It was moved by Senator Holmberg, seconded by Representative Vigesaa, and carried on a voice vote that the minutes of the September 16, 2020, meeting be approved as distributed. REPORTS Recycling Produced Water in Oil and Gas Operations The committee received a report on October 1, 2020, regarding the Industrial Commission's study on recycling produced water in oil and gas operations (Appendix B) pursuant to Section 19 of House Bill No. 1014 (2019). EmPower ND Commission Chairman Wardner called on Mr. James Leiman, Director, Economic Development and Finance Division, Department of Commerce, for testimony (Appendix C) regarding the EmPower ND Commission's energy policy recommendations. In response to a question from Senator Piepkorn, Mr. Leiman said the largest petrochemical product produced in North Dakota is a variety of plastics. In response to a question from Senator Hogan, Mr. Leiman said to encourage infrastructure development projects, the Legislative Assembly should consider supporting additional road capacity installation to accommodate any increase in transportation demands and also invest in salt caverns. -

The prayer was offered by Rev. Rich Wyatt, Living Hope Church of the Nazarene, Bismarck. COMMUNICATION FROM SECRETARY OF STATE ALVIN A. JAEGER December 3, 2018 In accordance with Section 54-03-03 of the North Dakota Century Code, I certify the enclosed list is a true and correct record of members of the House of Representatives elected in the General Election held on November 6, 2018. The State Canvassing Board certified the results of the election on November 16, 2018. As specified in Section 16.1-15-45 of the North Dakota Century Code, Certificates of Election were then prepared by the Secretary of State and signed by the Governor, the Clerk of the Supreme Court (as the designated representative of the State Canvassing Board), and the Secretary of State. Each newly elected member of the Legislative Assembly was then issued their Certificate of Election (copies enclosed), as specified in Section 16.1-15-46 of the North Dakota Century Code. In addition, in accordance with Section 4, Article XI, of the North Dakota Constitution, an Oath of Office (or affirmation) form was provided to each Representative, with instructions to execute the Oath before a Notary Public and file it with the Secretary of State before he or she assumes the duties of their office. IN TESTIMONY WHEREOF, I have set my hand and affixed the Great Seal of the State of North Dakota at the Capitol in the City of Bismarck on this date. -

Rep. Guggisberg testified as a sponsor of this bill. I was on the interim committee for employee benefits and we received a summary report of what the bill proposes to take out. We heard testimony that it is a 500-page report and there are departments that are spending 400 hours on it. It appears the 61 st legislative assembly found some improper use of these funds in a certain department and decided to have them report. It has caused a lot of work for departments that were outside of that agency. To get these funds first of all, they have to create a rule that has to go through the rules committee. These funds are tracked during our audits, both fiscal and performance audits. It seems like it is doing the same work twice. Rep. Ben Koppelman If your bill was passed, would these things still show up as a line item in other year end reports? Rep. Guggisberg The budgets I have seen so far in appropriations, these are not line items, but when the department is audited, it is something that they look at in the audit. -

Minutes: Chairman Dan Ruby opened the hearing on HB 1470. Representative Kelsh, District 26, introduced HB 1470. He explained that a superintendent asked him to bring this bill forward. He stated that when schools require a bus driver to have a physical, often times the doctor will find something that may be wrong. At that point the person is referred to another doctor, such a specialist in a different town. Then the school is billed for all the medical costs, often a large amount. It happens more frequently because at this time it is very difficult to hire bus drivers, and older people are being hired. The schools would like the physicals to be billed to the person's insurance or Medicare with the remainder being paid by the school district. Representative Rick C. Becker: Is the patient going to the physician with paperwork from the school district? I can't imagine that a physician will bill an employer, rather than the insurance company. What makes this different, that a physician will send the bill to the employer instead of the insurance? Representative Kelsh: I don't know, except that the superintendent told me that they get the bill directly without it going to the insurance. Chairman Dan Ruby: My employees have to have physicals too. The bill does not go on the employee's health plan on Blue Cross; it comes to me right away. -

Minutes: Testimony 1 , 2 , 3 ,4 , 5 & 6 Chairman N. Johnson: Opened the hearing on HB 1255. Rep. B. Thoreson: Introduced the bill. (Attorney General's opinion #1). This is where there was a question raised about the electronic fund transfer is the same thing as a check because checks need to be reported. Sen. Andrist made this request and you can read through the opinion, but if you read through the first page it says for the reasons indicated below it is my opinion that the requirements contained in 40-01-09. 1 do not include payments made by electronic fund transfer. This bill would make those reportable also. I think we live in a time where checks are probably going the way of dinosaurs in many ways. We use credit cards, internet purchases and we are going to be paying a lot with these. Soon we are going to be using your cell phone are increasing popular in other parts of the world and are rapidly coming to the US. I think we need this legislation to cover those types of payments also. Not just the traditional check payments. This does make the necessary changes and does cover county commissioners and school boards along with cities and I would ask for your support. -

Minutes: Chairman Dever: Opened hearing on SB 2343. Jim Silrum, Deputy Secretary of State: See Attachment #1 for testimony in support and to explain the bill. (2:55)Chairman Dever: The deadline to file this is the Friday before the election? Jim Silrum: For certain offices, legislative offices, multi-countyoffices, city and school offices, that would be true, but for statewide offices it is 20 day prior and for judicial offices it is 20 days as well. Those are already in statute. Chairman Dever: If you don't file a form, then are your votes counted? Jim Silrum: They would be counted but they would not be a part of the official abstract because you haven't identified yourself as a specific candidate. Therefore, the votes for any write in candidate that is listed who had not filed a certificate of write in candidacy would be listed in the abstract as a scattered write in vote. What has prompted this over the course of time is that for some reason, we and county election officialsand others, are noticing an increase in fictitious names that are being placed on the ballot. There are a lot of people who want to simply vote for themselves because they don't like any of the candidates that are there on the ballot. -

ASSIGNMENT OF ADDITIONAL COMMITTEE RESPONSIBILITY Senator Holmberg, Chairman, Legislative Management, said he is assigning the committee an additional responsibility to review the potential purchase of the Research Enterprise and Commercialization Building on the campus of the University of North Dakota. He said the building was originally financed and constructed by a nonprofit entity. He said the Legislative Assembly through Section 23 of 2013 Senate Bill No. 2003 authorized the State Board of Higher Education to enter a purchase and financing agreement with a private entity to purchase the building using donations, gifts, or other funds. He asked the committee to review the status of the building purchase, including the source of any funds used in the purchase. -
