PROJECT INTRODUCTION

The Efficiency Improvement of 110kV Distribution Network Project is to construct

and reconstruct 22 substations and transmission lines at voltage level of 110kV in the

provinces: Ha Tinh, Nghe An, Thanh Hoa, Ha Nam, Son La, Bac Giang, Thai Binh, Thai

Nguyen, Quang Ning Tuyen Quang, Vinh Phu, Phu Tho, Lao Cai, Yen Bai, Lai Chau.

The Efficiency Improvement of 110kV Distribution Network Project in the northern

provinces which is managed by the Power Company No. 1 mainly aims at:

+ Improve effectiveness and quality of electricity supplying for living activities;

improve the spiritual and material life of the people living in the project areas.

+ Develop handicraft households

+ Speed up development of industry and services

+ Contribute part to the prosperity and stability of the socio-economic in the

CHAPTER II: MEASURES TO MINIMIZE LAND ACQUISITION AND LOSSES Since the T/Ls and substations were designed in such a way to avoid as much as possible houses, structures and trees that may be cut off within ROW areas. The T/Ls mainly traverse sparsely populated areas, there would be no losses of houses or structures. Alternatives were carefully considered and selected during survey and design stage. Even though number of households affected by permanently land acquisition is high, the impact on each PAH will be of no significance that accounts from 1% to 20% of each PAH's total land. Therefore, PAHs will not be influenced much in terrns of permanently land acquisition and therefore there's no significant impact on their income.

CHAPTER HII RESETTLEMENT POLICY AND ENTITLEMENT The overall objectives of RAP are guided both by Vietnam law and WB policy on involuntary resettlement.(O.D 4.30) The Vietnamese laws, decrees and regulations that have let the preparation of this RAP and warrant its legality are: The 1993 Land law of 7/14/1993 The Government Decree No 22/1998 CP-NN dated 22/4/1998 on the compensation for damage when State recover land for National defense, security, national interests and public interests. Circular No 145/1998 TT-BTC dated 11/4/1999 of Minister of Finance on implementation guidance of The Government Decree No 22/1998 CP-NN The Government Decree No 54/1999 ND-CP of 7/8/1999 on the protection of high voltage power network. The Governnent Decree No 64/1999 ND-CP of 9/27/1999 on the distribution agricultural land to the households in long term for the argicultural purpose. The Government Decree No 87/CP of 17/8/1995 on the stipulation of the frame for the price of land types. Circulation No 5 BXD/DT of 9/2/1993 on the classification of the house types.

Decision of the Provinces for the land recovers for the purposes of public interests. For compliance with O.D 4.30 of the WB, all PAPs included in the inventory list are entitled to compensation according to their losses. People eventually settling in the affected areas after the cut-off date will not be entitled to compensation. Also for compliance with WB OD 4.30, compensation rates will be provided at substitution cost for houses, buildings, and perennial trees, and at market rates for crops.

A part from compensation for land acwuisition and losses, PAHs would be provided allowances and subsidies as sipulated in the Government Degree No. 22/1998/CP dated 24/4/1998.

+ Resettlement Allowance:

- Each heads of the impacted family will receive an allowance amount of VND150.000 per head/month and receiving period will be in 6 months for living activity costs.

- PAHs having house relocated will be entitled to a relocation allowance of VND200,000VND/HH

+ Income restoration

- The PAHs whose business or production are postponed or affected by land acquisition or house removal are entitled to a fixed subsidy for business or trade activities to be used for re-development of their business. The amount is supposed to be VND3,000,000/HH, which is equivalent to their enumerated income amount per month.

+ Special subsidy for veterans

As stipulated in the law of Vietnam, the household of veteran, heroes are entitled to a special subsidy form 2 to 3 million VND. For the Efficiency Improvement of 110kV Distribution Network Project, the subsidy amount is 3.000.000VND/HH.

As the scope of the project in each province is inconsiderable, each component can be completed in about 3 or 6 months. Thus the impact of ltemporary acquisition land will be on one crop time. CHAPTER V RESETTLEMENT SITES In order to minimize number of houses or structure affected by the project, the evaluation of alternative routes and substation sites have been considered in the survey and design stage. The optimal line routes were selected in order to avoid population areas and minimize land acquisition and losses. The impact on land acquisition causing resettlement is in a very small scale and there's no PAH that has to be relocated. The PA-Hs has houses/land which are partially impacted by the project would be resettled in adjacent areas.

CHAPTER VI INSTITUTIONAL ARRANGEMENT The local authority takes responsibility for compensation clearance and resettlement and ensures that the plan should be implemented in accordance with the approved plan progress. Co-ordination schemes between investors and local authority will be established and carried out to ensure that those being influenced by the project are paid attention to, and important issues are not delayed. CHAPTER VII RAP IMPLEMENTATION ARRANGEMENT

All PAPs have right to be informed of entitlement policy, modes and rates of compensation, complaint and grievances rights, to take part in land acquisition process... Resettlement information booklet (RIB) will be prepared and delivered to the PAP by the PMB, or announced on TV, radio, newspaper, posters in the public which such as DPCs, schools...

Inform widely to PAP as soon as the Government and the WB approve the project. The RIB contains the bellowing:

1/ The projects' objectives and scopes

2/ The projects' compensation and resettlement policies; Eligibility and ineligibility rights to be compensated.

3/ The principle that only households owning, leasing affected land at the time prior the inventory or formal publishing of land acquisition

The compensation must be paid in one time before construction constract signing. The allowances will be delivered to PAP within the first 5 days of each month the period of allowance payment.

CHAPTER VIII: COST AND BUDGET

Preparation costs include costs already made for and demarcation, spotting and detailed measurement survey (DMS). They include also the costs of training for various resettlement boards (DRBs, PRBs); payments (salaries, per diem) for resettlement boards, payment to conduct necessary survey, and payment to conduct monitoring.

Contingency amount accounts for 10% of the total implementation costs.

All costs have been prepared based on decree 22/1 998/CP-NN on 24/4/1998 and official dispatch No. 4268/CV-KHDt on 4/12/1998 of the Ministry of Industry regarding stipulation of cost frame for site clearance implementation for T/Ls and substation contruction.

CHAPTER IX PARTICIPATION AND CONSULTATION 1. Objectives of information campaign and consultation program

Information dissemination to, consultation with and participation of the affected people and involved agencies reduce the potential for conflicts, minimize the risk of project delays, and enable the project to design the resettlement and rehabilitation program as a comprehensive development program to fit he needs and properties of the affected people, thereby maximizing the economic and social benefits of the project investment.

The objectives of the public Information Campaign and PAH Consultation Program are as follows:

- To share fully information about the proposed project, its components and its activities, with affected people

- To obtain information about the needs and priorities of the effected people, as well as information about their reactions to proposed policies and activities.

- To obtain the cooperation and participation of the affected people and communities required to be undertaken for resettlement planing and implementation.

- To ensure transparency in all activities related to land acquisition, resettlement and rehabilitation.

CHAPTER X GRIEVANCE REDRESS Since the entire resettlement and rehabilitation program is being carries out with the participation of the PAHs and the impacted scale of this project will be relatively small, it is expected that no grievance issue will be raised. However, to ensure that the PAHs have avenues for redressing their grievances related to any aspect of compensation and resettlement, detail procedures of redresses of grievances have been established for the project. The objective is to respond to the complaints of the PAHs speedily and in a transparent manner. The mechanism is design to be easy, transparent and fair. CHAPTER XI MONITORING AND SUPERVISION The implementation of RAP shall be constantly supervised and monitored by the PNPMB in co-ordination with local People's Committees An independent consulting agency will be entrusted with external monitoring tasks. The selection of this agency will be submitted for approval of PNPMB and WB. The candidates suggested to be chosen are: 1. Independent with the Investor 2. Experienced in reparation of compensation and resettlement plan especially for WB projects 3. Sufficiently having professional experts and staff to carry out independent monitoring work

ANNEX: INDIGENOUS PEOPLE DEVELOPMENT PLAN

The Indigenous People Development Plan is part of the RAP and was prepared for the Efficiency improvement of 110kV-distribution project in northern region.

The plan mainly aims at providing information on ethnic group in the project areas and pointing out suitable development plan in compliance with WB policy OD 4.20, ensuring the following:

- Respect characteristics of customs, habits and cultural tradition of the ethnic group.

