1 Introduction

The purpose of this report is to advise Committee of the introduction of a Good Neighbour Agreement

Background

The Anti Social Task Force was set up in January 2001. Included in the remit was the necessity to develop and introduce initiatives to tackle anti social behaviour.

Although the Missive of Let outlines the tenant's responsibilities regarding anti social behaviour, the Good Neighbour Agreement is concerned with simplifLing the issue and highlighting the practicalities of being a good neighbour.

2.3 The Good Neighbour Agreement will be a useful Housing Management tool especially when pursuing legal action as it demonstrates that tenants are aware of what is expected of them and the consequences of failing to meet its terms.

3 Considerations

3.1 The draft charter proposed by the Anti Social Task Force was drawn up in June 2001. A copy is attached as Appendix 1 to this report.

3.2 The Anti Social Task Force has consulted with Elected Members, Tenants & Residents Associations, Community Groups, Housing Associations and Housing and Property Services staff, inviting suggestions and comments on the proposal. Details of those contacted are included as Appendix 2 to this report.

3.3 The feedback from consultation was generally very positive and in favour of implementing the agreement. A list of responses is included at Appendix 3 to this report.

4 Corporate Considerations

4.1 Legal Services Department has been consulted regarding any legal implications of introducing the agreement.

5 Recommendations

5.1 It is recommended that Committee:

(a) Adopt the Good Neighbour Agreement for use throughout

(b) Authorise the arrangements for a series of Public Meetings to be held throughout North Lanarkshire to publicise this initiative.

THE RIGHT TO ENJOY YOUR HOME AND THE AREA YOU LIVE IN

North Lanarkshire Council believes that nuisance behaviour is unacceptable and will not be tolerated.

The Housing and Property Services Department, through local Area Housing Offices and the Anti Social Task Force, will use all powers available to deal with the problem effectively, firmly, but in a fair manner, to ensure that all tenants in North Lanarkshire enjoy living in their homes.

To meet this pledge the council is committed to:

Making sure that every tenant enjoys the right to security of tenure in their own home, regardless of race, creed, gender, disability or sexuality.

Making sure that tenant’s rights to thepeaceful enjoyment of their home is protected.

Creating an environment, which makes North Lanarkshire a more attractive place to live.

Taking strong and effective action to tackle any problems of an anti social nature, including legal action. Responding professionally and sensitively to complaints made.

Ensuring that any action is continued until the problem is resolved to the satisfaction of the council.

WE EXPECT THE TENANTS OF NORTH LANARKSHIRE TO:

0 Show consideration for your neighbours and not to cause nuisance or disturbance to them or their visitors.

Take responsibility for your children. Being a good neighbour applies to your children too. They should be made aware that respect should be shown to your neighbours and their property, especially in flats where areas are shared

0 Be responsible for the behaviour of your visitors

0 Keep your house in a reasonable state of cleanliness and decoration

Take your turn to clean common stairs and landings

0 Make sure that security doors are closed properly. This applies to visitors too. Keep your garden tidy. If you are elderly or there is no one physically fit to do this in your household you can apply to be included on the Garden Assistance Scheme

Store your rubbish in bins provided

Keep pets under control, if you are allowed one in your home. Remember to clean up after their needs and do not allow your pet to foul in communal areas either inside communal closes or outside your home.

Ask us for permission if you wish to use your home for business purposes

Let us know if your property will be unoccupied for 21 days or more, otherwise we may believe that it has been abandoned and reclaim possession. Please give us a contact address in case of any emergencies, e.g., Burst Pipes

Park your vehicles with consideration and courtesy for your neighbours.

IN RETURN NORTH LANARKSHIRE COUNCIL WILL:

Fully investigate complaints of anti social behaviour

Offer a mediation service to allow neighbour disputes to be dealt with at an early stage

Provide a 24 Hour service to deal with the problem of Anti Social Behaviour

Keep complainants fully informed of the progress of their complaint

Work closely with other agencies, such as the Police and other council departments, in order to deal with complaints effectively.

Provide a confidential service and offer support to victims of anti social behaviour

Take the strongest possible action, where necessary, to ensure a peaceful living environment for all tenants in North Lanarkshire. This will include verbal and written warnings, action for recovery of possession (eviction) and applications for Anti Social Behaviour Orders. Other legal remedies will also be considered.

