Foreword

RIFCIU-SWJTU, the organization for external monitoring and evaluation on resettlement in Ya’an-Lugu Expressway Project, in strict accordance with requirements of Asian Development Bank(ADB), performed field investigation and completed monitoring and evaluation independently in September, 2011, during which 3 monitoring and evaluation teams went to of City, , , and of Ya’an City to performed field investigation on Land acquisition, house demolition and resettlement in Ya’an-Lugu Expressway Project.

After fully learning the progress of project implementation and resettlement, compensation standards, fund appropriation, and the resettlement implementation plan according to the Resettlement Action Plan for this Project, the monitoring and evaluation teams collected wide range of opinions and recommendations on the resettlement results of resettlers, compared changes on living and production of people affected before and after the resettlement, finally, based on the updated investigation and statistical data, through analysis, sorting, information feedback, etc., completed the preparation of Phase V of the External Monitoring and Evaluation Report on Resettlement. The deadline of investigation information, which is basis of this report, is in early September, 2011.

Overview of Monitoring & Evaluation

1. External Independent Monitoring and Evaluation Report (Phase VI) submitted by RIFCIU-SWJTU, the external monitoring and evaluation organization for land requisition and relocation in Ya’an-Xichang Expressway Project (hereinafter referred to as “the Project”) is summarized as follows:

By September 25, 2011, construction of the Project has progressed smoothly as scheduled, during which, investment of 17323.25 million yuan has been accumulated, of which, 14394.85 million yuan is for civil subgrade works. Since the beginning of the year, a total of 3179.49 million yuan has been invested. 44.98 million cubic meters of subgrade earth/stone works for project image have been finished accumulatively, accounting for 99.9% of the total; 1.158 million cubic meters for the superstructure and 1.44 million cubic meters for the substructure of super major bridges and major bridges have been completed, accounting for 96.2% and 100% of the total volume respectively; 82258 m of tunneling has been finished, accounting for 98.3%; 81181m of lining has been built, accounting for 97%. Other completed works include, 429 culverts and channels, accounting for 96%; 1554000m3 of protection works, accounting for 94.5%; 2471669m2 of pavement subbase, accounting for 77.9%; 2296076m2 of pavement base course, accounting for 77.1%; 3511575 m2 of pavement surface course, accounting for 47.5%; traffic safety works accounting for 44%; housing construction accounting for 43%; greening works accounting for 54%; electromechanical works accounting for 17%; Niba Mountain tunneling accounting for 91.2%.

By September 2011, the actual area for permanent land acquisition for the Project has totaled 17646.509mu, being 115.69% of the area planned for land acquisition in the Resettlement Action Plan, which is 15253.89mu (1016.926 hectares). The excess area is the area supplemented for land acquisition due to design modification and various reasons.

4. Along the whole line of the Project, with houses of 2340 households having been demolished, the actual house demolition area has totaled 316420.97m2, accounting for 152.63% of the planned house demolition area of 207312.7m2. And buildings of 27 enterprises (25320.405m2) and 8 schools have been demolished, for which compensations have been made timely and relocation and resettlement have been completed.

5. Fund appropriation: by September 25, 2011, the Owner has appropriated 831.8914 million yuan for land acquisition and house demolition, in which, 750.7494 million yuan has been paid to all counties and districts, with a balance of 81.142 million yuan. Compared with monitoring during the previous phase, land compensation fund is retained on villages’ collective account instead of being allocated to farmers (this is the same as that in the previous phase), and in 4 townships (towns) in non-reservoir area of Pubugou Power Station, Tangjia Township, Shuangxi Township, Fuchun Township and Jiuxiang Town, land compensation has been fully paid to related people according to land acquisition standards of the Project (more

progress are made).

6. Land acquisition and resettlement: in area with small cultivated area per capita along the Project, monetary resettlement dominates after land acquisition since land adjustment resettlement is not possible; that is to say, land compensation and resettlement compensation are paid to the affected households totally. In a very few affected villages where land adjustment resettlement is possible, most land compensation is used to develop agricultural production and public welfare establishments. In Yucheng District, Yingjing County and Shimian County, pilot work has been carried out and social security of land-lost farmers has been implemented in accordance with Trial Measures on Endowment Insurance for Land Occupied Rural-to-urban Residents beyond Urban Planning Area of Yucheng District in Ya’an City (YFB[2009]No.29), Provisional Measures of Employment and Social Security for Land-occupied Persons (YFF[2009]No.10), and Outline on Promotion of Social Security for Rural-to-Urban Residents due to Land Acquisition in Shimian County.

7. Temporary land use: in general, compensation has been paid to affected persons as required by compensation policies. Project construction will be completed in the near future and Yucheng Section and Mianning Section have been completed and open to traffic, so temporary land use will hardly increase. Follow-up work will be focused on reclamation of temporarily used land and further compensation for those which can not be restored.

8. With both centralized and decentralized resettlement, the Owner and the local resettlement departments have jointly planned 17 centralized resettlement sites. Currently, the construction of 11 centralized resettlement sites in Yucheng District, Yingjing County and Hanyuan County has almost been completed and most of relocated households have moved into their new houses. Though the resettlement in Shimian County is characterized by large scale and great difficulty, with the big push by the Yaxi Company and the Shimian County Government, the construction of resettlement sites has achieved better progress compared with the previous phase and the majority of resettlement sites are to be completed in 2011. By September 25, 2011, the number of households resettled in resettlement sites along the while line has amounted to 64% of the total number to be resettled.

9. Resettlement results: in general, it is difficult to carry out the house demolition and resettlement along the Project, but everything goes smoothly and some achievements have been obtained. Especially, the Owner and the resettlement departments at all levels jointly improved the compensation for house demolition in August 2008, which considerably accelerated the progress of house demolition and resettlement. The resettlement departments of various places adopted various measures to give preferential treatment to affected families with poor conditions, including the vulnerable families within the policy framework and performed the special resettlement; moreover, the families of different nationalities received the equal treatment, without any discriminatory policy against ethnic groups.

