(A ) THE APPLICATION

Development Requiring Express Planning Permission.

• The erection of 14 65m tower height turbines (110m to top blades hence 90m diameter) tubular tower with three blade rotor • 2 x lattice anemometry masts 65m high • Switchgear building 10570 x 7680 x 5154 to ridge. Finished in brick or other facing materials to be agreed with Argyll & Bute Council. • Improvements to existing forest tracks • 6.4 km of new access to be constructed to link existing tracks to the wind farm site • Installation of 33kv underground cable to connect turbines to sub station • Construction of temporary site offices and compound (100 x 25) (to be removed within 6 months of the wind farm becoming operational)

Other Operations

• Connection to the local grid at the existing Scoir Mor power station

(B ) RECOMMENDATION

The proposal is recommended for Refusal because of the adverse impact on the landscape of North Loch Awe and at the Dalmally area, the adverse effect on ornithology particularly golden eagles and being contrary to Structure Plan and Local Plan Policies.

Whilst there have been a considerable number of representations, I do not consider that a hearing would be appropriate as the Committee would not be able to form a competent motion in the light of Scottish Natural Heritages strong objections and the potential impact on protected species.

(C ) THE APPLICATION SITE, APPLICATION AND SUPPORTING INFORMATION

This application was received in April 2005 and has been the subject of meetings with the developer and Scottish Natural Heritage (SNH) and extensive consideration.

Prior to submission a scoping exercise was conducted and SNH advised against the submission of an application as they consider this hillside is an inappropriate location for development. SNH are the Council’s primary adviser on ornithology and related matters.

The site is in an area considered not suitable for wind farm developer in the emerging consultation Draft Argyll and Bute Local Plan. However this policy has been objected to and cannot be given any weight at present.

Currently there is one wind farm in Lorn at Beinn Ghlas south of Taynuilt. This was granted permission in 1997. The turbines on that site are much smaller than those in the current proposal.

The Council has not objected to a large wind farm at Carraig Ghael southwest of Kilchrenan which will be prominent from the Loch Awe landscape. This wind farm will generate more than 50MW and is therefore a proposal is processed under Section 36 of the Electricity Act by the Scottish Executive. I expect the proposal to be granted in the near future.

There are two current applications for wind farms on this hillside to the south of Dalmally and north of Lochan Shira. There is the current proposal and a Section 36 application at Shira to the east for a further 22 turbines, most 115 metres high at the blade tips. This proposal will have a significant adverse effect on landscape and eagles and the developer has asked for it to be kept pending to await the outcome of SNH’s proposal for Glen Fyne Eagle Special Protection Area (SPA).

There have been discussions and meetings with the agents during the processing of the application. The landscape and ornithology concerns and SNH and RSPB concerns raised. The developer proposed mitigation for Golden Eagle habitat by clearing a large area of forest to create a new habitat and feeding area south of the wind farm. This was not considered to solve the difficulties with Golden Eagle habitat.

A revised access was suggested from the A819 at Accurach Farm which may have overcome SNH concerns about the Glen Shira SPA. This was a material change which would have needed a new application. The proposal remains for access from the A83.

Removal of 3 turbines was discussed and montages produced. Whilst this reduced some of the impact on landscape this was not considered to be significant and the changes were not formally submitted.

The site for the turbines is on the southern side of the ridge south of Dalmally. The site is about 5km south of Dalmally and the A85(T) and 3km to the east of the A819 south of Cladich. It is WNW of Lochan Shira and on the southern fringe of Ward 5 close to its boundary with Ward ?. Vehicular access will be from A83(T) at Loch Shira outside Lorn. The application is currently one of two under consideration on this ridge. The other proposed is a Section 36 at Shira. This is for 22 turbines, 20 @ 115m high to blade tips and 2 @ 125m to blade tip.

The site is rugged upland currently used for sheep grazing and lies at 290 – 400. Access is proposed by way of a minor road and forest tracks traversing the east side of Glen Shira to the NE of Inveraray.

It is anticipated that the wind farm will operate for some 25 years and thereafter the equipment would be removed and the site restored.

