct 11 rain water harvesting pits. The solid waste generation will be 1749 kg/day.The bio-degradable waste will be treated in the project area by adopting appropriate technology. The total parking spaces proposed are 1107 ECS. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project 6 proponent and consultant. Detailed discussions were held regarding water requirement, quality of water, green belt development plan, Ambient Air Quality, NOC regarding non-involvement of Aravalli Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic circulation etc. The representative of the project proponent submitted the assurance of HUDA for supply of water along with proof of EDC/IDC paid to HUDA for the services for supply of water, sewerage connection and drainage system, NOC of airport Authority regarding height clearance and NOC from DC Gurgaon regarding non applicability of a Aravalli Notification. The representative of the project proponent also submitted an undertaking that they will not raise any construction in the ROW reserved for HT line. The representative of the project proponent was directed to revise the water calculation @ 135 lpcd instead of @111 lpcd and calculation of water requirement for EWS @ 5 persons instead of @ 2 persons and shall submit revised water requirement and water balance diagram accordingly.It was noticed that the RWH pit calculation was not in accordance with the prevailing norms of 1 pit/acre. The representative of the project proponent was directed to submit the revised RWH plan. It was also noticed that the surface parking proposed by the project proponent is not satisfactory as the proposed parking shall result in congestion on the internal roads as the proposed internal road along the sides of surface parking has been proposed is irregular in shape having bends/curves which will obstruct the smooth movement of vehicles. The representative of the project proponent was directed to provide one more basement for parking or suitably revise the surface parking plan ensuring that the smooth movement of vehicle on internal roads is not obstructed. The representative of the project proponent the submitted revised parking plan, RWH plan, revised water calculation @135 lpcd, revised water balance diagram and an undertaking that no construction has been started and also submitted duly attested photographs of the site showing no construction has been started. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. 7

[1] All system of water supply, sewerage system, STP etc. shall be provided based on revised requirement of @135lpcd. [2] The project proponent shall construct 11 RWH pits. [3] The project proponent shall provide helipad facility as required under NBC norms and shall seek permission of helipad from AAI accordingly. [4] The project proponent shall not raise any construction activity in the ROW reserved/acquired for High Tension Wire passing through the project area and shall maintain horizontal and vertical ROW as required under Indian Electricity Rules, 1956/DHBVN latest instructions. [5] The project proponent shall not carry out any construction in the basement below others land as shown in the Zoning Plan. Item No. [4] Environment Clearance for the construction of University Campus project located at Mullana-Ambala, Haryana by M/s Maharishi University Trust. The SEAC referred this case to the SEIAA with the recommendation for initiating further legal action.The SEAC has considered the project proposal in its 99th meeting held on 28.01.2014 and noticed that the project proponent has started construction of the University Campus project without obtaining prior Environmental Clearance which amounts to violation of EIA Notification dated 14-09-2006. The project proponent on 18.11.2013 also submitted a copy of resolution passed by MM University Trust Mullana on 14.11.2011ensuring that violation of provisions of the Environment (Protection) Act, 1986 will not be repeated in future. The Resolution also resolved that the Trust Management admits its mistake for carrying out construction without obtaining prior Environmental Clearance. The recommendation of SEAC in this case was examined in the light of MoEF, GoI OM no. J-11013/41/2006-IA.II (1) dated 12-12-2012. After detailed deliberations it was decided that:- [1] The Principal Secretary Environment may be requested to initiate credible action on the violation by invoking powers under Section 19 of the Environment (Protection)Act,1986, for taking necessary legal action under Section 15 of the Act for the period for which the violation has taken place, against the M/s Maharishi Markandeshwar University Trust, M.M.University Sadhopur, Ambala 8

