KARONGA CHITIPA WATER SUPPLY PROJECT Public Disclosure Authorized COMPENSATION PLAN

1.0 DESCRIPTION OF WORKS

The project involves rehabilitation, upgrading and extension of Karonga and Chitipa Water Supply Schemes. Structures to be constructed are outlined below:

1.1 Karonga Public Disclosure Authorized

* Maximum of 6 boreholes to be drilled - each one occupy up to 600 m2 of land including pump control room.

* Access road to water tanks - length 450 m (land owned by Government)

* 3 Water tanks at 2 different sites. - 2 on Nyanja hill on 3000 m2 of land including chlorine room,

Public Disclosure Authorized guardhouse and parking space (land owned by Government). - 1 at compound of existing treatment works (land owned by Northern Region Water Board)

* Number of houses - 3 units for operators dwelling - 1 at existing old pumping site (land belongs to Northern Region Water Board). - 2 at well field site each on 600 m2 of land (2 households affected).

* Length of transmission main is 1700 m. Public Disclosure Authorized * Length of distribution network is 62000 m. 1.2 Chitipa

* 2 boreholes - each one occupying up to 200 m2 of land including pump control room.

* 1 water tank at existing tank site (land owned by Northern Region Water Board).

* Number of houses - 3 units for operators dwelling - 2 at existing office site (land owned by Northern Region Water Board). - 1 at existing tank site (land owned by Northern Region Water Board).

* Length of transmission main is 1047 m.

* Length of distribution network is 37000 m.

2.0 STATUS OF THE WORKS

2.1 Karonga

* Boreholes - drilling commenced on 13th July 2002 and is in progress

* Access road - excavation completed.

* Nyanja Hill water tanks - excavation for foundation commenced on 1st July 2002

* Operators dwelling - this has not yet commenced (awaits finance).

* Transmission main - this has not yet commenced; awaiting drilling results.

* Distribution Lines in the town - about 6000 metres of trench excavation has been performed along the road right off way.

* The project has not commenced in Chitipa

3.0 MARKET PRICES

3.1 Determination Of Unit Rates In order to determine unite rates to be used for compensation for various crops in the affected areas, information was collected from the District Commissioner's Office and the Department of Forestry office (North).

The information collected was giving the average yield in kilograms per hectare and the Government unit rates for various crops grown in the country. However, these rates were produced in 1994 and did not give a true reflection of the market value. It was also observed that the affected individuals could not accept such low prices.

The Board therefore carried out a survey in the market areas of Karonga and Mzuzu. This was done by obtaining a unit price of the crop per kilogram. It was noted therefore that the market rates were in general 50% higher than the Government rates.

Since it was not possible to determine the actual weight of the crop in the field, the affected crop areas were therefore measured. The unit rate in Kwacha per kilogram obtained from the survey were therefore converted to Malawi Kwacha per square metre since the average yield in kilogram per hectare is known e.g. for maize crop the average yield per hectare is 4000 kilogram, giving 0.4 kg /m2, while the unit price is MK17.00/kg giving MK6.8/m2.

Through the same survey unit rates for pole and mature trees were obtained. Blue Gum and Gmelina trees with diameters less than 150mm are normally used for poles and valued in the market at 6OMK and 75MK respectively. Trees with bigger diameters are considered to be mature trees and are used for firewood. The oldest trees are about sixteen years old and have a diameter of 400mm. Mature Blue Gum

3 trees and mature Gmelina trees are valued at 600MK and 475MK respectively by the Department of Forestry.

4.0 NUMBER OF HOUSEHOLD AFFECTED

The Board had identified 75 and 35 beneficiary households in Karonga and Chitipa respectively. Construction of the works in Karonga started in farming season, but is expected to be completed before the next farming season. About a third of the beneficiaries are being compensated for cassava, which is grown in both areas throughout the year.

5.0 POLICY FOR COMPENSATION FOR PROPERT AND CROPS

5.1 For temporary loss of crops and/or structure, the Board compensates individuals, regardless of ownership status (tenured or customary including road reserves), for loss of current crops and replacement of structures.

5.2 For permanent loss of land, crops, and/or structures, the Board compensates affected individuals regardless of ownership status (tenured or customary including road reserves), where the Board pays compensation and relocates the affected individual to another equivalent site acceptable to him/her and compensates him/her for the full replacement value of the lost crops and structures.

6.0 BASIS FOR COMPENSATION OF PROPERTY AND CROPS

6.1 Crops - The District Commissioner (DC) maintains a schedule of compensation rates for various types of crops and trees. The schedule is used to set minimum compensation rates. (Note: Rates used by the NRWB are about 50% above the minimum rates.)

6.2 Land - The NRWB pays compensation according to the following formula: Amount of Compensation = Area (m 2) x

4 Unit Price @0.485 MK/M2v; and, in consultation with traditional leaders, relocates the affected individual to another equivalent site acceptable to him/her.

6.3. Structures - For compensating structures, the District Commissioner uses the services of professional assessor who determines the value of the affected structure.