The application was accompanied by and Environmental statement which has 7 parts. a. Volume 1 Non Technical Summary b. Volume 2 Environmental Statement Test c. Volume 3 Figures. This includes photos from 18 view points and details of the turbines d. Volume 4 Appendices e. Volume 5 Confidential Ecology Appendix f. Planning Supporting Statement g. Addendum to Chapter 15 following publication of the Consultation Draft Argyll & Bute Local Plan – 2005

The Environmental Assessment includes photomontages of wind farms taken from 20 viewpoints agreed with the applicants which help to give a good indication of what the visual impact of the wind farm will be. There, together with plans showing what areas of wind farms will be visible from will give a good understanding of the impact of the proposal.

The viewpoints are popular hills, tourist spots and other typical public destinations. They are as follows:

1) Macintyre Monument near Dalmally, here 10 turbines will be visible along the hillside to the south. 2) Cladich where the wind farm is not visible because this community is in a dip in the landscape.

3) Kilchurn Castle where 12 turbines are visible along the hillside to the south. 4) Loch Awe village where 13 turbines are visible along the hillside access the loch. 5) Ardanaiseig Hotel on the west side of the loch where 14 turbines would be visible if not screened by lochside trees. This does show the sensitivity of this side of the loch to distant views of the turbines. 6) Stronmilchan where 7 turbines are visible on the hillside south of Dalmally. This is typical of the visibility along the B8077. 7) Ben Bhuidhe, all 14 turbines clearly visible. 8) A819 Glen Aray all 14 turbines visible to the east of the road. 9) B8077 near Glen Strae 12 turbines visible 10) Cruachan Visitor Centre, 14 turbines visible 11) A85 at Strone, wind farm not visible 12) Kilchrenan, 8 turbines visible from the road 13) Glen Nant, 14 turbines visible 14) Beinn Eunaich, 14 turbines visible 15) Cruachan, 14 turbines visible 16) Ben Lui, 14 turbines visible 17) Ben Chapull, 14 turbines visible 18) Bridge of Orchy/West Highland Way, 5 turbines visible at a great distance 19) Stob Ghobar, 14 turbines visible

(D) ASSESSMENT AND MATERIAL DETERMINING CONSIDERATION

Section 25 of the Planning Act required that applications be determined in accordance with the Development Plan unless other material considerations indicate otherwise.

The assessment of a wind farm application is complex and to simplify matters I have assessed the proposal under the following headings.

a) Road Safety b) Archaeology c) Ornithology d) Noise and Disturbance e) Landscape f) Cumulative Impact g) Health and Safety h) Historic Environment i) Telecom j) Economic Development k) Tourism and Recreation

a) ROAD SAFETY

The access to the site will be from A83 at Loch Shira using existing estate roads. Trunk Roads and the Area Roads Engineer have no objections to this proposal. A proposal to access via the Accurach Farm off the A819 Cladich to Inveraray road was discussed at one time (to try to overcome SNH! Concerns regarding Glen Shira) but this was not progressed.

There are no road safety issues and the proposal is consistent with Structure Plan and Roads Policy.

b) ARCHAEOLOGY

The Environmental Statement gives a comprehensive study of the archaeology on the site and surrounding area. Thirteen sites of cultural heritage significance were identified within the application site. These included medieval or late rural settlement features and features associated with the 20 th century HEP scheme. The conclusion of the report is that the impact of the development on the cultural heritage resource would not be significant and I agree with this. West of Scotland Archaeological Service has similar views and no objections to a condition for an archaeological watching brief.

There are no archaeological issues and the proposed complies with Structure Plan Policy STRAT DC9 and NPPG 18.

c) ORNITHOLOGY

The Nature Conservation interests were identified in the Environmental Statement. The area supports and assemblage of breeding and foraging birds including Golden Eagles and Hen Harriers. Mitigation for Golden Eagles was discussed and put forward but SNH and RSPB were not satisfied that this mitigation would overcome their concerns.

SNH and RSPB have objected to the proposal, Glen Fyne and Lochan Shira are one of the most important areas for breeding Golden Eagles in Scotland and it is considered that they would be endangered by the wind farm and the high possibility of collision with the blades of the turbines.