134007for commencing constructionof University Campus project located at Mullana- Ambala, Haryana without obtaining prior EnvironmentalClearance under EIA notification14-09-2006. The Principal Secretary Environment may also be requested to provide the evidence of credible action taken against the project proponent. Item No. [5] Environment Clearance for Proposed Construction of 489 Nos. Residential qtrs for NSG Camp, Manesar, Gurgaon (Haryana) by National Security Guard. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed the construction of489 Nos.Residential qutrs. for NSG Camp. Manesar, Gurgaon. The totalplot area is71750.76 sqmt. The total built up area shall be 44296.37 sqmt.The Residential project shall have 04 type qtrs. in which Stilt + maximum 11 floors. The height of the building is 42.35 meters. The total water requirement shall be 527 KLD. The fresh water requirement shall be 267 KLD. The waste water generation shall be 289 KLD, which will be treated in the STP of 400 KLD capacity. The total power requirement shall be 2000 KVA which will be supplied by DHBVN. The Project Proponent has proposed to develop green belt on 43.64% of project area (33.64% tree plantation + 10% landscaping). The Project Proponent proposed to construct 17 rain water harvesting pits. The solid waste generation will be 1275 kg/day.The bio-degradable waste will be treated in the project area by adopting appropriate technology. The total parking spaces proposed are 655 ECS. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent and consultant. Detailed discussions were held regarding water requirement, quality of water, green belt development plan, Ambient Air Quality, NOC regarding non-involvement of Aravalli Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic circulation etc. The representative of the project proponent submitted permission for withdrawal of ground water from the 2 nos. bore wells for drinking purpose and NOC from DC Gurgaon regarding non applicability of a Aravalli Notification.The representative of the project proponent submitted an undertaking that the project site is at a distance of 35 km of air strip of 9

IGI Air Port therefore NOC from AAI is not required. The representative of the project proponent submitted the analysis report of ground water samples. The representative of the project proponent was directed to provide RO system for treatment of ground water for making fit for human consumption. The representatives of the project proponent submit an undertaking that drinking water will be supplied after necessary treatment. The representative of the project proponent also submitted an undertaking stating that Executive Engineer, NSG Manaser Project Division, CPWD, NSG Camp Manaser will be the Nodal Officer for compliances of condition of environmental clearance letter. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] Executive Engineer, NSG Manaser Project Division Gurgaon nominated as Nodal Officer by NSG shall be responsible for implementation of all conditions of Environmental Clearance letter. [2] The project proponent shall install RO system for treatment of ground water for making it fit for drinking purposes/human consumption. Item No. [6] Environment Clearance for our Group Housing Project located at Village- Dhunela, Sector-33, Sohna, District-Gurgaon, Haryana by M/s International Land Developers Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed the construction ofGroup Housing Project located at Village- Dhunela, Sector-33, Sohna, District –Gurgaon, Haryana. Total plot area is46994.120 sqmt (11.6125 acres). The total built up area shall be 127720.991 sqmt.The proposed project shall have 08 Towers having 2 Basements + Stilt + Maximum 27 Floors, community building, convenient shopping, EWS housing, 2 no. nursery school, club area etc. The height of the building is 81.10 meters. The total water requirement shall be 696 KLD. The fresh water requirement shall be 436 KLD. The waste water generation shall be 521 KLD, which will be treated in the STP of 750 KLD capacity. The total power requirement shall be 6576.25 KVA which will be supplied by DHBVN. The Project Proponent has proposed to develop green belt on 30% of project area (20% tree plantation + 10% landscaping). 10

The solid waste generation will be 2271 kg/day.The bio-degradable waste will be treated in the project area by adopting appropriate technology. The total parking spaces proposed are 1331 ECS. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent and consultant. Detailed discussions were held regarding water requirement, quality of water, green belt development plan, Ambient Air Quality, NOC regarding non-involvement of Aravalli Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic circulation etc. The representative of the project proponent submitted the assurance of HUDA for supply of water along with proof of EDC/IDC paid to HUDA for the services for supply of water, sewerage connection and drainage system, NOC of airport Authority regarding height clearance and NOC from DC Gurgaon regarding non applicability of a Aravalli Notification. The representative of the project proponentalso submitted an undertaking stating that they will not raise any construction in the ROW reserved for HT line. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice.. [2] The project proponent shall provide helipad facility as required under NBC norms and shall seek permission of helipad from AAI accordingly Item No. [7] Environment Clearance for proposed Parsvnath City located at Kasba Karnal, Sector-35, Karnal, Haryana under Category 8(b) project by M/S Parsvnath Developers Ltd. rd The case was considered in the 63 meeting of SEIAA held on 23.12.2013 wherein, it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. 11