- Avoid negative impacts on ethnic group during development progress and

- Ethnic group will be entitled to socio-economic interests suitable to their cultural tradition.

Information of the ethnic group was collected during investigation period and in socio- economic surveys.

Vietnam Law: Equality right of ethnic people was stipulated clearly in the Vietnam Law. Article 5 in the Vietnam Constitution (1992) stipulated as follows:

The Socialist Republic of Vietnam is an united nation having many nationalities in Vietnam. The State implements an equality and united policy and supports spiritually all nationalities andprohibits race discrimination and separation. Each nationality has the right to use its own language and characters to preserve their characteristicsand to improve its own good traditionaland cultural customs. The State carries out a policy to develop thoroughly and gradually improve the quality of life of ethnic minorities in Vietnam physically and spiritually.

Since 1968, the Govermnent has promulgated resettlement policy for ethnic groups, reducing

One of the most important policies on relation with ethnic groups is the Govemment Guidance No.525/TTG on 2/11/1993 regarding in detail on implementation guiding of development in high land areas and ethnic areas with the main following points:

* Develop infrastructure especially transportation road system and fresh warter supplying

* Step by step overcome the lack of food

* Consolidate of education system; adjust education program basing on characteristics of provinces; create favour conditions and support the inregular education program and develop internal economic force.

The entire ethnic household will be entitled according to resettlement and compensation policy. Besides, ethnic HH would be subsided as stipulated in the special subsidy program:

Though the impacts on ethnic minorities are minor, they are very sensitive. Beside general impact mitigation measures, special resettlement provision for the ethnic minorities, thus, will be applied as follows:

To ensure rights of the ethnic PAHs, they can have:

- PAHs representatives from ethnic minorities will be on the local resettlement boards

- The provisions of plummets will be explained to them in specially arranged meeting in each affected commune. Plummets on RAP will be translated in to their language and posted in public areas. - EM PAHs surrounding substation and line routes shall be disseminated about safety measures during operation period. Methods to be applied: pamphlets, panel, posters.. in provinces that have EM PAHs such as Lao Cai, Son La, Lai Chau, Yen Bai ...

CHAPTER I PROJECT INTRODUCTION

1. Project objectives

The Efficiency improvement of 1 10kV-distribution network project is to construct and reconstruct of total 22 substations and transmission lines at voltage level of 110kV in provinces: Ha Tinh, Nghe An, Thanh Hoa, Ha Nam, Son La, Bac Giang, Thai Binh, Thai Nguyen, Quang Ninh, Tuyen Quang, Vinh Phuc, Phu Tho, Lao Cai, Yen Bai, Lai Chau. Currently, the existing networks are mainly 110kV, 35kV and 10kV. As electricity losses are high and supplying quality is low, it is necessary to upgrade and develop the existing networks to satisfy increasing load demands in the provinces. Current data shows that there's seriously lack of electrictcity especially in dry season consulting improvement of power capacity in the region. In additional, number of households connected to network in the north region is very small. With the loan from WB, the Rural energy project is under implementation in order to supply electricity to 350 communes of northern provinces. This will much improve spiritual and material life of people living in the mountainous areas of North Vietnam. Besides, the Electricity of Vietnam has been carrying out many other power projects from its capital annually.

The Efficiency improvement of 11OkV distribution network project will satisfy the requirement of power network development in the project's areas, meeting immediate requirements and future electricity demand, increasing electricity supply and sharing electricity availability with existing substations which were currently over loaded. In respect to the project in the north rural areas of Vietnam, there are difficulties in minotity developing infrastructure as well as economic due to mountain topography, low population density with poor ethnic people. The 110kV substations and T/Ls project therefore will constribute part in the socio-economic development in the region. 1.1/ OkV Can Loc substation and 110 kV TIL

The T/L is emitted from pole No. 152A (between 2 poles: No. 152 and No. 153 of 110 kV Hung Dong - Thach Linh T/L) to north-east, traversed the rice field of Thien Loc village and Nghen town to 110 kV Can loc Substation with 600m length. 110 kV Can loc substation is supposed to be built near 35/10 kV Nghen substation, 135m far from highway No. 1A. Currently, there is much fallow (wasteland) in Nghen town- Can Loc district. This position has some advantages as follows: * The North: next to the 35/10 kV Nghen substation * The southern: located on part of one-season rice field of households including fields number: 108, 109, 110, 111, 112, 122, 123. * The East: next to the fences of households' crop fields * The West: next to the fallow of a small provincial factory.

1.2/110 kVDo Luong -Tuone Duonz T/L and 11OkV Tuone Duong Substation - Extend 110 kV feeder of Do Luong substation cross following districts: Do Luong, Con Cuong, Tuong Duong - Nghe An Province. - With the length of 113Km, the T/Ls traverse districts in west west-north areas of Nghe an province. The line is started at llOkV Do Luong substation and ended at llOkV Tuong Duong substation. - I 1OkV Tuong Duong Substation area is covered by 3800 m2. The substation is located in rice-field of Thac Giam village - Tuong Duong district

1.3/110 kV Cua Lo - Dien Chau - Quynh Luu T/L and I IOkV Dien Chau Substation

- With the length of 52,8Km, 110 kV Cua Lo - Dien Chau - Quynh Luu T/L traverses 4 districts: Nghi Loc, Dien Chau, Quynh Luu and Yen Thanh. The line mainly run along west of National Road No. IA and south-north railway, through alluvial flat of Dien Chau and part of hill land in Nghi Loc district. - Dien Chau 1 OkV substation is located in Page Than village, Dien Phuc commune- Dien Chau province near existing 35/10kV substation. This position is on the west of Nation road No. IA, north of National road No.7 and next to Dien Chau town. The substation is covered by 2728 m2.

1.4/110kV Tinh Gia substation and 110 kV T/Ls

- 220 kV Tinh Gia branch starts at Nghi Son substation of Truong Lam village, traverses Mai Lam village - Tinh Gia district with the length of 6,5 Km. - The 110 kV Tinh Gia substation supposed to be built next to Chuot Tru Mountain - Tinh Hai village - Tinh Gia districts. It is located on the right of provincial way No. 513 to Nghi Son cement factory. The substation is covered about 3059 m2.

1.5/liOkVThieu Yen-Ba Thuoc T/Ls and llOkVBa Thuoc Substation

- 110 kV Thieu Yen - Ba Thuoc T/L traverse through districts: Yen Dinh, Tho Xuan, Ngoc Lac, Lang Chanh, Ba Thuoc - Thanh Hoa Province. - With the length of 60,4 kin, the line route starts at 110kV Thieu Yen substation and ends at 110kV Ba Thuoc substation. - Covering 4200 m2, the 110kV Ba Thuoc Substation is located in Thiet Ong village - Ba Thuoc district - Thanh Hoa Province.

1.6/110 kV Ly Nhan - Donj Van T/Ls and I I OkVDong Van Substation

- 110 kV Ly Nhan - Dong Van T/L traverses districts: Ly Nhan, Duy Tien - Ha Nam Province. - 110kV Ly Nhan substation starts at gate-tower and ends at gate-tower of 110kV Dong Van substation with length of 18,5 km. - Located in the area belong to Dong Van town, 110kV Dong Van Substation is 90m far from highway No.38 and covering 3800m2.

1.7/ 1 1 0 kVBac Giang - Luc Ngan T/Ls and ll OkV Luc Njan Substation

- 110 kV Luc Ngan- Bac Giang T/Ls traverses districts: Lang Giang, Luc Nam, Luc Ngan - Bac Giang Province. With length of 46,21 km the TIL starts at section J1O 220/110 kV Bac Giang substation and ends at 110 kV bas bar of 110/35 kV Luc Ngan substation. - Covering 4572 m2, 110kV Luc Ngan Substation is supposed to be built in the rice field of Hong Quang village - Luc Ngan district - Bac Giang Province.

1.8/110 kV T/Ls and lOkVNorth Viet Tri Substation

- Traversing agricultural land of Phu Tho Province with length of 0,3 km, the 110kV TL to North Viet Tri substation starts from 110kV Van Phu T/L and ends at 110kV North Viet Tri substation. - Covering 5875 m2, the substation is located on a hill next to fence of Thuy Van industrial zone, about 100m far from 35 kV T/L of the industrial zone. The substation also is located near 110kV T/L, 220kV Viet tri substation.