10. Focus of monitoring during the next phase:

1) Shimian County will be particularly followed up for compensation standards on forest land;

2) Attention will be paid to 4 towns (townships) in reservoir area of Pubugou Power Station to check for payment to people affected;

3) Attention will be paid damage of local waters, road damage, temporary land for spoil ground, houses damaged by explosion and so on caused by construction contractors and compensation and restoration of temporary land use;

4) Attention shall be continuously paid to resentment departments of local governments, especially resettlement progress and relocation of those affected, so as to facilitate early and satisfactory resettlement;

5) Future life supply of a few land-lost farmers after the land acquisition will be focused on, and in particular, the issuance and implementation of social security policies in various districts will be followed up. 1. Works Progress of the Project

1.1 Construction progress of the Project

11. By September 25, 2011, construction of the Project has progressed smoothly as scheduled, during which, investment of 17323.25 million yuan has been accumulated, of which, 14394.85 million yuan is for civil subgrade works. In three major controllable works, two mid-span closure segments in the right of main part (105+200*2+105) of Labajin Super Major Bridge which is a prestressing concrete cantilever-cast rigid one, 1106m in length and 230m in height, were cast and closed successfully in September 6 and the main part is expected to be fully closed in middle of October; by September 22, 9234m along the left tube of Super Long Tunnel had been excavated, accounting for 92%, with 728m remained; 9395m along the right tube had been excavated, accounting for 90%, including secondary lining, with 601m remained; by now, 36 spans have been

fabricated, 16 installed, 6 placed on bridge deck and 6 for integrated hoisting platform installed.

13. Follow-up works as regard to pavement, traffic safety, greening, house construction, electromechanical works, etc. are proceeding in order. 2. Monitoring on Material Objects Affected by Land Acquisition and House Demolition

2.1 Material indexes of land acquisition

14. By the time when external monitoring organization started field investigation, material indexes of land acquisition and house demolition, checked and confirmed by Yaxi Expressway Co., Ltd., land acquisition and resettlement departments of local governments of each county (district) and related agencies, are as follow.

2.1.1 Permanent land acquisition

15. By September 2011, the actual area for permanent land acquisition for the Project has totaled 17646.509 mu, being 115.69% of the area planned for land acquisition in the Resettlement Action Plan, which is 15253.89mu. The excess area is the area supplemented for land acquisition due various reasons. 2.1.2 Temporary land use

16. By the end of this monitoring, the external monitoring organization has obtained no data on temporary land occupation. Temporary land occupation area provided for

Yingjing County, Shimian County and Hanyuan County is 4202.952mu. Sections in Mianning County and Yucheng District are open to traffic. No data on temporary land occupation in Mianning County and Yucheng District has no obtained since the firs phase mostly because the construction contractor has directly reached agreement on temporary land occupation with affected persons in affected villages. Thus, some land is not reported to land management departments as required, making local resettlement be unable to provide complete data on temporary land occupation. Though construction in these two locations has been completed, the monitoring and evaluation organization recommends negotiating with local governments and requiring them to supplement quantity of temporary land occupation so as to fully reflect resettlement.

17. Along the whole line of the Project, 316420.97m2 housing is actually demolished in total, accounting for 152.63% of planned demolition area in RAP of the Project (207312m2). Relocated households total 2340, including 8035 persons. See Table 3 for Statistics on area of housing demolition. Actual housing demolition is more than it was planned because those affected was increased due to variations of project design.

2.3 Infrastructure demolition

18. By the end of this monitoring, the external monitoring organization has obtained statistics on infrastructure demolition in Hanyuan County and Shimian County as shown in Table 4 and Table 5 and required other resettlement departments which has provided no data to provided details in the next phase.

19. By the end of this monitoring, various enterprises and school housing planed to be demolished in the Project totals 25320.405m2 and has all been demolished. See Table 6 for details. Daduhe Machine Side Processing Plant in Chuanxindian Community of Xinmian Town, which was still not demolished during the previous phase, has been demolished and relocated.

20. During monitoring in the previous phase, Shimian National Junior Middle School which is among those to be relocated was still under construction and others were subject to complete relocation and construction. By the end of this monitoring, it is learned that Shimian National Junior Middle School has been open to students since September 1, 2011. See 4.2.1 of this report for restoration resettlement of the school. 3. Compensation Standards for Resettlement and Monitoring over Compensation Fees

3.1 Compensation policy and monitoring over compensation standard

3.1.1 Compensation policy

21. The external monitoring and evaluation organization has detailed resettlement compensation policies and standards for Ya’an-Lugu Expressway Project, including adjustment policies for compensation standards, in the previous five monitoring and evaluation reports. During this monitoring, with respect to temporary transition fee, second relocation fee and change of paddy filed into farmland, it is recommended to increase related standards and supplementary work has been implemented.

3.1.2 Monitoring over compensation standards

22. In general, compensation standards for land acquisition and house demolition identified in RAP of the Project are implemented in a strict manner. According to comparison with actual compensation standards, compensation standards for land in the Project are generally higher than it was planned. See Table 7 for details.

24. With respect to the issue that some paddy fields in Hanyuan County could only be cultivated as dry land since it is impossible to irrigate due to the affect of construction, compensation shall be made at the difference between the output value

of the paddy field (1854 yuan/mu) and the annual output value of the dry land (1181 yuan/mu); that is to say, the compensation standard is 673 yuan/mu per year. With two seasons in a year, the compensation standard for one season is 336.5 yuan/mu. Compensation shall be made season by season, until the irrigation is recovered.

25. With respect to compensation standards for house demolition, resettlement departments in each county (district) implemented policies to increase house compensation because of price increase in 2007 and 2008 respectively. Adjusted compensation standards for house demolition in the Project are shown in Table 8. Actual compensation in each county is higher than that required by the Project. During this monitoring, compensation standards for each county and district are maintained the same as those in the previous phase.

Affected by land adjustment for resettlement and relocation and reconstruction of the Pubugou Power Station, in Hanyuan County, house sites of relocated peasant households are being solved in a delayed manner, which results that the temporary transitional period of a part of relocated peasant households exceeds the stipulated time limit, with the maximum transitional period lasting 9 months. In order to deal with the actual difficulty of relocated peasant households properly, the time for the payment of temporary transitional allowance has been extended and the transitional periods before peasant households for decentralized resettlement have confirmed the mode for building houses by themselves and before the house sites have been divided to peasant households for centralized resettlement are calculated based on actual conditions.

