Scratch Time is prior to 10:30 A.M. the day of the race. ALL PARTICIPANTS MUST COMPLY WITH THE FOLLOWING:

1. The applicant shall enter and race the horses listed on the stall application which have been assigned free stall space by Delaware Park in races which they qualify and are eligible unless the racing secretary agrees otherwise in accordance with good horsemanship. 2. All horses entering the grounds of Delaware Park are required to have a valid “certificate of vaccination” for equine influenza and rhino pneumonitis (evh) seven (7) to one hundred twenty (120) days prior to entry and a health certificate within the past ten (10) days. All horses including ponies are required to have a negative coggins test certificate issued within the past twelve (12) months. These documents must accompany the horse(s)/ponies for entry to the stable area. 3. Delaware Park reserves to itself the exclusive right and sole discretion to enter, modify, alter or change the physical condition or use any of its facilities, wherever located on the premises. Further, Delaware Park reserves the right and sole discretion to reduce the number of stalls assigned and/or change the locations of these stalls assigned to the undersigned. 4. Water consumption will be monitored in the Delaware park stable area. All faucets must be turned off when not in use. Automatic shut-off nozzles must be used on all hoses. Internet Access - 5. It is illegal to use household extension cords in the stable area - three prong grounded ext. Daily Info Updates cords must be used. Violators will be subject to stall allocation revocation. 6. Due to federal EPA regulations, all horses must be bathed on the designated wash pads, biodegradable soap only. For all Emergencies on property using a Delaware Park house or barn phone dial 7777. 7. It is the trainer’s responsibility to keep all trash picked up outside of assigned stalls and bunkhouse rooms. wash station areas shall be kept free of horse manure and debris at all times 8. No washing machines, round pens & window a.c. units in bunkhouses. Violators will be subject to stall allocation revocation. 9. There will be a $250.00 deposit for bunkhouse room. deposits will be refunded by request at the conclusion of the season providing: a) Bunkhouses are maintained, to the satisfaction of Delaware Park. b) The key is returned. Periodic inspections of bunkhouses may be conducted during the racing season. 10. All horses entering the Delaware park stable area will be verified to agree to your stall application and/or must have approval from the racing secretary’s office. The foal certificate/registration must be filed in the racing office. Violators will be subject to stall allocation revocation. 11. No dogs will be allowed in the Delaware park stable area. All cats must be spayed/neutered. 12. Oat cookers must be used with a metallic container. Cause of fire subject to immediate revocation. 13. No firearms permitted on the premises. 14. Electrolytes are permitted on race day. No other substance of any kind can be in the electrolytes that may result in a positive. No drugs may be administered with the electrolytes. (Trainers should check the ingredients on all electrolyte packages to be sure that there is no other substance in the electrolyte.) If not certain, consult your racing commission veterinarian. 15. No horse will be allowed to leave the grounds once on the overnight until after the horse has run. Any horse taken off grounds will necessitate an automatic scratch. Equine shipping requirements for Delaware Park:

All horses (including ponies) entering the grounds of Delaware Park are required to present the following documents on arrival: 1. A valid Certificate of Veterinary Inspection “Health Certificate/CVI” from the state of origin. It must be issued by an accredited veterinarian on an official state health certificate within the past ten (10) days. Clinic Letterheads are not accepted 2. A valid Certificate of Vaccination for Equine Influenza Virus “Flu” and Equine Rhino pneumonitis Virus “Herpes” which must be administered prior to seven (7) days of arrival to Delaware Park and within one hundred and twenty (120) days by an accredited Veterinarian or the vaccination dates can be entered on the Health Certificate (CVI). 3. A negative Coggins test dated within the last twelve (12) months. It is the trainers’ responsibility to keep a current coggins on file in the Stall and Horse Identifier offices. Blood Drawn slips are not accepted

Horses that are currently stabled at Delaware Park and are being taken off or returning to the premises for any reason such as “Race & Return, Vet & Return, Farm & Return, etc.” must present: 1. A Health Certificate/CVI not older than ten (10) days which must also contain the vaccination dates of the Equine Influenza Virus (“Flu”) and Equine Rhino pneumonitis Virus (“Herpes”) and/or accompanied by a Vaccination Certificate. 2. A Valid Coggins (within 12 months) which if not on file in the Stall Office must be presented at time of re-entry.

Worker’s Compensation and General Liability All horsemen stabled and racing at Delaware Park are required to have a certificate of Insurance for Worker’s Compensation covering stable employees and contract jockeys in the State of Delaware. *General Liability Policy, Farm Owner’s Policy and / or Stable Liability Policy, as applicable - $1,000,000 per occurrence / $2,000,000 aggregate / $10,000 medical, with Delaware Park Management Company, LLC and Delaware Park Racing Association names as additional insureds. Workers Compensation Insurance for all employed personnel in accordance with the statutory requirements of The State of Delaware.

*All certificates shall provide that Delaware Park shall receive at least thirty (30) days advance notice by the insurer of any cancellation or material change in coverage.

Over 3,000 thoroughbreds are “Delaware Certified” and eligible to participate during the 2021 Delaware Park meet for 50%* owner purse enhancements and certifier bonuses. bonuses in 2021! The Delaware Bred or Certified Thoroughbred Program (DCTP) owners receive 25% of purse share for the first through third place earnings. DCTP earnings are paid to owners with purse money and are considered part of the horse’s official earnings. Delaware Bred or Certified are preferred in all races, if condition eligible.

At the end of each month, DCTP certifiers receive their cumulative bonuses of 25% of any first, second or third place earnings.

The 2021 meet will run four DCTP stakes races. The Small Wonder and The First State Dash are both 2-year-old Delaware Bred or Certified restricted five and one half furlongs stake races. The Tax Free Shopping Distaff and The New Castle are both six furlongs stake races for Delaware Bred or Certified horses three and up. All four races have free nominations and will run on Saturday, September 25, 2021.

The Governor's Day and George Rosenberger Memorial Stakes have been granted a purse supplement of $50,000 for Delaware Certified eligible horses that run and finish first, second or third. (Purse total will be $125,000 for DCTP horses.)

