"Department maintained markers" means any special shellfish buoy, range, stake or marker maintained by the Department of Environmental Protection, for the purpose of aiding in the delineation of water classified for shellfish harvesting.

"Depletion" means the planned removal of market size shellfish from areas other than approved, for resource man­ agement and control purposes.

"Depuration or controlled purification" means the pro­ cess that uses a controlled aquatic environment to reduce the levels of bacteria and viruses in live shellfish.

"Depuration plant" means a premise or establishment in which shellfish obtained from waters officially sanctioned and classified by the Department of Environmental Protec­ tion as Special Restricted or Seasonal Special Restricted are subject to a process of controlled purification with the proper controls approved by the Department of Health and Senior Services which will render the depurated shellfish alive, and microbiologically acceptable within the meaning of State statutes and regulalions.

"Depuration process" means the procedure and equip­ ment employed by which shellfish are halVested from waters sanctioned and classified by the Department of Environ-

7:12-9.13 Scientific Collection and Non-Human Consumption Program The Department may continue 10 issue special permits for the collection of sheJlfish from waters classified other than Approved for the purpose of non-human consumption and scientific research, including the restoration of shellfish beds. The Shellfish Resource Recovery Steering Committee shall __ review the application for a scientific collection permit. Fol· lowing this review, the Shellfish Resource Recovery Steering Committee shall make a recommendation regarding the per­ mit application to the Commissioner of the Department of Environmental Protection or his or her designee. Conditions of the permit will be tailored as necessary to the specific program(s} requested.
