ELEVENTH NORTHERN MARIANAS COMMONWEALTH LEGISLATURE

FIRST REGULAR SESSION, 1998 ______

AN ACT

To reallocate appropriated funds for certain capital improvement projects in the First Senatorial District; and for other purposes.

BE IT ENACTED BY THE ELEVENTH NORTHERN MARIANAS COMMONWEALTH LEGISLATURE:

Section 1. Findings and Purpose. The Legislature finds that the High School is in desperate need of a vocational shop and JROTC classrooms with storage rooms and further, that the village roads in and Sinapalo villages are in dire need of maintenance, construction and paving. Accordingly, this Act is necessary to reallocate appropriated capital improvement project funds to these areas within the first Senatorial District where the funds are most needed.

Section 2. First Senatorial District Capital Improvement Projects: Reappropriation. Repeal and reenact P.L. 10-38, Section 3(b) to read as follows:

"(b) First Senatorial District. (1) $1,700,000 for A&E and construction of a vocational shop and JROTC classrooms including storage rooms for the Rota High School. (2) $2,283,375 for A&E, construction and paving of village roads in Songsong and Sinapalo villages. Notwithstanding any other section or part of this Act, expenditure authority for projects under this paragraph shall be vested in the Secretary of Public Works and the Mayor of Rota. Delegation appropriations pursuant to this section are exempt from the limitations of 1 CMC § 1402(b) but shall conform with 1 CMC § 7103(g)."

Section 3. Severability. If any provision of this Act or the application of any such provision to any person or circumstance should be held invalid by a court of competent jurisdiction, the remainder of this Act or the application of its provisions to persons or circumstances other than those to which it is held invalid shall not be affected thereby. Section 4. Savings Clause. This Act and any repealer contained herein shall not be construed as affecting any existing right acquired under contract or acquired under statutes repealed or under any rule, regulation or order adopted under the statutes. Repealers contained in this Act shall not affect any proceeding instituted under or pursuant to prior law. The enactment of this Act shall not have the effect of terminating, or in any way modifying, any liability, civil or criminal, which shall already be in existence at the date this Act becomes effective.

Section 5. Effective Date. This Act shall take effect upon its approval by the Governor or upon its becoming law without such approval.