27. The relocation subsidy standard in Hanyuan County is 358yuan/person. Peasant households have been relocated twice, i.e. moving into the transitional houses and then moving into the permanent houses. However, as stipulated originally, relocation subsidy has been paid for only one time, which is not appropriate. Therefore, relocation subsidy shall be paid once again. For this purpose, the government plans to invest more than 14.00 million yuan as compensation for the second relocation.

3.2 Monitoring over compensation appropriation

3.2.1 Fund appreciation

28. Timely appropriation of compensation funds for resettlement is of great importance to the restoration of production and living of affected persons. Counties (districts) generally adhere to the use of a fixed sum for a fixed purpose and external monitoring organization has found no embezzlement of compensation funds.

29. By September 25, 2011, the Owner has appropriated 831.8914 million yuan for land acquisition and house demolition, in which, 750.7494 million yuan has been paid to all counties and districts, with a balance of 81.142 million yuan. 30. In this phase, most land compensation fund is retained on villages’ collective account instead of being allocated to farmers.

31. Compared with the previous phase, great progress has made in the appropriation of compensation funds in Hanyuan County (which was lagged due to impact of Pubugou Power Station Project on Hanyuan County during the previous 5 phases), with satisfactory payment. From the end of 2010, with promotion of resettlement of Pubugou Power Station Project, most affected persons get proper settlement, and the impact on other projects has been mitigated gradually. In addition, the compensation has been fully paid to the relocated persons as per the compensation standard for land acquisition of the Project in 4 affected townships (towns) located in the non-reservoir area of Pubugou Power Station, i.e. Tangjia Township, Shuangxi Township, Fuchun Township and Jiuxiang Town, appropriate proportion being 95%. In 4 affected townships (towns) located in the reservoir area of Pubugou Power Station, i.e. Fuquan Township, Qingfu Township, Shirong Township and Xiaobao Township, compensation has not been paid temporarily because it is necessary to carriy out identity authentication for affected persons (identity authentication means distinguishing a household belongs to resettlers of Pubugou Power Station or those of Ya’an-Lugu Expressway).According to local resettlement departments, identity authentication is coming to the end. Therefore, compensation allocation will be performed immediately after confirmation through meetings and approval of related organizations and is expected to be finished in first half of 2012.

4. Monitoring on Resettlement Results 4.1 Monitoring on resettlement results of land acquisition and house demolition

4.1.1 Overall assessment for resettlement results of land acquisition and house demolition

32. The external monitoring organization for resettlement has detailed the resettlement results of the Project in the previous monitoring and evaluation report, and the monitoring and investigation results of this Phase also show the positive conclusions: i.e., generally, most regions strictly enforced compensation standards for land acquisition and house demolition, and on the basis of full and timely appropriation, resettlement subsidies for land acquisition have been successively appropriated timely and exactly on the whole as per the acquisition sequence of various types of affected objects, as well as the affected villages and groups all adopted the land resettlement, or monetary resettlement, or their combination after the land acquisition. During the monitoring and evaluation of this Phase, the monitoring and evaluation organization learned that Yucheng District, Yingjing County and Shimian County have launched the policies and measures on endowment insurance for land-lost peasants, which will provide the living guarantee for a very few of families totally losing land in the future.

33. The construction contractors who temporarily need to use land due to project construction, have generally paid the compensations to the affected person according to requirements of compensation policies.

34. The resettlement in centralized and decentralized ways was adopted. The resettlement departments of various places encouraged the affected person to give first place to the independent resettlement, and assisted in relocating the affected households and solving the problem of rebuilding the house site with the cooperation of the villages and groups. Most of the residents who selected decentralized resettlement have finished rebuilding of new houses with the help of the resettlement departments and have moved into the new house to lead a new life. After the completion of new houses, the resettlement departments offered the affected households convenience to transact the housing land permit and house property certificate.

35. 1073 households were arranged in the centralized way in the Ya’an-Lugu Expressway Project; the centralized resettlement sites all are located in Ya’an and subject to the uniform planning and design by the local government, meanwhile, the protective measures were taken in consideration of potential earthquake effect on all resettlement sites to keep safety. The Owner and the local resettlement departments have jointly planned 17 centralized resettlement sites (16 in the previous phase, 2 added in Shimian County and 1 cancelled in Yingjing County due to the rerouting), among which, the construction of 11 centralized resettlement sites in Yucheng District, Yingjing County and Hanyuan County has almost been completed at present and most of relocated households have moved into the new houses. The

centralized resettlement sites in Shimian County are under construction.

36. In general, it was difficult to carry out the house demolition and resettlement along the Project, but everything went smoothly and some achievements have been obtained. Especially, the Owner and the resettlement departments at all levels jointly improved the compensation for house demolition since August 2008, which considerably accelerated the progress of house demolition and resettlement. The resettlement departments of various places adopted various measures to give preferential treatment to affected families with poor conditions, including the vulnerable families within the policy framework and performed the special resettlement; moreover, the families of different nationalities received the equal treatment, without any discriminatory policy against ethnic groups.

4.1.2 Monitoring results of centralized resettlement sites

37. By September 25, 2011, the number of households resettled in centralized resettlement sites along the whole line has amounted to 64% of the total number to be resettled. The construction of 17 centralized resettlement sites along the line is detailed in Table 10.

Located in Fengmu Village, Babu Township (Figure 1), the centralized resettlement site of Yucheng District covers the land of 50 mu, which is able to accommodate 101 households of 388 persons. The centralized resettlement site was uniformly planned by the government and constructed by relocated households as per the house site of 30m2 per capita; there was no requirement for number of storey, and 80% households constructed the houses of 150m2. The site leveling was conducted in 2009, with house site distributed in November. Currently, 80% relocated households have already moved.