ASSOCIATION SCRATCH POLICY

In order to preserve the free benefits granted by Delaware Park, along with the stalls and all training privileges, the Association in return insists that horse(s) stabled on Association premises enter and run at Delaware Park.

For that reason, anyone intending to enter and/or run at another race meet must contact the Racing Secretary, prior to entering elsewhere, to receive approval.

Thank you for your consideration into this matter.

ASSOCIATION SCRATCH POLICY

The following rules are crucial to reassure that the Delaware Park, Purse Accounts and the racing fans are given a chance to wager on an acceptable amount of betting interests. We ask for your teamwork for the benefit of all parties involved.

There will be no exceptions to these rules.

Scratch time is prior to 10:30 A.M. the day of the race. Scratches will be made from off the program. Once a horse has been drawn into a race, or appears on the alternate list they are considered a Starter. Any Owner, Trainer or other duly authorized person wishing to scratch out of an engagement to race must do so prior to 10:30 a.m. the day of the race, Stake races exempt. The scratching of a horse out of an engagement for a race is irrevocable. The Stewards must approve all scratches. In a race other than a Stake, no horse shall be permitted to scratch if the number of betting interests remaining in the race number less than eight (8), unless the Stewards permit a lesser number. Where there are more requests to scratch, that if granted, would leave a field of less than eight (8) betting interests, the Stewards shall determine which entrants may be scratched and permitted to withdraw from the race.

Any horse appearing on the alternate list and is re-entered will be an automatic scratch off the alternate list providing the race fills and the horse draws in the body of the race.

For any and all VET scratches, horses will be placed on the Veterinarian List for nine (9) days starting the day after the race. Horses will not be permitted to race during that time.

Any horse appearing in the body of a race must receive permission from the Racing Secretary to re-enter and will be an automatic scratch the previous day of entries providing the race fills and the horse draws in the body of the race. (Stake races excluded).

Per Rule 11.14.1.5 - The Stewards will review all cases in which a horse is entered to run at a licensed track in Delaware, while appearing in the entries in another racing jurisdiction, during the five day entry period for Delaware. It shall be a violation of these Rules for a licensee to scratch a horse entered to race in Delaware in order for said horse to race in another jurisdiction within the five day entry period. Violations of this Rule absent of mitigating circumstances, will be subject to fines of not less than $1,000 and no more than $2,500. This rule shall not pertain to Handicap and Stake races.

Trainers have until 45 minutes prior to post for Stake races to scratch their horse without reason.

Preference Dates: Entries

Delaware Bred or Certified Horses have preference in all races providing they meet condition eligibility requirements. (Stake Races Excluded)

The Preference Dates are GOOD FOR ANY DISTANCE & SURFACE.

Preference dates will not supersede conditions of a race. Horses will not be eligible to receive a Eligibility Zero (0) date until their papers and/or digital papers are on file in the racing office or have been scanned. All horses registered prior to NOON, Wednesday, May 19th, will receive a zero (0), which is the lowest possible date. All horses registering after NOON on Wednesday, May 19th, will receive a one (1) or preference corresponding to the day of the meeting when registered. A zero (0) has first preference. Horses entering for the first time but not getting in a race that fills, (i.e. placed on the A.E. or are excluded), will receive an entry date corresponding to the date of which they entered for. NO DATE ONLY ENTRIES. Entry Preference for all surfaces (Dirt/Turf):

Horses which have established a date at the current meeting will lose their preference should they race elsewhere and must reestablish a preference date at this meeting.

Horses that run or have the opportunity to run will receive a preference corresponding to the date they race and lose all dates previously held, (i.e. R1 would correspond to a horse running Entry Schedule: on the first day of the meet.). This excludes stakes and handicaps. If a race scheduled on the turf is transferred to the dirt all starters will receive a (*) date, the (*) date is most preferred. The (*) date is good for the next entry made at Delaware Park. If horse races elsewhere the (*) date is lost.

Horses which scratch or are scratched will receive an (S) date upon which date they scratch. Bonuses / 2021 The (S) date is least preferred, REGARDLESS IF DELAWARE BRED OR CERTIFIED AND/OR STABLED ON GROUNDS. Delaware Bred or Certified Horses An up to date preference list will be made available after the overnight list is out. Any omissions, discrepancies, errors etc. must be lodged prior to the next drawing of entries. Maiden Delaware Bred or Certified Horses may enter for the waiver in all Maiden Claiming events of $25,000 and up. All horses placed on the Stewards, Veterinarian or Starter lists will be available in the racing office. They will not be permitted to enter until they have been approved to start. Naming a Rider

In no way does the claiming, ownership transfer or trainer transfer of a horse affect the preference date. When a horse’s name appears in a race, other than a stake, and is entered DTRC Rule 11.2.10 for the following day, such entry will be given no consideration should the race in which it is entered be overfilled. It is the responsibility of a person making an entry to claim preference at time of entry. The stewards will consider no claims that do not comply with above regulations Check On/Off time

Coupled Entries

Division of Purses - All purses will be divided up as follows

Preference Dates: Entries May close by 10:30 am or when deemed appropriate by the Racing Secretary. Owners and Trainers, when entering horses in races, are cautioned to check carefully as to the eligibility of horses in their care and allowances claimed in races. Under the universal rules of racing, an Owner or Trainer is responsible for the weight his horse carries. The Racing Secretary will be glad to give the horsemen any information in respect to their horses that is desired, but the final responsibility rests with the Owners and Trainers. Hunt Meet races are not considered in either eligibility or weight allowances. The right is reserved to change or withdraw any unclosed race.

Eligibility The following horses will not be eligible to STABLE or RACE at Delaware Park:

1. Horses which have started eight (8) or more times consecutively without finishing 1st, 2nd, 3rd, 4th or 5th. Allowance, Stake and Handicap races are exempt. 2. Maidens Eight (8) years of age or older and horses over twelve (12) years of age will not be eligible for stall space or permitted to start. 3. Without Proof or Confirmation of Worker’s Compensation and General Liability.

