("ISC"), by its attorney, hereby submits its counterproposal with respect to the above-referenced rulemaking proceeding. With respect thereto, the following is stated: Auburn Network, Inc. has proposed that the FM Table ofAllotments be amended as follows: Community Current Proposed Auburn, Alabama 249A 249A,263A However, Auburn, Alabama already has assigned to it not only Chanel249A (Station WKKR(FM)), the community also has assigned to it Station WAUD(AM), and NCE station WEGL(FM)). Thus, this allotment would represent thefourth aural service assigned to Auburn. As a counterproposal, ISC instead proposes that Channel 262A be allotted to the community ofCamp Hill, Alabama. As seen in Attachment 1, Camp Hill is a census-recognized community of 1,982 persons (2000 Census). The Commission's has an established allotment criteria which was set forth initially inRevision ofFMAssignmentPolicies andProcedures, 90 F.C.C.2d 88 (1982), which establishes the following allotment priorities: ~o. of Copies rac'd USiA BCDE --.------ (1) first full-time aural service (2) second full-time aural service (3) first local service (4) other public interest matters Camp Hill has allotted to it no other aural services. Therefore, under the Commission's established criteria, Aubum Network's proposalonly can be considered under "Priority 4" (other public interest matters). In contrast, since Camp Hill has assigned to it no other aural services, ISC's proposal would be entitled consideration under "Priority 3" (first local service). Therefore, ISC proposal should be favored over the proposal filed by Auburn Network insofar as it will result in a preferential arrangement ofallotments. As seen in Attachment 2, this proposed allotment is mutually-exclusive with the proposed allotment of Channel 263A at Auburn, and can be allotted in fully accord with the Commission's minimum spacing requirements. Accordingly, it is requested that the FM Table ofAllotments be amended as follows: Community Current Proposed Camp Hill, Alabama 262A WHEREFORE, International Systems Corp. respectfully requests that this Counterproposal be adopted, that the Commission amend the FM Table ofAllotments to specify the new channel at Camp Hill, Alabama. BMC proposes to (1) relocate the LPFM service to a portion of this spectrum space; (2) expand the NCE service into the adjacent portion of this band; and (3) provide for the conversion and migration of all AM stations into the remaining portion of the band over an extended period of time and with digital transmissions only.