[1] The project proponent shall submit proper layout plan showing location of STP, Solid waste management site. [2] The project proponent shall submit permission of competent Authority for using revenue rasta for laying of services lines in the project area or revised service line plan showing that the revenue rasta is not intercepted. [3] The project proponent shall submit revise water supply and dual plumbing plan. [4] The project proponent shall submit an undertaking with the declaration that (i) The project will have the provision for infrastructure services (water supply, sewer, storm water lines etc) to accommodate the additional load arising from population residing in other lands falling within the project limits/vicinity. (ii) That no construction shall be raised in the ROW reserved for HT line passing through the area. In the today’s meeting the reply dated 05.03.2014 was taken up for consideration.It was informed that the project proponent vide letter dated 13.03.2014 has requested to defer this case to the next meeting as they will not be able to attend the meeting due to unavoidable reasons. The Authority accepted the request of the project proponent and agreed to defer this case to the next meeting. Item No. [8] Environment Clearance for the Expansion of “ Hotel Noor Mahal” (Hotel, Restaurant and Banquet Hall) at village Phusgarh, Karnal District Karnal, Haryana by M/s Jewel Classic Hotels Pvt. Ltd. This case was considered in the 58thmeeting of the SEIAA held on 05.10.2013 wherein, it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit revised Form-I giving proper details of Existing built up area and proposed built up area under Expansion for Hotel, Restaurant and Banquet hall only. [2] The project proponent shall submit copy of validated CLU.

[3] The project proponent shall give assurance of water supply from HUDA.

[4] The project proponent shall submit NOC from DFO regarding non- involvement of Forest land. 12

In the today’s meeting the reply dated 26.02.2014 submitted by project proponent was taken up for consideration in the presence of representative of the project proponent. It was noticed that the project proponent has submitted application for construction of Expansion of “Hotel Noor Mahal”(Hotel, Restaurant and Banquet Hall) at village Phusgarh, Karnal District Karnal, Haryana. It was noticed that the Town &Country Planning Department has approved the building plan of Hotel, Restaurant and Banquet Hall for built up area of 23007.87 sqmt and the project proponent as already constructed 17874.06 sqmt of area and has submitted application for expansion of Hotel, Restaurant and Banquet Hall having existing built up area 17874.06 sqmt and the built up area under expansion indicated as 5133.81 sqmt. It was observed that the project proponent has violated the provisions of EIA Notification, dated 14.09.2006 by commencing the construction of expansion project without obtaining prior Environmental Clearance. This case was examined in the light of MoEF, GoI OM no. J-11013/41/2006-IA.II (1) dated 12-12-2012. After detailed deliberations it was decided that:- [1] The Principal Secretary Environment may be requested to initiate credible action on the violation by invoking powers under Section 19 of the Environment (Protection) Act 1986, for taking necessary legal action under Section 15 of the Act for the period for which the violation has taken place, against the M/s Jewel Classic Hotels Pvt. Ltd. C/o Rajiv Verma Manager Techincal Hotel, Resturant & Banquet Hall “Noor Mahal” Village Phusgarh, Distt. Karnal, Haryana- 132001for commencing construction of Expansion of “Hotel Noor Mahal”(Hotel, Restaurant and Banquet Hall) at village Phusgarh, Karnal District Karnal, Haryanawithout obtaining priorEnvironmental Clearance under EIA notification 14.09.2006. The Principal Secretary Environment may also be requested to provide the evidence of credible action taken against the projectproponent. [2] The matter relating to violation shall be put up by the project proponent to the board of Directors for consideration of its environmental related policy/plan of action as also a written commitment in the form of a formal resolution to be submitted to SEIAA Haryana within a period of 60 days from the date of issuance of this letter ensuring that violations will not be repeated; failing which 13 it will be presumed that the project proponent is no longer interested in pursuing the project further and the project file will be closed. [3] To delist the case. Item No. [9] Environment Clearance for development of Commercial Complex at Sec-83, Village Sihi, District Gurgaon, Haryana by M/s S.V.Housing Pvt. Ltd. The case was considered in the 62ndmeeting of SEIAA held on 19.12.2013 wherein, it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit revised parking plan by making provision for 3rd basement or shall provide Mechanical parking only for 20% additional proposed parking. In the today’s meeting the reply dated 21.02.2014 was taken up for consideration in the presence of representative of the project proponent and consultant. It was observed that the project proponent has provided one additional basement for parking and due to addition of the 3rd basement the total built up area of the project will now be 52039.348 sqmt. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] Vertical fenestration shall not exceed 40% of total wall area. [2] The project proponent shall not use fresh water for HVAC and DG cooling. Air based HVAC system should be adopted and only treated water shall be used by project proponent for cooling, if it is at all needed. [3] The project proponent shall provide helipad facility as required under NBC norms and shall seek permission of helipad from AAI accordingly. Item No. [10] Environment Clearance for w.r.t Expansion of Ware House at Village Behrampur, Gurgaon, Haryana by M/s P.D.Enterprises. The case was considered in the 60th meeting of SEIAA held on 06.11.2013 wherein it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit certificate of DC regarding non- applicability of Aravalli Notification. 14