SNH in their response of 26/07/05 point out that the collision risk prediction for the site is 1 eagle killed every 1.2 years with a worst case scenario of 23 birds killed during the operation of the wind farm.

Furthermore, the area to the south of the wind farm has been put forward by SNH as an Eagle Special Protection Area. Whilst this currently has no legal status it would be unwise given the above figures for the Council to support this development which is anticipated to seriously affect European Protected Species.

There are therefore significant ornithological issues relating to this proposal and therefore it is contrary to Structure Plan Policy STRAT DC 7 and NPPG 14, Natural Heritage.

d) NOISE AND DISTURBANCE

The Environmental Statement contains a detailed assessment and the levels of noise likely to occur at the nearest local residential property as a result of the operation of the turbines.

The nearest properties are Accurach Farm (2km away) Millside (2.7km away) and Achlian (3km). Dalmally is 5 kilometres away. The report concludes that the wind speed dependant noise levels at the nearest residential property are comfortably below the background noise levels and that noise from the wind farm would not be detrimental to the amenity of local residents.

Environmental Health have no objections to noise grounds and therefore I accept that there are no significant noise and disturbance concerns regarding the proposal provided appropriate conditions are imposed.

e) LANDSCAPE

This is an important aspect of the assessment and I have split it into 4 sections.

• The impact on Loch Awe • The impact on distant points • The impact on high mountains • The impact on the National Park

In chapter 8 of the Environmental Statement the applicants assess the landscape impact/change as a result of the proposed wind farm mainly as negligible, low or medium.

Landscape Impact on Loch Awe

The application site is clearly visible to travellers on long sections of the A85 and the west and north sides of the Loch and communities such as Loch Awe, Stronmilchan and tourist spots such as Kilchurn Castle and MacIntyre Monument. The proposal would introduce dominating modern industrial structures into an area which has a natural and unspoilt appearance of forest and hill grazing with no man made or modern industrial structures.

I consider that there will be a significant adverse impact on this landscape. If this wind farm is developed the existing semi natural landscape will be dominated by turbines.

Conclusion :

I consider that this landscape has no capacity to absorb a wind farm in such a prominent position and it will adversely affect the setting and character of this area and this important train and vehicle route through Lorn.

Landscape Impact on Distant Points

The wind farm can be viewed from distant points.

The environmental assessment gives an example from the A82 or West Highland Way near Bridge of Orchy and this shows that the impact will be insignificant. Similarly the wind farm will have an insignificant impact on the A83 at Loch Shira because of the distance of the wind farm from these locations which make it an insignificant feature in the overall landscape.

Conclusion :

The wind farm will not have a significant impact from distance points because the turbines will be obscured by features closer to the viewpoint or will appear small and insignificant in the wider landscape.

Landscape Impact on High Mountains

The environmental assessment shows views from 6 nearby Munros. All summits will have a clear view of 14 turbines but I consider because of the distances involved and the angles involved (they will not be sky lined) there is not a significant adverse impact. Currently the view is wider and expansive but due to the significant distance and the downward angel of vision will not have a significant impact on the landscape.

Conclusion :

The wind farm will not have a significant adverse impact on most high tops.

Landscape Impact on Loch Lomond and Trossachs National Park

Ben Lui is in the National Park and is a very popular hill for walkers. The environmental assessment shows that it has a clear view of 14 turbines and SNH are concerned about this impact. However, this is 12 km away and the wind farm will not be a significant feature in the landscape.

Conclusion :

The wind farm will have a negligible impact on the Loch Lomond and Trossachs National Park.

f) CUMULATIVE IMPACT

Cumulative impact is the potential impact of seeing more than one wind farm in one view/vista or the experience of viewing a number of wind farms in a journey through an area. SNH have raised no concerns regarding this matter. The environmental assessment contains photos of the landscape showing existing and proposed wind farms.

As stated above there is an existing wind farm at Beinn Ghlas and I expect one to be granted by the Executive at Carraig Ghael. There are no significant viewpoints when 2 or all 3 wind farms will be visible. On a journey along the A85 this proposal will be prominent but neither of the other wind farms will have a significant impact because of their size and/or location.