Bonuses / 2021 - Bonuses will be awarded to the owners of horses which start in a race and finish out of the money. That Bonus will be $125.

Delaware Bred or Certified Horses - Receive preference in Races providing they meet condition eligibility requirements. (Excluding Stakes) Maiden Delaware Bred or Certified Horses may enter for the waiver in all Maiden Claiming events of $25,000 and up.

Naming a Rider – All Trainers must secure a call with a jockey’s agent prior to making an entry. It is the trainer’s responsibility, at the time of entry, to list all backup riders including an apprentice if a call has not been secured prior to entry.

DTRC Rule 11.2.10 – In order to claim an apprentice allowance, at the time of entry an apprentice jockey must be named, including backup rider.

Check On/Off time – Check time will be the following day entries are taken and that time will be 9:30 A.M. All mounts not checked on will have a rider appointed by lot by the stewards.

Coupled Entries - Any race of which two different owner entries are made will automatically be uncoupled. Same owner coupled entries are both allowed to race in trifecta wagering races.

Division of Purses - All purses will be divided up as follows: 60% to the Winner, 20% to Second, 11% to Third, 6% to Fourth and 3% to Fifth.

Salix (Furosemide/Lasix) Schedule Equipment Changes - All equipment changes must be made at time of entry. Any late changes must be approved by the Stewards. Blinker changes off a win can only be approved by the Stewards. The use of nasal strips are permitted.

Horsemen’s Bookkeeper (Cindy Houghton – x7262) - The Office is open until after the last race on racing days to transact business with horse Owners, Trainers, and Jockeys. The office will be closed on Tuesdays, Fridays and Sundays (unless a race day). In order to transact business efficiently, Owners, Trainers and Jockeys need to be sure the Bookkeeper has accurate information on names, addresses and tax identification numbers. If your address has changed since being licensed, please notify the Bookkeeper. Internal Revenue Service regulations require current names and tax identification numbers (Social Security numbers) to be on file. In accordance with Delaware State Income Tax Law, all Owners, Trainers and Riders are required to file income tax returns with the State of Delaware for any monies earned within the State.

Horsemen’s Checks - Internal Revenue Service regulations require submission of signed W-8 or W-9 forms with Federal ID number or Social Security number in order for checks to be issued. Failure to file these forms will require 31% withholding of all funds. Please contact the Horsemen’s Bookkeeper for further information.

Workouts - Any horse not starting in the last sixty (60) days must have one (1) Official work before being allowed to start. First Time Starters, must have two (2) Official works (and be okayed from the gate) before being allowed to start. All horses entering the track for training shall be identified by name (if unnamed by breeding), type of workout, distance and name of Trainer. Failure to report this information to the clocker @ ext. 7242 will be referred to the Stewards. Instructions for Bleeder Certification

SALIX (Furosemide/Lasix) NOTICE - The ONLY permissible medication at Delaware Park will be SALIX, and ONLY can be administered by the appointed Delaware State Veterinarian.

Salix (Lasix/Furosemide) horses shipping in must be in the detention barn four and half (4 1/2) hours before post time for their race (refer to the furosemide schedule on the next page).

Horses shipping in to run, not on Salix (Lasix/Furosemide) must be on the grounds three (3) hours prior to their race or no later than 12 p.m.

Shipping to Delaware Park - All horses shipping into Delaware Park (Race & Go) must enter the stable area through Gate 4 (Stable Gate) and unload at the AG gate. The Stable Gate is accessible by exiting off I-95 at exit 4-B, and merging onto Churchman’s Road and straight past hospital to the back entrance. Trainers must check in with the Receiving Barn Personnel immediately upon arrival. Each horse must be out of the receiving barn by 7:00 p.m. day of race, unless permission has been granted. Trainers are responsible for the correct information on the Health Certificate (including the spelling of name of horse, accurate Coggins and Vaccination Dates) for all their horses shipping in/out of the Stable Gate. Horses shipping in to run at Delaware Park prior to the day of race must have permission from the Receiving Barn or must contact the Stall Superintendent prior to arriving. We require expected time of arrival and number of horses shipping in. You must have a valid Coggins Test, Vaccination Records and

Health Certificate to enter the stable area. All vans & vehicles must register at Gate 1 (Main Gate).

Salix (Furosemide/Lasix) - A horse that bled for the first time shall not be permitted to run for a period of ten (10) calendar days beginning the following calendar day. A horse, which bleeds a second time, shall not be permitted to run for thirty (30) calendar days. A horse, which bleeds a third time, will not be permitted to run for ninety (90) calendar days. A horse, which bleeds a fourth time within a calendar year of the first bleeding incident, shall be barred from further racing in the state of Delaware. If a Workouts horse’s fourth bleeding incident occurs more than one (1) year after the first bleeding incident, the horse shall not be barred, but shall not be permitted to run for one (1) calendar year. A positive endoscopic examination may be classified as a first time bleeder.

Instructions for Bleeder Certification 1. All certificates must be turned into the Salix/Lasix office within 24 hours. Certificates will not be SALIX (Furosemide/Lasix) NOTICE - accepted after that time. 2. Certificate may not be distributed to Trainer until a State Veterinarian has signed it. 3. Veterinarians must obtain the foal papers of the horse (or a copy of them) in order to verify the Salix (Lasix/Furosemide) horses shipping in must be in the detention barn four and half correct name and tattoo. (4 1/2) hours before post time for their race (refer to the furosemide schedule on the next page). 4. Horses must be; tattooed and/or digitally tattooed with a microchip and named before being scoped for bleeder certification. No name, no tattoo, no scope!! Horses shipping in to run, not on Salix (Lasix/Furosemide) must be on the grounds three (3) hours 5. All information on certificate must be printed legibly. prior to their race or no later than 12 p.m. 6. Veterinarians must sign the certificate and then print their name. 7. Two Year Olds - Two year olds are allowed to race on Furosemide, if certified as a bleeder.