[2] The project proponent shall submit copy of revalidated CLU and building plan. [3] The project proponent shall clarify the details of built up area of the existing structure along with occupation certificate. [4] The project proponent shall submit assurance of HUDA/local Authority for supply of water. [5] The project proponent shall submit duly attested latest photograph of the site showing status of construction. [6] The project proponent shall submit the details of category of items to be stored in the proposed warehouse project. [7] The project proponent shall submit an undertaking that they will not store any hazardous waste or inflammable material in the warehouse. The reply dated 12.12.2013 submitted by the project proponent was taken up for consideration in the 66th meeting of SEIAA held on 05.02.2014 wherein, it was observed that the authorized person from the project proponent side failed to appear before the Authority for making presentation. However Sh. S. K. Sharma of M/s Vardan Enviro Net requested the Authority to allow him for presenting the case being authorized consultant engaged by the project proponent. It was noticed that the consultancy organization M/s Vardan Enviro Net has withdrawn the court case; thereby under present circumstances neither the consultant is accredited by QCI/NABET nor there is any stay granted to the consultant by Hon’ble Court. Accordingly the representative of the consultant was not allowed to make presentation and the case was deferred to the next meeting. In the today’s meeting the reply dated 12.12.2013 was taken up for consideration in the presence of representative of the project proponent and consultant. It was observed that the project proponent has submitted NOC from DC, Gurgaon regarding non-applicability of Aravalli Notification,NOC from HUDA for carrying out of construction at site without using ground water, undertaking that no hazardous or inflammable material will be stored in the warehouse and photographs of site showing status of construction. However the project proponent failed to submit copy of revalidated CLU, assurance of HUDA for supply of water. 15

After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days or before next meeting. [1] The project proponent shall submit revalidated CLU. [2] The project proponent shall submit assurance of HUDA for supply of water for drinking purpose. [3] The project proponent shall submit an undertaking that no construction has been raised beyond 4828 sqmt for which occupation certificated has been granted. Item No. [11] Environment Clearance for “Group Housing Colony” at Sector- 91, Village – Mewaka, Gurgaon, Haryana by M/S Jubliant Software Services Pvt. Ltd. The case was considered in the 60th meeting of SEIAA held on 07.11.2013 wherein, it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit permission of competent Authority for using revenue rasta for laying of services lines in the project area. [2] The project proponent shall submit a plan earmarking space for solid waste management. [3] The project proponent shall submit an undertaking that they have not raised any construction at the site as yet. [4] The project proponent shall submit duly signed latest photograph of the site showing status of construction if any. In the today’s meeting the reply dated 06.03.2014 was taken up for consideration in the presence of representative of the project proponent and consultant. It was noticed that the project proponent has submitted plan earmarking space for solid waste management and an undertaking stating that no construction has been raised along with duly attested photographs. The permission of DC for using revenue rasta for laying of services lines was not accepted by the Authority. The representative of the project proponent was informed that as per Principal Secretary to Govt. of Haryana Development and Panchayats Department Memo no. SBA-4- 2014/13885-13906 dated 14.03.2014 the DC is not competent to grant permission and 16 the Principal Secretary to Govt. of Haryana, Development and Panchayat Department is competent body to grant permission/approval. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days or before next meeting. [1] The project proponent shall submit permission of competent Authority for using revenue rasta for laying of services lines in the project area. Item No. [12] Environment Clearance for the Ware House Project located at village- Binola, Distt. Gurgaon, Haryana by M/S SUNSAT Real Estate Services Pvt. Ltd. The case was considered in the 62nd meeting of SEIAA held on 18.12.2013 wherein, it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit assurance of water supply from local Authority or permission of CGWA for abstraction of ground water for drinking purpose. [2] The project proponent shall submit revised traffic circulation plan by providing internal roads of sufficient width for smooth movement of trucks. [3] The project proponent shall submit revalidated/fresh permission of NHAI for access to the proposed warehouse complex. In the today’s meeting the reply dated 05.03.2014 was taken up for consideration in the presence of representative of the project proponent and consultant. It was noticed that the project proponent has already applied for revalidation of permission of NHAI for access to the proposed warehouse complex. It was also noticed that the project proponent has submitted revised traffic circulation plan by providing internal roads of 11 and 12 meter width. The representative of the project proponent also submitted proof of registration of two bore-wells existing in the project area with the DC, Gurgaon; for withdrawal of ground water for drinking purpose and clarified that all the permissions for withdrawal of water pending with DC, Gurgaon office shall be issued after 31.03.2014 including permission related to their project. 17