Ensure that effective action is taken against tenants who do not accept responsibility for the offensive actions of their children or visitors to their home

Not accept or may cancel an application for housing if we consider that a tenant or anyone living with a tenant has been guiIty of anti social behaviour......

Draft Good Neiphbour Agreement - Consultation

As you will be aware the council is committed to tackling anti social behaviour and ensuring that tenants adhere to their conditions of tenancy.

The Anti Social Task Force has produced a Draft Good Neighbour Agreement, which would be implemented following consultation.

All new tenants will be required to sign the Good Neighbour Agreement and all existing tenants will be asked to adhere to the principles of the agreement. Details of the agreement would be displayed in council offices, etc to raise awareness of these issues.

I have enclosed a copy of this draft agreement and would be obliged to receive your comments on this document by Friday 1Oth August 200 1.

THE RIGHT TO ENJOY YOUR HOME AND THE AREA YOU LIVE IN

North Lanarkshire Council believes that nuisance behaviour is unacceptable and will not be tolerated.

The Housing and Property Services Department, through local Area Housing Offices and the Anti Social Task Force, will use all powers available to deal with the problem effectively, firmly, but in a fair manner, to ensure that all tenants in North Lanarkshire enjoy living in their homes.

To meet this pledge the council is committed to:

Making sure that every tenant enjoys the right to security of tenure in their own home, regardless of race, creed, gender, disability or sexuality.

Making sure that tenant’s rights to the peaceful enjoyment of their home is protected.

Creating an environment, which makes North Lanarkshire a more attractive place to live.

Taking strong and effective action to tackle any problems of an anti social nature, including legal action. Responding professionally and sensitively to complaints made.

Ensuring that any action is continued until the problem is resolved to the satisfaction of the council.

WE EXPECT THE TENANTS OF NORTH LANARKSHIRE TO:

Show consideration for your neighbours and not to cause nuisance or disturbance to them or their visitors

Be aware of the problems caused by excessive noise, particularly regarding late night use of domestic appliances and visitors to your property. This is especially important for those living in flatted or 4 in a block accommodation.

Take responsibility for your children. Being a good neighbour applies to your children too. They should be made aware that respect should be shown to your neighbours and their property, especially in flats where areas are shared

Ensure that no damage occurs to Council property

Be responsible for the behaviour of your visitors

Keep your house in a reasonable state of cleanliness and decoration 0 Take your turn to clean common stairs and landings

0 Make sure that security doors are closed properly. This applies to visitors too.

Keep your garden tidy. If you are elderly or there is no one physically fit to do this in your household you can apply to be included on the Garden Assistance Scheme

0 Store your rubbish in bins provided

0 Keep pets under control, if you are allowed one in your home. Remember to clean up after their needs and do not allow your pet to foul in communal areas either inside communal closes or outside your home.

0 Ask us for permission if you wish to use your home for business purposes

0 Let us know if your property will be unoccupied for 21 days or more, otherwise we may believe that it has been abandoned and reclaim possession. Please give us a contact address in case of any emergencies, e.g., Burst Pipes

0 Park your vehicles with consideration and courtesy for your neighbours.

IN RETURN NORTH LANARKSHIRE COUNCIL WILL:

0 Fully investigate complaints of anti social behaviour

0 Offer a mediation service to allow neighbour disputes to be dealt with at an early stage

Provide a 24 Hour service to deal with the problem of Anti Social Behaviour

0 Keep complainants fully informed of the progress of their complaint

0 Work closely with other agencies, such as the Police and other council departments, in order to deal with complaints effectively.

0 Provide a confidential service and offer support to victims of anti social behaviour

0 Take the strongest possible action, where necessary, to ensure a peaceful living environment for all tenants in North Lanarkshire. This will include, where North Lanarkshire Council consider it appropriate, verbal and written warnings, action for recovery of possession (eviction) and applications for Anti Social Behaviour Orders. Other legal remedies will also be considered. 0 Ensure that effective action is taken against tenants who do not accept responsibility for the offensive actions of their children or visitors to their home

Not accept or may cancel an application for housing if we consider that a tenant or anyone living with a tenant has been guilty of anti social behaviour.
