First session: The individual dimension of the right to peace

Main issues: What are the main legal principles of the right to peace? What is the connection between the right to human security and freedom from fear and from want, both being elements of positive peace? How does education and socialization for peace and human rights contribute to build identities disentangled from violence? Is there a right to conscientious objection against activities that entail a threat against peace? If so, how could members of any military or security institution claim their right not to participate in wars of aggression, international military operations not authorised by the United Nations, or other armed operations, which violate international human rights law or international humanitarian law? What is the connection between the right of peoples and individuals to and oppose oppressive colonial, foreign occupation or dictatorial domination and the right to peace? The right to truth, justice and reparation of gross violations of human rights, as an integral part of the right to peace. Migrants and refugees’ rights and the right to peace1.

Main issues: Is the disarmament, and in particular the a pre­condition to the enjoyment of the right to peace? If so, should peoples and individuals have the right to have the resources freed by disarmament allocated to the economic, social and cultural development? What is the connection between the regulation of private military and security companies and the enjoyment of the right to peace? How can operations improve their promotion human rights during and after conflict situations? What is the type of linkage between peace and security and development? How should the full enjoyment of the right to and economic, social and cultural rights promote the right to peace? How could peoples and individuals claim their right to live in a sustainable and safe environment as part of the right to peace?2

Main issues: What are the main duties and obligations of States, international organizations, civil society, peoples, individuals, corporations, the media and other actors in society for the realization of the right to peace? Should States adopt additional measures to build and consolidate peace? Is the “responsibility to protect” humankind from the scourge of war part of the right to peace? What are the functions of the General Assembly, the Security Council and the Human Rights Council in the field of protection of human rights from violations which may constitute a danger or threat to international peace and security? Can the Security Council meet its Charter­based responsibilities with its current composition and methods of work? Are “preventive wars” compatible with the right to peace in international law? How could international and domestic courts adjudicate the right to peace? What options are available to establish an effective monitoring mechanism of the future UN Declaration on the right to peace? What are the best practices developed by the HR Council?3

Biographies

Co-organizers

H. E. Mr. Slimane Chikh is the Permanent Observer of the Organization of the Islamic Cooperation (OIC) to the United Nations in Geneva. He is a diplomat from Algeria. Amongst several educational qualifications, he posseses a first degree in Law from University of Paris Sorbonne, France, a Master's degree in law from the University of Algers, Algeria and a Ph.D in Political Science from the University of Grenoble, France. He is an aggregated professor to the Faculty of Law at the University of Algers and has lectured at three prominent institutions in France namely: the University of Reims, the University of Aix Marseille and the Institute of Political science Paris. He has also lectured at the University of Laval Canada. He was the director of the Institute of Political Science University of Algers from 1975 to 1978 and from 1982 to 1984 rector of University of Algers. From 2001 to 2004 he served as ambassador of Algeria to Egypt and was also the permanent delegate to the League of arab States. From 1998 to 2001 he was a member of the National Council , 1995 to 1997 Minister of National Education, 1994 to 1995 Minister of culture, 1992 to 1994 Counsellor to the presidency of Algeria and 1988 to 1989 Minister of National education and training. He is author of several books, such as "L'Algérie en armes ou le temps des certitudes" (Paris economica, 1981, 511 p.) and "L'Algérie, porte de l'Afrique (Casbah Editors, 1999, 319 p.).

H. E. Ms. Alya Ahmed Saif Al-Thani is Ambassador Extraordinary and Plenipotentiary Permanent Representative of Qatar. Prior to her appointment to Geneva, Ms. Al-Thani had been serving as Ambassador to the Cabinet of the Ministry of Foreign Affairs since August 2011. She served at the Permanent Mission of Qatar to the United Nations in New York from April 2007 to July 2011, first as Counsellor, then as Minister Plenipotentiary and finally as Deputy Permanent Representative. She was a member of the General Secretariat of the Supreme Council for Family Affairs of Qatar from September 1999 to March 2007, first as a researcher in the Department of Research and Planning, as a Senior Specialist in the Department of International Relations, as Acting Director of the Child Rights Department and finally as Director of the Division of the Rights of the Child. She served as a member of the United Nations Committee on the Rights of the Child from 2007 to 2009. She has also represented Qatar in numerous United Nations meetings of the Commission on the Status of Women, the Commission for Social Development, the General Assembly, the Economic and Social Council, the Commission on Human Rights and others. She has a B.Sc. in economics from Qatar University, Faculty of Administration, Science and Economics (1996) and an MA in international studies and diplomacy from the University of London – School of Oriental and African Studies (2005-2006).