After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The project proponent shall install STP of 25 KLD for treatment of waste water. [2] Pollution control measures for oil/diesel waste due to large no of Trucks involved in transportation shall be made. [3] The project proponent shall get approval of scheme for firefighting from the concerned Authority before commissioning the project. [4] The project proponent shall install RO plant for purification of waterfor drinking/domestic purposes. [5] The project proponent shall submitpermission from DC, Gurgaon for abstraction of ground water, before the start of construction. [6] The project proponent shall control fugitive emission due to loading, unloading and other operations. In no case any truck/other vehicle should be parked on the road side. [7] The project proponent shall dispose of excess of Sewage/storm water during rains at appropriate place after taking prior approval of competent authority. [8] The project proponent shall not store hazardous and inflammable substances in the proposed ware house. [9] The project proponent shall obtain revalidation of permission of NHAI for access to the proposed warehouse complex before actually using the same. Item No. [13] Environment Clearance of Proposed Group Housing Complex “Esfera” at Village- Bassi, Sector-37C Distt-Gurgaon, Haryana by M/s Phoenix Datatech Pvt. Ltd. The case was considered in the 66th meeting of SEIAA held on 05.02.2014 wherein, it was noticed that the NOC granted by DC Gurgaon regarding non- applicability of Aravalli Notification the Tehsildar Gurgaon has reported that award has been issued for khasra no. 755 to 771 (part) of the project area. The representative of the project proponent was asked to explain and clarify about this award of the licensed area as has been indicated in the DC certificate, he was also directed to earmark this awarded area on the layout plan. The representative of the project 18 proponent could not give satisfactory explanation and requested to give 15 days’ time for providing necessary clarification. The request of the representative of the project proponent was acceded to and the case was deferred accordingly. In the today’s meeting the reply dated 04.03.2014 was taken up for consideration in the presence of representative of the project proponent and consultant. It was noticed that the project proponent has submitted a report of LAO stating that the land falling under the license is free from acquisition. The project proponent also submitted a report of the Tehsildar that the record has been updated. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The project proponent shall provide helipad facility as required under NBC norms and shall seek permission of helipad from AAI accordingly. [2] The project proponent shall not raise any construction activity in the ROW reserved/acquired for High Tension Wire passing through the project area and shall maintain horizontal and vertical ROW as required under Indian Electricity Rules, 1956/DHBVN latest instructions. [3] The project proponent shall not carry out any activity in the balance left over area without obtaining prior environmental clearance. Item No. [14] Environment Clearance for “Plotted Development Project” at Sector 3, 4 & 4A, Village- Islamnagar, - Urban Complex, Panchkula, Haryana by M/S MAGNOLIA PROPBUILD Pvt. Ltd. The case was considered in the 63rd meeting of SEIAA held on 23.12.2013 wherein, it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit revalidated NOC from the forest department [2] The project proponent shall submit revalidated NOC from Chief Wild Life Warden after submitting whole project plan and conceptual plan. 19

