Proposed Submission Plan:MK Statement under Regulation 22 of the Town and Country Planning (Local Planning) () Regulations 2012

1. As part of the submission of the Proposed Submission Plan:MK October 2017, Council is required to produce a Statement of Consultation under Regulation 22 of the Town and Country Planning (Local Planning) (England) Regulations 2012. This statement sets out how Milton Keynes Council published the Proposed Submission Plan:MK and invited bodies and individuals to make representations in accordance with the Council’s adopted Statement of Community Involvement and the Town and Country Planning (Local Planning) (England) Regulations 2012.

2. This statement evidences how these requirements have been met, indicates the number of representations made and provides a summary of the key points arising from those representations. A separate Statement of Consultation for the Regulation 18 ‘Draft Plan:MK, February 2017’ has been submitted to demonstrate how the requirements under Regulation 22, c, i-iv of the Town and Country Planning (Local Planning) (England) Regulations 2012 have been met.

When was the Proposed Submission Plan:MK published?

3. The Proposed Submission Plan:MK October 2017 was published on 8th November 2017 for a six week consultation ending on 20th December 2017. The full list of the bodies and individuals invited to provide representations on the plan and copies of the notification letter/email, Statement of Representations Procedure, Response Form and Guidance Notes for Respondents are set out within Appendices 1-5.

4. Alongside the Proposed Submission Plan:MK October 2017, Milton Keynes Council consulted on a Proposed Submission Plan:MK Policies Map Schedule, Sustainability Appraisal and Habitats Regulation Assessment. An Equalities Impact Assessment and the Regulation 18 Statement of Consultation were also published as part of the Regulation 19 consultation.

5. From 8 November 2017 the following documents, together with other background documents, were made available to view and download from the Council’s website (https://www.milton-keynes.gov.uk/planmk) and online consultation portal (http://miltonkeynes-consult.objective.co.uk/portal/) :

8. Notification letters or emails, including a copy of the Statement of Representations Procedure, were sent to all the bodies and individuals listed in Appendix 1. A copy of the notification letter/email is provided in Appendix 2.

9. Public exhibitions of the Proposed Submission Plan:MK October 2017 were held at three locations, with copies of the documents listed at paragraph 5 above and copies of the Response Form, Statement of Representations Procedure and Guidance Notes for Respondents being made available for inspection and to take away. The locations were:

10. On the 25 October 2017, an open invitation was sent from the Council to all Town and Parish Councils within the Milton Keynes Council area offering to provide further exhibitions or attend town/parish meetings to provide a presentation on the Proposed Submission Plan:MK October 2017. A presentation and briefing on the Proposed Submission Plan:MK October 2017 was subsequently given at the Olney Town Council meeting on 4 December 2017. Additionally, a presentation and briefing was made to the MK Youth Cabinet on the 9 December 2017.

Number of representations made

11. The Council received 894 comments from 210 respondents on the Proposed Submission Plan:MK October 2017, received via email, post and through the Council’s online consultation portal.

12. The Council also received nine comments from eight respondents on the Sustainability Appraisal and Habitats Regulation Assessment of the Proposed Submission Plan:MK October 2017. However, a number of comments made on policies or sections of the Proposed Submission Plan:MK October 2017, with regard to legal compliance of the plan, also related to the Sustainability Appraisal. Table 1 below shows the number of comments against each Policy.

Main issues raised via the Regulation 19 Consultation

A summary of the main legal and soundness issues arising from the Regulation 19 consultation is provided below. This is not an exhaustive list of all minor points that were raised.

Legal compliance

13. 322 comments did not provide an answer to the question as to whether the Proposed Submission Plan:MK is legally compliant.

14. Of those that did answer, 415 comments consider that the Proposed Submission Plan:MK is legally compliant and 157 do not consider that it is legally compliant, for the reasons set out below.

15. No objections were raised by Duty to Cooperate bodies on the basis of failing to meet the Duty to Cooperate. 35 other respondents objected on the grounds that the Duty to Cooperate had not been met.