1.9/ llOkVPhu Tho Substation and branch

- With length of 7485m including two circuits, 110 kV branch to Phu Tho Substation traverses Phu Ninh district-Phu Tho province. - The start-point is the first pole of 110kV Phu Tho substation and end-point is a tension N24-2 that is connected to 110kV Thac Ba - Van Phu substation, next to pole N213. - Covering 6482 m2 , 110kV Phu Tho Substation is located on a hill belongs to Van Lung commune, about 3KKm far from Phu Tho town, near 1 lA provincial road.

- With length of 13,5 Km, 110 kV Viet Tri - Lap Thach T/Ls traverse 2 provinces: Vinh Phuc and Phu Tho. When traversing Phu Tho province the T/L run along route out of Viet Tri city. Within Phu Tho province the T/L traverses Lap Thach district only. A portion of T/Ls shall traverse Lo River of about 700 m. + Start point: 1 OkV Bas bar of 220 kV Viet Tri substation + End Point: 1lOkV Lap Thach substation - 1 lOkV Lap Thach substation belongs to Phu Long commune, Lap Thach town. The substation covers area of 4305 m2 that currently belongs to People Committee of Lap Thach town.

- 1 1OkV branch including 2 circuits is connected from 1 1OkV Viet Tri - Dong Anh T/L at pole 179 - 180 through first pole of IOkV Vinh Tuong substation.With length of about 1,4 km,the T/L traverses field of two-season rice field and one - season crops in Tho Tang and Tan Tien villages - Vinh Tuong district - Vinh Phuc Province. - 110 kV Vinh Tuong substation is located in a rice field of Tho Tang - Vinh Tuong - Vinh Phuc Province, near interprovincial road No 304, and about 1,5 km far from highway No2.

- 110 kV Thai Binh (Dong Hung) - Vu Thu T/L and Vu Thu substation traverses districts: Vu Thu, Dong Hung - Thai Binh Province. With length of 15,21 km, the T/L starts at pooc-tich 110 kV Thai Binh substation and ends at 110 kV Vu Thu substation. - Covering 3280 m2, 1 lOkV Luc Ngan Substation is supposed to be built in the rice field of Minh Quang village Vu Thu district - Thai Binh Province.

3. Proposed impact areas of the project and land acquisition 3.1 PermanentlyImpacts:

The safety ROW is determined by 2 parallel flats, which has 4m wide calculated from side phase to the right and left sides of the phase without win. Within ROW rice, crop and fruit tree could be planted but the safety distance shall be warranted (safety distance is calculated at least 3m height from top of the tree to nearest T/L).

Houses, schools, health cares agencies and other structures shall not be built in side 110kV ROW. Unless other wise the structures in side the MV ROW should be satisfied the following:

- Vertical distance from conductor in static condition to any part of the structure must be at least 4m

- Electrict and construction safety measurements of houses or structures must be strengthened in case traversed by T/Ls.

Height of trees to be planted must be at least 3m lower than conductor positions in static's condition. Trees over 4m high in 110kV ROW shall be cut out. However it is encouraged to plant subsidiary crop which is under 4m high in the ROW. Land acquisition permanently for construction is including impacted areas surrounding tower foundation and substation. A 110kV-tower foundation - supporting concrete tower is making up 10m2, foundation of strain tower is 100m2, foundation for tower crossing over river is 200m 2 and substation is from 3200 to 4000m2.

3.2 Land temporary acquisitionfor construction is including:

Surrounding areas of tower foundation which are temporarily damaged by the project during the construction period due to temporarily access.

Temporarily affected areas during conductor's stringing period is including areas along ROW 2m wide calculated from ROW center to both two side of the ROW respectively (total 4m wide). Impact to transportation roads; drain water systems, which were built by provinces during construction period and equipment transiting period.

Even number of permanently land acquisition is high and covering provinces, number of land acquisition of each household is small. Losses of houses, structures and properties therefore will be insignificant and PAHs are compensated in cash one time at substitution cost for acquisition land and resettled in adjacent area.

CHAPTER II MEASURES TO MINIMIZE LAND ACQUISITION AND LOSSES

1. Efforts made during the design stage to minimize the land acquisition and losses Since the T/Ls and substations were designed in such a way to avoid houses and structures and the MV lines mainly traverse sparsely populated areas, there would be no losses of houses or structures. Alternatives were carefully considered and selected during survey and design stage. Even though number of households affected by permanently land acquisition is high, the impact on each PAH will be of no significance that accounts from 1% to 20% of each PAH's total land. Therefore, PAHs will not be influenced much in terms of permanently land acquisition and resulting no significant impact on their income. As the scope of the project in each province is inconsiderable, each component can be completed in 3 or 6 months. Thus the impact will be on one crop time. Consider commencement right after harvest of annual crops, if possible, to minimize the project impacts. These impacts will be solved after construction period. However, trees that may grow over high limit within ROW area must be cut down to ensure safety requirements. Only other types of crop such as soy-bean trees, rice, maize... could be planted in the ROW areas as they would not grown higher than limit. Therefore traversing forest by T/Ls was minimized during design stage in order to avoid number of trees cutting in the areas. This impact will not be much considered.

2. Mitigation measures The following route selection criteria are used to avoid environmentally sensitive areas as: dense forests and high-tree areas; residential structures and settlements, holy places, archeological and government sites; mangrove forest, national parks and other conservation areas; telephone and telegraph cables. - The T/Ls are designed mainly go along inter-village roads with many turning angles to avoid houses and other structures - To avoid long construction period and impact on agricultural production, it is necessary to have good preparation manpower, material as well as equipement and try to construct

complete line sections to minimize temporary requisition of land. Public consultation is also required during selection period of line routes and substations' location. Arrange construction time right after harvest of annual crops and terminated before next showing crop, if possible, to minimize the project impacts. Temporary access roads to be used while constructing not required for ongoing operations would be promptly revegetated. Thanks to the mitigation measures applied, agricultural production and living activities of people living in the project areas will not be much affected.

CHAPTER III RESETTLEMENT POLICY AND ENTITLEMENT

1. Legal framework The overall objectives of RAP are guided both by Vietnam law and WB policy on involuntary resettlement.(O.D 4.30) The Vietnamese laws, decrees and regulations that have let the preparation of this RAP and warrant its legality are: The 1993 Land law of 7/14/1993 The Government Decree No 22/1998 CP-NN on the compensation for damage when State recover land for National defense, security, national interests and public interests. Circular No 145/1998 TT-BTC of 11/4/1999 of Minister of Finance The Government Decree No 54/1999 ND-CP of 7/8/1999 on the protection of high voltage power network. The Government Decree No 64/1999 ND-CP of 9/27/1999 on the distribution agricultural land to the households in long term. The Government Decree No 87/1999 ND-CP of 17/8/1999 on the stipulation of the frame for the price of land types. Circulation No 5 BXD/DT of 2/9/1993 on the classification of the house types. Decision of the Provinces for the unit prices of compensation. Decision of the Provinces for the land recovers for the purposes of public interests. For compliance with O.D 4.30 of the WB, all PAPs included in the inventory list are entitled to compensation according to their losses. People eventually settling in the affected areas after the cut-off date will not be entitled to compensation. Also for compliance with WB OD 4.30, compensation rates will be provided at substitution cost for houses, buildings, and perennial trees, and at market rates for crops.

2. Definition of Eligibility and Limitation to Elibility. Definition of the Project Affected Person and Project Affected Household:

Project affected persons (PAP) and Project Affected Household (PAH) are all the individual, households, firms or institutions which have or have not legal title, own, rent oI use land, properties or jobs which are affected by project. It is identified clearly as following: - All the PAPs owed land and properties on it, leasing house or land which will be acqured for the tower foundation, the substation areas, the permenent roads, access ronds, for construction and maintenance of the project or withhin ROW which need to be removed, demolished or cut. - All PAPs have properties on their land before the declaration officialy by the govemement and authoritites about affected areas and acquired land by the project. - Encroachers who settled in to proposed affected Area after cut-off date will have no entitlement of compensation and resettlement. They will be required to demolish their structures and cut out the trees or harvest their crops for and clearance to the project. In the case necessary, they will be forced to remove out the proposed project area. Nevertheless, they do not have to pay any fine or sanction. - The cut-off date has been fixed as the day of inventory completion (supposed around October 2002). The cut-off date will be declared officially by the competent local authorities.