13.1.2 SHOE RULE Toe Grabs with a height greater than Four (4) millimeters on the front shoe WILL NOT BE PERMITTED. Bends, Jar Caulks, Stickers or any other traction device on the front shoes of horses are not permitted while racing or training on all surfaces. Bends with a height no greater than a Quarter (¼) Inch on the Hind Shoes will be permitted. 13.18

Turf Course Shoe Rule Shoes with Outer Rims, Caulks, Stickers, Blocks, Bends, Raised Toes, Turndowns, Mud nails or Any Extended Toe Grab WILL NOT BE PERMITTED on the turf course. 13.6.1 Flat, Queen’s Plate, Queen’s Plate XT and/or Factory Wedge Queen’s Plate WILL BE PERMITTED for use on the turf course. when transferred to the main track.

Tattoos/Digital Tattoos Required Claiming Rules: 13.1.1 - In Claiming races, any horse is subject to claim for its entered price by any Owner in good standing, and who has started a horse at the race meeting at which the Claim is made.

13.1.2 - An Owner may Claim out of the race in which he first starts a horse. 13.12.3 In the event a SHOE RULE horse dies during a claiming race or is euthanized on the racetrack during a claiming race, any claim on that horse will be declared void.

13.18 - Caveat Emptor: Notwithstanding any designation of sex or age appearing on the racing program or in any racing publication, the claimant of a horse shall be solely responsible for determining the age Turf Course Shoe Rule or sex of the horse claimed.

13.6.1 - No horse claimed in a Claiming race shall be sold or transferred, wholly or in part, to anyone within (30) days after the day it was claimed, except in another claiming race. A horse claimed by an Owner that has started a horse at the current meet and by a Trainer that is currently stabled on the grounds of the Association, shall not be permitted to run in another racing jurisdiction for the period of sixty (60) days, beginning the day after the claim was made, or until the end of the current meet, Turf Races whichever comes first. A horse that is claimed by an Owner that has started a horse at the current x meet, by a Trainer that is not currently stabled on the grounds of the Association, shall not be permitted to race elsewhere until the close of the meeting which it was claimed. The Stewards shall have authority to waive Rule under application, so as to allow a claimed horse to race in a Stakes race. The Stewards may also permit a horse claimed in a Steeplechase or Hurdle race, to race elsewhere in a Steeplechase program, if such a Program ends before the close of the meeting at which it was claimed.

13.20.1 (Waiver Claim) – At the time of entry into a claiming race, the owner may opt to declare a horse ineligible to be claimed provided that the horse has been laid-off and has not started for a minimum of 120 days since its last race and is entered for a claiming price equal to or greater than the claiming price of the horses last start. All horses that elect to enter for the waiver and win, that win will be considered a claiming win at the entered level for Delaware Park race conditions eligibility. Please contact all surrounding racing jurisdictions to clarify their eligibility pertaining to this condition.

Who May Make a Claim? A. In claiming races, any horse may be claimed for its entered price by any Managing Owner (or his x duly Authorized Agent) if the Managing Owner is presently registered in good faith and has started a horse, up to or including the race in which the claim is made. Such claim may be for the account only of the Managing Owner making the claim, or for the ownership of the horse which establishes such Managing Owner’s right to claim, as indicated by the Managing Owner making the claim, as indicated by the Managing Owner on the claim blank. However, no person shall claim his own horse or cause his own horse to be claimed directly or indirectly for his own x account. x B. Where the Managing Owner is a partnership, only such partnership through its Managing Partner or such Managing Partner’s duly Authorized Agent may claim.

Delaware Park reserves the right to transfer any C. A new Owner, i.e., an Individual Partnership, Corporation or any other authorized racing interest scheduled turf race to the main course because of who has not held an Owner’s license in any racing jurisdiction during the prior year, is eligible to track condition. In the event a race must be claim one horse by obtaining an “Open Claiming License” from the Delaware Thoroughbred transferred from the turf to the main course, the Racing Commission. Conditions for Starting a Claimed Horse - If a horse is claimed it shall not start in a claiming race for a Claim Irrevocable When Lodged period of twenty (20) days from the day after the claim for less than twenty-five (25) percent more than the amount of which it was claimed. The day claimed shall not count, the following calendar day shall be the first day and the horse shall be entitled to enter whenever necessary so that it may start on the Collusive Claiming Punished: twenty-first (21) calendar day following the claim at any price. This provision shall not apply to starter handicaps, allowances, and starter allowance races.

Requirement for Claim: Determination by Stewards - All claims shall be in writing, sealed and deposited in a locked box provided for this purpose by the clerk of the course, at least ten (10) minutes before post time. No money shall accompany the claim. Each person desiring to make a claim, unless he shall have such amount to his credit with the association, must first deposit with the association the whole amount of the claim in cash, for which a receipt will be given. All claims shall be passed upon by the Stewards and the person determined at the claiming time for claiming to have the right of claim shall become the Owner of the horse when the start is effected, whether it be alive or dead, sound or unsound or injured during the race or after it, unless the age of such horse has been misrepresented, and subject to the provisions of subdivision (b) of this section. If more than one person should enter a Stewards Certificate to Claim claim for the same horse, the disposition of the horse shall be decided by lot by the Stewards. An Owner shall not be informed that a claim has been made until after the race has been run, and any horse so claimed shall be delivered to the Claimant. Both the claim form and envelope must be filled out completely and must be accurate in every detail. A post-race test may be taken from any horse claimed out of a claiming race. The Trainer of the horse at the time of the entry for the race from which the horse was claimed shall be responsible for the claimed horse until the post-race sample is collected. Any claimed horse not otherwise selected for testing by the Stewards shall be tested if requested by the Thirty Day Prohibition - Sale of Claimed Horse Claimant at the time the claim form is submitted in accordance with these Rules. The successful Claimant shall have the right to void the claim should the forensic analysis be positive for any prohibited substance, an illegal level of a permitted medication, or if a blood sample exhibits a positive response to the erythropoietin (EPO) antibody test.