7.0 PROCESSING OF DETERMINING COMPENSATION

7.1 The process of compensation is managed with the full involvement of the DC's office which is the authority mandated to handle issues of compensation.

7.2 The process starts with identification of the required land and affected individual, and assessment of the crops, structures and the size of the affected property. This assessment is done jointly with the DC's office, the Local Leaders (chiefs), professional assessors, and the owner of the property, structures and/or crops.

7.3 Once the assessment is made, the Water Board in the presence of the DC negotiates compensation with the affected individual.

7.4 After an agreement with the affected individual has been reached, payment for compensation is made by the Board to the affected individual through the DC's office.

COMPENSATION PLAN

Six Water Supply Scheme Project which is being financed under National Water Development Project (NWDP) by IDA is targeting Six District towns namely: Nkhota-kota, Salima, Ntchisi, Dowa, Ntcheu and Dedza. This project is aimed at improving water supply for the said towns by carrying out rehabilitation programme of the existing system which is dilapidated and experiencing frequent breakdowns and high unaccounted for water. The project is also aimed at expanding the system to meet the population demand for the year 2010. The works are more than 95% complete as of July 2002. The project details are as follows:

During the implementation of the project we made sure that before the project started, a copy of drawings showing all sites and locations were sent to the Chief Executives and District Commissioners of Town and District Assemblies. These are the representatives of Malawi Government at the District and Town level.

The value of customary land is standard at 30,000 MK/HA. It is only in towns and commercial arrears where the rate is driven by market forces as well as the infrastructure development. This is also applicable to free hold and estates owned land where the government has no direct control. Compensation for land was only required on customary land, no other lands were involved.

As this project has mainly been rehabilitation and some extension of the distribution network not much new land was required for boreholes, water tanks and buildings. Of that which was required most already belonged to the board. The description is as follows:

Nkhota-kota

One borehole has been drilled in a well field already belonging to the water board. The area of land used is 50 m by 50 metres. (2500m3)

Two Chlorination buildings have been built occupying almost 5m2 each. These are also in our own land where other Central Region Water Board structures are existing.

* Stand Pipe Tank 2 It is occupying IOOm (10 x 10 m) of land near Catholic institution. The land was given to Central Region Water Board free of charge by the Catholic Institution.

* Communal Water Points Each Communal Water Point is occupying IOOm2 (lOm x 10m). These sites were selected by Community Water Point Committees through discussions facilitated by Community Liaison groups (CLGs), where there was not cost for the land. There are 58 CWP in Nkhota-kota in several villages and communities total area of land occupied is 5800m2 .

* Scheme office The scheme office is occupying 2500m2 of land (50 x 50 m). The land has been leased by Central Region Water Board from Nkhota-kota District Assembly. Development charges were paid and fees will be paid annually to the Assembly as lease charges.

The length of the new distribution system is 24000 m.

2 SALIMA

* Borehole Three new boreholes have been drilled. Each borehole is occupying an area of 50 x 50 (2500 m2 ) piece of land.

* Chlorination Buildings There are two chlorination buildings erected in Salima. Both buildings have been erected on the land acquired for boreholes. One building is controlling two boreholes that are feeding the standpipe at Kaphatenga while the other one controls one borehole which is feeding the ground level tank.

* Tanks A total of 725 m2 has been acquired for the ground level tank and the standpipe tank. The land occupied by standpipe tank was donated to Central Region Water Board free of charge by the Catholic Institution in Salima.

* Communal Water Points (CWP) There are 62 Communal Water Points in Salima the total area of land occupied is 6200 m2 100 m 2(10 xlO m) being for each CWP.

* Zone office This has been erected on the land already belonging to Central Region Water Board, where the old stores used to stand.

* CH1O House This house is on 1500 m2 (30 m x 50 m) piece of land. This is a leasehold land from Salima Town Assembly.

The length of the new distribution is 32000 metres and 5900 m for transmission main.

NTCHISI

* Boreholes Two boreholes has been drilled in Ntchisi the land had to be acquired and compensation paid.

* Chlorination Buildings This has been built on land already owned by the Board.

* Tanks A 300 m3 tank has been erected next to two existing tanks on a piece of land which already belongs to the board.

* Scheme Office and EH-5 House One big piece of land 6200 m2 in total was acquired for both the scheme office and the EH5 House. The land is demarcated partly for office use and partly for the EH 5 Houses.

3 DOWA

* Borehole Three boreholes have been drilled in Dowa 2 on the land acquired from Department of Forestry (50m x 50m + 2500m2 for each borehole) and one has been drilled on CRWB land next to an existing borehole.

* Chlorination Buildings Three chlorination buildings have been built. Two are next to each borehole forestry boreholes. One is built next to CRWB's existing borehole.

* Tanks One concrete tank of 600 m3 volume has been built on 900 m2 land acquired from Forestry Department.

* Communal Water Points Twenty-two Communal Water Points have been built in the surrounding villages and communities. In total, 2200 m2 of land has been used.

* Scheme offices Two scheme offices have been built in separate locations. Each office is built on 2500 m2 (50 x 50 m) piece of land.