3. Compensation and resettlement principles Principles and objectives of this RAP are defined in accordance with Vietnamese laws and Operational Directive 4.30 of WB. Vietnamese legislation and WB directives have been adapted to fit the specific conditions of the project as defined below: 3.1 - Resettlement and compensation programs must be designed so as to allow the improvement or at lease the maintenance of the PAP's pre-project living standards. 3.2 - Both resettlement and land acquisition must be minimized as much as possible. 3.3 - Resettlement distant must be minimized if the agricultural replacement land needs to be given, it should be as close as possible to the land that was lost. 3.4 - Cash compensation for houses/or structures shall be given at the substitution costs free from depreciation cost of salvage of the old construction materials, while cash compensation for land and crops/trees shall be given at the market-price rates.

3.5 - Resettlement transition period must be minimized and the compensation should be provided to PAP's before the beginning the construction activities affecting them, no land clearance if the full compensation have not been done. 3.6 - All PAP's residing/or cultivating land within the project area before the cut-off date are entitled to have compensation for their losses and to income rehabilitation. 3.7 - Reasttlement and land acquisition plans and all the replacement alternatives should be carried out following consultation with the affected population and it should have popular acceptant of PAP's. The plans are also required to be approved by local Authorities. 3.8 - Resettlement and compensation programs must provide adequate institutional arrangements to warrant effective and timely implementation and proper monitoring. 3.9 - Financial and technical resources for the resettlement, land compensation and subsidies should have be available when and where required. 3.10 - The previous level of community services and resources should be maintained or improved in the new sites. 3.11 - Once approved by the Government of Vietnam what stipulated in this RAP will be enforceble as an official legal document.

4. Eligibility to compensation Entitlement

According to the Decree No. 22/CP and OD 4.30 of the WB, legitimate PAPs are all the affected householfds and institution in the inventory with or without ligal title included in the RAP inventory or able to demonstrate with other means that prior to RAPcut-off date they owned, rented or used land, and properties associated with land.

In addition, legitimate PAP's are also all households and institution who prio occupation and/or business and related income are affected by the project due to acquisition of land and other assets, temporarily or permnanently.

5. Compensation Policy

Compensation for land and crops will be provided at the market prices. Compensation for houses, buildings, trees and other assets will be provided at the substitution cost.

Compensation for land losses less than 25% of total land which a PAP and all other losses will be provided in cash. Compensation for land losses greater than 25% of total land a PAP has will be provided in terms of land at the equivalent area and quality of the lad acquired by the project.

Compensation prices have been defined according to tariff established by the provinces and base on the Decree 87-CP and the Circular 145 of the Ministry of Finance. Since such prices may not correspond to market or substitution rates they have been adjusted as possible with available information as to correspod to these rates. All prices will be checked again and if necessary adjusted one more time as of the Detailed Measurement Survey (DMS) to be carried out before project implementation.

Standing validity of entitlement and compensation policy: After project approval the above entitlement and compensation will acquire legal status and will be sanctioned as such following GOV approval.

Compensation for crops will be given in cash at the current market rates calculated on the productive average of the last three years.

Compensation for houses, buildings and trees will be provided in cash at the substitution cost rates.

6. Impact Catergories and Entitlement Policy

By the nature of the project as dcried above and based on the survey of the PAPs, the impacted categories could be classified as below:

Temporary impact: All the PAP has the lands, tree and crops or structure in ROW of transmission line (T/L), surrounding areas of tower foundations, in the temporary service roads which are temporary affected only during the construction period.

Permanent impact: All the PAP owed land and properties on it, which will be permanently acqured for the tower foundation, the substation areas, the permenent roads, for construction and maintenance of the project. All PAPs have houses (fully or partially of houses) or structures, trees over 4m in ROW which need to be removed, demolished or cut.

Entitlement and Compensation Policies are determined as below:

a. Compensationpolicy:

Affected households have land and properties on it in ROW areas

1. PAHs that have residental, agricultural land or trees, crops in ROW areas

There's no compensation for lands in ROW areas as they are damaged temporarily by the project during the construction period due to temporary access or conductors' stringing.

Compensation for crops in ROW ares will be given in cash at the current market rates calculated on the productive average of the last three years. The areas to be compensated will be affected areas within ROW. Long-standing trees, rough timber ... will be compensated at substitution cost basing on number of trees, type of trees (diameter of the tree, tree age...). However only trees over 4m high would be cut off. Households could use trees after cutting and grow other type trees or crops that would not grow over permitted height.

2. PAHs have residental land or garden in ROW areas

+ Land with no houses or structures on it

There's no compensation as all impacts are temporary in construction and stringing periods only. The PAHs can still use land within ROW areas. Compensation price will be calculated basing on substitution price for trees to be cut down or affected during construction and stringing periods. The compensation also depends on number, type, and age of affected trees.

+ House will be fully compensated at substitution price if the damaged part <25% of the total affected house including preparation/reconstruction costs (including demosishing costs of the walls to be demolished).

+ Houses or structures affected within safety areas.

Residental land or garden out of the safety areas that not engough for reconstruction partly or totally of the afftected house as large as it used to be, PAHs can chose the following alternatives:

* Compensate full in cash for residental or garden, trees at market price. Compensate in cash at substitution costs for house areas or structures. PAHs will arrange themselves land and rebuild house in other areas, give back land to the commune.

* Compensate land of equal dimensions as the lost one with the same quality for affected residental land, gardens. Houses, structures, fruit and industrial trees will be compylsated in cash at substitution price. PAHs must arrange themselves materials for rebuild their house in compensated land areas. PAHs could use give back land to comnmune but material and the PAHs would use scrap from house demolishing.

* If the PAHs agreed to rebuild house smaller than the damaged one in residental land or garden out of the safety ROW, they will be compensated at substitution price for all of the affected house eventhough it was partly damaged. There's no compensation for land within safety ROW as PAHs could still use. However all safety regulations on electricticity must be satisfied. Trees would be compensated at substitution price basing on type, age, and number of affected trees.

There's number of households have land and properties affected permanently but the damaged areas of each house holds are small. Land and crops will be compensated in cash at market price; structures at substitution price; trees at substitution price basing on type, age and number of affected trees. The areas that temporaryly affected during construction period will be returned to the PAHs after cleaning up.

PAHs that have land affted without legal title will be arranged to complete all procedures for land certification during comensation period or as soon as possible by the local authorities.

b. Subsidy policy and allowance:

Beside the direct compensation for the losses, PAHs will be entitled to several subsidies and allowances. These subsidies and allowances follow the Decree 22/1998 ND-CP dated on 24/4/1998 and Circular No. 145 guidelining implementation of Degree No. 22 of the Government as following:

+ Resettlement Allowance:

- Each heads of the impacted family (have to be relocated) will receive an allowance amount of VND 150.000 per head-month and receiving period will be in 6 months.

- PAHs having house relocated will be entitled to a relocation allowance of VND200,000VND/HH

+ Income restoration

- The PAHs whose business or production are postponed or affected by land acquisition or house removal are entitled to a fixed subsidy for business or trade activities to be used for re- development of their business. The amount is supposed to be VND3,000,000/HH, which is equivalent to their enumerated income amount per month.

+ Special subsidy for veterans

As stipulated in the law of Vietnam, the household of veteran, heroes are entitled to a special subsidy form 2 to 3 million VND. For the Efficiency Improvement of 11 OkV Districbution Project this subsidy amount is 3.000.000VND

1. Socioeconomic surveys

This section aim at providing basis data on the localities traversed by the T/L. These data are based on survey on PAPs having land in ROW. The survey information is on income sources, income, socio-economic situation; impact of resettlement on living standard and income. A lot of information was obtained, yet not all questions had answers. Some households could not point out the concrete income source and their revenue. However with 20% of PAHs included in the survey, socio-economic survey on PAHs also aims at identifying characteristics of effected areas, assessing the development of population, houses, socio-economic, average income, health care, education... Survey data used for making resettlement policy and bases for evaluating restoration of living standards later.