39. No.1 and No. 3 centralized resettlement sites (Figure 2-Figure 3) were selected along Yingjing Section. Located in the brick plant by the enterprise office of Qinglong Township, No. 1 Resettlement Site covers the land of 17.595 mu and is able to accommodate 36 households of 157 persons, while No. 3 Centralized Resettlement Site is situated on the other side of 108 Line on Hongyan Bridge, covers the state owned land of 8.5372 mu, which is able to accommodate 30 households of 122 persons. The resettlement sites were uniformly constructed through tender; at present, the relocation in No. 1 Resettlement Site has been finished, and the house construction of No. 3 Resettlement Site has been completed, some are in service, and the remaining is under decoration.

40. There are 6 centralized resettlement sites in Shimian County, which can accommodate 686 households of 1791 persons (Figure 4-Figure 6). As the resettlement is relatively centralized, difficult to carry out and has a large scale, the appropriate resettlement site is hard to solve and the work load and difficulty of planning and design are considerable; however, under the positive consultation and great promotion of Yaxi Company and the Shimian County Government, the construction of resettlement sites has achieved better progress compared with the previous phase and the majority of resettlement sites are to be completed in 2011.

41. There are 8 centralized resettlement sites in Hanyuan County, which can accommodate 220 households of 856 persons (Figure 7 – Figure 9). Some of the centralized resettlement sites were uniformly planned by the government and built by the peasants, while the remaining was constructed by the government. Except Danong Resettlement Site (which is not solved due to the dispute between the relocated households and the construction contractor), the relocated households have moved into other 7 resettlement sites.

4.1.3 Cases of special resettlement of vulnerable group

42. Liu Zhonghong, male, 45-year old, a villager of 4th Group of Xinchang Village, Tangjia Township, Hanyuan County, is disabled in intelligence without labor ability. He lives with his 18-year-old son. Based on this situation, they are taken into minimum living standard security by local government, and can get 55 yuan subsidy per person a month. Their cultivated land is more than 1mu, but in poor cultivation conditions, the output is poor. The demolished house was an adobe one with an area of about 50m2, and the compensation for house demolition is about 10,000 yuan in total. In consideration of their poor economy, through the negotiation, the project coordination office of Hanyuan County and Yaxi Company decided to provide additional allowance of 20,000 yuan including 10,000 yuan for brick, sand and stone materials, 5000 yuan from social subsidy and the Bureau of Civil Affairs. The Villagers’ Committee helped them to employ construction team and to manage construction. With the great assistance from all sectors of the society, their new brick-concrete house of 90m2 was completed as scheduled.

43. Cao Zhenghong, male, a villager of Xinchang Village, Tangjia Township, Hanyuan County, is over 70 years old. He is disabled in intelligence with amblyopia. He has a son over 30-year old who is also disabled in intelligence. They have 1 mu cultivated land to plant vegetables and corn, the output just can support their living. The demolished house is an adobe one with an area of 60 m2, with the compensation of more than 10,000 yuan. They are taken into minimum living standard security by

local government, and can get 55 yuan subsidy per person a month. During the construction of new house, Cao Zhenghong’s toe was broken. Therefore, local government specially provided him 10,000 yuan subsidy for living and medicine treatment. Cao Zhenghong built a brick-concrete house of 95 m2, with the assistance of local government and the construction contractor.

4.1.4 Interviews with important persons in the know of the affected county & district, township & town, village & group

44. The exclusive interviews with resettlement departments, as well as the important persons in the know of the affected villages and groups by the external monitoring and assessment organization reflected the general progress of compensation and resettlement for the person affected by land acquisition and house demolition in the Project and the existing problems to some extent. It also showed the recovery of production and life of the affected person.

4.1.4.1 Mianning County

I. Management Office of Headquarters of Yaxi Company in Mianning County

45. On December 29, 2010, 65km Mianning Section of Ya’an-Xichang Expressway passing through four years construction was completed and opened to traffic in advance. During this monitoring, 6 relocated households were added, because the expressway construction affected their convenient access to the transport facilities and they voluntarily required to relocate considering the construction affect. The previous compensation for house site was 26500 yuan/mu, which was considered to be less by the affected person, so the Resettlement Office provided the subsidy to the affected person and the compensation increased by 690 yuan/person, and the compensation for everybody and other three subsidies were added by 6880 yuan/person totally, therefore, the subsidy amounted to 7570 yuan/person, and the house demolition and resettlement have been solved basically.

II. Caogu Township Government Chen Zhiqing (13308153016)

46. The land acquisition and house demolition in Caogu Township involve 3 villages of 19 groups, with land acquisition covering an area of 153519.31 m2, including the paddy field of 18489 m2. After the land acquisition, the compensation has been paid to the affected households totally; there are a lot of cultivated lands, so no peasant lose their lands and their living is not considerably affected by the land acquisition. In the Township, the house demolition affected 53 households, and the peasant households selected house sites for house construction; the land price was lower than the compensation for house site, so the affected peasant households found the satisfying house sites and their housing conditions were improved greatly. Currently, all houses for resettlement have been constructed.

III. Ge Yuangang, Secretary of Shilong Township Government (13518422191)

47. The Expressway totals about 4.78 km in the Township, affects 3 villages of 15 groups and involves the land acquisition of 292.75 mu, including paddy field of 124.97 mu and dry land of 167.78 mu. The monetary resettlement was adopted after the land acquisition and the compensation has been paid to the affected households totally, without the land adjustment. The operation of expressway brings impact to Shilong Township in the following three aspects: I. increase of income per capita; II. increase of brick-tile house, III. improvement of disaster prevention. In the long term, the expressway construction will certainly make more convenient access to the transport facilities, improve the living conditions, thus the integrated economic and social development of Shilong Township will be boosted ultimately.

48. The existing problems:

1. Compensation for land, farming access, added land acquisition, appurtenance and so on is not paid;

2. Remaining fund for works outside boundary line is not paid;

3. Some problems of water system recovery is to be solved (transforming of paddy field into dry land, land reclamation).

IV. Lugu Town Government Zhu Dan (1398150377)

49. As the largest town in Mianning County, Lugu Town covers an area of 95.7 km2, including the cultivated land of 10067.25 mu, and has 5391 households of 20591 persons in total, who mainly engage in primary industry such as farming, forestry, animal husbandry, side-line production and fishery. The Expressway totally extends 2.8 km in the Town and affects 3 villages (Wangjiaci Village, Datian Village and Wuyi Village) of 16 groups. The land acquisition involved the paddy field of 202.5 mu and dry land of 0.85 mu, affecting 490 households. The monetary resettlement was employed for the land acquisition and the compensation has been paid to the affected households totally, without land adjustment. The house demolition in these three villages involved 17 households, with decentralized resettlement adopted; the affected households selected the house site by themselves and the house reconstruction has been finished.