[3] The project proponent shall submit service line plan showing that revenue rasta is not intercepted by it or shall seek the permission of concerned competent Authority for laying of services under the revenue rasta. [4] The project proponent shall submit a Master plan/Sector plan showing various accesses to the project area. [5] The project proponent shall get the study conducted from IIT Roorkee regarding precautionary measures required to withstand the impact of any natural disasters and problems like flash floods etc. in the project area as well as surrounding areas. Project proponent shall submit the modified plan by incorporating the suggestions/recommendations of the study report. [6] The project proponent shall conduct Rapid EIA study and shall submit EIA/EMP report. [7] The project proponent shall submit NOC from Irrigation department that the natural drainage in the area will not be affected by his proposed colony. [8] The project proponent shall submit NOC from HUDA that plotted development by him is within the overall planning of HUDA and all the proposed infrastructural services of water supply, sewerage, storm drainage and power etc. are satisfactory as per site conditions. In the today’s meeting the reply dated 20.02.2014 was taken up for consideration in the presence of representative of the project proponent and consultant. It was noticed that the project proponent has submitted revalidated NOC from Forest Department, permission of HUDA for use of revenue rasta for laying of services lines, copy of master plans/sector plan showing various accesses to the project area, a copy of study conducted by IIT Roorkee, regarding precautionary measures required to withstand the impact of any natural disasters and problem likes flash floods, EIA/EMP, NOC from Irrigation department that the natural drainage in the area will not be affected by this project and NOC from HUDA that plotted development is within the overall planning of HUDA and all the proposed infrastructure services of water supply, sewerage, storm drainage and power etc are satisfactory. As regards revalidation of NOC from Wild Life Warden, Haryana it was noticed that the project proponent has submitted request to the Chief Wild Life 20

Warden. It was noticed that the project area is approximately 2.72 Km from Bir Shikargah Wildlife Sanctuary & 1.8 Km away from Khol Hi Raitan Wildlife Sanctuary and MoEF GoI vide draft Notification dated 03.06.2009 has declared 5 km of radius area around the boundary of Wildlife Sanctuary as Eco-Sensitive Zone but the final Notification has not been issued as yet. The case was examined in the light of MoEF GoI revised guidelines dated 19.12.2012; for taking non-forestry activities in Wildlife habitat. The guideline at item no. 3.5.1 provides that: Activities within 10 kms from boundaries of National Parks and Wildlife Sanctuaries: In pursuance to the order of Hon’ble Supreme Court dated 7th December 2006 in Writ Petition (Civil) No. 460/2004, in case any project requiring Environmental Clearance, is located within the eco-sensitive zone around a Wildlife Sanctuary or National Park or in absence of delineation of such a zone, within a distance of 10kms from its boundaries, the User agency/Project Proponent is required to obtain recommendations of the Standing Committee of NBWL. It was observed that the project area falls within the 10 kms from the boundaries of Wildlife Sanctuaries and for the requirement of Environment Clearance the project proponent is required to obtain recommendations of Standing Committees of NBWL. It was also noticed that the applicant is required to submit application on the prescribed Performa for seeking recommendation of Standing Committee of NBWL. The representative of the project proponent informed that their application was taken up in the 1st meeting of State Board for Wildlife Haryana and a decision has been taken to send the case for approval to Standing Committee on NBWL Govt. of India. The representative of the project proponent also assured to submit the copy of documents submitted to State Board for Wildlife of Haryana for seeking recommendation of Standing Committee of NBWL. The representative of the project proponent was also directed to submit duly notarized undertaking on affidavit that they will start development of the project only after receipt of recommendation of Standing Committee of NBWL in this case and shall also comply with the recommendation of Standing Committee of NBWL. The study report regarding 21 precautionary measures to be required to withstand the impact of any natural disasters and problem like flash floods was discussed in detail. The representative of the project proponent explained in details regarding storm water drainage system, contour of the area, and precautionary measures to be adopted as suggested in the study report. It was noticed that the following precautionary measures have been recommended in the study report with respect to the project area. 1. To provide Spur between cross-sections 8 and 9 with its launching apron. The bank will not be eroded and hence the proposed Residential Township will be in safe zone. The upstream and downstream of spur shall also be protected by suitable works like boulder wire crates etc. for the good functioning of spur. 2. Light protection works with RCC cut-off wall starting from river cross-sections 10 to 16. The Authority decided that full protection measures shall be taken in totality as per overall planning of the area under approved development plan either by HUDA/ by the project proponent to the satisfaction of Irrigation Department Haryana.The representative of the project proponent informed the Authority that HUDA is already in the process of providing above recommended precautionary measures throughout the entire stretch of 1.5 km Kaushalaya River Bank alongside 45 meter wide road and assured that they will adopt the recommendation given in the study report as far as their project area is concerned. The representative of the project proponent was asked to submit an undertaking in this regard. It was observed that the Town & Country Planning Department Haryana vide Memo no. LC-1592b+2099-JE (VA) 2011/3223 dated 16.03.2011 has enclosed copy of plan showing the flood prone areas along and also passed directions that no earth work/construction activity in the flood plain area as indicated by the Irrigation Department can be undertaken even after approval of zoning plan and the NOC from Irrigation Department Haryana in such cases is required. The representative of the project proponent informed that the 7.32 Acre of licensed area which is part of 198.80 Acre of licensed area falls in flood plain area as per the plan showing the flood prone areas along Kaushalya River issued by Irrigation Department. The representative of the project proponent assured the Authority that they will not raise any kind of construction in this area. The Authority 22 advised the representative of the project proponent to develop thick green belt on this 7.32 Acres area in addition to already proposed green belt; which will help to stop/control any kind of soil erosion in the area. The representative of the project proponent agreed and assured to submit the proposal with plan. The representative of the project proponent explained in the details the storm water drainage system to propose in the project area. The representative of the project proponent was directed to develop storm water drainage system in the project area strictly in accordance with the submitted plan. The representative of the project proponent agreed. The representative of the project proponent submitted duly notarized undertaking declaring that i) The development work will be started only after the receipt of recommendations of NBWL and shall comply with the recommendation of NBWL ii) No construction shall be raised on 7.32 acre of project area iii) Recommendation of study report of IIT Roorkee shall be implemented. The representative of the project proponent also submitted proof of submission of application with Chief Wildlife Warden Haryana for NOC from standing committee of NBWL. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The Environmental Clearance to this project is subject to obtaining clearance under the Wildlife (Protection) Act, 1972 from the Standing Committee of National Board for Wildlife and the project proponent shall start development work of the project only after the recommendation of Standing Committee of NBWL in this case. [2] The project proponent shall ensure to provide Spur between cross-sections 8 and 9 with its launching apron. The bank will not be eroded and hence the proposed Residential Township will be in safe zone. The upstream and downstream of spur shall also be protected by suitable works like boulder wire crates etc. for the good functioning of spur simultaneously with start of development. [3] The project proponent shall ensure to undertake light protection works with RCC cut-off wall starting from river cross-sections 10 to 16 simultaneously with start of development. 23