1.1 Population

The project areas are mainly northern mountainous provinces of Vietnam that are sparsely inhabited with average population density of 132 people/Km 2.

Household characteristics:

- The average number of persons per household is 5.47, a bit higher than that of the whole country (4.97). Large households usually comprise of 3 or 4 generations.

- Most households (90%) are headed by men, female heads of households are mostly widows (35,3%)

- Young people (from 0 to 17 years old) present 51.36%

- The productive age group (from 18 to 54 years old) accounts for 43.5 1%

- Old people (over 55 years old) take 5.13%

1.2 Education

Most of household heads are literate. Only 11.83% of males and 22.54% of females have no recorded level education. However, the percentage of high diploma is rather low, most diplomas are primary level (48.66%) or secondary level (25.14%). Few people recorded vocational or university level. All districts and communes covered by the projects have primary and secondary school systems; 100% of the districts and communes have at least 1 or 2 primary or secondary schools.

1.3 Health cares systems

Hospitals and health services system had and have been built in all the districts and communes for community health care purpose. However they are currently suffering out of date material facilities conditions or seriously lack of equipment.

1.4 Housing condition:

According to Circular 05-BXD/DT dated 9/2/1993 regarding house classification, houses arc divided in to 4 classes as below:

- Ist class house

- 2d class house

2 class house

- 4t class house

Houses or buildings of 1st and 2nd classes are permanent structures with modem facilities & interior decorations, private toilets & bathroom, separate living rooms & bedrooms. This types of buildings is usually located in big cities or centers, there is no such building in the ROW.

Buildings of 3rd class are permanent structures with brick wall, reinforced concrete roof, brick floor, conventional facilities & interior decorations (about 30%)

Buildings of 4 th class are semi-permanent structures with brick or wooden wall in the rural, tile roof zinc-galvanized iron sheet, brick or cement floor and usually without toilets (about 55%)

Beside the above mentioned classes, in the rural areas of Vietnam there are a lot of

nonstandard houses such as 4 th class houses with soil wall, thatched roof & soil floor accounts for 15%

Additionally, there are huts with thatched roof surrounded by bamboos only. These structures are usually used as auxiliary structures, by-road hutches, animal stables, etc.

Most households have large arable plots. About 75% of households have garden areas of over 2000m2. House are ususlly constructed in this area therefore sometimes it is difficult to identify ersidental & arable area. A part form garden land, PAHs also have 2000m2 - 5000m2 agricultural land or more for cultivation. Cultivation in this area is mainly on rice, maize, industrical crops such as tea, coffee, rubber, cinnamon trees, etc.

1.5 Amenities

PAHs' modem facilities of are not much. 19.20% PAHs have motorbikes, 35.08% PAHs have TV sets, 64.03% PAHs have bicycles, 40.52% have radio sets.

Stream water - the most common source accounts for 91.05% of the total PAHs, watercourse, river and stream for 8.95%, while there no household uses pumped water.

Most of PAHs in the project areas connected to power network.(about 75.41%). 20% of the total PAMs are using power sources from small hydropower generators, batteries and diesel generators. The rest is still not connected to network (4.95%)

1.6 Income

Source of income: PAHs main source of income is from agriculture (62.69%) followed breeding (19.88%), small scale trade activities (9.98%) and other sources from rice, crops... (7.55%). However about 14.8% of the PAHs have several sources of income that are nearly equal to each other. It is very difficult to specify PAH exact income as PAHs themselves can not point out their income exactly. PAHs income changes frequently when the price of agricultural products.

The average monthly income of PAHs is 634.OOOVND/HH. Some PAHs earn over 1.000.OOOVND/month. Meanwhile many PAHs earn less than 300.OOOVND/month.

2. Impact on land acquisition

- During conductor stringing period As the scope of the project in each province is inconsiderable, each component can be completed in 3 or 6 months. Thus the impact will be on one crop time. Consider

Chapter V Resettlement sites Since the T/Ls and substations were designed in such a way to avoid as much as possible houses and structures and the I lOkV lines mainly traverse sparsely populated areas, number of impacted houses/structures of the project is small and damaged or loss house/structure or land of each household is insignificant. Resettlement of the project therefore would not be necessary. There's no HH has to relocate as they would be resettled in adjacence areas. Total HHs have house impacted: 830HHs Including: - PAHs type 3: 600HHs

- PAHs type 4: 61HHs

- PAHs type 5: 169HHs

- PAHs type 6a: 769HHs

- PAHs type 6b: OHHs 661 PAHs have partly damaged house/structure with damaged portion <25% of total and they will be compensated in cash and must arrange themselves to rebuild house in the remaining areas. 169 PAHs have partly or totally damaged house/structure in the 15 provinces will be compensated all in cash and must self arrange to rebuild house in new areas as they agreed during public consultation period. 796 PAHs have permanently land acquisition for tower foundations, substations less than 25% and agree to resettle in adjacen areas. There's no HH has loss portion more than 25% of total area.

The impact on land acquisition causing resettlement is in a very small scale and there's no PAH that has to be relocated. The PAHs has houses/land which are partially impacted by the project would be compensated one time in cash and resettled in adjacent areas.

CHAPTER VI INSTITUTIONAL ARRANGEMENT

The local authority takes responsibility for compensation clearance and resettlement and ensures that the plan should be implemented in accordance with the approved plan progress. Co- ordination schemes between investors and local authority will be established and carried out to ensure that those being influenced by the project are paid attention to, and important issues are not delayed.

1. Management structure The following organizations and institutions will be involved in to the preparation and implementation of the compensation and resettlement plans for the project - Province People's Committees: Ha Tinh, Nghe An, Thanh Hoa, Ha Nam, Thai Binh, Quang Ninh, Bac Giang, Thai Nguyen, Tuyen Quang, Lao Kai, Yen Bai, Phu Tho, Vinh Phuc, Son La, Lai Chau. - Electricity of Vietnam - Power network Project Management Board - Power Company No 1 - Designing & Construction Consulting Units - Province pricing and financial services - Provincial Land Offices - Provincial Construction Offices - District People's Committee where the projects are located. - Land Office of districts, communes - Resettlement Boards of districts and communes - District and Commune People's Committees - Project Affected Households 2. Bodies' responsibilities 2.1-Electricity of Vietnam - As a project investors, responsible for overall management regarding investment policies, design and research, construction as well as supervision of compensation clearance and resettlement process, managing project design and implementation for professional agencies to approve decisions related to resettlement task submitted by the project management unit. The Power Company No 1 is delegated by the EVN to directly guide the project implementation progress.

2.2- Power Network ProjectManagement Board - Power company No 1 The Power Company No. 1 requires the Power Network Project Management Board to take responsible for coordinating project's plans including resettlement plan, impact research, and plans for project implementation. The PNMB takes the responsibility as detailed below: - Setting up the overall plan, managing and supervising site clearance and compensation of the projects, to determine the overall PAH, give good benefits to PAH in compliance with the site clearance and compensation policies. - Ensuring that all PAP are informed of policy applied in planning and determining benefits, providing them with a summary of information regarding the project and site clearance plan in a thin book (RIB). This can be seen as a benefit programme towards resettlement. - Explaining the project to People's Committee of all levels, agree with these organizations on regulations of OD.4.20 (WB) and Degree No. 22 of the Government. - Send RAP to site clearance units, explaining applicable methods and benefits of the project - Supervising the compensation process, implementing and coordinating land requisition and site clearance activities. - Canrying out independent supervision of RAP implementation and appointing one qualified and experienced agency to do this job. - Reporting the site clearance progress to WB and EVN To implement those duties, the project management unit (PMU) need to have a department or a group of experienced people to supervise and implement environmental and resettlement issues.

2.3-Province People's Committee Province People's Committee is an approving body and guides issue regarding compensation and resettlement activities within the province. The Province People's Committee is responsible for: Instructing relevant units and localities in the province such as Land Service, Construction Service, Pricing and financial service and district people's committees. Approving the compensation pricing of land, structures, trees, crops... within the province Approving lands re-procession documentation and land delivery in the province Establishing province compensation and resettlement board and guiding all activities of this board Guiding and leading coordination between sectors, services in terrns of RAP implementation.

