PALESTINE ORDERS IN COUNCIL, 1922 TO 1939.

ORDER, NO. 76 OP 1944, BY THE HIGH COMMISSIONER UNDER ARTICLE 16c.

WHEREAS an area of land measuring 466 square metres, forming part of parcel No. 182 of Land Registration Block No. 7053, Jaffa, and coloured green on Survey Plan No. 358/43, is registered in the Land Registry of Jaffa in the category termed "Metrouke", having previously been registered in the category termed "Mulk"; AND WHEREAS prior to the coming into force of a town planning scheme known as Scheme "E"—Bassa Replanning Scheme, Jaffa, notice of the grant by the High Com• missioner of authority to put which scheme into force was published in the Gazette No. 788 of the 8th June, 1938, at page 651, the hereinbefore recited land formed part of a public highway; AND WHEREAS by the said scheme it was provided that the alignment of the said public highway should be altered so that the hereinbefore recited land should cease to form part of the said public highway; AND WHEREAS I am satisfied that it is in the public interest to convert the herein• before recited land from the category termed "Metrouke" to the category termed "Mulk", and that, by the alteration of the alignment of the said public highway in accordance with the said scheme, provision will be made whereby any rights or benefits which may formerly have been enjoyed in or over the hereinbefore recited land will be replaced by such rights and benefits as I regard as being reasonably equivalent in character to such former rights and benefits; Now, THEREFORE, I, JOHN STANDISH SURTEES PRENDERGAST VEREKER, FIELD-MARSHAL VISCOUNT GORT, V.C., G.C.B., C.B.E., D.S.O., M.V.O., M.C., High Commissioner for Palestine, in exercise of the powers vested in me by Article 16c of the Palestine Orders in Council, 1922 to 1939, and of all other powers enabling me in this behalf, do hereby order that the hereinbefore recited land shall be converted into the category termed "Mulk" and registered accordingly in the Land Registry of Jaffa. LOCAL COUNCILS ORDINANCE, 1941. • BY-LAWS MADE BY THE LOCAL COUNCIL OF KAFR YASIF UNDER SECTION 9. No. 36 of 1941. IN EXERCISE of the powers vested in them by section 9 of the Local Councils Ordinance, 1941, the Local Council of Kafr Yasif, with the approval of the District Commissioner, Galilee District, have made the following by-laws: — Citation. 1• These by-laws may be cited as the Kafr Yasif (Licensing and Control of Dogs) By-laws, 1944. —־: Interpretation. 2. In these by-laws Local Council area" and "Local Council" shall mean the Local" ־ Council area of Kafr lrasif and the Local Council of Kafr Yasif respectively. 8. —(1) The Local Council may refuse to grant a licence to any person Refusal or or may withdraw any licence granted to any person to keep any dog withdrawal of within the Local Council area for all or any of the following reasons : — licence in (a) that such dog is of a savage disposition; certain cases. (6) that such dog is dangerous to public security; "'(c) that such dog by its barking causes any noise which is so loud and so continuous or repeated as to cause a nuisance to occupants or in­ mates of any premises on which such dog is kept; (d) that the owner of such dog has been convicted for an offence under section 386 of the Criminal Code Ordinance, 1936, on more than No. 74 of 1936. one occasion; (c) that the owner of such dog has on more than one occasion been convicted for committing a nuisance by keeping a dog under such conditions as are dangerous to public health. (2) Where a licence is withdrawn under the provisions of this by­ law no refund of the fees charged under by-law 6 hereof will be made.

9. —(1) Every dog in respect of which a licence has been refused or Dogs for which withdrawn shall, within four days, be delivered by its owner to the ken­ licences have nels of the Local Council and, subject to the provisions of paragraphs been refused (2) and (3) hereof, shall be disposed of as the Local Council may direct. or withdrawn. (2) Where any dog has been delivered to the kennels of the Local Council by reason of a licence having been refused or. withdrawn under paragraph (a) or (b) of by-law 8(1) hereof, such dog shall not be destroyed until an order authorising its destruction has been granted by a Magistrate in accordance with section 5 of the Rabies Ordinance, No. 39 of 1931, 1934. (3) Where the owner of any dog which has been delivered to the ken­ nels of the Local Council by reason of a licence having been refused or withdrawn under paragraph (c) or {d) or (e) of by-law 8(1) hereof: (a) within forty eight hours from the delivery of such dog to the kennels of the Local Council, indicates in writing to the Local Council his intention of taking legal proceedings against the dest­ ruction of such dog, and (b) pays in advance to the Local Council a fee at the rate of 50 mils per diem for the feeding and accommodation of and attendance on such dog in respect of a period of twenty one days and thereafter in respect of such further period until a decision in the matter has been given by a Competent Court, such dog shall not be destroyed until after a decision as aforesaid has been given: Provided that if any dog so detained in the kennels of the Local Council is subsequently destroyed or released or dies during such de­ tention, the owner of such dog shall be charged only in respect of the number of days for which the dog was actually detained and the bal­ ance will be refunded to him. 10. —(1) Subject to the provisions of by-law 5 hereof, any dog found Seizure, within the Local Council area which is not licensed or which is not wear­ detention and ing a collar bearing the metal number-plate referred to.in by-law 4 destruction of hereof shall be seized by an officer of the Local Council or the Police unlicensed clogs. wnd shall deliver it to the kennels of the Local Council: December,'••191-1. ־THE PAWBSTINE GAZETTE No. 1378—SUPPLEMENT No. 2. ••14th 1390

