Farmers are already hurting. The last thing they need is a limited supply of fertilizers and increased costs.

Farmers face challenges and volatility and are already struggling with a wave of bankruptcies, trying to survive a six \ year downturn. The imposition of duties on imported phosphate fertilizers will only exacerbate their challenges, resulting in cost increases and supply issues. For an average farmer, fertilizer can represent 15% of their costs. Increases in the cost of fertilizer could be the difference between profit and loss for farmers — threatening the viability of their j business and their ability to remain competitive in global markets.

Phosphate fertilizers are an indispensable input for farmers for producing corn, city and state soybeans, , wheat, fruits and vegetables, and other crops. America's hard-working farmers are vital contributors to the U.S. economy. American farmers are the most productive in the world, producing food to feed our families and people across the globe. Key to their productivity is their smart and sustainable use of fertilizers to increase their crop yields. Now their reliable and affordable access to phosphate fertilizers is threatened. 20% The Mosaic Company, the second largest phosphate fertilizer producer in the world, filed of fertilizers in a petition in June with the U.S. Department of Commerce (DOC) and international Trade Commission (USITC) asking for an investigation into imports from certain countries and the U.S. seeking the imposition of heavy duties (tariffs) on those imports. are phosphate based, according to a 2015 Effective December T 2020, the U.S. Department of Commerce announced a preliminary EPA Agricultural Fertilizer duty of 23.46% will oe imposed on imports of phosphate fertilizer from Morocco. It also study. imposed duties on Russian impons. That decision could change in the final investigation stage of the process. But if substantial final duties are imposed, critical sources of imported supply could be shut out of the U.S. market and Mosaic could gain a near monopoly over phosphate fertilizer supply in America.

increased duties could put farmers largely at the mercy of one single company for their phosphate fertilizer needs. (n fact, Mosaic already controls over 74% of the American phosphate fertilizer production. Mosaic's petition is an attempt to increase their already enormous market power. With Mosaic already controls imports from key producing countries shut out, Mosaic alone likely wouldn't be able to meet the demand of U.S. farmers, who are already struggling to recover from the impacts more than of COVID 19 on the economy.

Phosphorus is an essential and irreplaceable element in all plant, animal and human life 2/3 and -rich fertilizers are critical to farm productivity. Given that the average of the American fertilizer grower allots nearly 15% of their entire budget to fertilizer alone, reduced supply and production, according to increased costs for this vital nutrient could seriously hurt American farmers. Mosaic's own USITC petition.

Farmers are already struggling. Agricultural products have faced year-after-year of falling prices, while investment and input costs keep rising. Despite the current administration's infusion of $33 billion in aid, farmers wilt continue to struggle with profitability. And on top of it all, if Mosaic succeeds in forcing key major importers out of the market, American farmers could lose the ability to even find sufficient fertilizer to buy in the first place.

Since the petition was filed, supplies of fertilizer have tightened and farmers' costs have increased. Permanently placing duties on imported phosphate fertilizer would further increase costs making American crops loss competitive in global export markets and putting The estimated impact of American farmers at a disadvantage. Mosaic's petition equates to roughly Countless elected officials and organizations are speaking out and expressing opposition to the petition: $480 to • Eight Farm Belt Senators from Nebraska, Texas, iowaT Kansas and more, have $640 signed onto a letter urging the Department of Commerce and USITC to deny Mosaic's petition. million • The former chief economist of the American Farm Bureau calls the Mosaic petition in added fertilizer bills for U.S Crony Capitalism, stat ng it would "harm the very farmers that this effort farmers, according to Bob ostensibly seeks to 'protect' by artificially increasing prices of the phosphate Young, former Chief Economist for the American fertilizer they need ... to benefit only a few domestic producers.” Farm Bureau Federation. • Commodity groups are also stepping forward to oppose the Mosaic petition, including the National Sorghum Producers (NSP)r the Agricultural Retailers Association, the National Cotton Council of America, USA Rice, the Iowa Corn Growers Association and more

The Department of Commerce and the international Trade Commission are expected to make a final determination April 1,2021.

The impact of this decision could be felt for years to come. Anyone who supports a diverse and reliable supply chain for farmers should oe outraged by this attempt to limit supply and increase costs. American farmers deserve the opportunity to choose their preferred fertilizers to grow their crops, teed their fellow Americans ana compete with farmers around the globe. FREQUENTLY ASKED QUESTIONS

Why are the Department of Commerce and the International Trade Commission considering duties on phosphate fertilizer imports?