2.4- Provincialprice andfinancing Services (PPFSs) As a chairman of the appraising council the PPFSs will takes responsibility for documenting detailed compensation pricing to be applied for province's project; appraising land compensation

During the implementation, the pricing and financial service need to cooperate with construction service, land service, agricultural and rural development service and district People's Committees in order to set up compensation price relating to houses, land, plants, trees, crops. The PPFSs are responsible for study and suggestion the unit price for compensation. For this responsibility, PPFSs collaborate with the provincial construction Services for getting replacement cost of different type of houses, collaborate with districts land Services for the decision of land compensation unit prices. PPFSs are responsible for finance of implementation of RAP on the behalf of the provinces

2.5-ProvincialConstruction Office As a member of the council, the provincial construction office will take responsible for appraising in terms of construction and construction programming.

2.6-ProvincialLand Office As member of the council, the provincial land office will take responsible for appraising of temporary land acquisition documentation and project land pennission.

2.7-ProvincialResettlement Boards (PRBs) A body responsible for consulting the province to approve RAP and guiding the implementation of compensation and resettlement plan as approved in the province. This unit has the following duties: Helping investment and district compensation and resettlement units in detailing compensation and resettlement implementation. Checking data affected by the project and plan of implementation details designed and submitted by district site clearance units. Approving implementation plan. Duration to approve plans is within 10 days from the day site clearance unit submits the plan. Reviewing and sending for approval of RAP by province People's Committee in the province Guiding and supervising RAP implementation as scheduled and indicated by approved policy in the province Solving issues remained unsolved satisfactorily by district site clearance units Paying compensation to RAP through district site clearance units Members of province site clearance unit will work as dual appointment and be provided allowance according the province's decision. Working staff who works through the project implementation period will receive salaries for this period

2.8-The province/districtcompensation and site clearanceunits These units shall include representatives from the following services: - Head of pricing and financial services

- Representative of construction service - Representative of land office - Representative of agricultural and rural development service - President/vice president of district/commune People's Committees - Representative of province project management unit - Representative of provincial power services The province/district compensation and site clearance units will take responsible for statistics of compensation and resettlement in the province/district; propagate information and policies compensation and site clearance of the project; present for approval compensation and resettlement plan. The committee has the following duties: Creating conditions to cooperate with relevant bodies in research of impact by project. Organizing community consulting activities, providing people in the district with guidelines of project implementation and land repossession for the project. Confirming affected property of HHs in the survey and preparing compensation documentation for each HH Instructing, supervising resettlement activities within the district Helping HHs to over come difficulties during reconstruction and reparation of affected houses. Coordinating with provincial/district resettlement board in classification of affected property, confirmation of entitlement of the property Joining force with district site clearance unit to solve issues emerged during the RAP implementation

2.1 0-Project Affected Persons (PAPs) - Check their affected properties, which determine by the surveyors by the DRBs, certify for that by put their signature on the compensation document of individual. - Recommendation and comment for the RAP provisions on entitlement, the proposed replacement measures which are suggested by the project developer through the consultation. CHAPTER VIII RAP IMPLEMENTATION ARRANGEMENT

1. Implementation measures

2. Compensation and RAP implementation

Action 1:

Right after approval of RAI) anid project, the PMB hires the monitoring unit, whiclh is approved by PC I and WB.

Action 2:

I'rovinces set up reseilmeni board at different levels and province or in'vestor arranige finance for implementation of RAP as the approved amount and schedule tor distlict resettlement boards (DRBs) and declare the tasks for l)RBs.

Actioni 3:

The DRBs will intonm plan and policies of compensation and 1%'VcIleC1W1L, propose the project implementation schedule and other detail related to RAP implementation. Ihe board also cariy out the detail inventory on the impacted assets includinig property, land, trees, crops, structures.., and specify the compensation unit, or if necessary readjusts them again so that the compensatiol at markets and substation rates is warranted.

Action 6: A meeting between DRBs and the P'APl is organized. During the meeting all aspects havinig to do with eligibility, entitlement, compensation and implementation action shall be discussed with PAP. PAlls shall be assisted and supported in repairing their houses and stabilization of their life. Their other assets will be continuously compensated. I)uring project implementation, internal monitoring ulit, independent monitoring unit shall supeivise RAP implemetitationi pr-oc'ess; discuss, prepare reporls on changes occuried dutilng implemeitationi period and propose methods to solve the Jdl li tlit,IcIin order to satisfy the project progress.

Action 7:

Since the entire resttlement and rehabilitation program is being cairies out with the participation of the I'AHs and thic impacted scale of this proj cet will be relatively amall, it is expected that no grievance issue will raise. HFowever, to ensure that the PAl Is have anvenues for mLdr1Cini, their grivences related to any aspect of compensation and resettlement, detail procedures of redsresses of grievances have been established for the project. The objective is to respond to the complaints of'the PAIls speedily and in a transperent maner. 'I'hle rmechanisnm is design to be easy. tranperent and fair. The purposc is to grievance issues in an effective maner. By resolving grievances at the project level, the progress ol'thle project would be more eftective asseertainied.

The procedures are as follows:

* If any person is aggrieved by any aspect of the rcILleit im anid rehiabilitation program, he' can lodge an oral or writen grievanice to the DRBs. * In case of grievance, complaint will be confirmed by Coommune People Committee andl forwarded to district resettlenient board. The DRBs will consider and solve the case according to regulations and policies of the project compensation and resettlement withiin I week.

* If any .. '-' i' l person is not satisfied with the decision of D)RBs. he/she can bring the complaint to the attention of the PRBs and thc l'RBs will reach a decision on the complaint within two weeks.

* If the PAI-I is still dissatisfied with the decision, he/slhe can appeal to the District People's Court (D)PC) in accordances witlh the "'ivil Procedure Act" within 15 days of receiving the decision of the PRB %%ilOUL being charged. DPC decisioni will be a legal flinal basis lor compensation.

CHAPTER VIII

BUDGET AND COST

1. Sources of fund:

All costs for compensation, site clearance and resettlement will be sourced from Investor's capital on behalf of Vietnam part.

- DRBs: compensation for PAH, payment for ground clearance in their areas.

- Other institutions engaging in resetttlement activities: Independent monitoling organisation (IMO) and those providing training services.

- DRBs receive money from Investor and PNPMB and will be responsible for:

+ Payment of compensation directly to PAP for lost of land, crops, trees, structures, allowances.

+ Payment of compensation for DRBs, to cover costs of resettlement activities.

3. Implementation, administration costs and contingencies:

Preparation costs include costs already made for and demarcation, spotting and detailed measurement survey (DMS). They include also the costs of training for various resettlement boards (DRBs, PRBs); payments (salaries, per diem) for resettlement boards, payment to conduct necessary survey, and payment to conduct monitoring.

Since the cost estimates have been prepared based on decree price for various categories of affected assets which may be substantially lower than the compensaiton to be paid at replacement/ market prices for affected assets and land, there will be a contigency amount of 10%.

Compensation prices have been difined according to the tariffs established by the provinces and based on the Decree 22/1998/CP-NN on 24/4/1998 and Official dispatch No. 4268/CV-KH-DT on 4/12/1998 of the Ministry of Industry regarding tariff of implementation costs for site clearance of lines and substation

CHAPTER IX PARTICIPATION AND CONSULTATION

1. Objectives of information campaign and consultation program

Information dissemination to, consultation with and participation of the affected people and involved agencies reduce the potential for conflicts, minimize the risk of project delays, and enable the project to design the resettlement and rehabilitation program as a comprehensive development program to fit he needs and properties of the affected people, thereby maximizing the economic and social benefits of the project investment.

The objectives of the public Information Campaign and PAH Consultation Program are as follows:

- To share fully information about the proposed project, its components and its activities, with affected people

- To obtain the cooperation and participation of the affected people and communities required to be undertaken for resettlement planing and implementation.

- To ensure transparency in all activities related to land acquisition, resettlement and rehabilitation.

There are two phase of the public information campaign and PAH consultation:

Phase I:

This phase consisted of commune meeting, line route selection, detailed measurement survey of affected assets, and identification of strategies for relocating

Phase II:

During the phase, meetings will be organized in the provinces. The implementation of resettlement and rehabilitation activities includes resettlement policies and procedures; calculation and payment of compensation; relocation options, design, and clearance for the project area.