4.1.4.2 Shimian County

50. Shimian County has 6 centralized resettlement sites, among which Caobapai Centralized Resettlement Site and Chuanxindian Centralized Resettlement Site are larger in scale and can accommodate 102 and 507 households separately; currently, their construction approaches to an end, the houses are planned to be delivered at the end of December, some relocated households will move into their new houses before the Spring Festival. Almost persons relocating in Caobapai Community engage in farming, so the houses are provided with the flat roofs to sufficiently offer the convenience for their production and living.

51. In Shimian County, the land acquisition involved forest land of more than 1800 mu, Liziping Nature Reserve is provided with the special funds for forest land protection, including the fixed protection fund of more than 2000,000 yuan and temporary protection fund of more than 200,000 yuan. Shimian County does not formally issue the compensation standard for forest land affected by Ya’an-Lugu Expressway Project, however, the compensation for ground appurtenance has been paid. The actual compensation for forest land is 40000 yuan/mu, including the vegetation recovery fee and compensation for ground appurtenance.

52. A few of permanent land acquisition, mainly including the supplementary land acquisition, is added in 2011 in Shimian County. The compensation for land acquisition has been paid to the affected villagers; however, the allocation of compensation reserved by collective organization is not discussed.

4.1.4.3 Hanyuan County

VI. Land and Resources Bureau of Hanyuan County for Expressway Chen Dengfu 15681621888, Land and Resources Bureau of Hanyuan County

53. In Hanyuan County, the land acquisition within boundary line has been delivered; currently, only the supplementary land acquisition of 350 mu is not finished. All house demolition has been completed; among 8 resettlement sites in the County, the resettlement has been carried out properly, except Danong Resettlement site under construction. The auxiliary facilities and drainage systems in Shangyan and Xiaoguan resettlement sites is being further improved. The house construction of a few of households selecting the decentralized resettlement is not completed.

54. The peasant households have been relocated twice, i.e. moving into the transitional houses and then moving into the permanent houses, so the relocated households required to pay the subsidy- 358 yuan/time per capita for the twice relocation as per the resettlement policies in Pubugou Power Station Project. For this purpose, the

government plans to invest more than 14.00 million yuan as the compensation for the second relocation. The application requirements for compensation adjustment are detailed in HF (2011) No. 50 document.

55. The compensation in Hanyuan County was relatively lagged due to the resettlement impact in Pubugou Power Station Project. The compensation has been totally paid to the affected person in Tangjia Township, Shuangxi Township, Fuchuan Township and Jiuxiang Town located in non-reservoir area of Pubugou Power Station, with appropriate proportion being 95%. The allocation method of compensation for collective owned land is decided through villager assembly, without being reserved by the collective organization. Among 4 townships and towns (reduced to 3 townships and towns after merging) in reservoir area of Pubugou Power Station, the identity authentication of relocated person in Qingfu Township and Shirong Township has been completed and the meeting aiming to study and implement the compensation will be hold in recent.

56. Problems:

1. The compensation in some townships and towns is not completely paid. The land ownership shall be checked for the land acquired in Xiaobao Township and Fuquan Township.

2. The reclamation progress of temporary land of more than 300 mu involved in C7 – C9 contract lots is slow, and the implementation plan is not issued at present. Yaxi Company proposed to pay the compensation for young corp for two seasons and return the land that can be reclaimed to affected person and pay the compensation for land not reclaimed as the permanent land acquisition after the assessment on reclamation possibility and fee by a qualified organization.

3. The infrastructure to be recovered mainly includes the damaged roads and occupied tractor roads.

4. Group 4 and Group10 of Gonghe Village, Shirong Township suffered the landslip due to the construction impact, which damaged the houses of more than 20 households, so certain compensation shall be paid after assessing the extent of damage and the road subject to landslip shall be reinforced.

VII. Government of Tangjia Township, Hanyuan County

57. The land acquisition in Ya’an-Xichang Expressway Project involved 7 villages of 33 groups and the house demolition involved more than 700 households; with both centralized and decentralized resettlement, the centralized resettlement sites are constructed in Xiaoguan, Wuli, Fuchun (Qingmuguan) and Wenwupo. The compensation for land acquisition is 46452 yuan/mu as per 28 times of annual

production value of 1659 yuan/year; the compensation of 18500 yuan/mu was paid in 2008, and the remaining was paid within December 2010 ~ June 2011.

58. The compensation for house demolition was paid in three times: 30% paid at foundation construction, 30% at the completion of first floor and 40% at the completion, which promoted the house construction to some extent. The first affected person moved into the new houses in the first half year of 2009 and the resettlement has already been finished at present.

4.1.4.4 Yingjing County

VIII. Director Wang of Land Acquisition and House Demolition Office of Yingjing County Chen Tao, Head of Qinglong Township, Yingjing County (13508163749)

59. Yingjing Section of Ya’an-Lugu Expressway has been partially opened to the traffic and the houses of relocated households have already constructed. However, following problems on land acquisition and house demolition are not solved:

60. The temporary land is difficult to reclaim. The reclamation of temporary land of more than 300 mu for stock yard and other purposes requires the expense of 20000 yuan/mu. If these lands are acquired permanently, the compensation is more than 20000 yuan/mu, in addition, the land is located in narrow and long places where the cultivated land per capita is less, so the affected peasants prefer to reclaim the land. This problem is to be solved.

61. The problems on project design include: ① the drainage pipe does not reach the safe drainage places due to insufficient length, causing the farmland to be inundated; ② there is potential geological disaster and the retaining walls are not constructed in some spoil areas.

62. A few of households have some issues to be solved:

1. 3 relocated households added due to collapse of connection section reconstructed their houses on the original house sites using the compensation for house demolition paid by Yaxi Company, and previous 2 relocated households are building houses next to the house sites of these 3 households.

