Art. 1, Sec. 3) Term Limits: No Residency Requirement: Individuals running for office must have been a citizen of the United States for nine years and, when elected, an inhabitant of that state in which he shall be chosen. (U.S. Const. Art. 1, Sec. 3) Age Requirement: 30 years of age (U.S. Const. Art. 1, Sec. 3) REPRESENTATIVES IN CONGRESS Term of Office: Two-year term (U.S. Const. Art. 1, Sec. 2) Term Limits: No Residency Requirement: Individuals running for office must have been a citizen of the United States for seven years, and when elected, an inhabitant of that state in which he shall be chosen. (U.S. Const. Art.1, Sec. 2) Age Requirement: 25 years of age. (U.S. Const. Art. 1, Sec. 2) 8 CONSTITUTIONAL REQUIREMENTS FOR STATE OFFICES The Nevada Constitution, Art. 15, Sec. 3, states that “No person shall be eligible to any office who is not a qualified elector under this constitution.” “Qualified Elector” means “All citizens of the United States (not laboring under the disabilities named in this constitution) of the age of eighteen years and upward, who shall have actually, and not constructively, resided in the state six months, and in the district or county 30 days next preceding any election, shall be entitled to vote for all officers that now or hereafter may be elected by the people, and upon all questions submitted to the electors at such election: provided that no person who has been or may be convicted of treason or felony in any state or territory of the United States, unless restored to civil rights, and no idiot or insane person shall be entitled to the privilege of an elector.” (Nevada Constitution Art. 2, Sec. 1) Attorney General’s Opinion No. 85, June 19, 1972, has held that the Nevada constitutional six months state residence requirement for entitlement to vote was preempted by the provisions of the fourteenth amendment of the U.S. Constitution. (Dunn v. Blumstein, 92 S.Ct. 995 (1972). A letter opinion of that office of September 22, 1972 states that “voting registration may legitimately be closed 30 days before an election in order that the registrar may investigate and process all registrations. This procedure has the practical effect of requiring a person to live in Nevada 30 days preceding an election.” The Nevada Legislature passed NRS 293.485 to conform to this opinion. As to the constitutionality of the age requirements for the various offices, the Nevada Supreme Court in Menglekemp v. List, 88 Nev. 542, 501 P2d 1032 (1972), upheld the 21 year age requirement for individuals running for the state assembly, as required by NRS 218.010, as being constitutional. Term Limits originated in 1994 through an initiative petition to amend the state constitution. It was identified as Question 9 approved by the voters in the 1994 general election. An Attorney General’s Opinion No. 96-23 states the term limits are not retroactive and therefore limits apply to those elected after Nov. 27, 1996. Respectively, the limits would start from the
