IntroductionandRegulatoryFramework ThisappendixdescribestheopportunitiesprovidedtominorityandlowͲincomepopulationsto activelyparticipateintheOMSFplanningprocessandevaluateswhethertheproposedproject wouldresultinanydisproportionatelyhighandadverseeffectsonindividualsinthesepopulations. TheanalysiswaspreparedincompliancewithPresidentialExecutiveOrder12898,FederalActions toAddressEnvironmentalJusticeinMinorityPopulationsandLowͲIncomePopulations(EO12898), datedFebruary11,1994,andwiththeU.S.DepartmentofTransportation(USDOT)OrdertoAddress EnvironmentalJusticeinMinorityPopulationsandLowͲIncomePopulations(DOTOrder5610.2).

EO12898,issuedin1994,providesthat“eachfederalagencyshallmakeachievingenvironmental justicepartofitsmissionbyidentifyingandaddressing,asappropriate,disproportionatelyhighand adversehumanhealthorenvironmentaleffectsofitsprograms,policies,andactivitiesonminority andlowͲincomepopulations.”Theexecutiveorderaddressestheimportanceofpublicparticipation inthereviewprocess.USDOTissuedtheDOTOrder,whichestablishestheprocedurestousein ordertocomplywithEO12898inordertoavoiddisproportionatelyhighandadverseeffectson minorityandlowͲincomepopulations.TheDOTOrderrequiresagenciestotaketwoactions:

z Explicitlyconsiderhumanhealthandenvironmentaleffectsrelatedtotransportationprojects thatmayhavedisproportionatelyhighandadverseeffectsonminorityorlowͲincome populations.

z Implementprocedurestoprovide“meaningfulopportunitiesforpublicinvolvement”by membersofminorityorlowͲincomepopulationsduringprojectplanninganddevelopment (DOTOrder§5(b)(1)).

TheDOTOrderfurtherprovidesthat“Inmakingdeterminationsregardingdisproportionatelyhighand adverseeffectsonminorityandlowͲincomepopulations,mitigationandenhancementmeasuresthat willbetakenandalloffsettingbenefitstotheaffectedminorityandlowͲincomepopulationsmaybe takenintoaccount,aswellasthedesign,comparativeimpacts,andtherelevantnumberofsimilar existingsystemelementsinnonͲminorityandnonͲlowͲincomeareas”(DOTOrder§8(b)).

Thisanalysisdescribesthedemographics ofthebuildalternativestudyareasfor What Are Census Tracts and Block Groups? A census tract is a small subdivision of an urban area used by theproposedprojectusingthemost the U.S. Census Bureau to identify population and housing recentU.S.Censusdataavailableatthe statistics. Census blocks are subdivisions of census tracts and are the smallest unit of census geography for which the Census timetheanalysiswasinitiated(2010and Bureau collects data. The boundaries of census blocks are generally streets or other notable physical features and often 2011AmericanCommunitySurvey); correspond to a city block. A census block group is a combination providesinformationontheeffortsthat of census blocks, typically encompassing two to four city blocks. The2010censusand2011AmericanCommunitySurveydatawerereviewedtodeterminethe demographiccompositionofminorityandlowͲincomepopulationslocatedwithinthestudyarea, andthendevelopedgeographicinformationsystem(GIS)mapstoillustratetheminorityandincome characteristicsofthepopulationinthestudyarea.Noneofthebuildalternativeswoulddisplace residentialuses.Censusdataisusedtocharacterizethedemographicsofpersonslivinginthe vicinity(i.e.,the0.5Ͳmilestudyarea)ofeachbuildalternativesite.Thestudyareaincludescensus blockgroupsthatareeitherlocatedentirelyorpartiallywithinthe0.5Ͳmileradius.Minority populationswereanalyzedatthecensusblockgrouplevel,whileincomeinformationwasreviewed atthecensustractlevelbecauseincomeandpovertyinformationisnotavailableatthecensusblock grouplevel.FiguresCͲ1throughCͲ4bshowminoritypercentagesinthestudyarea,andFiguresCͲ5 throughCͲ8bshowpercentagesofthepopulationbelowthepovertyline.Theenvironmentaljustice analysiscomparesthedemographicsinthestudyareawiththoseoftheSoundTransitdistrict,asa whole,tounderstandhowthedistributionandconcentrationofminorityandlowͲincome populationscouldbeaffectedbytheproposedprojectandhowtheyrelatetothebroader geographicareawhereSoundTransitprovidesservices.TheSoundTransitdistrictincludesthemost populatedareasinKing,Pierce,andSnohomishCounties.Itgenerallyfollowstheurbangrowth boundariesthatwerecreatedbyeachcountyinaccordancewiththestateGrowthManagementAct andtheelectoralprecinctsestablishedin1996.1