16. 73 objections were raised on grounds that the Proposed Submission Plan:MK was not accompanied by a compliant Sustainability Appraisal. These objections are made principally on the assertion that the Sustainability Appraisal has not adequately considered the full range of reasonable alternatives or has not dealt with the reasonable alternatives in a consistent and logical way. In particular objections were raised with regard to the allocation of the South Caldecotte Strategic Employment Site and the reserve allocation of the East of M1 Strategic Urban Extension over other alternatives.

17. 64 objections were raised on the grounds that the Proposed Submission Plan:MK has not been prepared and consulted upon in accordance with the Statement of Community Involvement and regulatory requirements for consultation. These objections were primarily raised by residents, resident groups and parish councils located within the area of the South East Strategic Urban Extension and East of M1 Strategic Urban Extension. The majority of objections assert that the changes introduced between the Regulation 18 and Regulation 19 versions of Plan:MK, principally the additional 2,000 homes allocated within the South East Strategic urban Extension and allowing development of this site to commence before 2026, has not been consulted upon prior to publishing the Proposed Submission Plan:MK.

18. 33 objections were raised on the grounds that the Proposed Submission Plan:MK was not prepared in accordance with the Local Development Scheme.

Soundness

19. 122 comments did not provide an answer to the question as to whether the Proposed Submission Plan:MK is sound.

20. Of those that did answer, 176 comments consider that the Proposed Submission Plan:MK is sound and 596 do not consider that it is sound, for the reasons set out below. A summary of the arguments made to support comments which consider the Proposed Submission Plan:MK is unsound is then provided.

Development Strategy

21. No fundamental objections on the soundness of the Proposed Submission Plan:MK were received from Highways England, Environment Agency, Natural England, Historic England, Anglian Water, Bucks Natural Environment Partnership (NEP) and neighbouring LPAs. However, Historic England, Natural England, Environment Agency, Anglian Water and the Bucks NEP did object to the wording of various policies (principally development management policies). The objections relate to specific policy wording and terminology.

22. A number of omission site promoters have objected with the assertion that there is no robust site assessment and selection process or how the assessment of reasonable alternatives has been done, in particular with regard to the choice of the South Caldecotte Strategic Employment Site and the East of M1 Strategic Urban Extension.

23. A number of site promoters suggested that the Objectively Assessed Housing Need methodology is flawed, particularly in how we account for past under- delivery, job forecasts, the recommendations made by the National Infrastructure Commissions on growth within the Oxford-Milton Keynes- Cambridge arc or corridor.

24. A range of alternative housing targets were suggested ranging up to around 37,000 homes over the plan period. Higher housing targets have been argued on the grounds of the Council using a flawed methodology for calculating the Objectively Assessed Housing Need, and because the Council should be seeking to deliver a higher amount of growth to maximise the opportunities provided by significant infrastructure investment in and around Milton Keynes, principally East West Rail and the Oxford to Cambridge Expressway.

25. A number of omission site promoters’ object to the strategy for meeting the housing target. Whilst the buffer is welcomed, it is argued that the allocations are reliant on large sites which take time/are subject to delays, which will result in a failure to provide a five-year housing land supply upon adoption and throughout the plan period.

26. Rural omission site promoters object that the plan does not positively seek to meet the needs of rural communities by planning for development in the rural area.

27. A number of omission site promoters’ object to the plan period being too short. Suggestions range from at least 2033 (15 years from the point of expected adoption in 2018) to 2036.

28. CMK Town Council and some omission site promoters object on the grounds that the expected number of dwellings from the SHLAA is an over-estimate as it does not account for lapsed permissions and uses higher densities than in neighbourhood plans.

Strategic Site Allocations

29. A large number of objections were received to the South East, East of M1 and South Caldecotte strategic allocations from the local parish councils and resident groups in those areas and from omission site promoters, both on the principle of allocating those sites and in terms of the impacts development of those sites might bring. Central Bedfordshire Council also objected to the East of M1 Strategic Urban Extension on the grounds that it is not justified by the conclusions of the Sustainability Appraisal, that it is required to help deliver more affordable housing, and is not required to help Milton Keynes Council meet is Objectively Assessed Housing Need.

