1. An AdministrativeReview Boardwill be convenedto reviewyour caseto determine if your continueddetentionisnecessary.

2. The Administrative Review Board will conduct a comprehensive review of all reasonably available and relevant information regarding your case. At the conclusion ofthis review the Board will make a recommendation to : ( ) release you to your home state; ( 2 ) transfer you to your home state , with conditions agreed upon by the and your home state; or ( 3) continue your detention under United States control.

3. The following primary factors favor continued detention:

a . Commitment

1. In September1995the detaineefoughtalongsideal Qaidaas a Talibanmilitary generalagainstthe NorthernAlliance. The detaineewas responsiblefor the linenearMurghab inthe vicinityofHerat, . 2. The detainee claimedhejoinedthe in 1999. Heworkedfor the governor of , Afghanistanuntil December 1999. In February2000 the detaineearrived inMazar- e Sharif, Afghanistan

3. The detainee began working the Taliban government as one ofeight assistants to the governor ofMazar- e - Sharif.

4. The detaineeeventuallybecamethe governorofBalkhProvince, Afghanistan, as he was one ofvery few tribalmemberswho couldreadandwrite. The detaineeheld this position forabouteightto tenmonths. Hereceivedthe titleofMullahdue to hiseducationandpolitical position

5. The detainee was fighting on the front lines at Mazar - e - Sharif as a Taliban fighter. As the front lines in Mazar- e -Shariffell he moved with a majority of the remaining fighters to Kunduz, Afghanistan to reestablish the front lines

6. While traveling from Mazar - e -Sharif to Zabol Province , Afghanistan , the detainee agreed to negotiate with Dostum's forces regarding the surrender of Taliban forces .

Thedetainee'sjob requiredhimto standguardduty, armedwitha Kalishnikov, at buildings. Hedeniedever receivingany trainingfor this position. Thedetaineestated that he neverlearnedhowto taketheweaponapart, but heknew howto use it.

Connections/Associations

1. Thedetaineewas identifiedas the Talibanleaderincharge ofMazarBal.

2. The detainee'snameappearson a list ofkeyTalibanpersonalities.

3. The detainee is a close associate of a high- rankingTaliban leader.

4. The detainee hosted al Qaida commanders.

5. The detainee held a meetingwith the head ofthe Islamic MovementofUzbekistan, who discussedjihad inUzbekistan.

6. Whileservingas the governorofBalkhProvincein Mazar- e -Sharifthe detaineemet a subordinateofUsamaBinLadento pass a messagefrom the Talibansupremeleader.

7. As oflate July 2003 Talibanleaderscloseto the detaineewereleadingeffortsinZabol Provinceto destabilizethe AfghanTransitionalAdministration.

8. As of early November 2003, while he was the Taliban Northern Zone Chief, the detainee provided assistance to a friend who was using profits from the sale of narcotics to provide material support to the Taliban and al Qaida . The detainee had given him money and provided himwith a money exchange shop.

1. The detainee was incharge of about150 combat troops and one helicopter.

2. A group of individuals, including a Taliban member, continue work supportthe detainee

4. Thefollowingprimaryfactors favor releaseortransfer:

a . The detainee does not consider himselfan enemy ofthe UnitedStates. Hehas never believedthat the UnitedStates is an enemy ofAfghanistan. Hereiteratedthat he never fought with orshota gun at anyone.

b . The detainee advisedthat he didnotknow much about Usama Bin Laden andhad only heard of him on the radio He has never seen Usama Bin Laden .

c. The detainee said that he is not against the United States in any way. Ifhe were allowed to return home, he would attempt to obtain a positioninthe new government with the hope of being able to provide for his family. The detainee would hold nothing against the United States andwould not give support to anyone who was against the United States.
