The originating law, Chapter 30, Article 38 of the West Virginia Code is titled the “West Virginia Real Estate Appraiser Licensing and Certification Act.” A second law, Chapter 30, Article 38A of the West Virginia Code, the “West Virginia Appraisal Management Companies Registration Act,” was passed in 2013 to register and regulate appraisal management companies. Subsequent to passage of the Chapter 30, Article 38A, the Board’s mission includes protecting the public interest by assuring that all consumers of real estate appraisal services receive such services from appraisers who are fully qualified in accordance with both Federal and State law and from appraisal management services from appraisal management companies who are fully compliant with State law. The Board was established as a result of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (FIRREA). FIRREA is considered the most important banking law since the Great Depression, when the FDIC was created. FIRREA was the beginning of statutory attempts to re-regulate the banking and savings and loan industry. For real estate appraisal, Title XI of FIRREA established the Appraisal Subcommittee (ASC) as a sub- committee of the Federal Financial Institutions Examination Council. Title XI’s purpose is to provide that Federal financial and public policy interests in real estate transactions would be protected by requiring that real estate appraisals utilized in connection with federally related transactions were performed in writing, in accordance with uniform standards, by individuals whose competency was demonstrated and whose professional conduct was subject to effective supervision. The Appraisal Subcommittee monitors the West Virginia Real Estate Licensing and Certification Board, as well as the licensing and certification programs for real estate appraisers in each State to determine whether the State’s policies, practices and procedures are consistent with Title XI and enforcing the requirements of Title XI. The ASC has adopted formal Policy Statements Regarding State Certification and Licensing of Real Estate Appraisers. These Policy Statements interpret Title XI and reflect the general framework that the ASC uses when it reviews State appraiser regulatory programs for compliance with Title XI. A copy of the 2013 Appraisal Subcommittee Policy Statements is included with this report. Board Members Chapter 30-38-6 of the West Virginia Code specifies the composition of the West Virginia Real Estate Appraiser Licensing and Certification Board. The Board consists of nine members appointed by the governor with the advice and consent of the Senate: Each member shall be a resident of the state of West Virginia. Four members shall be certified real estate appraisers having at least five years' experience in appraisal as a principal line of work immediately preceding their appointment, and shall remain certified real estate appraisers throughout their terms. Two members shall have at least five years' experience in real estate lending as employees of financial institutions. Two members may not be engaged in the practice of real estate appraisal, real estate brokerage or sales or have any financial interest in these practices. One member shall be a representative from an appraisal management company registered under the provisions of West Virginia Code, Chapter 30-38A. No member of the Board may concurrently be a member of the West Virginia Real Estate Commission. Not more than two appraiser members may be appointed from each congressional district. The following were in attendance: Glenn Summers, Chair; The Honorable Anthony Julian, Douglas Butcher, Dean Dawson, Nathan Nibert, Rachel Phillips, Mary Beth Aliveto, Michael Shaw, Sandy Kerns, Executive Director; Darlene Washington, AG Legal Counsel; Courtney Buskirk, Billie Hancock and Brenda Ashworth. Dale Dawson-Clowser was not in attendance. The meeting was called to order at 10:00 am. Jeff Burrell, a West Virginia licensee, attended the meeting as a member of the public. Reading of the Minutes Minutes from the December 9, 2015 and December 28, 2015 meetings were presented to the Board. A motion was made by the Honorable Judge Julian to approve the December 9, 2015 and December 28, 2015 meeting minutes. Mary Beth Aliveto seconded the motion. Motion carried. Elections Glenn Summers, Chair, opened the floor for nominations for Vice-Chair. Rachel Phillips nominated Dean Dawson for Vice-Chair. Mary Beth Aliveto seconded the nomination. Dean Dawson was elected Vice-Chair by unanimous vote. Mr. Summers opened the floor for nominations for Board Secretary. Dean Dawson nominated Rachel Phillips for Secretary. Mary Beth Aliveto seconded the nomination. Rachel Phillips was elected Secretary by unanimous vote. The Honorable Anthony Julian, Mary Beth Aliveto and Michael Shaw were sworn into their Board seats. It was determined by the Board that it was not necessary for the AMC to notify the appraiser, unless said appraiser was being removed from panel entirely. The Board further stated an AMC has the right to assign any appraiser on its panel to a customer. A motion was made by Mary Beth Aliveto that the Board move into executive session for the purpose of discussing

The State of West Virginia was cut off from Virginia during the civil war and was admitted to the Union on June 19, 1863. As orig­ inally constituted it consisted of 48 counties; subsequently, in 1866, it was enlarged by the addition -of two counties, Berkeley and Jeffer­ son, which were also detached from Virginia. The boundaries of the State are in the highest degree irregular. Starting at Potomac River at Harpers Ferry,' the line follows the south bank of the Potomac to the Fairfax Stone, which was set to mark the headwaters of the North Branch of Potomac River; from this stone the line runs due north to Mason and Dixon's line, i. e., the southern boundary of Pennsylvania; thence it follows this line west to the southwest corner of that State, in approximate latitude 39° 43i' and longitude 80° 31', and from that corner north along the western boundary of Pennsylvania until the line intersects Ohio River; from this point the boundary runs southwest down the Ohio, on the northwestern bank, to the mouth of Big Sandy River.

WEBSTER SPRINGS SYCAMORE Will Blozan 1, Jess Riddle 2, and Ron Busch 2 1 President, Eastern Native Tree Society 2 Eastern Native Tree Society I was reading through Colby Rucker’s list of big trees by state in preparation for the trip to Pennsylvania for the Cook Forest Rendezvous. I was interested in West Virginia since we have almost no tree data from the entire state, aside from Cathedral State Park. I came across Colby’s description of the Webster Springs Sycamore, a massive tree listed as the “largest tree in WV” and the “largest sycamore in the world.” Colby also inferred that based on wood volume, it may be “one of the largest trees in the East.” Curious, I proposed to my travel mates (Jess Riddle and Ron Busch) that we try to find it and take measurements. On our way back from Cook we found the tree. We were impressed that there was actually a brochure (titled simply “Big Sycamore”) about the tree in the West Virginia Welcome Center off the interstate. The photos were impressive and the directions easy to follow (even though the map indicated that the roads were straight!). Driving though blinding snow and hill after hill of nauseating twists, we arrived at the cute town of Webster Springs, West Virginia. The brochure map gave directions up a dirt road along the Back Fork of the Elk River. The road ended in a turn-around with View looking up the Webster Sycamore, highlighting a suspension bridge over the river and several the lack of a top and handful of live branches in the interpretive signs.

One source of information on early forests is found in old deeds or surveys, where boundary corners were described by noting nearby trees known as witness trees. This paper describes the creation and analysis of a database of witness trees from original metes and bounds surveys of what became the Monongahela National Forest in West Virginia. We include an estimate of positional error from the conversion of paper maps to digital format. The final database contains 15,589 corners and 22,328 trees of 49 species from deeds dating from 1752 to 1899. White oak was the most frequent witness tree, followed by sugar maple, American beech, and American chestnut, and distribution patterns were recognizable across the study area. In early forests of the study area, magnolia, sugar maple, and black cherry were found on high-elevation ridges. Red spruce, hemlock, birch, and American beech were found on high-elevation toe slopes. Basswood was found in high-elevation coves, and red oak was associated with bench landforms at high elevations. At moderate elevations American chestnut and chestnut oak were associated with ridges, white pine and yellow pine occurred on benches, and an unknown species called spruce-pine was found on valley landforms.
