EXECUTIVE CABINET MEMBER – LEADER’S PORTFOLIO

A record of decisions made by the Executive Cabinet Member with responsibility for the Leader’s Portfolio:-

Following consideration of the matters detailed below in the presence of:-

66. MONITORING OF EXECUTIVE MEMBER DECISIONS

The Borough Solicitor submitted a report which provided an update on decisions taken at previous meetings of the Executive Cabinet Member.

The Executive Cabinet Member NOTED the report.

CONFIDENTIAL ITEMS

The background papers and report in relation to the following items was considered confidential as defined in paragraph 3 of Schedule 12A of the Local Government Act 1972 and that it be deemed that, in all the circumstances of

the case, the public interest in their exemption outweighs the public interest in their disclosure.

67. PARK ROAD, WESTHOUGHTON – DISPOSAL OF OPEN SPACE

The Director of Place submitted a report which advised the Executive Cabinet Member of the position following the advertisement of the loss of open space at Park Road, Westhoughton.

The report stated that the proposed disposal of the site was advertised in the News for two weeks and one representation had been received which was attached to the report.

The Executive Cabinet Member AGREED that this item be deferred for further information.

68. CAR SHOWROOM DEVELOPMENT – ROAD, BOLTON

The Director of Place submitted a report which sought the Executive Cabinet Member’s approval to the terms as detailed in the report in respect of a car showroom development at Manchester Road, Bolton.

The Executive Cabinet Member NOTED –

(i) The progress of the car showroom development at Manchester Road, Bolton; APPROVED – (ii) A lease to Bolton Car Centre on the terms as outlined in the report; (iii) The land exchange with the Homing Club; and AUTHORISED – (iv) The use of the CSO5 of the Standing Orders relating to Contracts as detailed in the report; and (v) The Director of Place to conclude negotiations and the Borough Solicitor to carry out all the necessary legal formalities.

69. BLACKROD COMMUNITY CENTRE, GREENBARN WAY, BLACKROD

The Director of Place submitted a report which apprised the Executive Cabinet Member of the progress which had been made with regard to negotiations to lease Blackrod Community Centre.

The Executive Cabinet Member APPROVED –

(i) The terms provisionally agreed for the grant of a lease at Blackrod Community Centre on the terms detailed in the report and AGREED – (ii) To delegate authority to the Director of Place to agree any further amendments subject to such amendments being of no materiality; and AUTHORISED – (iii) The Borough Solicitor to conclude the necessary legal documentation.

70. UNITY BROOK, MANCHESTER ROAD, KEARSLEY – DISPOSAL OF OPEN SPACE

The Director of Place submitted a report which sought the Executive Cabinet Member’s approval to the sale of the open space land at Unity Brook, Manchester Road, Kearsley.

The Executive Cabinet Member APPROVED the disposal of the Council’s interest in the property at Unity Brook, Manchester Road, Kearsley by way of a 999 year lease and authorised the Borough Solicitor to complete all the necessary legal documentation.

71. BOLTON TO BURY CYCLE WAY, LAND AT VIADUCT, DARCY LEVER VIADUCT AND LAND LINKING THE VIADUCTS, BOLTON

The Director of Place submitted a report which updated the Executive Cabinet Member of the terms previously approved for the acquisition of land at Burnden Viaduct, Darcy Lever Viaduct and land linking the Viaducts, Bolton to facilitate the

completion of the Bolton to Bury Cycle way from Burden Viaduct to Darcy Lever Viaduct.

The Executive Cabinet Member APPROVED –

(i) The acquisition of the part freehold and part leasehold interests in the land at Burnden Viaduct, Darcy Lever Viaduct and land linking the Viaducts, Bolton for the Bolton to Bury Cycle Way which forms the route of part of the now disused former railway line under the revised arrangements as outlined in the report; and AUTHORISED – (ii) The Borough Solicitor to complete the necessary legal documentation.

72. BOLTON TOWN HALL – REFURBISHMENT OF NORTH BASEMENT

The Director of Place submitted a report which sought the Executive Cabinet Member’s approval for the refurbishment of the north basement in the Town Hall, Bolton.

The Executive Cabinet Member AUTHORISED the Director of Place to progress the refurbishment of the north basement in the Town Hall, Bolton and the Borough Solicitor to complete the necessary legal documentation.

73. BOLTON TOWN HALL AND CIVIC CENTRE ESSENTIAL POWER SUPPLY MAINTENANCE WORK

The Director of Place submitted a report which sought the Executive Cabinet Member’s approval for the Bolton Town Hall and Civic Centre essential power supply maintenance works and to agree to waive standing orders to allow procurement from a specialist contractor.

The Executive Cabinet Member AUTHORISED –

(i) The Director of Place to progress the essential power supply maintenance works as an addition to the capital programme; and APPROVED –

(ii) The waiving of Standing Orders for Contracts to allow procurement to be made from ENW and Schneider.