2. 1 household located at the road junction has received the house site and is willing to move to the centralized resettlement site, however, the planning of centralized resettlement site has been finished, so the household can not be incorporated into the centralized resettlement site.

3. A couple over-70-year-old, with their 4 children chose the centralized resettlement, now their children propose to resettle the couple separately, so the House Demolition Office is planning to arrange the couple in the welfare center for the aged.

house, now he agrees to live in the welfare center for the aged (invested by the county government and managed by the township government).

4.1.4.5 Yucheng District

63. Yucheng Section of Ya’an-Lugu Expressway has been opened to the traffic, shortening the time of travel between Babu Township and Ya’an to 7-8 minutes and 15 minutes through the National Highway No. 108. The house demolition involved more than 160 households in Babu Township, these households have found the house site, and the construction of 90% houses has been completed, with 10% under construction. The construction of roads in resettlement sites in Babu Township promotes the development of very poor and inconvenient roads in Fengmu Village, and the extension of roads in existing resettlement sites will bring the access-to-door and convenient transportation to more than 200 villagers of Group 3 in Fengmu Village, who depended on walking and piggyback in the past.

64. Resettlement sites of Babu Township are located in Fengmu Village and cover 50 mu land used as the farmland of 50-60 peasant households in the past; Yaxi Company paid the land compensation as per 26572 yuan/mu. The site leveling was performed in 2009, and the house sites were distributed by lot in November. The government uniformly planned the resettlement sites and Yaxi Company invested 8.7 million yuan in the infrastructure for resettlement sites to carry out three supplies and one leveling. The roads in resettlement sites are Class II and 9m wide. The houses were built by the relocated households, with the house site distributed as per 30m2/person, now almost relocated households have moved into their new houses.

65. The leading group in charge of the subsequent landscaping in resettlement sites was established in Babu Township. According to "5-10-100-1000 Project” (the comprehensive urban-rural environmental improvement project in selected 5 cities, 10 counties, 100 towns and townships and 1000 villages) of Yucheng District, the resettlement site is set as a model, where the tree and flower are planted and squares for entertainment and fitness are built, to show the construct style of the whole resettlement site.

66. The temporary land acquisition involves 80 mu land in the Township, with the compensation of 1610 yuan/mu. The compensation for temporary land acquisition of this year has been paid. Currently, the land is unlikely to recover to the original conditions and the terraced field is impossible to recover to the original area. Due to the different occupations, some affected peasant households choose the reclamation, and others choose the permanent acquisition. By now, almost affected peasant households are willing to choose the permanent acquisition; however, the solution is not determined.

67. Social security for land-lost peasant. The land-lost peasants (over 60 years old for male and over 50 years old for female) can pay 38520 yuan at once to purchase the

endowment insurance for land-lost peasant and pay 39000 yuan in case of one year younger, and then receive the pension every month. Also, they can apply for loan of 20000 yuan and pay some endowment insurance, and repay the loan by installment. In November 2009, 120 peasants firstly purchased the endowment insurance and received 464 yuan/month from December, and then 80 peasants purchased the endowment insurance in May 2010, received 584.5 yuan/month in 2010 and 724 yuan/month in 2011.

4.1.5 Sampling survey of affected households

68. Zhang Chengkun, a male villager of Boxiang Village, Qinglong Township, is 45 years old with primary school education level and arranged at No. 1 Resettlement Site of Qinglong Township. With 3 members in his family, his wife works at gas station and has the monthly income of about 1000 yuan; he rents a shop on the street to run a teahouse, which was opened in July. Due to being opened recently and visitors flow to be fostered, the business is not well and just can sustain the living. With the cultivated land of 1.3 mu, including 1 mu land involved in the permanent land acquisition and 0.3 mu land for corn planting, and the reforested land of 2 mu, the family received the compensation for land acquisition of more than 20000 yuan and has the annual income from agricultural production of 650 yuan and receives a small number of subsidy every year. Before the house demolition, the family had the new brick-concrete house of 260m2, so the family received the compensation for house demolition of more than 130000 yuan as per the compensation standard of 506 yuan /m2. Being relocated in the centralized resettlement site, the family has the new house of 115m2 and spent about 47000 yuan. The monthly expense on food and water & electricity is about 200 yuan and 80 yuan respectively, and the expense on other things is less due to thrifty living. As infrastructure in No.1 Resettlement Site is well constructed, with water, power and gas supply, moreover the street is neat and the environment is well, the neighboring residents come to dance every night, which enriches people’s entertainment activities. In general, the family is less impacted by the land acquisition and house demolition, and found the means of future livehood. Meanwhile, the employment of land-lost peasant is a common issue in at present; without certain skills, the land-lost peasants have difficulty to find job, so the business operation is a good choice, but it is difficult to produce benefit within a short term due to considerable limit by the local economy.

69. Zhang Chengliang, a male, is 46 years old with junior middle school education level and arranged at No. 1 Resettlement Site in Qinglong Township. His son works at (as a safety guard) and has the monthly income of 1000-2000 yuan. The family had the cultivated land of 1.3 mu, including 0.8 mu land involved in the permanent land acquisition and 0.5 mu land for corn planting, with annual income from agricultural production of 700 yuan. The original house of brick-wood structure is 140m2, so the family received the compensation for house demolition of 56000 yuan as per the compensation standard of 400 yuan/m2; with the new house of 115m2, the family spent all compensation for house demolition and savings of more than 20000 yuan on the decoration as per the price of 490 yuan/m2. He has the annual income of more than 7000 yuan depending on the odd job in slack season; unfortunately, his eyes were injured last year and he received the low-income

subsidy of 73 yuan every month. Currently, the family mainly depends on the compensation for land acquisition and house demolition and the income from odd job, so their finance is likely to continuously reduce with age increasing.