OutreachtoMinorityandLowͲIncomePopulations Aspartofproposedprojectpublicoutreach,SoundTransithasmadeitaprioritytoengagediverse minorityandlowͲincomepopulationsthroughouttheplanninganddevelopmentprocessby providingmaterialsandmakingthemavailableinmultipleformats.Publicparticipationisakey componentofEO12898andtheDOTOrder.SoundTransithasdevelopednumerouseventsand toolstosuccessfullyengageandcommunicatewiththepublic,includingscopingmeetings, workshops,factsheets/handouts,posters,displayadvertisements,stakeholderbriefings,anda projectwebsitethatisregularlyupdatedthroughouttheproposedproject.Publicinvolvementin theproposedprojectisdescribedinAppendixB,PublicandAgencyInvolvement.

Beforescoping,SoundTransitreviewedtheminorityandincomecharacteristicsofthepopulationin theproposedprojectvicinitytoidentifyminorityandlowͲincomepopulations.Basedonthis information,publicinvolvementhasincluded,andwillcontinuetoinclude,outreachatkey milestonesspecifictothosegroupsusingthepublicinvolvementtoolsdevelopedbySoundTransit.

ThepublicscopingmeetingswereheldattheHighlandCommunityCenterinBellevueandthe LynnwoodConventionCenter,withattendancetotalingapproximately100peoplebetweenthetwo meetings.Themeetingsconsistedofan“openhouse”formatcombinedwithabriefpresentation andaquestionandanswersession.MeetingshadsignͲinareas,commentforms,andinformation stationswithdisplaysandbackgroundmaterials.Projectstaffmemberswereavailabletolistenand answerparticipant’squestions.

DraftEISCirculation TheDraftEISwascirculatedtothepubliconMay9,2014,forapublicreviewandcommentperiod of45days,fromMay9toJune23,2014.TwopublichearingsinopenͲhouseformatwereheld,one inBellevueattheCoastHotelonJune5,2014,andoneinLynnwoodattheLynnwoodConvention CenteronJune3,2014.Morethan170peopleattendedthetwopublichearings,withmorethan 100attendeesinBellevueandapproximately70attendeesinLynnwood.

NotificationoftheDraftEISpubliccommentperiodwasintendedtoreachabroadaudience,witha focusontheproposedproject’stargetaudiences,identifiedasfollows.

Methodsofdistributionvariedaccordingtonotificationtype,withthegoalofreachingasbroadan audienceaspossible.Thetoolsandmethodsusedforthisdistributionweregleanedfromthetwo scopingperiodsandinfluenceddecisionsregardingmediause,organizations,andthemail distributionlocationsfortheposter,whichresultedinwidenotificationinthestudyarea. Advertisementsincludedinformationaboutthecommentperiod,publicopenhousesandhearings, aswellasdifferentwaystoaccesstheDraftEISdocument,submitcomments,findmore information,andcontactstaffmembersforabriefing.

TheNoticeofAvailability,whichprovidedinformationregardingthecommentperiodandpublic hearingdatesandlocations,wasmadeavailableontheprojectwebsite,throughprintandonline displayadvertisements,andwithnoticesinlocalnewspapers,localcommunitypapers,andother publications.Thenoticeandnotificationsaboutthepublichearingswerealsodistributed electronicallytothosewhohadsignedupfortheelectronicmailinglist;theywerealsosentto propertyownersinandsurroundingthebuildalternativesitesthroughdirectmailings.Aswith previousoutreachefforts,mailingsincludedtranslationandaccommodationinformationineight

Atthecloseofthepubliccommentperiod,SoundTransitreceivedapproximately790comments fromvariousfederal,state,andregionalagencies;tribes;businesses;communityorganizations;and membersofthepublic.Generally,thecommentsfocusedonoppositiontooneofthealternatives; however,manyoutlinedspecificenvironmentalconcerns(e.g.,landacquisitionsanddisplacements, ecology,landuse,communitiesandneighborhoods)asbeingtheprimaryconcerns.

