The refinery is located in Sasolburg in the Northern Free State, and is operated on behalf of two shareholders, Sasol Oil (Pty) Ltd (63.64%) and Total South Africa (Pty) Ltd (36.36%). As set out in this 2017 Postponement Application, Natref is challenged to meet the MES as reflected in its AEL, by 31 March 2018 for sources at five points of compliance. Natref is therefore applying for this postponement, to complete the necessary project activities underway to implement the most appropriate solutions and make provision for the safe and complete execution of the projects, which should achieve compliance with the prescribed emission standards for the five points of compliance. Natref’s application includes the findings of an independently prepared Atmospheric Impact Report (AIR), which determines Natref’s impact on ambient air quality, along with further reasons that warrant consideration in a decision about postponements from the MES. Natref has appointed Airshed Planning Professionals (Airshed) to prepare the AIR and SRK Consulting (South Africa) (Pty) Ltd. (SRK) to manage the technical studies and the Public Participation Process (PPP). 1.1 Scope of this report This report documents the public participation activities undertaken during the announcement phase, the process whereby Interested and Affected Parties (I&APs) were provided the opportunity to comment on the Draft Motivation Report and AIR prepared as part of the application and documents any comments received and associated responses given. 2 Approach to Public Participation The PPP undertaken as part of Natref’s application for postponement of the compliance timeframes, is structured to meet the requirements of Chapter 6 of the Environmental Impact Assessment (EIA) Regulations (Government Notice No. 982, 04 December 2014), published under the National Environmental Management Act (Act 107 of 1998) (NEMA), as specified in the November 2013 MES Regulations. The PPP is an important component of the application and is closely linked to the technical activities required for the preparation of the Motivation Report. Figure 2-1 details the Technical and Public Participation processes. Registered during previous Natref postponement application in 2014. Registered with the Offset Implementation Plan public participation process. The I&AP database for the Natref operation comprises approximately 1140 I&APs, representing various sectors of society as listed below (Refer to Appendix 1 for the full database of I&APs): National government: The Department of Environmental Affairs, Department of Mineral Resources and the Department of Water and Sanitation.
