RGICS RAJIV GANDHI INSTITUTE FOR CONTEMPORARY STUDIES JAWAHAR BHAWAN, DR. RAJENDRA PRASAD ROAD, NEW DELHI-110001 RGICS ISSUE BRIEF (09 May, 2016) CUSTODIAL DEATH BY FAKE ENCOUNTER: THE MURDER OF ISHRAT JAHAN Prepared By: Yesha Paul Supervisor: Barkha Deva RGICS issue brief Custodial Death By Fake Encounter: The Murder Of Ishrat Jahan 2 Introduction: On 15th June, 2004, 19-year-old Ishrat Jahan was gunned down along with three men on the outskirts of Ahmedabad by the Gujarat police. A college student from Mumbra, Maharashtra, she was alleged to have been affiliated to the Lashkar-e-Toiba (LeT), and part of a plan to kill then Gujarat Chief Minister Narendra Modi in retaliation for the 2002 Gujarat pogrom. However, many experts doubt the veracity of police claims about the encounter, believing instead that Ishrat was a victim of an extra-judicial execution by the Gujarat police in collusion with the Intelligence Bureau. The subsequent scrutiny that the Gujarat government was subjected to after the “encounter” was in part due to the murky circumstances surrounding the case that implicated state leaders, and in part due to the fact that the crime branch of the Gujarat police had gained a reputation for encounter killings, some allegedly fake, that eliminated not only the alleged criminal but also any possible witnesses, whether guilty or innocent. This case brings to light the darker side of Indian democracy – that of custodial deaths and fake encounter killings. Unfortunately, these issues have been brushed aside in a race to gain political mileage out of the travesty of justice meted out to a young girl who was also a citizen of this country.

But, the nature of truth, has baffled philosophers all over the world for ages. Like the Holy Grail, it is envisioned differently by different persons in different times and tracts. People who pursue the truth single-mindedly must of necessity tread the lonely path beset with travails and tribulations bereft of expectations of help from anyone except their own conscience to guide them. This version of the truth of the disturbing events in Gujarat during 2002 and the saga of fake encounters makes fascinating reading. According to the author, this book gives the reader an insight provided by the lens of a spy camera and spy microphone both of which were freely used in a long drawn sting operation. As to whether the material presented in this book represents facts, or mere perspective vision of the events, is for the reader to judge. The narrative interspersed with quoted conversations makes interesting reading. It is for the State apparatus enforcing the Rule of Law and the Constitutional machinery as its sentinel to objectively assess the trustworthiness of the facts narrated here and take necessary action to restore the faith of the citizens of this country in the Rule of Law.

The SIT is currently probing the post-Godhra communal riots of 2002. The objection came when the court said there was a need for going to the bottom of the case. “The state has to go to the bottom of the case. The investigation has to be beyond all doubts,” said a bench comprising justices Tarun Chatterjee and Aftab Alam. The court said that the question of referring the case to the SIT has arisen because of the alleged attempt by the Gujarat police to cover up the conspiracy leading to the killing of Sohrabuddin and his wife Kauser Bi. “This is no less disturbing when you admit that this is a fake encounter,” the bench said, when senior advocate Mukul Rohatgi, appearing for the state government, opposed the suggestion to hand over the investigations of the case to SIT. Mr Rohatgi’s submission was, however, countered by senior advocate Dushyant Dave, who, appearing for the victim’s family, alleged that the investigating officer in the case Geeta Johri, a senior IPS officer, also betrayed the trust reposed in her by the apex court.