Todate,socialserviceprovidershavenotexpressedconcernorobjectionsregardingtheproposed project’spotentialimpactsonminorityorlowͲincomepopulations.Furthermore,SoundTransithas receivedlimitedfeedbackfromcommunitieswithminorityorlowͲincomepopulationsaboutthe impactsonthemfromthebuildalternatives.

TheCedarValleyneighborhoodisdirectlywestoftheLynnwoodAlternativeandhasahigher presenceofminorityandlowͲincomepopulationscomparedwiththestudyareasthatsurroundthe otherOMSFalternatives.LeadinguptotheDraftEIScommentperiod,doorhangerswere distributedinthisneighborhoodtoraiseawarenessabouttheproposedproject.DuringtheDraftEIS commentperiod,residentsoftheneighborhoodopposedtheLynnwoodAlternative,stating concernsoverpedestriansafety,noise,andvisualimpacts.TheMuckleshootIndianTribeprovided commentsaboutitsoppositiontotheLynnwoodandSR520Alternativesbecauseofpotential impactsonfisheryresourcesintheLakeWashingtonbasin.SoundTransithasreceivednoobjections regardingtheimpactsofthePreferredAlternative(BNSF)orBNSFModifiedAlternativeonminority orlowͲincomepopulations.

TheLynnwoodAlternativewouldrequiretheacquisitionanddisplacementoftheDepartmentof SocialandHealthServices(DSHS)officeslocatedat2031152ndAvenueW.Servicesatthislocation includedisabilityassistanceoffices,vocationaleducationservices,andemploymentassistance offices.TheseDSHSofficeshavemultiplelocationsthroughouttheStateandSnohomishCounty.Itis anticipatedthatthereisadequateavailabilityofsimilarofficebuildingsintheCityofLynnwood, suchthatthepopulationwouldbeadequatelyservedbytherelocatedDSHSoffices.Therelocation oftheseofficestoasimilarfacilitywithintheCityofLynnwoodwouldnotresultinalackofsocial serviceproviderofficesintheCityofLynnwoodorinthegreaterregion.

Oftheapproximate101businessesthatmaybedisplacedundertheSR520Alternative, approximatelysixoftheseaswellastwochurchͲassociatedfacilities(SeattleFormosanChristian Church–EastsideFacilityandCornerstoneChurchadministrativeoffices)serveanAsiancommunity fromthesurroundingarea.Neitherchurchfacilityisaprimarylocationofworship.TheCornerstone ChurchfacilityservesastheadministrativeofficefortheCornerstoneChurchwhichholdsserviceat LakeHillsElementarySchoollocatedapproximately1.9mileawayfromtheSR520Alternativesite. TheFormosanfacilityprovidesweekendyouthactivitiestoitscongregationmembers;however,its primarylocationis333NE76thStreetapproximately8.4milesawayinSeattle.Itislikelythatthe churchfacilitiesandbusinessesonthesitecouldberelocated.Althoughsomeofthebusinessesmay beminorityowned,displacedbusinessownerswouldbecompensatedequally.Allimpacts associatedwiththeproposedprojectwouldbeeffectivelymitigated.Completeinformationonthe projectimpactsisprovidedinChapter3,AffectedEnvironmentandEnvironmentalConsequences,of theFinalEIS.

Conclusion Whenmakinganenvironmentaljusticedetermination,DOTOrder5610.2andFTA’sEnvironmental JusticePolicyGuidanceforFederalTransitAdministrationRecipientsdirectprojectproponentsto considertheimpactsofaprojectandwhomaybeaffected,thenconsiderthemitigationproposed fortheimpactsand,finally,anyoffsettingbenefitstominorityandlowͲincomepopulations.

Theenvironmentaljusticestudyareafortheproposedprojectwasdefinedtoidentifypopulations thatwouldbeaffectedbythebuildalternatives.Thestudyareacapturespopulationsthatwould experiencebothdirectandindirectimpactsaswellasthebenefitstheproposedprojectwould provide.Mostprojectimpactswouldbelimitedinscope,andadverseimpactswouldbemitigated throughtheimplementationofeffectivemitigationmeasures.Completeinformationonthe proposedprojectimpactsandmitigationisprovidedinChapters3,AffectedEnvironmentand EnvironmentalConsequences,ofthisFinalEIS.Projectimpactswouldnotdiffersubstantially betweenthebuildalternatives.Mitigationmeasureswouldbeprovidedforimpactsuniformlyinall affectedareas.