Provided that if any such dog cannot be seized it may be destroyed at sight by an officer of the Local Council or the Police. (2) Any dog which has been delivered to the kennels of the Local Council in accordance with the provisions of paragraph (1) of this by­ law shall be detained for a period of forty eight hours. If during the said period of forty eight hours the dog is not claimed it shall be destroyed: Provided always that if the dog appears to be of value, and there is reason to believe that it is licensed although not wearing a collar bearing a number-plate as aforesaid, the period of detention may be extended to seven daj\s.

Eccovery of 11. The owner of any dog which has been seized and detained in detained dogs. accordance with the provisions of the preceding by-law may recover such dog within the period specified in the said by-law upon produc­ tion of a licence in respect thereof and upon payment to the Local Council of a fee at the rate of 50 mils per diem for the feeding and accommodation of and attendance on such dog.

Register. 12. The Local Council will cause a register to be kept for the pur­ pose of these by-laws in which will be recorded full particulars of any dog in respect of which a licence is granted, and the owner thereof shall furnish such particulars as may be called for by the Local Council.

PenaltT. ' 13. Any owner of a dog who fails to comply with the provisions of these by-laws shall be liable on conviction to a fine not exceeding five pounds and in the case of a continuing offence to an additional fine not exceeding one pound for every day during which the offence is con­ tinued after conviction as aforesaid.

Compensation. 14. No compensation shall be payable to any person on account of any action taken by the Local Council or their servants or agents under these by-laws except upon proof that the provisions of these by­ laws have not been complied with by the Local Council or their ser­ vants or agents. These by-laws may be cited as the Kafr Yasif (Licensing of Bicycles and Tricycles) By-laws, 1944. Interpretation. 2. In these by-laws — "Bicycle" and "tricycle" mean any bicycle or tricycle other than a motor bicycle or motor tricycle. "Local Council area" and "Local Council" mean the area of guris- 1391

know of or connive at the meeting or that he bona fide believed that the meeting was not a meeting of an unlawful association, or (/) has in his possession, custody or control any book, account, periodical, handbill, poster, newspaper or other document, or any funds, insignia or property, belonging or relating to or issued by or in the interests of, or purporting to belong or relate to or to be issued by or in the interests of, an unlawful association, or ((/) writes or otherwise prepares or produces, prints, types or otherwise reproduces, publishes, exhibits, sells or exposes for sale, distributes, transmits, or knowingly handles, any such thing as is mentioned in paragraph (/) ,or (A) collects, receives, requests or demands any donation or sub­ scription for an unlawful association or under pretence that it is for an unlawful association, (1) by writing, words, signs, or other acts or representation, directly or indirectly whether by inference, suggestion, implica­ tion or otherwise, acts on behalf of, or as a representative of, an unlawful association, shall be guilty of an offence against these regulations. (2) Sub-regulation (3) of regulation 18 of these regulations shall have effect in respect of any such offence as though "three years" was substituted therein for "six months" as the maximum imprisonment which can be imposed on conviction following a trial under the pro­ visions of the Magistrates' Courts Jurisdiction Ordinance, 1939, and as though "ten years" was substituted therein for "three years" as the maximum imprisonment which can be imposed on conviction fol­ lowing a. trial upon information. (3) In this regulation "document" includes any substance record­ ing, or on which is recorded, any matter, whether by letters, figures, marks or pictorial or other representation, or by more than one of those means."

8. Sub-regulation (3) of regulation 18 of the principal regulations is Regulation 18 of hereby amended— the principal regulations (a) by substituting "Magistrates' Courts Jurisdiction Ordinance, amended. 1939" for "Magistrates' Courts Jurisdiction Ordinance, 1935" therein; (b) by substituting the reference "No. 45 of 1939" for the reference "No. 16 of 1935" in the margin thereof; (r) by substituting the following for the second paragraph thereof: — "Where any person is convicted under the provisions of these re­ gulations, any goods, articles, documents, money or other things in respect of which or in relation to which the offence was com­ mitted shall be liable to be forfeited by order of the Court to the Government of Palestine."