2. Compensation and resettlement plan preparation

It is necessary to inform and consult local people and organizations during plan preparation period.

Phase I

During phase I, the phase of detailed resettlement planning and RAP preparation, the following activities were carried out sequentially:

Phase 1- Activityl: Information and discussion with local authorities on the line routes After studying maps and visiting the site, PECCI had investigated a preliminary route on 1/50,000 scale map. This map was sent to all locations passed by the line and relevant local authorities. The local authorities have agreed on the project line routes. These activities took place in 2nd quarter/2002

Phase 1- Activity 2: Impact survey and statistics

Base on the agreed line routes, survey teams had realized the routes at sites, made the piling and coordinated with provincial authorities to make a list of PAHs' affected land and crops. The

socio-economic survey were delivered to each household and these activities took place in 3rd quarter/2002

Phase I-Activity 3: Meetings with PAHs' representatives

When the survey finished, Consulting Units in coordination with provincial officials held meetings with PAHs having land in the ROW and with provincial representatives. In these meetings, consulting officials informed the participants of the project purposes; presented the project impacts on land and crops in detail: introduce the principles and policies of compensation and advised people not to build new structure in the line ROW. PAHs were consulted on the entitlement and compensation policy. And the compensation in cash had been accepted.

3.Information campaign & consultation during resettlement implementation

Phase II-Activity 1: Information dissemination and training of RBs

After signing of the loan agreement, the first resettlement activity is to establish PRBs on resettlement implementation. PCI will provide local RBs at all levels with information on policies for PAHs, detailed information about RAP policies and implementation procedures of local meetings. This activity will take place in Ist quarter/2002

Phase II- Activity 2: Inform action on resettlement document and compensation form distribution to PAHs:

Local RBs will make a detailed compensation form for PAHs as basis for compensation for PAHs. Activity 2a: Distribution of compensation forms for lost assets and resettlement information booklets (RIBs) to PAHs. RIBs described in item 6.4 will be distributed to PAHs together with a forrn for listing lost assets. Additionally, they are given by radio, TV, local broadcasting means, posted public notices at he offices of commune people's committee and DRBs.The forms must include:

- Inventory and calculation of entitlement compensation

- Inventory of affected assets

- Inventory affected land, trees, and crops...

(It is required a current condition drawing for land or structure)

Activity 2b: After distributing RIBs and compensation forms, RBs of all provinces should organize meting in each commune to explain RIB and instruct PAHs to list their affected assets in the compensation forms. Meeting invitation must be given to PAHs. Time, place of the meeting must be informed by local broadcasting means and posted public notices.

In these meeting, PAHs can raise their questions on any resettlement issue

PhaseII-Activity 3: Meeting with PAHs on compensation unitprice

After getting statistic on lost assets in the line ROW, permanently land acquisition, organize meeting with PAHs to introduce the compensation rated for different impacts. Table of compensation rates will be posted in the offices of commune people committee.

At the meeting PAHs can comment on the proposed compensation rated. Disagreement on compensation rates will be noted down and collected for consideration. Recommendations, if any, will be sent to PAHs for revision and modification if necessary.

Besides, PAHs will be informed of time, location and process of compensation payment for

damages. The meeting is scheduled by end of 2nd quarter/2002

Phase 2-Activity 4: Application of compensationprice

The adjusted compensation rated proposed to be made valid by DRBs and district RBs in

3rd /2002. PAHs who agree with compensation price for their assets will sign on the compensation form. Disagreement comments will be recorded.

Meeting for solving grievances and appeals will be held. Disagreement comments will be recorded and reported to higher level for settlement in accordance with the appeal procedure mentioned in chapter XI of this RAP.

PhaseII- Activity 5: Information to local authoritieson implementation schedule

Provincial power services shall monthly inform province and commune authorities and PAHs about construction schedule and procedures as well as the project schedule.

PPSs will keep the commune and district RBs informed of schedule for the project components concerning each locality.

Commune and district RBs must coordinate with PPSs to ensure that all PAHs know well about compensation schedule in order to rehabilitate their lives as soon as possible.

Resettlement information booklet

To ensure that PAHs, their representatives and their local govermments of the affected areas fully understand the details of the resettlement program, and also are informed about the compensation and the rehabilitation packages applicable to the project, a resettlement information booklet (RIB) will be prepared by Power Network Project Management Board - PC1, and will be distributed to all PAHs in the project area in the initial duration of the implementation stage of the project.

The RIB will give information on the following:

Basic features

- Project description: Describe main construction works in the area, objective and electricity supplying areas

- Project design objectives

- Implementation schedule

- Project impacts

- Rights and entitlements of the affected people

- Institutions responsible for resettlement

- Information dissemination to and consultation with the affected people

- Grievances and appeals

CHAPTER X GRIEVANCE REDRESS Since the entire resettlement and rehabilitation program is being carries out with the participation of the PAHs and the impacted scale of this project will be relatively small, it is expected that no grievance issue will be raised. However, to ensure that the PAHs have avenues for redressing their grievances related to any aspect of compensation and resettlement, detail procedures of redresses of grievances have been established for the project. The objective is to respond to the complaints of the PAHs speedily and in a transparent manner. The mechanism is design to be easy, transparent and fair. The purpose is to grievance issues in an effective manner. By resolving grievances at the project level, the progress of the project would be more effective ascertained. The procedures are as follows:

Stage 1:

If any person is aggrieved by any aspect of the resettlement and rehabilitation program, he/she can lodge an oral or written grievance to the DRBs.

Incase an oral complaint is made, it will be written on paper by the village unit and processed Village Administration Committee or the DRB will resolve the issue within two weeks.

Stage2:

Unless all grievance issues have been resolved, ground clearance can be started. All aggrieved persons must obey DPC's decision. If any Aggrieved person is not satisfied with the decision in stage 1, he/she can bring the complaint to the attention of the within one month form the date of the receipt of the decision in stage 1. PRA will reach a decision on the complaint within two weeks.

Stage 3:

If the PAH is still dissatisfied with the decision, he/she can appeal to the District People's Court (DPC) in accordance with the "Civil Procedure Act" within 15 days of receiving the decision of the PRB without being charged. DPC decision will be a legal basis for compensation.

PAHs can make an appeal on any aspect of the resettlement and rehabilitation program, including compensation rated being offered.

CHAPTER XI MONITORING AND SUPERVISION

The implementation of RAP shall be constantly supervised and monitored by the PNPMB in co-ordination with local People's Committees An independent consulting agency will be entrusted with external monitoring tasks. The selection of this agency will be submitted for approval of PNPMB and WB. The candidates suggested to be chosen are: 4. Independent with the Investor 5. Experienced in reparation of compensation and resettlement plan especially for WB projects 6. Sufficiently having professional experts and staff to carry out independent monitoring work The chosen external monitoring institution shall be contracted by the PNPMB immediately after RAP approval and shall begin supervision and monitoring activities from beginning of the implementation phase. 1. Internal Monitoring Internal supervision and monitoring include the following activities: a) Monitoring the population and socio-economic survey of PAH and the inventory of PAH asset, status, occupations and living conditions and supervising the implementation of compensation, resettlement and rehabilitation for the PAH in the terms agreed by the PAHs b) Monitoring whether the implementation of resettlement and compensation tasks are cared out as provided in this RAP c) Monitoring the availability and quality of replacement land d) Monitoring the timely and sufficient deployment of resettlement and compensation funds or of replacement land as prescribed by this RAP e) Investigate and fairly and sufficient assess each case of complaint and grievance f) Internal monitoring agencies will prepare a quarterly report detailing the progress of RAP implementation. Such a report should be made available to appropriate GOV authorities, WB and external monitoring agencies. 2. External Monitoring

Beside evaluation the quarterly reports produced by intemal monitors and conduct the same king off investigation assigned to internal monitoring, the external monitoring agency will be responsible for the following: a) Evaluation of inventory survey b) Evaluation of socio economic project impact on the PAH c) Supervision of the implementation of RAP to achieve the objectives of the RAP in particular "to improve or at least maintain the incomes and living conditions of the PAP after the resettlement" d) Putting forward the amendments for the implementation of RAP so as to achieve the objectives of this RAP e) Offering suggestions on how improve RAP programs f) Closely monitoring compensation activities and be prepared to give inforned evaluation of complaint and grievance cases g) Write working reports to be submitted to PNPMB and WB every 06 months on which assessment of RAP policies implementation in accordance with Vietnam government and WB regulations shall be made h) A final report shall be prepared after the completion of the entire resettlement program. This report shall provide detailed evaluation of the RAP and its implementation and it also includes information basing on interviews with number of PAHs, their situations, opinions and difficulties after they have been resettled and compensated. Thanks to that, suggestions will be made to PNPMB, WB and other authorities to help these PAHs over come difficulties and stable their lives. Finally, on bases of the RAP implementation experience this document shall provide suggestion both to help reinforce local RAP expertise and to improve future resettlements plans.