Indirectbenefitsoftheproposedprojectwouldincludeimprovingregionalconnectivitythrougha reliable,efficient,andaffordablemeansoftransportationforpopulationsthatrelyonpublictransit.

InadditiontotheaboveͲlistedfacilities,theEastsideRailCorridorislocatedadjacenttothe PreferredAlternativeandtheBNSFModifiedAlternative.TheEastsideRailCorridoris“railbanked,” whichpreservesthecorridorforreactivationoffreightandallowsforatrailuseonaninterimbasis. Becausethecorridorisformallyreservedforafuturetransportationuse,reactivationoffreight,it doesnotqualifyasaSection4(f)resource.ThedesignofboththePreferredAlternativeandBNSF ModifiedAlternativeacknowledgestherailbankedstatusoftheEastsideRailCorridorbyallowing sufficientwidthandheightclearancestoaccommodateafuturetrailandfuturefreightorpassenger railuseofthecorridor.

TheCityofBellevueownsasmallparcel,whichwasaformerrailspurassociatedwiththeformer BNSFRailCorridor,justsouthofthePreferredAlternativeandBNSFModifiedAlternativesites.The parcelisidentifiedintheParksandOpenSpaceSystemPlan(CityofBellevue2010)asopenspace ownedbytheCity.Thispropertyiscurrentlyundeveloped,andthereisnospecificplanorfunding fordevelopmentofthispropertyasaparkresource.Becausetherearenospecificplanstodevelop thisparcelanditsdevelopmentiscontingentupondevelopmentoftheEastsideRailCorridorintoa regionaltrail,itisnotconsideredaSection4(f)resourceforthepurposesofthisanalysis.Thedesign andlayoutofthePreferredAlternativedonotprecludefuturedevelopmentofthisparcel.In addition,thePreferredAlternativewouldincludedevelopmentofaninterimcrushedͲgraveltrailin theEastsideRailCorridorinthevicinityoftheOMSF,asimilarlydesignedtrailconnectiononthe northsideoftheOMSFbetweentheEastsideRailCorridorand120thAvenueNE,anda multipurposepathalong120thAvenueNEtoprovidenonmotorizedconnectivitybetweenthe EastsideRailCorridorandtheEastLink120thAvenueStationarea.

Section3.17,HistoricandArchaeologicalResourcesandAppendixE.4detailtheproposedproject’s potentialimpactsonhistoricandarchaeologicalresources.Basedonthisreview,FTAdetermined thatnohistoricpropertiesonoreligibleforlistingintheNRHParelocatedintheAreaofPotential Effect(APE)fortheproject.TheWashingtonDepartmentofArchaeologyandHistoricPreservation (DAHP)concurredwiththisdeterminationonAugust22,2013.Nofurtheranalysisofhistoricand archaeologicalresourcesforthepurposeofSection4(f)isrequired.

z Nolandfromtheseresourceswouldbepermanentlyincorporatedintotheproposedproject.

z Noconstructionactivitiesorequipmentwouldoccupyanyportionoflandfromtheseresources duringanypointofconstruction;therefore,notemporaryoccupancywouldoccur.

Proximityimpacts(e.g.,noise)oftheproject,bothduringconstructionandoperation,wouldnot substantiallyinterferewiththeuseandenjoymentoftheseresources.ScriberCreekParkis consideredanoiseͲsensitiveuseunderFTAnoisecriteria.Anoiseanalysiswasconductedthat determinedthatnoisegeneratedbytheLynnwoodAlternativewouldbebelowtheFTAcriteriafora moderatenoiseimpact.Therefore,noisegeneratedbytheLynnwoodAlternativeatScriberCreek Parkwouldnotinterferewiththeuseandenjoymentofthepark.

TheonlypotentialforaSection4(f)useinvolvestheInterurbanTrail,whichwouldbeaffectedby LynnwoodAlternative.UndertheLynnwoodAlternative,anelevatedleadtrackwouldcrossoverthe InterurbanTrailapproximately820feeteastof52ndStreet.TheLynnwoodAlternativeproposes twoleadtracksfromthesouthernmidpointoftheLynnwoodAlternativesitetotheparcelopposite thetrailalong48thAvenueW.FigureDͲ1depictstheproposedprojectdesignfeaturesinrelationto theInterurbanTrail.