* CH 10 and EH 5 Houses

2 2 Both these houses have been built on 2400 m (60 x 40 m) and 900 m (30 x 30 m) respectively. This land already belongs to the board.

DEDZA

* Boreholes Four boreholes have been drilled in Dedza. One borehole is drilled at Kapalamula next to an abandoned borehole which collapsed. This 2500 m2 site already belongs to the CRWB. Three boreholes have been drilled in Dauya on land occupying 7500 m2 total. This land had to be acquired and compensation paid. The CRWB is currently negotiating with owners of land for the acquisition land for access road.

* Chlorination Buildings Three Chlorination Buildings have been built on property already owned by the CRWB near existing boreholes.

* Water Tanks Two water tanks have been erected in Dedza on land owned by the CRWB.

4 * Zone office The Zone office has been built on a 6000 m2 (60 x 100 m) piece of land which has been leased from Dedza Town Assembly.

* CH 10 House This has been built on 2400 m2 (40 x 60 m) piece of land leased from the Town Assembly.

NTCHEU

* Boreholes No new borehole has been drilled.

* Chlorination Buildings Three chlorination buildings are being constructed on CRWB land. One at Chiole Booster Station and one at the Ndagoma Tank Site.

* Tanks Two tanks have been built, one 65m3 concrete tank at the Booster Station and one 100m3 steel groundwater tank at the office site. This is basically a break pressure tank from Ndagoma tank.

* Communal Water Points Twenty-five Communal Water Points have been built to several Communities and villages.

* EH 5 Houses Two have been built, one at the booster station and other one at Ndagoma Tank and Chlorination Site.

MARKET PRICES The compensation rates for crops was determined through a market survey. For example, for maize, a 50 kg bag is sold at a commercial rate of K850.00 which is equivalent to K17 per kg. This is the same rate being applied under item 17 and 18 to Mrs Lefani Chisala and Mr. Rabson Mvula in Ntchisi. Similarly, the supermarket rate for cabbage drumhead ranges from K20 to K45 per head (inclusive transport tax and profit) depending on the size. Mr. Rabson Phiri and Mrs Kanyemba in Ntchisi were paid at the rate of K20 per head respectively. (see compensation plan where this and other examples are provided).

In our opinion the rates used are a representative of the market prices and in some case better, especially for food prices due to the current food situation in Malawi.

NUMBER OF HOUSEHOLDS AFFECTED From the table submitted a total number of 128 houses were affected. You will note that in Dowa it is only the Forestry department (not are individuals) that was affected.

2.0 BASIS FOR COMPENSATION OF PROPERTY AND CROPS

2.1 Crops - The District Commissioner (DC) maintains a schedule of compensation rates for various types of crops and trees. The schedule is used to set minimum compensation rates. (Note: Rates used by the NR WB are about 50% above the minimum rates.)

2.2 Land - The CRWB pays compensation according to the following formula: Amount of Compensation = Area (m2 ) x Unit Price @30,000 MK/m2 ; and, in consultation with traditional leaders, relocates the affected individual to another equivalent site acceptable to him/her.

2.3 Structures - for compensating structures, the District Commissioner uses the services of a professional assessor who determines the value the affected structure.

3.0 PROCESS OF DETERMINING COMPENSATION

3.1 The process of compensation is managed with the full involvement of the DC's office which is the authority mandated to handle issues of compensation.

This assessment is done jointly with the DC's office, the Local Leaders (Chiefs), professional assessors, and the owner of the property, structures and/or crops.

3.3 Once the assessment is made, the Water Board in the presence of the DC negotiates compensation with the affected individual.

3.4 After an agreement with the affected individual has been reached, payment for compensation is made by the Board to the affected individual through the DC's office.

EXAMPLES OF COMPENSATION CALCULATIONS ON SIX CENTRES PROJECT

We are in receipt of your Email of 17 'h June, 2002 in which you brought to it to our attention concerns raised regarding the calculation of compensation.

As mentioned earlier in our correspondence to you, compensation is paid for based on three main categories:

A LAND

The Ministry of Lands and Housing stipulates that for locations outside the Cities of , , Mzuzu and Zomba be compensated for at MK30,000 per hectare. Taking one hectare to be 10,000 square meters, the rate of compensation works out to be MK3 per square meter. Table 1 below shows five recipients of compensation under the Six Centres Project, and the size of the land for which compensations was paid. Note the similarity in value of compensation between Mr. S Yenderani (750m2) and Mr Tsabvu (756m2) both of Sanza Village in Ntchisi.

B CROPS/EGETABLES/TREES

For trees whose sole purpose is for use as poles, calculation of compensation is based on the number of trees and the diameter of the tree 500cm above the ground level. For fruit trees (e.g. peaches, oranges, bananas, etc.) Ministry of Lands and Housing stipulates the expected number of fruits that the tree would bear per annum and this is multiplied by the current market price of the fruits to calculate the compensation payable. For such crops such as beans, groundnuts, sweet potatoes, the Ministry of Lands and Housing provides the maximum production figures in Kilograms per hectare of land hence the calculation of compensation is dependent on the size of the cultivated land.
