The Anti-social Behaviour (Designation of the Corporation) Order 2015

The City of London Corporation has power to make byelaws in relation to the land specified in the table in article 3 under the enactments set out in that table.

The Secretary of State, in exercise of the powers conferred by sections 71(1) and 181(2) of the Anti-social Behaviour, Crime and Policing Act 2014(a), makes the following Order.

Citation and commencement 1. —(1) This Order may be cited as the Anti-social Behaviour (Designation of the City of London Corporation) Order 2015. (2) This Order comes into force on 16th April 2015.

Interpretation 2. —(1) In this Order, “City of London Corporation” means— (a) in relation to and the Deer Sanctuary adjoining Epping Forest, the mayor and commonalty and citizens of the City of London acting by the Common Council of the City of London, acting as the Conservators of Epping Forest; (b) in relation to (including ) and Park, the Common Council of the City of London; (c) otherwise, the mayor and commonalty and citizens of the City of London acting by the Common Council of the City of London. (2) In this article, “Common Council of the City of London” means the Common Council of the City of London acting in a capacity other than as a local authority, police authority or port health authority.

Designation of the City of London Corporation 3. —(1) The City of London Corporation, having power to make byelaws in relation to the land specified in column 1 of the table set out below (“the table”) under the enactments set out in

(a) 2014 c. 12. column 2 of the table, is designated under section 71(1) of the Anti-social Behaviour, Crime and Policing Act 2014 in relation to that land. (2) In the table, “Open Spaces Act 1878” means the Corporation of London (Open Spaces) Act 1878(a).

District Council and the London Boroughs of Newham, Redbridge and Waltham Forest Farthing Downs in the London Borough of Section 11 of the Open Spaces Act 1878. Croydon Hampstead Heath (including Golders Hill Park) Section 15 of the Open Spaces Act 1906 (as in the London Boroughs of Barnet and Camden applied by article 32 of, and Schedule 5 to, the London Authorities (Property etc.) Order 1964(f), and by article 5 of the London Government Reorganisation (Hampstead Heath) Order 1989(g)). in the London Borough of Section 11 of the Open Spaces Act 1878 (as Haringey applied by section 8 of the Highgate and Kilburn Open Spaces Act 1886(h)). Amendment of the London Government Reorganisation (Hampstead Heath) Order 1989 4. —(1) The London Government Reorganisation (Hampstead Heath) Order 1989 is amended as follows. (2) In article 5(5), after “this Order” insert “or the Anti-social Behaviour (Designation of the City of London Corporation) Order 2015(a)”.

EXPLANATORY NOTE (This note is not part of the Order) This Order designates the City of London Corporation (in the various capacities in which it exercises power to make byelaws in relation to open spaces outside of the City of London) for the purposes of section 71 of the Anti-social Behaviour, Crime and Policing Act 2014 (c. 12) (“the 2014 Act”) in relation to specified land. As a result of the designation, the City of London Corporation (in its various capacities) has the powers of a local authority under Chapter 2 of Part 4 of the 2014 Act in relation to the specified land. This includes the power to make public spaces protection orders and to authorise persons to issue fixed penalty notices. This Order also amends the London Government Reorganisation (Hampstead Heath) Order 1989 (S.I. 1989/304) in order to ensure that the powers conferred under this Order may be exercised in relation to Hampstead Heath (including Golders Hill Park).