PermanentUseEvaluation—InterurbanTrail UndertheLynnwoodAlternative,nopermanentuseoftheInterurbanTrailwouldoccurasnoland fromthetrailwouldbepermanentlyincorporatedintotheproposedproject.Theelevatedguideway wouldrequireairrights,butnophysicalpropertywouldbeacquired.USDOT’sSection4(f)policy paper(FederalHighwayAdministration2012)distinguishestheneedforairrightsfromthe acquisitionofland,andstatesthatthereisnouseaslongastheaerialstructuredoesnotadversely affecttheresource.

ConstructiveUseEvaluation—InterurbanTrail AlthoughoperationoftheLynnwoodAlternativewouldresultinapermanentstructureoverthe InterurbanTrail,whichwouldhavesomevisualeffectsonthetrailusers’experience,these proximityimpactswouldbeexperiencedforabriefdurationduringanygivenuser’stripalongthe trail.TheOMSFwouldcreateshadingandalterviewsforpartofthetrail,butthechangeintheview forthissectionofthe15Ͳmiletrailwouldnotadverselyaffecttheactiverecreationalandtrailtravel activitiesthatareessentialtothetrail’spurpose.Further,theprimarypurposeoftheInterurban Trailisrecreationaltravel(e.g.,walking,bicycling,jogging,andskating).Generally,visualimpacts wouldnotbesubstantialorinterferewithsuchactivitiesandwouldposeonlyaminorannoyance forthetrailuser.

TemporaryOccupancyEvaluation—InterurbanTrail ConstructionactivitiesfortheLynnwoodAlternativewouldrequiretemporaryoccupancyof portionsoftheInterurbanTrailinordertoconstructtheleadtrackandconductconstructionwork ontheLynnwoodAlternativesite.AnexceptiontotherequirementforSection4(f)approvalis grantedfortemporaryoccupancywhentheconditionslistedonpageDͲ4aresatisfied.Thefollowing discussionevaluateshowtheproposedprojectmeetstheconditionsforanexceptiontothe requirementforSection4(f)approvalfortemporaryoccupancy.

1. Duration.Workrequiredtoconstructtheleadtrackwouldbetemporary,lastingashortnumber ofdaysrelativetotheentireprojectconstruction.Constructionofalightrailguidewayspan overthetrailmayrequirethetrailtobeclosedandreroutedforapproximatelyupto3weeks. 2. ScopeoftheWork.Theworkwouldbeminorinscope,andwouldnotresultinapermanent effecttotheInterurbanTrailsuchasdamagetothetrailpavement. 3. EffectsontheResource.BecauseportionsoftheInterurbanTrailwouldbeoccupiedby constructionequipmentandworkers,andconstructionworksurroundingthetrailmayhave posesafetyconcerns,atemporarydetourofthetrailwouldberequiredtoallowforthe continuedrecreationaluseofthetrailduringconstruction. 4. Restoration.VegetationsurroundingtheInterurbanTrailwouldbereplacedandgenerally restoredtoitspreconstructionconditions. 5. Consultation.SoundTransitwouldconsultwiththeCityofLynnwoodregardingthetemporary occupancyoftheInterurbanTrail.Writtenconcurrenceoftheabovefindingsfromtheofficials withjurisdictionovertheInterurbanTrailwouldbeneededpriortoapprovaloftheproposed project.FTAwouldneedwrittenconcurrencefromtheCityofLynnwoodbeforeitcouldapply theSection4(f)temporaryoccupancyexception. ThetemporaryoccupancyposedundertheLynnwoodAlternativewouldnotconstituteauseunder Section4(f)asconstructionworkwouldbetemporaryandshorterthantheoverallconstruction phase.TomitigatetheconstructionperiodclosureoftheInterurbanTrail,SoundTransitwould coordinatewiththeCityofLynnwoodtodevelopadetourandprovidesignageandnoticestousers toallowforcontinueduseofthetrailandpreventinterferencewithitsactivitiesorpurpose.The trailwouldberestoredtoitscurrentconditionsfollowingconstructionworkandreplacement landscapingwouldalsobeprovidedwherevegetatedareasneedtobeclearedforconstruction. Withthesemeasuresinplace,SoundTransitanticipatestheshortͲtermconstructionimpactswould qualifyforaSection4(f)exceptionfortemporaryoccupancy,andnoSection4(f)usewouldoccur. TheCityofLynnwood,whichhasjurisdictionoverthetrailasarecreationalresource,wouldneedto agreeinwriting.