Rule 15.1.3.1.13 Erythropoietin (EPO) - A finding by the official chemist that the antibody of erythropoietin (EPO) was present in a post-race test specimen of a horse shall be promptly reported in writing to the Stewards. The Stewards shall notify the Owner and Trainer of the positive test result for erythropoietin antibodies. The Stewards shall notify the Commission Veterinarian of the name of the horse for placement on the Veterinarian’s List, pursuant to Rule 5.32, if the positive test result indicates that the horse is unfit to race. Any horse placed on the Veterinarian’s List pursuant to this Rule shall not be permitted to enter a race until the Owner or Trainer, at their own expense provides proof of a negative test result for EPO antibodies from a laboratory approved by the Commission provided said test sample is obtained under collection procedures acceptable to the Commission or its designee under these Rules. Notwithstanding any inconsistent provision of these Rules, a horse shall not be subject to disqualification from the race and from any share of the purse in the race and the Trainer of the horse shall not be subject to application of the Trainer’s responsibility based on the finding by the laboratory that the antibody of erythropoietin was present in the sample taken from that horse.

Limitations on Claims: a. No person shall claim more than one horse in a race. b. No Authorized Agent, although representing more than one Owner, shall submit more than one claim in any one race. c. When a stable consist of horses owned by more than one person, trained by the same Trainer, not more than one claim may be entered on behalf of such stable in any one race. d. An Owner who races in a partnership may claim in his or her individual interest if the individual has started a horse in the partnership. e. The individual must also have an account with the Horsemen’s Bookkeeper that is separate from the partnership account.

Claim Irrevocable When Lodged - When a claim has been lodged with the Secretary, or the Clerk of the Course, it is irrevocable, and is at the risk of the Claimant.

Collusive Claiming Punished: a. Should the Stewards be of the opinion that any person is claiming a horse collusively for the benefit of another interest or in order to evade the provisions of any section of this Article, they may require him to make an affidavit that he is not so doing, and if upon proof it be ascertained that he make a false affidavit, he shall be referred to the commission for further action.

b. Should the Stewards within 24 hours after the running of a race be of the opinion that the lease of the entry of a horse was not made in good faith but made for the purpose of obtaining the privilege of entering a claim, then in each case may disallow or cancel any such claim and order the return of a horse that may have been delivered and refer the case to the Commission for further action.

Stewards Certificate to Claim - An Owner whose stable has been eliminated by claiming or fire or other hazards shall have the right to claiming during the remainder of the meeting at which his stable was eliminated, or for the next thirty (30 days). If the thirty (30) day period shall extend into the next succeeding meeting of the Racing Association, the Owner must obtain a certificate from the Stewards of the meeting at which he lost his last horse, and must present the certificate when filing a claim at the next meeting.

Thirty Day Prohibition - Sale of Claimed Horse - No horse claimed in a claiming race shall be sold or transferred, wholly or in part, to anyone within thirty (30) days after the day it was claimed, except in another claiming race.

Apprentice Allowance for Jockeys - An Apprentice Jockey may claim the following weight allowances in Equine Vaccines all overnight races except stakes and handicaps: a) Ten pound allowance beginning with the first mount and continuing until the Apprentice has ridden five winners. (Also A ten pound apprentice rider will not be allowed to ride a First Time Starter (FTS) and will not be allowed to ride on the Turf Course, Per Stewards.) b) Seven pound allowance until the Apprentice has ridden an additional thirty five (35) winners; and c) If an Apprentice has ridden a total of forty (40) winners prior to the end of a period on one year from the date of riding their fifth winner, the Apprentice jockey shall have allowance of five pounds until the end of that year, d) If after one year from the date of the fifth winning mount, the Apprentice Jockey has not ridden forty (40) winners, the applicable weight allowance shall continue for one more year or until the 40th winner, whichever comes first. In no event may a weight allowance be claimed for more Helmets and Vests than two years from the date of the fifth winning mount, unless an extension has been granted.

Bunkhouse Rules - A deposit of $250.00 for Bunkhouse/Room will be required by the trainer or occupant to cover any theft or damage to the room, including but not limited to Blinds, Smoke Heel Nerved Detectors, Smoke Detector Batteries, Fire Extinguishers, and Sprinkler Systems. No deposits will be returned until the room key has been returned and said Bunkhouse/Room passes inspection by the Stall Office Personnel. CORNELL™ COLLAR PROCEDURES FOR USE AT DELAWARE, The trainer must submit a letter to the Stewards from a licensed Delaware veterinarian stating the use of the Cornell™ collar is justified and appropriate for use on the horse in question. The trainer, in consultation with that licensed Delaware Licensed Personnel veterinarian, shall be responsible for the proper placement of the Cornell™ collar. Use of the Cornell™ collar must be declared at time of entry for that race. When the horse is brought over to the paddock, the Paddock Judge will visually inspect the Cornell™ collar to determine if it is properly installed. If not, then the Paddock Judge will notify the Commission Veterinarian. The Commission Veterinarian will then instruct the trainer of the horse to check the apparatus to ensure that it is properly fitted. The Commission Veterinarian will then notify the Stewards so that it can be duly noted in their daily report. Once a horse races with the Cornell™ collar, it must continue to race with this equipment unless the attending Delaware licensed veterinarian submits a letter to the Stewards stating that the use of the Medication Summary of Commission Rule Changes Cornell™ collar is no longer appropriate for that horse. Only authentic Cornell™ collars will be approved for such use. No knock-offs or substandard/home-made equipment will be allowed for use. Once a Milligrams per Milliliter Penalties horse has had the equipment approved, and if at some later date that equipment is no longer appropriate, and then use of the Cornell™ collar is prohibited. However, if the horse in question has a different trainer, they may re-certify the horse following the initial procedures outlined herein.

