Toszek* THE INTERNATIONAL SUBJECTIVITY PROBLEM OF THE PRINCIPALITY OF SEALAND — ABSTRACT — Th e Principality of Sealand was founded on the abandoned military plat- form on the North Sea. Because of its location beyond the British territorial waters, it was not the point of interest of the British authorities. In 1960s and 1970s, the Principality have got its national emblems and constitution. Despite of this initial development, most of the citizens moved from the platform to mainland because of hard conditions of life. Th e most dange- rous threat for the Principality existence was the declaration of widening British territorial waters zone up to 12 NM (Nautical Miles), but no British troops or navy ship tried to disturb Sealand’s sovereignty. Despite ‘not disturbed’ status, the Principality is not the state in the meaning of the international law. It has not got its territory nor people, because offi cially the platform is the Ministry of Defence property and all of Sealand’s citizens live in the mainland now. Th e Principality has not been recognized by any state or international organization, so it has no possibilities to take part in international relations. From the legal point of view, the Principality is not only a state, but even quasi-state, however, it could be recognised in the future as a virtual micronation, although it is not a legal category. — KEYWORDS — international relations, international subjectivity, recognition of the state ‘Th e Principality of Sealand’, Th e United Kingdom * Uniwersytet Szczeciński, Instytut Politologii i Europeistyki. 102 ATHENAEUM vol. 45/2015 Polskie Studia Politologiczne W powszechnym mniemaniu pojęcie „państwa” stanowi oczywistą kategorię, która poprzez swoją obecność w codziennym życiu całego społeczeństwa może być z łatwością zdefi niowana przez każdego człowieka. Jednak w rzeczywisto- ści nieostre defi nicje potoczne nie odpowiadają różnorodności istniejących we współczesnym świecie form państwowych1, których określenie wymaga precyzji właściwej dla języka prawnego. Problem ten dotyczy w szczególności tych quasi-państw, które nie zostały uznane przez ogół lub część społeczności międzynarodowej i w konsekwencji nie nawiązały stosunków zagranicznych, natomiast spełniają inne kryteria uzasadniające ich traktowanie jako organizmów państwowych. Wśród podmiotów tego rodzaju największe zainteresowanie opinii publicznej2 skupia Księstwo Sealand, aspirujące do rangi suwerennego państwa od niemal 50 lat. Twórcą Księstwa Sealand był emerytowany major armii brytyjskiej Roy „Paddy” Bates, który w październiku 1965 roku założył piracką rozgłośnię radiową Radio Essex na opuszczonej platformie przeciwlotniczej HM Fort Knock John znajdującej się u ujścia Tamizy. Ponieważ za nadawanie programów radio- wych bez licencji na właściciela stacji została nałożona grzywna w wysokości 100 GBP, a wniosek o rejestrację Radio Essex został odrzucony, Bates zdecydował się przenieść swoją rozgłośnię na inną opuszczoną platformę przeciwlotniczą HM Fort Roughs3, usytuowaną na Morzu Północnym na szerokości geografi cznej 51°53’40”N i długości geografi cznej 1°28’57”E, tj. w odległości 7 mil morskich od wybrzeży Wielkiej Brytanii. W okresie działań wojennych na platformie przebywał oddział Royal Navy, liczący od 150 do 300 osób. Ich liczba stopniowo malała po zakończeniu II wojny światowej, a ostatni żołnierze zostali wycofani w 1956 r. Toszek : Problem podmiotowości prawnomiędzynarodowej 103 rialnych wynosiła wówczas 3 mile morskie, nie ulegało wątpliwości, że platforma zajęta przez Batesa znajduje się na wodach międzynarodowych, niepodlegających jurysdykcji brytyjskiej4. Pomimo tego Radio Essex musiało zostać ostatecznie zlikwidowane ze względu na regulacje brytyjskiej ustawy z dnia 14 sierpnia 1967 roku skierowanej przeciwko pirackim rozgłośniom radiowym (Marine Broadcasting Off ences Act 1967)5, która znajdowała zastosowanie do obywateli brytyjskich, bez