In the Year One Thousand Nine Hundred and Sixty-Two

An Act to provide for a special capital outlay program FOR THE COMMONWEALTH. 1 Whereas, The deferred op< ration of this act would tend to 2 defeat its purpose, which is o provide funds immediately for 3 a special capital outlay progr am for the commonwealth, 4 fore it is hereby declared to b e an emergency law, necessary fo* 5 the immediate preservation of the public convenience. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

1 Section 1. To provide f< " a special program of recon- 2 struction, repair and improvi nent of the various properties 3 of the commonwealth and for the purchase and installation of 4 certain equipment, the sums set forth in section two of this 5 act, are hereby made available for the period ending June 6 thirtieth, nineteen hundred and sixty-four, subject to the pro- -7 visions of law regulating the disbursement of public funds and 8 the approval thereof. Said amounts are based upon schedules 9 approved by the joint committee on ways and means, a copy 10 of which shall be deposited with the budget commissioner and 11 shall be expended according to the priority order of such 12 schedules.

1 Section 3. Passenger motor vehicles to be purchased from 2 sums appropriated in section two of this act shall be authorized 3 by the purchasing agent in accordance with schedules filed by 4 the budget commissioner with the house and senate committees 5 on ways and means prior to the passage of this act; provided, 6 that the commission on administration and finance may au- -7 thorize the replacement of other motor vehicles with similar 8 models from available funds when it determines that the re- -9 placement is necessary because the cost of necessary repairs 10 would not be economical; and, provided further, that said com- il mission is hereby authorized to transfer a motor vehicle from ￿ 12 one agency or department to another, when, in its opinion, such 13 a transfer is for the best interest of the commonwealth.

1 Section 4. Projects authorized by this act shall not be 2 subject to the provisions of section thirty A of chapter seven 3 of the General Laws; provided, however, the commission on ad- -4 ministration and finance may, after determining that structural 5 changes in buildings to be repaired as authorized in section two 6 of this act will require extensive engineering, place such projects 7 under the supervision of the director of building construction.

1 Section 5. Except as otherwise provided in section thirteen 2 of chapter seventy-five of the General Laws, no agency of the 3 commonwealth receiving an appropriation under section two of 4 this act shall make any expenditure for consultant services, 5 so called, or services coded in accordance with the expenditure 6 code manual under the subsidiary title "03 Services Non- 7 employees” unless the rate of compensation for such services 8 shall have been approved by the commission on administration 9 and finance upon the recommendation of the director of the 10 division of personnel and standardization. The said director 11 shall, immediately upon the approval of any such rate or rates. 12 file copies of the schedule or schedules of approved rates with the 13 comptroller and with the house and senate committees on ways I 14 and means. Every such agency before engaging such consultant 15 services under said subsidiary title “03,” as so coded, as “Pro- 16 fessional,” except for “Peligious Services,” shall file a statement 17 of intent with the budget commissioner, the comptroller and 18 the house and senate committees on ways and means. Such 19 statement shall include the rate of compensation, the period 1962.] HOUSE —No. 3702. 13

20 of time for which the services are to be engaged or scope of work 21 to be done, and such other pertinent information as may be 22 necessary to establish the maximum limit of the commonwealth’s 23 obligation.

1 Section 6. The state treasurer may borrow from time to time 2 on the credit of the commonwealth such sums of money as may be 3 necessary for the purpose of meeting payments as authorized by 4 section two of this act, and may issue and renew from time to 5 time notes of the commonwealth therefor, bearing interest pay- -6 able at such times and at such rates as shall be fixed by the state 7 treasurer. Such notes shall be issued and may be renewed one 8 or more times for such terms, not exceeding one year, as the 9 governor may recommend to the general court in accordance 10 with section 3 of Article LXII of the Amendments to the Con- -11 stitution of the Commonwealth, but the final maturities of such 12 notes, whether original or renewal, shall not be later than June 13 thirtieth, nineteen hundred and sixty-five. Such notes shall be 14 payable from the proceeds of the excise on cigarettes as provided 15 in section six of chapter seven hundred and seventy-four of the 16 acts of nineteen hundred and sixty. Notwithstanding any pro- -17 visions of this act, such notes shall be general obligations of 18 the commonwealth.
