SOCIAL SAFEGUARDS MONITORING REPORT (As on 31 12 2016)

A. Executive Summary

The Overall progress of the Project is around 93% in 91% elapsed time considering the extended period 30/06/2017. elapsed time. All 184 Civil works are awarded to date and 152 works have been completed and the others are in advanced stages of implementation.

Resettlement Screening has been done for all subprojects and they have been categorized as “C”.

Impact on Indigenous People Screening has been done for all subprojects and they have been categorized as “C”

All the subprojects comply with the concerned laws and regulations of Sri Lanka.

Hence, it can be concluded that sub-projects of the Project do not have significant social safeguard issues. The subprojects have been categorized as ‘C’ as they do not have significant impacts based on the screening mentioned above.

Public consultations are carried out during planning and design stage and public issues are addressed during implementation to ensure that the any of stakeholders are not affected adversely on implementation of the subprojects.

GRM for the project is developed and approved by ADB and disclosed in project website. All the Grievances are attended by the Project Authorities.

No resettlement issues in the project to date.

B. Background of the Report and Project Description

Background of the Report:

The objective of the report is to provide an insight into the Compliance of social safeguard under the project and provide information on various safeguard issues (if any) and measures taken to solve them.

Project Description:

The Project – Local Government Enhancement Sector Project (LGESP) funded by the Asian Development Bank under Loan 2790 SRI (SF) is being implemented by the Ministry Provincial Councils and Local Government (MPC& LG), Government of Sri Lanka.

The Project is envisaged to improve the infrastructure services in selected local authorities who are lagging in terms of overall development. About 108 Local Authorities in seven provinces of Sri Lanka (except Northern and Eastern Provinces) have been selected to be taken up for development of Infrastructure facilities under the Project. The various subprojects Local Government Enhancement Sector Project Page 2 ADB Loan Number: Loan 2790-SRI Ministry of Provincial Councils and Local Government that would be taken up for implementation under this Project are roads and bridges, water supply and sanitation, drainage, solid waste management, and other basic facilities, including building or enhancing health-care centers and public markets.

The project will also support the institutional strengthening of the local authorities for improved and sustainable service delivery through business process reengineering and the development of their information technology (IT) system.

The Project has three components – Component 1: Local Government Infrastructure and Service Delivery System; Component 2: Local Government Policy Reforms and Capacity Building Support; Component 3: Project Management and Administration Support which were explained in detail in the first monthly report.

An amount of 59 Million USD (Present Net Amount – 52.09 Million) is obtained as a loan from Asian Development Bank and GoSL contributes 9.77 Million USD equivalent to the Project of size 62.77Million USD.

The Ministry of Provincial Councils and Local Government is the Executing Agency of the Project and implements the Project by establishing a Project Management Unit (PMU) to oversee and coordinate the overall implementation of the Project. The PMU is headed by the Project Director with necessary staff. At Provincial Level the Project is Co-ordinated by Sub Project Co-ordination Unit (Units).

C. Scope of Impacts

The subprojects are very small to the tune of 0.1 to 0.4mn US $ and consists of small office buildings, markets, libraries, small water supply projects etc. which do not have any significant adverse social impacts.

D. Compensation and Rehabilitation

As on date, considering the subprojects taken up, there is no rehabilitation / resettlement involved in the project. However, the project would report if it encounters any cases of rehabilitation / resettlement in future.

The process of temporary relocation of the vendors during the weekly fair to a nearby place with basic facilities was informed to ADB and ADB has since concurred the process and the process as agreed with ADB is being followed.

E. Project disclosure, public participation and consultation

The project has followed a consultative process in deciding the subprojects and finalizing the designs of the project.

At the PPTA and further stages adequate consultations were held in finalization of the subprojects. The details of the consultation in the project identification stage were given in the previous report. Public Consultations are once again held during the finalization of the design and comments considered in finalization of design. Public Consultations were held during the Implementation stage also. The details of public consultations during the design stage and implementation stage are given in Attachment 1.

F. Grievance Redress Mechanism (GRM)

A Grievance Redress Mechanism (GRM) has been prepared for the project and got cleared by ADB.

The framework of Grievance Redress Mechanism was given in the previous reports.

The Grievance Redress Mechanism of the Project is disclosed in the project website www.puraneguma.lk

The list of grievances recorded and attended is provided regularly in the quarterly progress reports.

G. Institutional Arrangement

Following are the institutional arrangements in respect to social safeguards:

Following are the details of the staff / experts hired for PMU (Project Management Unit); SPCU (Subproject Coordination Units of the Provinces) and the consultants.

1. Project Management Unit (PMU) - Central Office at Colombo.

This is staffed by:  One Safeguard Manager (Social and Gender) This responsibility is looked after by the Safeguards Manager (Environment) on an acting basis.

2. Subproject Coordination Unit (SPCU) - All Seven Provinces

This is staffed by:  Safeguard Manager (to look after social, gender and environmental issues)

3. The Project Management Consultants has also staffed by a Safeguards Expert (Social and Gender) who was also looking after all safeguard issues.

H. Monitoring Results – Findings

As on date, the project has not encountered any rehabilitation / resettlement issues.

There has been no significant issue on this account till date. The details of monitoring and safeguard compliance has been cumulated as on 31 December 2016 and attached to this report as Attachment 2.