30. The main reasons for objecting to the strategic allocations were:

a) South East Strategic Urban Extension: Objections were raised due to concerns about the coalescence of Woburn Sands and with Milton Keynes city and the adverse impact this would have on the character and identity of these two settlements; adverse impacts upon landscape and the Green Sands Ridge Nature Improvement Area; increased traffic and congestion through Woburn Sands and Bow Brickhill due to the lack of railway bridge crossings connecting the land south of the railway with the urban areas to the north (thereby being directed through the two existing level crossings); departure from the previous Draft Plan:MK that development of the north portion of the site would not occur before 2026, and the southern portion to be developed after 2031; and potential that this site would be undeliverable due to outstanding decisions relating to the Oxford-Cambridge Expressway.

b) South Caldecotte Strategic Employment Allocation: Objections were raised arguing there would be adverse impacts upon residents of Bow Brickhill; adverse impacts upon landscape and the Green Sands Ridge Nature Improvement Area; inappropriate location for logistics development due to the distance from the M1 and proximity to residential properties; increased traffic and congestion and road safety concerns due to the increased movement of HGVs through Bow Brickhill and Woburn Sands; and potential that this site would be undeliverable due to outstanding decisions relating to the Oxford-Cambridge Expressway.

c) East of M1 Strategic Urban Extension: Objections were raised arguing that the allocation is not consistent with the wider strategy to maximise growth opportunities provided by the Oxford-Milton Keynes-Cambridge corridor; existing transport infrastructure is not capable of supporting this growth; difficulties in delivering the site due to landownership; adverse impacts on listed buildings in the area; existing flood risk means that development is inappropriate and development would have adverse impacts upon the floodplain and future flood risk; and adverse impacts upon the wildlife corridor.

31. Promoters of the South East Strategic Urban Extension, as well as promoters of omission sites east of this allocation, have objected to restricting delivery of the site until decisions are made on the Oxford-Cambridge Expressway. The promoters of this allocation along with Bow Brickhill Parish Council object to requiring seven Gypsy and Traveller pitches to be delivered on this allocation arguing it is not justified as there are other more appropriate sites available to meet the needs for Gypsy and Traveller pitches over the plan period.

32. A number of proposals to expand the boundaries of the South East Strategic Urban Extension to include land adjoining it were received, along with requests to include land east of Newport Road to include a current omission site within a wider allocation.

33. The promoters of the East of M1 Berkeley object to restricting delivery of any of the site until funding is secured for infrastructure, arguing that parts of the site are capable of delivering development within the constraints of existing infrastructure.

Other main policy issues

34. Central Milton Keynes Town Council and retail property owners in Central Milton Keynes have objected to expanding the Primary Shopping Area to include the Xscape site.

35. Central Milton Keynes Town Council and a number of landowners in Central Milton Keynes object to the re-zoning of Central Milton Keynes that creates distinct land use zones, rather than mixed use throughout as per the current Central Milton Keynes Business Neighbourhood Plan.

36. Support was received for the flexible approach to housing mix and density, but requests were made to add additional viability clauses into the policy.

37. Objections were received to the increased density range within Central Milton Keynes. The Central Milton Keynes Town Council argue that the density range should mirror those within the current CMK Business Neighbourhood Plan.

38. Objections were raised that there is insufficient clarity as to what level of affordable housing the Council is requiring, with the use of minimum and maximum wording suggesting that the Council will seek more than 31% that will result in drawn-out negotiations and the production of viability evidence in each case.

39. A number of objections were raised against the setting of space and accessibility standards within Policy HN4 from developers and site promoters, arguing there is insufficient evidence to justify their adoption in Milton Keynes.

40. A number of objections were raised against the setting of carbon emission standards with Policy SC1, arguing they are not consistent with national planning policy and Government policy on carbon and energy standards.

Milton Keynes Council response to Regulation 20 responses consultation

41. The representations received during the Regulation 19 consultation have been analysed by Milton Keynes Council. Having considered these representations, Milton Keynes Council has drafted a Schedule of Proposed Modifications to the Proposed Submission Plan:MK October 2017 and Submission Policies Maps which respond to a number of suggested changes received, as well as changes the Council consider necessary to make. This is submitted alongside the Proposed Submission Plan:MK October 2017.