Apprentice Allowance for Jockeys - Equine Vaccines - It is the recommendation of the Delaware Thoroughbred Racing Commission that horsemen vaccinate their horses utilizing the various vaccines that are available to them through their private Veterinarians. The following vaccines are available through Veterinarians: 1) Influenza and Rhino pneumonitis (Flu and Rhino) (REQUIRED) 2) Clostridium Botulinum (Botulism) 3) Clostridium Tetani (Tetanus) 4) West Nile Encephalomyelitis (West Nile Virus) 5) Rabies 6) Equine Protozoal Myelitis (EPM) 7) Eastern and Western Encephalomyelitis 8) Streptococcus Equi (Strangles)

Helmets and Vests - All persons (Jockeys, Trainers, Outriders, Exercise Riders and Pony Riders) shall wear safety helmets and vests of a type approved by the Delaware Racing Commission specifications while riding astride a pony or horse on Delaware Park property. Bunkhouse Rules Heel Nerved - All heel-nerved horses must be reported to the Racing Secretary by the Trainer when registered for racing. After registration, approval by the Track Veterinarian is necessary.

Hunt Meet - Hunt Meet races are not considered in either eligibility or weight allowances. Are considered a published workout.

Licensing - The Delaware Racing Commission will charge a fee for licensing and fingerprinting (this Coggins includes all persons participating in racing). All owners, trainers, and their employees must be licensed. Fees for an Owner or Trainer license are $50.00. All licensees must have a valid Delaware Racing Commission picture ID. Trainers employing unlicensed help are subject to disciplinary action. No license will be issued to any trainer who is not properly covered by Worker’s Compensation and General CORNELL™ COLLAR PROCEDURES FOR USE AT DELAWARE Liability for the state of Delaware.

Licensed Personnel - All who enter the Stable area in any capacity whatsoever, shall wear upon the outside apparel in a prominent position, the authorized badges containing picture identification supplied by the Delaware Racing Association, and this shall apply to State, Track, Veterinarian personnel, as well as the vendors and suppliers authorized in the stable area. We ask that all who enter the backside are not to: walk along or through the golf course, unless they are a paid patron. Additionally, the authorized badges shall be readily available and produced by such personnel upon request of Track Security, City, County or State Police, Inspectors, and Stewards at said request.

Attention Horsemen - Experimental drugs awaiting FDA approval and drugs not authorized for use in the United States shall not be used or possessed on the grounds of Delaware Park. The possession of Blood-doping agents i.e. Epogen, Procrit and Aranesp and similar agents are strictly forbidden. This list of prohibited drugs will be updated as necessary. As the health and welfare of the horse is paramount, the official Delaware State Racing Commission Veterinarian may consider special requests on an individual basis.

Prohibited Practices - The following conduct shall be prohibited for all licensees:

a) The possession and/or use of a drug, substance, or medication, specified below, on the premises of a licensed race track under the jurisdiction of the Commission for which a recognized analytical method has not been developed to detect and confirm the administration of such Shavings Restriction substance including but not limited to erythropoietin, darbepoietin, and perfluorcarbon emulsions; or the use of which may endanger the health and welfare of the horse or endanger the safety of the rider; or the use of which may adversely affect the integrity of racing. Shock Wave Therapy/Instruments b) The possession and/or use of a drug, substance, or medication on the premises of a facility under the jurisdiction of the regulatory body that has not been approved by the United States Food and Drug Administration (FDA) for use in the United States.

Rule 15.12 - Would prohibit the possession or use of substances or medications for which there is no recognized analytical method including erythropoietin and substances which endanger the health and welfare of a horse, or are not approved by the FDA.

Paddock Attire - Delaware Park requires all licensed personnel attending a horse in the paddock area to be properly attired and to have a neat, clean appearance: Cut-offs, tank-tops, halter-tops, ripped or torn clothing, sagging pants, backward ball caps, sandals, flip-flops or any open toed shoe(s) are Stakes unacceptable. All Grooms are encouraged to wear a collared shirt and khaki pants. If the attire worn, by a licensed personnel, to the paddock is unacceptable, said person(s) will be asked to leave the paddock area immediately and will not be allowed to return until properly attired. By order of Delaware Park Management Owners, Trainers, Persons and their Employees are not allowed in the paddock area, unless they have a horse in such race. Stall Office – Paddock Schooling - The Paddock will be open for schooling in the morning only on Mondays and Wednesdays from 9:30am to 10:30am. For race day schooling please contact the paddock judge to make proper arrangements.

Post Parade Attire - All pony people escorting horses to the post must wear the required attire. Proper Starter Allowance races attire will be strictly enforced by the Outriders. Proper attire includes the following: White Helmet Cover, White Shirt, Hunter Green Protective Vest, Tan or Khaki Pants, Green Saddle Towels, Delaware Park Issued Jackets (If needed). Starters Fee

Obviously, if a fall occurs, the Stewards will demand an inquiry. If for any reason the Outrider is unable to communicate to the Attention Horsemen Stewards, there will be no Official for that race until all Jockeys have weighed in. It is understood that the outrider’s number one priority is to catch a loose horse and this responsibility takes precedence over the “Quick Official”. To permit an Owner or Trainer to request a claim of foul or to put a race on hold, telephones are available at the following locations: Winners Circle, Paddock Security Office, Racing Secretary’s Office and the Dining Room Maître d’s desk. Or they can tell the Clerk of Scales to communicate their wishes of a claim of foul, or to put the race in question on hold to the Stewards. Jockeys will continue to weigh in after the race in the same fashion as is customary. The Jockeys who Prohibited Practices have registered a foul will immediately contact the Stewards upon dismounting. At any time the outrider is not confident regarding the decision to permit a “Quick Official” he will request the race to be put on hold.

Shavings Restriction - Shavings stalls will be disbursed on a limited basis. Please inquire with the Stall Superintendent. Trainers in violation of shavings policy will be subject to Fines.

Shock Wave Therapy/Instruments: a) No person may possess on a licensee’s race track an instrument used for shock wave therapy. b) No horse may be treated with any form of shock wave therapy within ten (10) days of racing (the day of the treatment shall be considered the first day in counting the number of days). c) The administration of shock wave therapy may only be performed by a licensed Veterinarian. A Rule 15.12 Veterinarian using shock wave therapy shall document and report each treatment on his daily medication report. d) A Trainer or Veterinarian who has been found to have violated any of the above provisions of this Rule shall be subject to disciplinary action by the stewards and/or Commission including but not limited to a maximum suspension of ninety (90) days.