Mrs. Christina Papazoglou is a graduate of the Department of Economic and Legal Studies of Aristotle University of Thessaloniki and a member of the Law Bar Association of Thessaloniki, Greece. She holds an LLM in European and International Public Law from the Katholieke Universiteit, Leuven, Belgium and an Advanced Master in Human Rights Law from the Université Catholique de Louvain- la -Neuve, les Facultés Universitaires Saint- Louis, Bruxelles and les Facultés Universitaires Notre-Dame de la Paix, Namur, Belgium (Académie Universitaire ‘Louvain’). She has worked as an attorney in law in Greece, as legal advisor in the field of intellectual property law in Brussels and as legal expert on

Caux, 26-27 November 2012 In preparation of the first session of the OEWG on the right to peace citizens’ rights for a programme of the General Directorate of Internal Market of the European Commission. She is currently the Programme Executive for Human Rights and Global Advocacy at the World Council of Churches, Geneva, Switzerland. Mr. Jun Sasamoto, Attorney at law in Japan, Secretary general of the Japan Lawyers International Solidarity Association and member of the Steering Committee of the World Conference on Article 9 held in Tokyo in 2008. He published "Peace Constitutional Law in the world" and is co-editor of the book "Human Right to Peace: Making the UN Declaration", Kamogawa Publisher, Tokyo 2011 (in Japanese). Mr. Carlos Villán Durán is Professor on International Human Rights Law. Co-Director, Master on International Protection of Human Rights (University of Alcala, Madrid). Member of the International Institute of Human Rights (Strasbourg, France). President of the Spanish Society for International Human Rights Law (SSIHRL). Former staff member of the Office of the UN High Commissioner for Human Rights (1982-2005). Author of 149 publications on International Human Rights Law, among them six books and 23 articles on the human right to peace.

Moderator

H. E. Mr. Hubert Wieland Conroy is graduated from the Diplomatic Academy of Peru in 1983 and entered the diplomatic service in 1984. He holds a Master Degree in International Relations from the Graduate Institute of Geneva and in Constitutional Law from the Pontificia Universidad Católica del Perú. Mr. Wieland has worked at the Embassies of Peru in Austria, Germany, and Russia, as well as at the Permanent Mission in Geneva (1990­1992). He has also worked as staff member of the Office of the High Commissioner for Human Rights. He finally served as General Cónsul in Bogota, Colombia. Mr. Wieland is in Geneva since September 1st, 2011.

Facilitators

Mr. Alfred­Maurice de Zayas is an American lawyer, writer, historian, a leading expert in the field of human rights and international law, a retired high­ranking United Nations official, a peace activist, and since 2012 the United Nations Independent Expert on the Promotion of a Democratic and Equitable International Order, appointed by the United Nations Human Rights Council. He is currently a professor of international law at the Geneva School of Diplomacy and International Relations, and formerly worked with the United Nations from 1981 to 2003 as a senior lawyer with the Office of the UN High Commissioner for Human Rights, Secretary of the Human Rights Committee and the Chief of Petitions.

Mr. Jose Luis Gómez del Prado is former Chairperson of the UN HR Council’s Working Group on the Use of Mercenaries, servicing in his personal capacity as a human rights

He is a member of the Advisory Group of the Geneva Centre for Democratic Control of Armed Forces (DCAF) Private Security Regulation Net. He also served as a member of the U.N. Advisory Group of the Voluntary Fund in the First International Decade of the World’s Indigenous Peoples. As former senior UN human rights officer (1981-1997) he was in charge of advisory services and human rights field presences of the Office of the UN High Commissioner for Human Rights. He has been Senior Coordinator of the World Conference against Racism (Durban 2001) assisting the former UN High Commissioner for Human Rights, Ms. Mary Robinson.

Special invitees

H E. Mr. Mohamed Sahnoun was nominated by Secretary-General as United Nations/Organization of African Unity (OAU) Special Representative for the Great Lakes region of Africa in January 1997. He is also a member of the Special Advisory Group of the War-torn Societies Project, a joint endeavour of the United Nations Research Institute for Social Development (UNRISD) and the Graduate Institute of International Studies in Geneva. Prior to his current assignment, Mr. Sahnoun was Special Adviser to the Director- General of the United Nations Educational, Scientific and Cultural Organization (UNESCO) for the Culture of Peace Programme and formerly Special Representative of the Secretary- General of the United Nations to Somalia, from April to November 1992. In 1993, he was appointed Special Representative of the Secretary-General of the OAU in the Congo; and in 1994, he became a Pearson fellow with the International Development Research Centre in Ottawa, Canada. From 1964 to 1973, Mr. Sahnoun was Deputy Secretary-General of the OAU, and in 1973, he was appointed Deputy Secretary-General of the League of Arab States in charge of Arab-Africa dialogue. He also served as Algeria's Ambassador to Morocco and Secretary to the Maghreb Union (1989-1990); Ambassador to the United States (1984-1989); Chief of Algeria's Mission to the United Nations (1982-1984); Ambassador to France (1979- 1982); and Ambassador to the Federal Republic of Germany (1975-1979).

Mr. David Fernández Puyana is bachelor in Philosophy and Education Science by the University of Barcelona (Spain) and Graduated in Law by School of Law University of Pompeu Fabra (Barcelona, Spain); Master in International Studies by University of Pompeu Fabra (Barcelona, Spain); Master in International Human Rights Protection by the University of Alcala (Madrid) and holder of the LLM in International Human Rights Law by the University of Essex (Colchester, UK). He was the Director of the World Campaign on the Human Right to Peace. He is the representative of the Spanish Society for the International Human Rights Law and the International Observatory on the Human Right to Peace in Geneva. Mr. Rainer Guder coordinates Initiatives of Change International’s relations with the UN and other International Organizations and embassies in Geneva. He was born in New York of a German mother and a Spanish father. He grew up in the United States but spent much time in Europe as well and speaks English, Spanish, German, Italian, and French.