70. Li Qigen, 57-year-old, is a male villager of Group 1, Fengmu Village, Babu Township and arranged at the resettlement site in Babu Township, with 4 family members. His 26-year-old son is a driver of haulage vehicle, having the monthly income of more than 2000 yuan and his daughter-in-law works at a beauty shop and has the monthly income of more than 1000 yuan. The family received the compensation of about 26800 yuan for 1 mu land involved in the permanent land acquisition for expressway project, and the remaining land is 0.4 mu, including 0.2 mu for reforestation and 0.2 mu for corn planting for living. With the original brick-wood house of 90m2 and brick-concrete house of 130m2, the family received the compensation for house demolition of about 150000 yuan, which was evenly distributed to his two sons, and the family spent more than 80000 yuan on the decoration of new house of 270m2 and received the transition subsidy of about 1800 yuan during the transition period of a half year, moved into the resettlement site in June 2011. His wife paid the endowment insurance of 38509 yuan at once and now receives pension of 720 yuan every month. He engages in the agricultural production and finds odd job in slack season with daily month of 60 yuan, with the annual income of 3000-4000 yuan. 3 family members have the stable income, so their living is medium.

71. Li Xuedong, 55-year-old, is a male villager of Group 1, Fengmu Village, Babu Township, with 4 family member. He run a clinic nearby the highway in the past and now the clinic is located in the resettlement site, with profit of about 200 yuan every day. The family received the compensation of more than 40000 yuan for the land acquisition of 1.5 mu and has 0.3 mu land for reforestation. With the original brick-concrete house of 400m2, the family received the compensation for house demolition of more than 220000 yuan as per 550 yuan/m2, and spent more than 250000 yuan on the new house (without any decoration), moved into the resettlement site in April 2011 after the transition period of 1 year. He and his wife paid more than 70000 yuan for the endowment insurance. Because of the stable finance, their living standard is high.

72. Cao Peiwei, 57-year-old, is a male villager of Group 10, Xinchang Village, Tangjia Township, Hanyuan County. He worked at a supply and marketing cooperative before 2000 and engages in the agricultural product after layoff, with a part-time sanitation job bringing the income of 200 yuan/month. His wife is 55 years old and engaged in the agriculture. His 28-year-old son is a truck driver, only having the income of more than 10000 yuan due to the poor business. Before the land acquisition, the family totally had 0.73 mu paddy field for planting rice and young garlic shoot which is productive in the region and is a major economic pillar of agriculture. The family has the annual income from agriculture of more than 5000 yuan. With the paddy field of 0.4 mu involved in the land acquisition for Ya’an-Xichang Expressway Project, the family received the compensation for land acquisition of more than 20000 yuan. The compensation of 57000 yuan was paid to the demolished house of 140m2. The construction of new house of 3-storeyed

building with floor area of 255m2 was commenced in March 2009 and finished in January 2010, the house construction totally cost more than 100000 yuan. He is satisfied with the present living because of the improved housing conditions and easy access to transportation facility.

73. Ling Xujiang, a villager of Group 11, Daxing Village, Houshan Township, Mianning County, has four family members (his wife, mother and two sons); with the junior middle school education level, he is engaged in the flue-cured tobacco business and runs a small store. His family received the compensation of more than 200000 yuan for the brick-wood house demolished for the expressway project and spent about 300000 yuan on the construction of new house of 3-storeyed building with floor area of more than 600m2.

4.2 Monitoring on Recovery of Enterprises, Pubic Institutions and Schools

4.2.1 Schools

74. The resettlement departments of all places pay special attention to the resettlement of schools affected by house demolition for project construction. The house demoltion in the Project involves 8 schools. The present resettlement and recovery are shown in Table 11.

76. The Education Bureau of Shimian County had merged Huilong Middle School and the National Middle School into the present Shimian Junior National Middle School, and the new campus came into service on September 13, 2011. The total investment of the new campus construction cost over 30 million yuan, among which 28 million yuan was donated by Taiwan organizations. Besides, Yaxi Company also contributed 4.8 million yuan (including 1.2 million yuan paid during the transition period) to the local education bureau for the education development. The tender, design and construction were performed by Taiwan organizations. With the high-quality hardware facilities, the new campus occupies 30.2 mu with 19,700 m2

of building area, 6800 m2of office building, 970 students, 62 teachers and 18 classes of three grades. Each classroom is 80 m2 and allows for 50 students. The public area is designed with the scale of 1:1, i.e. 1 m2 for 1 student, and the dormitories are designed as per the scale of 1:4, 8-personed dormitory covers an area of 32 m2.

77. Shimian Junior National Middle School has integrated the educational resources of the entire county and improved the teaching quality. Its hardware facilities rank the first in Shimian County, and are the best in Ya'an city. The Headmaster Zhang is satisfied with the resettlement and has good wishes for the future of the school.

4.2.2 Enterprises and Public Institutions

78. All kinds of related enterprises have been relocated and resettled for the Project, with no problem left over. The Daduhe Noodle Factory in Shimian City with which the previous negotiation failed has reached an agreement with the Yaxi Company and the local resettlement department, for which, 793.47 m2 of houses have been demolished and 746,500 yuan has been compensated. So far, reconstruction of the factory has been completed and production recovered. The new plant of Daduhe Noodle Factory is shown in the following figure. See the monitoring reports of previous five phases for the details of resettlement of other enterprises.

79. Infrastructure reconstruction caused by the Project includes road relocation, water diversion, pipeline transfer, communication and power transmission line relocation, etc., and the infrastructure is under the gradual and orderly recovery and

reconstruction. According to agreements reached between Yaxi Company and local government, infrastructure affected shall be reconstructed in two principles: one is construction going prior to demolishing in order to avoid affecting normal production and living of the people; the other is reconstruction as per grade and quality of the original ones to avoid decreasing infrastructure level of area affected. The monitoring group confirms after investigations: both principles have been carried out completely and local governments are satisfied with infrastructure reconstruction. 5. Conclusions, Problems and Suggestions