I do not consider there is a cumulative impact because the Shira application has not been determined and there is sufficient separation between the other two wind farms.

g) HEALTH AND SAFETY

The Health and safety Executive have no comments re the application.

SEPA have no objections subject to conditions.

Scottish Water had no objections to the proposal.

Scottish Executive Environmental Group responsible for waste supply, water protection, sewerage, flood preventions, coastal protection, waste disposal and air quality had no comments to offer on the proposal.

h) HISTORIC ENVIRONMENT

It is necessary to access the impact of the proposal on adjacent historic features. There are no historic features in the vicinity of the proposed wind farm. There are Listed Buildings and Historic Gardens in Dalmally, Lochawe and by Loch Awe but these are remote from the wind farm and will not be significantly affected.

Therefore there are no Historic Environment issues and the proposed complies with Structure Plan Policy STRAT DC9 Historic Environment and Development Control.

i) TELECOMMUNICATIONS AND ELECTROMAGNETIC MATTERS

Ofcom were consulted on this application and had no objections.

j) ECONOMIC DEVELOPMENT

In terms of economic impact, there is likely to be a limited impact during construction in terms of jobs and in terms of long term maintenance and monitoring. Jobs will be created in the manufacture of turbines but the actual manufacturer cannot be guaranteed.

k) TOURISM AND RECREATION

There has been much debate on the effect on tourism and I believe that if the wind farm could be successfully absorbed into the landscape the effect on tourism would be negligible in this case.

In this case the wind farm can be absorbed into the Loch Fyne, Loch Shira landscape and the impact will be negligible.

However in terms of the landscape of Loch Awe and the tourist site along A85 this is a very important area and busy route to all from Oban. There would be an adverse visual impact in terms of landscape. What effect this would have on tourism in Lorn is difficult to quantify. I have concerns about the impact of this and the adjacent wind farm proposal on tourism and conclude that there would be a negative impact but not enough to justify a refusal on this basis.

CONCLUSION

The wind farm when viewed from many points around Loch Awe and along the A85 would have an adverse visual impact and would be contrary to National Strategic and Local Policy.

SNH concur with these views about the Loch Awe landscape.

The wind farm would have an adverse impact on the habitat of Golden Eagles.

REASONS FOR REFUSAL RELATIVE TO APPLICATION REF 05/00770/DET

1. The proposed for the erection of a wind farm West of Lochan Shira to the South of Dalmally on a prominent hillside visible from extensive areas of North Lochaweside would have a significant adverse effect on the Loch Awe Local Scenic Area when viewed from the West and North side of the loch, the A85 and the MacIntyre Monument and Kilchurn Castle.

From these important public viewpoints and this important and busy road through Lorn the introduction of up to 14 turbines, or parts of turbines, tips or rotors into a currently almost undisturbed undeveloped skyline on a prominent hillside would introduce a modern industrial, vertical, moving, confusing and incongruous element into this important local scenic area.

The introduction of such a development would have a negative effect in an area where there are no significant modern industrial type structures.

The proposed wind farm would change this landscape from a prominent partly wooded and partly open grazing area with a semi natural forested appearance to one of a hillside dominated by turbines which would be an alien intrusion.

The hillside cannot absorb this wind farm because of the shape of the ridge and the position of the turbines.

2. The proposed wind farm would detract from the landscape of this flat hillside South of Dalmally which is characterised by a horizontal tree covered landscape essentially free from development and would have a negative effect on the enjoyment of views from the A85 and viewpoints along this busy and popular route.

The proposed by virtue of the above adverse impact on the setting, character, enjoyment and experience of the North Loch Awe landscape is therefore contrary to:

i) The provision of National Scottish Executive Policy and objectives as detailed in NPPG6 (Renewable Energy Development) and NPPG15 (Rural Development) which seek to ensure that development does not adversely affect the natural environment by avoiding any adverse impacts of the character, quality, integrity and setting of non-renewable resources such as locally important scenic areas and their setting, so that the natural environment may be passed on to future generations in good order.

ii) The provisions of Policy RUR1 of the Local Plan and Policy WF1 of the approved Argyll & Bute Wind Policy which seeks to resist development which would have an adverse impact on the landscape quality of the scenic area.