The Mosaic Company the second largest phosphate fertilizer producer in the world fifed a petition with the agencies in June asking for an investigation into phosphate fertilizer imports from certain countries. Mosaic is seeking the imposition of heavy duties (tariffs) on those imports which could result in Mosaic gaining a near monopoly over phosohate fertilizer supply in America. Received by NSD/FARA Registration Unit 12/08/2020 10:51:33 PM How will this affect farmers?

For the average farmer, fertilizer costs can represent 15% of their entire budget, so increased costs would be disastrous. Cost increases could be the difference between making a profit and suffering a loss. Farmers would also have fewer choices and would see supplies tighten, potentially leaving them with less fertilizer than they need. This could lead to crop yields falling and an overall reduction in the production of agricultural goods, which could undermine U.S. agricultural self-sufficiency, while putting U.S. farmers at a disadvantage in world markets.

What would be the effect of duties on phosphate fertilizers?

Phosphorus is an essential element in all plant, animal and human life. Imposing duties on phosphate fertilizers would not only hurt farmers, but it would also create a near monopoly for the one dominant piayer in the U.S. fertilizer market, The Mosaic Company. The supply of these fertilizers would likely fall as major imorters are forced out of the market, leading to cost increases for already struggling farmers. With a diminished supply of fertilizer, crop yields could fall, production of agricultural goods could be reduced, thereby increasing prices for a wide range of products that American consumers rely upon.

When will a final determination be made on the imposition of countervailing duties?

The 23.46% duty announced on Moroccan phosphate fertilizers by the Department of Commerce effective December 1,2020, is only preliminary. Commerce and the U.S. International Trade Commission now move to the investigation phase. A final decision could come by April 1,2021, which could lock in duties for at least a year or beyond.

Has the agriculture industry and other producers weighed in on the issue?

Yes. A growing list of voices across the agriculture industry have widely criticized the Mosaic petition. The American Farm Bureau Federation, Nationai Sorghum Producers (NSP), Agricultural Retailers Association, National Association of Landscaping Professionals, National Cotton Council of America, USA Rice and Iowa Corn Growers have all written strong letters of concern. Additionally, a group of eight Farm Belt senators have signed onto a letter to the International Trade Commission and the U.S. Department of Commerce opposing the Mosaic petition.

Who should oppose this petition?

Farmers, ranchers, growers, retailers and distributors and others involved in the agriculture economy should be concerned by the Mosaic petition, as it would only exacerbate the challenges that they are already facing. Additionally, anyone who supports fairtrade and market competition should be outraged at the attempt to create a near monopoly for one industry player.

What are phosphate fertilizers and what are they used for?

Phosphate fertilizers are fertilizers that contain phosphorus — an essential plant nutrient, along with other key nutrients such as nitrogen and potassium. Countless farmers across the United States use phosphate fertilizers every year to produce a broad variety of crops such as corn, wheat, sorghum, soybeans and cotton, among others.

Who is the OCP Croup?

The OCP Group is standing with U.S. farmers to oppose the Mosaic petition. A proud partner of farmers on five continents. OCP Group is a 100-year old company based in Morocco and the world's largest producer of . They work across the value chain from and manufacturing to research and development of a broad range of innovative, sustainable plant nutrition products.

To better serve American farmers and customers, OCP opened OCP in multiple locations to work hand-in-hand with farmers, cooperatives, agricultural institutes and universities to deliver plant nutrition products suited to specific crop and soil needs.

Does the OCP Group receive subsidies or otherwise benefit from the Government of Morocco?

OCP pays substantial fees for its mining activities, following normal practices for companies mining natural resources in the country of Morocco. OCP similarly follows al! environmental regulations in Morocco and in every country in which it operates.

What is Morocco’s relationship to the United States?

Mosaic seeks the imposition of duties on phosphate fertilizer imports from Morocco — the global leader in phosphates. Morocco and the United States are valued, long-term allies with a long history of working together bilaterally and regionally, and a strong joint Free Trade Agreement? The two countries share common concerns and consult closely on security, political and economic issues. They a iso have a long standing and collaborative relationship on trade and share a strong joint Free Trade Agreement, in fact, Morocco was the first country to recognize and open its ports to the newly independent United States on December 20,1777.