5. 5.1 Monitoring and evaluation conclusions

80. The land acquisition, house demolition and resettlement in Ya’an-Lugu Expressway Project are basically executed in an orderly way in accordance with the original schedule and procedure. Up until the field investigation conducted by the Monitoring Team in September 2011, 115.69% of RAP for land acquisition on the entire line was completed, with the area for land acquisition exceeding the planned area. The area for house demolition is far more than 152.63% of planned area for house demolition stated in RAP of the Project, mainly because of changes in design during construction resulting in increased area for land acquisition and house demolition. At present, the focus of resettlement on the compensation for land acquisition and house demolition has moved towards the resettlement dominated with push of income recovery for affected persons. The current major task is to promote the construction of centralized resettlement sites, and ensure the compensation for affected persons in place and reclamation of temporary land, especially in Hanyuan County and Shimian County. Viewing from the land acquisition, house demolition and resettlement in all counties and districts, owing to the excellent preparation for resettlement, the manageable Resettlement Action Plan, rational compensation standards, well-implemented resettlement measures, extensive public participation and enthusiastic work of the resettlement management agency, and all resettlement work being performed in strict accordance with the resettlement action plan, there is no major issue. With great importance attached to some issues found by the External Monitoring Team in previous phases, the Owner and local government has adopted the following measures for the actual issues to greatly improve the living of dislocated persons and accelerate the progress of resettlement, which is appreciated by dislocated persons.

81. The significant development of the resettlement in this monitoring phase:

82. Great progress has made in the appropriation of compensation funds in Hanyuan County with the satisfying payment. From the end of 2010, as promotion of resettlement of Pubugou Power Station Project, most of affected persons get proper settlement, and the impact on other projects has been mitigated gradually. In addition, the compensation has been fully paid to the dislocated persons as per the compensation standard for land acquisition of the Project in 4 affected townships

(towns) located in the non-reservoir area of Pubugou Power Station, i.e. Tangjia Township, Shuangxi Township, Fuchun Township and Jiuxiang Town. Moreover, the identity authentication for affected persons is coming to the end and the compensation will be paid soon in 4 affected townships (towns) located in the reservoir area of Pubugou Power Station, i.e. Fuquan Township, Qingfu Township, Shirong Township and Xiaobao Township.

83. Ya’an-Lugu Expressway Project involves 1073 centralized resettlement households, with a large scale of resettlement and complicated resettlement tasks. Under the positive consultation and great promotion by the Yaxi Company and the Shimian County Government, the construction of resettlement sites has achieved better progress compared with the previous phase, and the majority of resettlement sites are to be completed in 2011. Currently, the construction of 11 centralized resettlement sites in Yucheng District, Yingjing County and Hanyuan County has almost been completed, and most of relocated households have moved into their new houses. By September 25, 2011, the number of households resettled along the whole line has amounted to 64% of the total number to be resettled. All the centralized resettlement sites are subject to the uniform planning and design by the local government, meanwhile protective measures have been taken in consideration of potential impact of seismic activities on all resettlement sites to ensure safety.

84. Therefore, the following conclusions can be drawn by the Monitoring Team: ① Based upon various kinds of information collected, such a clear conclusion can be reached: No matter dislocated persons affected by land acquisition or house demolition, they have all been properly resettled. By now, no affected persons live in poverty or their living standard falls down owing to the land acquisition or house demolition of the Project, which meets the target of the general resettlement policy of the Asian Development Bank and Chinese Government. ② The compensation standards for land acquisition, house demolition and resettlement are generally not lower than the standards stipulated in the Resettlement Action Plan. Additionally, to maintain the living standard of affected households, the Owner and the local government has taken various measures for improving the compensation standard to cope with the rising price, with giving special assistance to the vulnerable group in the Project. Therefore, the resettlement works well. ③ The housing condition of dislocated persons has been generally improved. Many relocated households lived in shabby houses, and a golden opportunity is provided for them due to the highway construction to rebuild their houses with the compensation given by the highway project owner and their own savings. All new houses are spacious and comfortable, and dislocated persons are very satisfied with the result. ④ The compensation funds can be paid timely by the highway project owner without any compensation for land acquisition, house demolition and resettlement being skimped or embezzled by the local government, which ensures smooth implementation of resettlement. ⑤ Resettlement management agencies at all levels, especially those of local governments at all levels, have done a lot of work for dislocated persons carefully.

5.2 Issues and suggestions

85. The major issues found during the field investigation by the Monitoring Team of

External Monitoring and Evaluation Organization and their proposed countermeasures are as follows:

86. The final payment of compensation for land acquisition in Shimian County and Hanyuan County to affected peasant households as per relevant standards has not yet completed. Moreover, the compensation standard for forest land acquisition in Shimian County has not yet issued, and in Hanyuan County, the compensation for land acquisition in 4 townships (towns) located in the reservoir area of Pubugou Power Station has not been paid to the affected persons. Therefore, payment of compensation for land acquisition in the Project is the most urgent highlight.

87. With the gradual completion of the construction, the reclamation of temporary land and the appraisal on recovery have been listed on the agenda. Such issues are to be settled as the change from paddy field into dry land due to improper irrigation by damaged waters, the definition and compensation of land impossible to be reclaimed (e.g. spoil ground), and restoration of damaged roads. The Owner shall coordinate with local governments in issuing policies involving compensation and recovery, and supervise the Construction Company’s timely recovery and compensation as per these policies for affected persons.

5.3 Focus of monitoring during the next phase

88. Great importance shall be attached on the implementation and completion of final payment of compensation for land acquisition to affected peasant households in Shimian County and Hanyuan County as per relevant standards. Especially, it is required to check issuance of compensation standards for forest land in Shimian County, and the compensation for land acquisition being paid to affected persons in 4 towns (townships) located in the reservoir area of Pubugou Power Station of Hanyuan County.

89. Attention shall be given to the progress of identity authentication for affected persons in the Project by the resettlement department of Hanyuan County, and to timely payment of compensation to relevant persons and solving of issues regarding production, resettlement and recovery.

90. Attention shall be paid to restoration of such impacts as damaged local waters, damaged road, temporary land for spoil ground, damaged houses by explosion and so on caused by the construction contractor; and to the implementation plan and progress of compensation and reclamation concerning the temporary land.

91. Attention shall be continuously paid to the resettlement department of the local government, especially to the resettlement progress in centralized resettlement sites in Shimian County and the relocation and occupancy of affected persons, so as to facilitate early and satisfactory resettlement.

92. Attention shall be given to future living security of a few land-lost peasants after the land requisition, and particularly to the issuance and implementation of social security policies in various districts.