42. The content of the Sustainability Appraisal and the Habitats Regulations Assessment remain unchanged.

Milton Keynes Council (MKC) is inviting representations on its Proposed Submission Plan:MK October 2017, which sets out the planning strategy for Milton Keynes until 2031 together with site allocations and development management policies.

Consultation will take place over a six week period, commencing on Wednesday 8 November 2017 and ending at 5pm on Wednesday 20 December 2017. The Proposed Submission Plan:MK October 2017, Proposed Submission Policies Map Schedule, Sustainability Appraisal, Habitats Regulations Assessment, Statement of Consultation together with a Statement of Representations Procedure, response forms and guidance notes for making a representation can be viewed at MKC’s online consultation portal (http://miltonkeynes.objective.co.uk/portal/) or on MKC’s website (http://www.milton-keynes.gov.uk/planmk) from Wednesday 8 November when the consultation event commences.

Paper copies of the Proposed Submission Plan:MK October 2017 and the other documents referred to above will also be available to view at a number of inspections points throughout the local area, details of which are set out in the enclosed Statement of Representations Procedure.

An exhibition on the Proposed Submission Plan:MK October 2017 will be held at the Central Library between 7 and 10 November where you will be able to speak directly to MKC officers.

Proposed Submission Plan:MK October 2017: Guidance note for respondents

A. Introduction

The Proposed Submission Plan:MK and its supporting documents are being published in order for representations to be made prior to its submission for examination. Once Milton Keynes Council (MKC) chooses to submit Plan:MK it will become the task of an independent Inspector appointed by the Planning Inspectorate to examine and decide whether it can be adopted – this means that any representations made between 8 November and 5pm on 20 December 2017 will be forwarded to the Inspector.

Representations on the Proposed Submission Plan:MK should address the purposes of examination set out in the Planning and Compulsory Purchase Act 2004 (as amended):

1. Does the Plan:MK comply with the legal requirements? 2. Is Plan:MK a sound plan for the future of Milton Keynes?

B. Legal Compliance

If you think that the addition of a new policy or proposal would be necessary to make Plan:MK sound, you should consider whether or not the matter is already dealt with by national policy or adequately covered by existing local planning guidance such as Supplementary Planning Documents. If this is the case, it is unlikely to be necessary for it to be duplicated.

D. General advice when responding

The Inspector will have to deal with a large number of responses in a limited amount of time, and may be unable to deal with responses which are not made in the correct way:

 Responses should either be made through MKC’s online portal; or by emailing or posting the relevant form which is available on MKC’s consultation portal, website or at the deposit points for the duration of the consultation.  Attachments should only be submitted where they are necessary to support the response (e.g. plans or images) – responses that simply state ‘see attachment’ may not be accepted  Responses should be brief and ‘to the point’ – the Inspector will be interested in the points being made, rather than how they are put across, and may not have time to consider letters or emails written as prose.  The consultation is not a vote, and the Inspector will give the same weight to an issue whether it appears in hundreds of responses or only in one. Where a group (for example a residents association or action group) shares a common view on how the Proposed Submission Plan:MK or one of the supporting documents should be changed, it will

assist the Inspector if the group only makes a single response. In such cases the response should indicate how many people the group represents, and how the group’s response has been authorised.

For the Local Plan and Policies Map Schedule:

 Responses should specifically address either soundness or legal compliance.  Objections to the Plan must clearly explain why it is either unsound or not legally compliant, and where possible set out the modifications that are therefore considered necessary to remedy this.  Responses on soundness should avoid generic statements such as ‘congestion will just get worse’ or ‘there is not enough infrastructure to support the additional houses’. Such concerns and reasons for considering why the Proposed Submission Plan:MK is unsound or not legally compliant must be explained more specifically.

For the Sustainability Appraisal and Habitats Regulations Assessment:

The Sustainability Appraisal and Habitats Regulations Assessment are required to inform the drafting of the Proposed Submission Plan:MK and in order for it to be legally compliant, but their findings are also open to consultation. Responses must specifically address the conclusions made in either the Sustainability Appraisal or Habitats Regulations Assessment, and not solely be a comment on the proposals made in the Proposed Submission Plan:MK.

For all documents, responses must be received by 5pm on 20 December 2017. Late responses will not be accepted or considered by the Inspector as part of the examination.