Stakes - A fully paid entry in a stakes race, when denied the opportunity of drawing a post position at the time of the official draw; will be entitled to a refund of nomination and/or entry box fee. In all Handicap stakes and overnights, preference will be given to high weights (scale considered). In Allowance stakes preference will be given to horses that have accumulated the highest total earnings in 2020-2021, unless otherwise noted in specifics of race. Delaware Park LLC retains the right to postpone or reschedule any stakes race.

Stall Office – The Stall Office will be open on live race days from 8 a.m. until 5 p.m. Make sure that you Paddock Schooling plan for your horse’s arrival to avoid being delayed at the gate. All work order blanks must be turned into the Main Gate and be filled out in detail with a contact person. Emergency work orders can be called into ext. 7161 or 7253.

Post Parade Attire Starter Allowance races - Starter races will be treated as an Allowance race in eligibility and determining allowances. In any Starter Handicap and/or Starter Stakes where any part of the nomination, entry or start fees are included in the purse shall be considered a Stakes race.

Starters Fee - All starters will pay a $20.00 fee in lieu of any pony fees. These fees paid to the Association shall be for the account of the Delaware Horsemen’s Assistance Fund, to be used exclusively by it to assist needy persons connected with Delaware Racing.

Starting Gate Hours - Schooling will be conducted from 7:00am to 10:00am daily, except the gate will Bunkhouse Fire & Safety Regulations Continued: be closed on Friday and Sunday.

Tattoos/Digital Tattoos Required - All horses must be tattooed and/or digitally tattooed; along with a microchip provided by the Jockey Club, inserted for identification to start at Delaware Park. Please contact the Race Office or the Horse Identifier for more information in regards to the new digital process.

Transfers - After horses have been registered with the Racing Secretary listing their Owners, no horse will be transferred, (unless claimed during a meeting) without permission of the Stewards, who will require a notarized bill of sale from the registered Owner. For a Trainer transfer, both the former and the current Trainer must contact the Stewards for approval.

Training Hours - Note: All times are subject to change (due to time change and darkness). The Main track will be open for training from 5:30 am to 10:00 am daily. Breaks will vary.

Work & Go’s - Prior to arrival to Delaware Park Racetrack, all Work & Go’s must be OK’d by the Racing Secretary and Work Comp & Gen. Liability must be on file in the Stall Office.

Vehicles - All traffic signs Must Be Obeyed. Violators may lose driving privileges on Delaware Park Stable Area Fire & Safety Regulations: grounds and/or may be fined. All vehicles entering the backside/stable area, that are used by Owners, Trainers, Vendors and their Employees must be registered through Delaware Park Security. At the beginning of the racing season, registration will be offered at the Horsemen’s Office, all other times Vehicle Registration will be conducted at Gate 4 (Main Gate). All Visitors to the backside must stop at Gate 4 (Main Gate) or Gate 1 (Stable Gate) and be issued a “Day Pass”. It is the responsibility of the individual that is being visited to insure that Visitors adhere to Delaware Park traffic rules. No vehicle is permitted to be parked or driven on any grassy portion of Delaware Park property, horse paths or cause to obstruct any loading ramps, manure pit, bunkhouse roadway or left attended or unattended in any place designated “No Parking”. If driver or owner cannot be located, vehicle will be towed at owner’s expense. All horse trailers operated or parked on Delaware Park property must be registered with Delaware Park Security. Security will issue a Delaware Park registration sticker that will be placed on the vehicle so that it may be easily identified by Security personnel. Delaware Park Security will maintain a log of registered vehicles containing the contact information. Trailers that are not displaying a sticker to be identified are subject to towing at the owner’s expense. Commercial Vehicles which have been registered with Security and have a Delaware Park Car pass do not require a sticker. It is requested that you register your trailer with Security.

Wash Pads - Due to Federal EPA Regulations, all horses must be bathed on the designated wash pads.

Water Restriction - Water consumption will be monitored in the Delaware Park stable area. All faucets must be turned off when not in use. Automatic shut-off nozzles must be used on all hoses. No washing machines, bio-degradable soap only. (Violations will be subject to stall allocation revocation).

Bunkhouse Fire & Safety Regulations 1. It is Delaware Park’s policy and the recommendation of the Delaware State Fire Marshal’s Office that the following appliances and items be prohibited for use in all bunkhouses: a) No Washers, Dryers, Oat Cookers, Electrical Hot Plates, Toasters, Stoves, Ovens, Frying Pans, Crock Pots, Coffee Pots, Gas/Charcoal Grills or any other cooking device with the exception of Microwave Ovens in proper working condition. b) No Portable Heaters - Gasoline, Kerosene, Electrical, Propane or any other type of heating devices. Evacuation Procedures c) No Lawnmowers, Weed Eaters. d) No hanging items or materials on Sprinkler Piping.

Starting Gate Hours Bunkhouse Fire & Safety Regulations Continued: e) No Heat Lamps or any light bulb over 60 watts. f) No multiple electric outlet plugs or adapters. Tattoos/Digital Tattoos Required g) No candles or other open flames. h) No Window Air Conditioning Units allowed. 2. No Children will be permitted in Bunkhouse Rooms overnight. 3. The trainer and/or occupant of Bunkhouse Rooms will be responsible for Fire Prevention and Safety of the Bunkhouse. Transfers 4. No locks, other than those issued by Delaware Park Racetrack, will be permitted to secure any Bunkhouse Room. 5. Any damage/theft/tampering of fire detection or suppression equipment shall be reported to the Fire Command Department at Ext. 7777. All Bunkhouse Rooms are equipped with Smoke Detectors; missing detectors, equipment and/or batteries will be charged to the trainer and/or occupant of the Bunkhouse Training Hours Room. 6. All fires must be reported to Delaware Park Fire Command and Security immediately at Ext 7777. 7. Fire and Safety Inspections of each Bunkhouse will be conducted by Delaware Park Fire Command Work & Go’s and Security on a regular basis. All Bunkhouses are subject to Inspection unannounced and at any time. 8. All extension cords must be “UL” rated heavy duty three (3) prong grounded type.