3. The wind farm would have an adverse impact on Golden Eagles and Hen Harriers which have an important habitat in this area and could affect the draft Special Protection Area. The wind farm could result in significant loss of eagles as a result of collisions with turbines.

APPENDIX RELATIVE TO 05/00770/DET

A. POLICY OVERVIEW

In terms of Section 25 of the Act the following Development Plan Policies are applicable:

Argyll and Bute Structure Plan 2002

STRAT DC 7 Nature Conservation and Development Control

A) Development likely to have a significant effect on a Natura site will be subject to an appropriate assessment. The development will only be permitted where the assessment indicates that it will not adversely affect the integrity of the site, or, there are no alternative solutions and there are imperative reasons overriding public interest. B) On sites of national importance, SSSIs and NNRs, development will only be permitted where it can be demonstrated that the overall objectives of the designation and the overall integrity of the designated area would not be compromised, or where any adverse impacts are clearly outweighed by social or economic benefits of national importance. C) Development which impacts on Local Wildlife Sites or other nature conservation interests, including sites, habitats or species at risk as identified in the Local Biodiversity Action Plan, shall be assessed carefully to determine its acceptability balanced along with national – or local – social or economic considerations. D) Enhancement to nature conservation interests will also be encouraged in association with development and land use proposals.

STRAT DC 8 Landscape and Development Control

A) Development which, by reason of location, siting, scale, form, design or cumulative impact, damages or undermines the key environmental features of a visually contained or wider landscape or coastscape shall be treated as ‘non-sustainable’ and is contrary to this policy. Outwith the National Park particularly important and vulnerable landscapes in Argyll and Bute are those associated with:

1. National Scenic Areas 2. Historic landscapes with close links with archaeology and built heritage and designed landscapes. 3. Landward and coastal areas with semi-wilderness or isolated or panoramic quality.

B) Enhancement to landscape will also be encouraged in association with development and land use proposals.

STRAT DC 9 Historic Environment and Development Control

Protection, conservation, enhancement and positive management of the historic environment is promoted. Development damages or undermines the historic, architectural or cultural qualities of the historic environment will be resisted; particularly if it would affect a Scheduled Ancient Monument, or its setting, other recognised architectural site of national or regional importance, listed building or its setting, conservation are or historic garden and designed landscape. More detailed policy and proposals for the historic environment will be set out in the Local Plan.

STRAT RE 1 Wind Farm/ Wind Turbine Development

A) Wind farm development is encouraged where it is consistent with STRAT DC 7, 8 and 9. Proposals shall be supported where it can be demonstrated there is no significant adverse effect on:

• local communities

• natural environment • landscape character and visual amenity • historic environment • telecommunications, transmitting or receiving systems, and

B) The Council will identify, with appropriate justification in the Local Plan, broad areas of search or, where appropriate, specific sites where wind energy development may be permitted. The Council will also indicate sensitive areas or sites which it is judged that for overriding environmental reasons, proposals for wind farm development would only be considered in exceptional circumstances in line with the criteria set out above. Issues associated with the cumulative impact of wind farm and wind turbine developments will be addressed. This will be done in partnership with the industry and other interested parties including local communities.

Lorn Local Plan

RUR 1 The Council will seek to maintain and where possible enhance the landscape quality of National and Regional Scenic Areas and coasts and areas of local landscape significance and within these areas will resist prominent or sporadic development which would have an adverse environmental impact:

(a) National Scenic Area : (I)Lynn of Lorn; (ii) Ben Nevis and Glencoe (b) Regional Scenic Areas : (I) Knapdale/Melfort; (ii) North Argyll (c) Regional Scenic Coasts : North West Argyll (d) Areas of local landscape significance : (I) Loch Etive/Benderloch Coast; (ii) Loch Awe; (iii) Loch Nell; (iv) Glen Lonan; (v) Loch Avich; (vi) Glen Gallain/Loch Scammadale.