[4] The project proponent shall ensure that the plinth level of the building block to be minimum 1.5 meter above highest flood level as per study carried out. [5] The project proponent shall ensure that no construction activity is undertaken either on surface or below or above surface of revenue rasta passing through the project area. [6] The project proponent shall indicatethe width and length of revenue rasta passing through the project area on sign board and shall display the same at both the ends of revenue rasta stretch, for awareness of public. Sign board shall also display the message that this is public rasta/road and any citizen can use it. There shall not be any gate with or without guards on revenue rasta further project proponent shall not encroach revenue rasta and shall not cross internal roads over revenue rasta. [7] The project proponent shall not raise any construction on 7.32 Acre of project area (flood plain area) and shall develop thick green belt in addition to already proposed green belt development plan. The project proponent shall submit green belt development plan of 7.32 Acre of project area before the start of construction. [8] The project proponent shall obtain NOC from Irrigation Department before the start of development work. [9] The project shall have the provision for infrastructure services (water supply, sewer, storm water lines etc) to accommodate the additional load arising from population residing in other lands falling within the project limits/vicinity. [10] The project shall provide the storm water drainage system in the project area strictly in accordance with the storm water drainage plan submitted with the SEIAA Haryana. Item No. [15] Environment Clearance for the Group Housing Complex namely “Ninex City” at Sector-76, Gurgaon, Haryana by M/S Ninex Developers Ltd by M/s Ninex Developers Limited. The case was considered in the 60thmeeting of SEIAA held on 07.11.2013 wherein, it was decided to write a reminder to MOEF GOI with the request to send the desired information at the earliest. It was also decided that the project proponent shall 24 supply copy of all the documents in this respect to all the members of SEIAA. Accordingly, the case was deferred. In the today’s meeting the case was taken up for consideration in the presence of representative of the project proponent and consultant. The representative of the project proponent was asked to give details regarding status of construction in chronological order but he failed to give proper response and requested to give time till next meeting. The Authority accepted the request of the project proponent and decided to defer this case to the next meeting. ********