1. Introduction

The Indigenous People Development Plan is part of the RAP and was prepared for the Efficiency improvement of 11 OkV-distribution project in northern region.

The plan mainly aims at providing information on ethnic group in the project areas and pointing out suitable development plan in compliance with WB policy OD 4.20, ensuring the following:

- Respect characteristics of customs, habits and cultural tradition of the ethnic group.

- Avoid negative impacts on ethnic group during development progress and

- Ethnic group will be entitled to socio-economic interests suitable to their cultural tradition.

Information of the ethnic group was collected during investigation period and in socio- economic surveys. According to WB guidance, the project impacts on the ethnic minorities must be mentioned in a separate report. However, study of impacts described in Chapter III shows that the project impact on EM HHs is small, mainly on land and crops in the line ROW.

Permanent land acquisition for 110kV-tower foundation is small (from 25m2 to 150m2) and scattered evenly along the line routes. Cultivation of trees of <4m high in the line ROWs is permitted so EM PAHs are insignificantly affected. As such, there should be no need to prepare a separate report and that the proposals for the resettlement of ethnic minorities could be described in an annex of this RAP.

2. Legal framework

2.1 Vietnam Law:

Equality right of ethnic people was stipulated clearly in the Vietnam Law. Article 5 in the Vietnam Constitution (1992) stipulated as follows: migration trends of the ethnic people. One of the most important policies on relation with ethnic groups is the Government Guidance No.525/TTG on 2/11/1993 regarding in detail on implementation guiding of development in high land areas and ethnic areas with the main following points:

* Develop infrastructure especially transportation road system and fresh warter supplying

* Step by step overcome the lack of food

* Consolidate of education system; adjust education program basing on characteristics of provinces; create favor conditions and support the irregular education program and develop internal economic force.

2.2 Ethnic Minorities Committee

According to the government guidance No. 525 in 1994, the Ethnic Minorities Committee and mountainous areas was assigned to co-ordinate with UNDP in implementation of external support for ethnic minorities' development.

3. Socio-econoniic condition of ethnic minorities in the project areas

3.1 Ethnic minorities in the project areas

The survey shows that there are 12,467 households affected by the 22 subprojects, of which 2,963 HHs are ethnic minorities. The ethnic minority groups are allocated as follows:

- 110kV Yen Bai-Nghia Lo T/L: (30%) mainly live Van Tran district including Tay people (14.89%), Muong people (6.38%), Dao (2.13%).

- 110kV Phu Yen (Son La) substation and T/L: Thai (35%), Muong (35%), H'Mong (10%), Dao (5%), Kinh (10%) and other ethnic minorities (5%).

- 110kV Bac Giang-Luc Ngan substation and T/L: Most of PAHs are ethnic minorities concentrated in Luc Ngan, Luc Nam districts and scattered in Hong Giang commune with Tay people (16.7%), Thanh Hai commune with Tay & San Diu (16.6%), Qui Son commune with San Diu & Hoa people (25%), Tru Huu commune with Hoa & Tay people (16.6%), Dong Hung commune with Trai & Hoa people (16.6%) and Phuong Son commune with Diu people. 3.2 Socio-economic condition of ethnic minorities

- The ethnic minorities in the project areas live in-groups, villages. Usually there're 20-30 HHs in one group and that of H'Mong people is 10-15 HHs. However, Thai people may live in larger group of about more or less than 200 HHs. Their main economic activities are on agriculture, forest products, hunting, breeding farm.. .and small number of service activities.

- The ethnic minorities live closely with the nature, their lives almost depends on nature. The ethnic people lead a very hard life as they mainly live on agriculture and hunting...

- Most of ethnic minorities maintain their traditional cultures

- Ethnic people have their own languages. However, most of them can speak the national language.

- Policy on settled agriculture and life of the Vietnamese Government: confronting long lasting forest destroy crises, the Vietnamese Government launched a campaign on settled agriculture life. Provincial departments on settled agriculture and life made plans for plantation of new tree types such as: coffee, tea, anise and mu oil trees. These help improving ethnic people's lives.

In the last years the Government of Vietnam has been promoting many literacy programs to ethnic minorities. Classes were set up for ethnic children. Up to now people's awareness is much improved. Backward customs were eliminated, living ways and standards are somehow better. These later will create favorable condition for household as well as for regional economic development.

+ Household characteristics

- The average number of people per household is 07, higher than that of the whole country (5.97) as an ethnic family usually comprises several generations.

- Young people (0-17 years) represent4l.87%. The productive age group (18-54 years) accounts for 50.39%. Old people (over 55 years) take 7.74%.

+ Education

Most of household heads are literate. Of which 81.27% finished primary level, 16.37% recorded secondary level, 2.36% completed intermediate and primary level. + Housing condition

Most houses are of 4th class and temporary ones with wooden wall, tile or zinc-galvanized iron sheet roof.

+ Amenities

PAHs' modern facilities of are not much. 3.36% PAHs have motorbikes, 13.63% PAHs have TV sets, 67% PAHs have bicycles, 34.7% have radio sets.

Most of ethnic minorities use natural stream water or pond/lake water. There's no use of water from water-pipe systems

Beside number of PAHs connected to national power network.(about 37.5%), the rest of the total PAHs are using power sources from small hydropower generators, batteries and diesel generators or still not connected to the power network

+ Cultivation land

Beside residential land and garden areas of about 800m2-2,000m2, EM HHs also have land for growing agricultural trees such as maize, cassava, rice... Number of HHs have agricultural land of 1,000m2-3,000m2 is 1,315HHs; that of 3,000m2-5,000m2 is 335HHs and the remaining is HHs of over 5,000m2.

All impacted ethnic people are farners. Their cultivation is mainly on rice, maize, corn and industrial crops such as coffee, anise and mu oil trees. PAHs' income is mainly from cultivation and livestock raising. Only 5% of PAHs have income from extra works and salary.

4. Entitlement

The entire ethnic household will be entitled according to resettlement and compensation policy. Besides, ethnic HH would be subsided as stipulated in the special subsidy program:

Land acquisition for tower foundations and substation is insignificant in comparison with their total area as most of the EM PAHs have very large area of agricultural land of from 1.000m2 to 5.000m2. Their income therefore would not be affected and the loss portion shall be compensated in cash as stipulated.

5.3 Impact on crops and trees

Ethnic people's cultivation is mainly on rice, cassava, corn. Some grow coffee, tea and anise trees. These trees are below 4m high, the impacts on these would be minimal within one crop. Thus, compensation will be in cash as stipulated.

5.4 Mitigation measures

Though the impacts on ethnic minorities are minor, they are very sensitive. Beside general impact mitigation measures, special resettlement provision for the ethnic minorities, thus, will be applied as follows:

To ensure rights of the ethnic PAHs, they can have:

- PAHs representatives from ethnic minorities will be on the local resettlement boards

- The provisions of plummets will be explained to them in specially arranged meeting in each affected commune. Plummets on RAP will be translated in to their language and posted in public areas. - EM PAHs surrounding substation and line routes shall be disseminated about safety measures during operation period. Methods to be applied: pamphlets, panel, posters.. in provinces that have EM PAHs such as Lao Cai, Son La, Lai Chau, Yen Bai ... The Socialist Republic of Vietnam is an united nation having many nationalities in Vietnam. The State implements an equality and united policy and supports spiritually all nationalities and prohibits race discrimination and separation. Each nationality has the right to use its own language and characters to preserve their characteristics and to improve its own good traditional and cultural customs. The State carries out a policy to develop thoroughly and gradually improve the quality of life of ethnic minorities in Vietnam physically and spiritually.