RUR 2 Proposals for development in or affecting National Scenic Areas, Regional Scenic Areas and Coasts or areas of local landscape significance will require to be justified against the following criteria

(a) economic benefit (b) infrastructure implications (c) specific locational/operational need (d) environmental impact

Government Guidance

National Planning Policy Guidance 6 (NPPG6 – revised 2000) Renewable Energy Developments

Planning Advice Note 45 (PAN 45 – revised 2002) Renewable Energy Technologies

The promotion of renewable sources of electricity generation, an integral part of the UK Government’s energy policy, has been identified as having a key role in its commitment to addressing the causes of climate change and the introduction of measures in support of the UK “ Climate Change Programme ”. The policy is for renewables to make a steadily increasing contribution to secure, diverse and sustainable energy supplies, as electricity consumption increases, existing generating capacity is retired and climate change reduces the incentive to generate electricity by burning fossil fuels. The Scottish Executive is therefore committed to increasing the amount of renewable energy used in Scotland. The UK Utilities Act 2000 and the associated new renewables obligations in Scotland and in England and Wales will provide the mechanisms for achieving more renewable sourced electricity.

In support of the UK Government’s commitment to renewable energy and its contribution to the climate change programme, more renewable energy developments are required to meet UK international obligations. The Scottish Ministers wish to see the planning system play its full part by making positive provision for such developments by:

• Facilitating and guiding renewable energy developments in up to date structure and local plans;

• Ensuring that development control decisions are taken efficiently, consistent with national and international climate change policy commitments and obligations and • Preventing unnecessary sterilisation of renewable energy resources.

Whilst at the same time:

• Meeting the international and national statutory obligations to protect designated areas, species and habitats of natural heritage interest and historic environment from inappropriate forms of development; and • Minimising the effects on local communities.

Other relevant national planning policy guidance includes:

• NPPG1: The Planning System • NPPG 14: Natural Heritage • NPPG 15: Rural Development • NPPG 18: Planning and the Historic Environment • SOED Circular 6/95 (as revised June 2000): Habitats Directive.

The underlying principle of all NPPGs and related policies is sustainable development. Some NPPGs are intended to encourage development, while others are intended to safeguard resources and features of national and international importance. Polices in the latter group do not necessarily preclude renewable energy developments, but development proposals should avoid significant adverse impact upon the character, quality, integrity and setting of a designated resource.

1.Impact on Glen Shira special area of Conservation. 2.Ornithology – adverse impact on golden eagle and hen harrier 3.Landscape – Due to the number of existing, consented and proposed wind farms will impact on the Lorn Plateau and North Argyll landscape to accommodate further wind farm development is severely limited. The development will have a significant visual impact from important viewpoints potentially Loch Awe and the Loch Lomond & Trossachs National park. 4. Protected species, concern about Water Vole Survey. 07.07.06 In March 2006 the Minister announced a number of proposed additions to current Special Protection Areas (SPA) in Scotland and requested that SNH identify additional areas for the protection of Golden Eagle habitats. SNH is progressing work on this in Loch Fyne. SNH believe that the development of Stacain wind farm would lead to the “pollution” and “deterioration” of this Golden Eagle habitat. 12/04/07 Observations on additional information. SNH position remains an outright objection to the development. Main concerns are potential effect on Golden Eagles and adverse impacts on the landscape. Also have concerns related to the effects on Hen Harriers. SNH cannot identify any mitigation which would realistically address their concerns. Firmly of the opinion that this sites is not suitable for this type of development. An area of Glen Fyne is being considered for a new SPA. In 2003 it contained 5 breeding pairs and was ranked among the top 4 most productive areas in Scotland. Concerned about mortality rates due to

Lifted objection relating to the Glen Shira SAC on understanding access will be in accordance with document “Method Statement Clachan Flats Access Track” approved as part of the nearby Clachan Flats wind farm development. 25/07/07 There is no fixed timetable for consideration of the Glen Etive and Glen Fyne SPA at present. A likely timetable is that formal consultation may start in October/November 2007. Currently it has no legal status and is referred to as a draft SPA.