Stable Area Fire & Safety Regulations: 1. No vehicle is permitted to be parked or driven under any barn, on any grass portion of Delaware Park property, or obstructs any fire hydrant or sprinkler riser shed. 2. Smoking is prohibited anywhere within the confines of a barn, horse shelter, shed row, bunkrooms and/or bunkhouses or in posted “NO SMOKING” areas. 3. Firearms WILL NOT BE ALLOWED ON THE PREMISES. 4. The following items are prohibited in or around a barn or horse shelter and/or bunkhouse: No electrical Hot Plates, Stoves, Ovens, Coffee Pots, Frying Pans, Crock Pots, Gas/Charcoal Grills or any other cooking device. No Portable Heaters - Gasoline, Kerosene, Electrical, Propane or any other type of heating devices. No Lawnmowers, Weed Eaters. No hanging items, equipment or materials on Sprinkler Piping. No Heat Lamps or any light bulb over 60 watts. No Open Flame Devices - matches, flares, lighters, charcoal, candles, etc. No Hay, Straw or Alfalfa stored in Tack Rooms. 5. Golf carts will be electrical type only, gas golf carts are prohibited. Golf carts will be properly maintained and insured by owner. Golf carts are prohibited in any shed row, tack room or inside any horse shelter, barn or stable. Wash Pads 6. The stacking of hay and straw will be limited to within (3) feet of any electrical panel, box, receptacle or fixture. Any violation by vendors or trainers will be grounds for a fine. Water Restriction 7. All trash receptacles must be kept at least 10 feet away from any barn or shed row. Trash receptacles are not permitted within the confines of any tack room, barn or shed row. 8. Fire and Safety Inspections of each stable unit will be conducted by Delaware Park Fire Command and Security on a regular basis. 9. Extension Cords it is illegal to use household extension cords in the stable area. All extension cords Bunkhouse Fire & Safety Regulations must be “UL” rated heavy duty three (3) prong grounded type. 10. The use of oat cookers must be used with a fireproof container. Anyone causing a fire will be subject to stall revocation. 11. Each barn is equipped with (2) water fire extinguishers. They are located at each end of the barn. All used or damaged fire extinguishers must be reported immediately to Fire Command (Ext. 7267).

Evacuation Procedures All individuals that work in the Stable Area and or reside in Bunkhouses at Delaware Park should familiarize themselves with Evacuation Procedures.

Fire & Medical Response Procedures Delaware Park Fire Command will provide Fire & Medical response in the Barn/Stable and Bunkhouse areas 24 hours a day, 365 days a year. Activation of Fire or Medical emergency response personnel will be initiated by calling the Emergency Telephone Number 7777 on any house telephone on the backside. Each telephone is equipped with an Emergency Telephone Sticker indicating the Emergency Number; Emergency Telephones are located in each Barn, Horsemen’s Office, Tack Shop, Stall Office, Cafeteria, Wellness Center and Security Gates. When activating the Emergency Number, you will need the following information: Your Name, Nature of the emergency, exact location of the emergency, and the telephone extension you are calling from. The more information you provide the faster emergency personnel can respond.

Fire Extinguishers - There is a water fire extinguisher located at the end of each barn. Each Bunkhouse is equipped with a portable ABC fire extinguisher. Notify Security at Ext 7777 anytime a fire extinguisher is used or discharged. Fire & Evacuation Procedures are posted at the end of each Barn/Stable.

Smoke Detectors - Smoke Detectors are located in each Bunkhouse Room and Bunkhouse Hallways.

Sprinklers - Each Barn is equipped with a Sprinkler System.

Fire Hydrants - Each fire hydrant is painted “RED” and are assigned and labeled with a hydrant number. Fire hydrants are to remain free from obstructions at all times.

Evacuation Procedures - The following events may warrant the evacuation of the Barn/Stable area: Fire, Flood Hurricane, Tornado, State of Emergency, Earthquake, Winter Storm, Train Derailment, and Hazardous Material Incident. In the event that Delaware Park implements a partial or full evacuation of the Barn/Stable area, the following will be adhered to:

x EVACUATION NOTIFICATION - Security will utilize the Public Address (PA) System to announce the evacuation of the Barn/Stable area. Security and Fire Command personnel will respond to all Bunkhouse, Barns, Stables Offices, etc. to ensure that all personnel have been notified, assist and verify evacuation.

x STAGING AREAS - If the event warrants a partial evacuation of the Barn/Stable area, personnel will be instructed to report to the Backside Cafeteria and wait for further instructions. If the event warrants a full evacuation of the Barn/Stable area, personnel will be instructed to leave the premises via the Main or Stable Gate.

x FIRE COMMAND - will be responsible for notifying outside emergency personnel (Fire, Police, Medical, etc.) to assist with the emergency.

x SECURITY - will ensure that all entrances & exits are open and will assist with crowd and traffic control. Security will be responsible to meet incoming emergency units at the entrances and escort them to the emergency location.

x RADIOS - any Delaware Park personnel utilizing radios will turn their radio to the emergency channel #2 and await further instructions.

Delaware Park and Delaware Thoroughbred Horsemen’s Association partner with two 501(c)(3) charities to help trainers find their horses quality homes after their racing careers. List your horse CANTER Delaware advertises your horse for you for free via online listings and social media.

• All horse sales (and sale profits) are made directly Fire Extinguishers between buyer and seller. • Check references on buyers (vet, blacksmith, boarding facility, etc.) • Get a notarized bill of sale for each horse. Smoke Detectors • Complete the Jockey Club “Retired from Racing” form if you do not want to sell your horse for racing. Sprinklers Bills of sale and JC “Retired from Racing” forms are available in the Horsemen’s Office. Fire Hydrants On average, horses sell for $1,100 and take about a month to sell.