względu na to, czy przebywali oni na terytorium Zjednoczonego Królestwa, czy poza nim. Chociaż Roy Bates został zmuszony do zaprzestania swojej dotychczasowej działalności, to jednak nie opuścił platformy HM Fort Roughs, lecz w dniu 2 września 1967 roku ogłosił ją suwerennym państwem pod nazwą Księstwa Sealand. Deklaracja nie wywołała początkowo żadnego oddźwięku ze strony władz brytyjskich, które nie widziały potrzeby zajmowania się ekscentrycznym dziwakiem roszczącym sobie pretensje do brudnej, rdze- wiejącej platformy na Morzu Północnym6 o powierzchni 560 m2 i otaczających ją wód morskich o powierzchni 4000 m2. Świadomość takiego stanu rzeczy miał także Bates, który w wywiadzie umieszczonym na stronie internetowej swojego quasi-państwa (Sealand News) stwierdził: „realizacja moich ambicji trwała bardzo długo […], a na początku nikt nie traktował mnie poważnie”7. Sytuacja uległa zmianie w maju 1968 roku, kiedy zarządzająca HM Fort Roughs korporacja Trinity House wysłała na platformę dwóch pracowników, którzy mieli przeprowadzić prace konserwatorskie. Nie zostali oni jednak wpuszczeni na platformę, a „książę” i jego 16-letni syn Michael zagrozili im użyciem broni w przypadku ponownego przybycia. W odpowiedzi, kiedy Roy Bates udał się na stały ląd, został aresztowany przez funkcjonariuszy policji za posiadanie broni palnej bez zezwolenia. Wprawdzie w wyroku z 1968 roku zostały jedynie określone przeszkody formalnoprawne uniemożli- wiające sądowi merytoryczne rozpatrzenie sprawy, jednakże Roy Bates uznał je za potwierdzenie swoich roszczeń wobec HM Fort Roughs, opierających się na obowiązującej w prawie międzynarodowym publicznym zasadzie res nullis credit primo occupanti9. Wyrazem tego przekonania było wezwanie jednostek Royal Navy, uczestniczących w ćwiczeniach prowadzonych u wybrzeży południowo- -wschodniej Anglii pod koniec 1968 roku, do niewpływania na obszar ogłoszony sealandzkimi wodami terytorialnymi w deklaracji z dnia 2 września 1967 roku: „W obronie suwerenności swojego państwa książę Roy nakazał okrętom mary- narki wojennej wycofanie się. Zostały oddane strzały ostrzegawcze”10. W latach siedemdziesiątych Księstwo Sealand zamieszkiwała 5-osobowa rodzina Batesów11 oraz „rozrastająca się stopniowo pionierska grupa […] osadników”12, w skład której wchodzili przede wszystkim hippisi, żądni przy- gód awanturnicy i bezrobotni, ale także kilku prawników i przedsiębiorców. Jednak trudne warunki bytowe utrzymujące się na HM Fort Roughs, pomimo składanych przez Batesa deklaracji o przekształceniu platformy

Part of the report is what was left after the March edition was totally filled and so let’s go with this edition in which first there’s space for a story I wrote last months after again doing some research: ‘Ronan O’Rahilly, Georgie Fame and the Blue Fames. Where it really went wrong!’ On this subject I’ve written before but let’s go back in time and also add some new facts to it: ‘Was Ronan O’Rahilly the manager of Georgie Fame?’ I can tell you there was a problem with an important instrument. When in April 1964 Granada Television came with an edition of the ‘World in action’ series, which was a production from Michael Hodges, they informed the television public about a new form of Piracy, the watery pirates. Two radio ships bringing music and entertainment under the names of Radio Caroline and Radio Atlanta. Radio Caroline was the first 20th century Pirate off the British coast with programs, at that stage, for 12 hours a day. Interviews with the Caroline people were made in the offices of Queen Magazine in the city of London and included – among others – Jocelyn Stevens and the then 23-year old Irish Ronan O’Rahilly. During this documentary it became known, which we would also read in several newspapers in the then following weeks, that Ronan O’Rahilly had started his radiostation Caroline as he couldn’t get his artists played on stations like Radio Luxembourg.

