A By-law of THE CITY OF WINNIPEG to amend the City of Winnipeg Traffic By-law to restrict motor vehicles on Sunday/holiday bicycle routes in the City of Winnipeg

THE CITY OF WINNIPEG, in Council assembled, enacts as follows:

Traffic By-law amended 1 The City of Winnipeg Traffic By-law No. 1573/77 is amended by this By-law.

Definitions amended 2 Section 2(2) is amended by adding the following definition in alphabetical order:

“Sunday/holiday bicycle route” means the area marked as such on the maps which are attached as Schedule 15 to this By-law.

Section 17.1 added 3 The following section is added immediately after section 17:

SUNDAY BICYCLE ROUTES

17.1(1) In this section

(a) “block” subject to section 17.1(2), means a section of a street extending from one intersection to the next; and

(b) “intersection” means an intersection between two roadways that are not back lanes.

17.1(2) In this section, the section of street between Birchdale Avenue and Highfield Street constitutes one block.

17.1(3) Subject to subsection (4), no person may operate a motor vehicle on a Sunday/holiday bicycle route between the hours of 08:00 – 20:00 on

(a) the Sunday immediately preceding and every Sunday thereafter until Day; and

(b) Victoria Day, , Civic Holiday (the first Monday in ), and Thanksgiving Day.

17.1(4) Subsection (3) does not apply to:

(a) a person who operates a motor vehicle for a distance of not more than one block; (b) vehicles used by a police force, fire department or ambulance service; (c) Winnipeg Transit vehicles; (d) vehicles operated by The City of Winnipeg or an agent of The City of Winnipeg engaged in the collection of garbage or recycling; (e) vehicles owned or operated by The City of Winnipeg or its agents while engaged in the provision of services; (f) marked utility company vehicles engaged in the provision of services; and (g) vehicles authorized to use Sunday/holiday bicycle route pursuant to a valid Use of Streets Permit or Parade Permit issued by the City of Winnipeg.

17.1(5) A person who contravenes this section is guilty of an offence and upon summary conviction is subject to a fine of $90.22 plus court costs and surcharges imposed by law.

Schedule 15 added 4 Schedule A of this By-law (four pages) attached hereto is added as Schedule 15 to the City of Winnipeg Traffic By-law No. 1573/77.

Coming into force 5 This By-law comes into force on August 1, 2014.