It has a higher degree of standardization and scalability than most earlier forms of networked information and communication technology. From social networking to retail, from financial transactions to e-mail and telephone, these and many other Metahaven services end up in the cloud. Surely, the internet already was a wholesale for all types of information and media formats. As Milton Captives of the Mueller notes, these “used to be delivered through separate technologies governed by Cloud: Part II separate legal and regulatory regimes,” while now having converged on the internet and its protocols.2 In the cloud, such “digital convergence” goes even further: data becomes more effectively and thoroughly harvested, analyzed, validated, monetized, looked into, and controlled than in the internet; its centralization is not just one of protocol, but also of location. The Form of the Cloud Many writers in recent decades have grappled with a seemingly borderless information society rooted in physical territories, and finding words for this condition has been key to most serious writing about information networks. For example, the term “space of flows” was coined in the 1990s by the Spanish sociologist Manuel n e Castells. Signed: ________________________________________ Jerome Devitt July 2018 ii Summary This thesis examines the Irish Executive’s reaction to the threat posed by transatlantic Fenianism from the closing phase of the US Civil War to the end of Fenian activity in the year following the Fenian Rising of February and March 1867. It argues that the Fenian conspiracy was the catalyst for a substantial development in the Executive’s ability to assert its control throughout the country in the name of maintaining state security. Its central argument is that the government’s adoption of a policy of deterrence, combined with the systematic reform of the composition and distribution of military and constabulary forces on the island, at first delayed and later helped to suppress the abortive rising that eventually emerged. Although the periodization is narrow, the four years in question set in motion a security policy that would influence the governance of Ireland throughout the remainder of the century. The Executive’s response, however, was influenced not only by the suppression of the Young Ireland rising in 1848, but was also guided by a wide range of transnational influences.

Source: www.sealandgov.com History of Sealand During World War II, the United Kingdom decided to establish a number of military bases, the purpose of which was to defend England against German air raids. These sea forts housed enough troops to man and maintain artillery designed to shoot down German aircraft and missiles. They were situated along the east coast of England on the edge of the English territorial waters. One of these bases, consisting of concrete and steel construction, was the famous royal fort Roughs Tower situated slightly north of the estuary region of the Thames River. In contrast to the original plan to locate the tower within the sovereign territory of England, this fortress was situated at a distance of approximately 7 nautical miles from the coast, which is more than double the then applicable 3-mile range of territorial waters; to put it briefly, this island was situated in the international waters of the North Sea.

    SEALAND, HAVENCO, AND THE RULE OF LAW James Grimmelmann* In 2000, a group of American entrepreneursmoved to a former World War I antiaircraftplatform in the North Sea, seven miles off the British coast. There, they launched HavenCo, one of the strangest start-ups in Internet history. A former pirate radio broadcaster,Roy Bates, had occupied the platform in the 1960s, moved his family aboard, and declared it to be the sovereign Principality of Sealand. HavenCo's founders were opposed to governmental censorship and control of the Internet; by putting computer servers on Sealand, they planned to create a "data haven" for unpopularspeech, safely beyond the reach of any other country. This Article tells the full story of Sealand and HavenCo-and examines what they have to tell us about the nature of the rule of law in the age of the Internet. The story itself is fascinating enough: it includes pirate radio, shotguns, rampant copyright infringement, a Red Bull skateboarding special,perpetual motion machines, and the Montevideo Convention on the Rights and Duties of State. But its implicationsfor the rule of law are even more remarkable. Previous scholars have seen HavenCo as a straightforwardchallenge to the rule of law: by threat- ening to undermine national authority, HavenCo was opposed to all law. As the fuller history shows, this story is too simplistic. HavenCo also depended on internationallaw to recognize and protect Sealand, and on Sealand law to protect it from Sealand itself. Where others have seen HavenCo'sfailure as the triumph of traditionalregulatory authoritiesover HavenCo, this Article argues that in a very real sense, Haven Co failed not from too much law but from too little.
