CLOSURE ORDER WITH DISCONNECTION OF ELECTRICITY.

WHEREAS a mass public complaint was received by the West Bengal Pollution Control Board (hereinafter will be referred to as the `State Board'), on 09­02­2012, 20­04­2012 and 07­06­2012 against a restaurant namely M/s Argeeleh, located at 2A, Motilal Basak Lane, Kankurgachi, P.S. Phoolbagan, Kolkata­700 054 alleging environmental pollution being generated from its kitchen and other activities.

AND WHEREAS the unit was called for hearing on 26­03­2012 by the State Board with all statutory licenses, including ‘Consent to Establish/Consent to Operate’of the State Board. Hence, Sri Akash Garodia appeared on behalf of the unit, submitted the copy of Trade License but failed to produce ‘Consent to Establish/ Consent to Operate’ of State Board at the time of hearing. However, Sri Manoj Kr. Shaw & Ors. appeared on behalf of the complainant in the said hearing.

AND WHEREAS the unit has not yet applied for Consent to Establish/ Consent to Operate’ of State Board and seems not even erected chimney for dispersion of gaseous substances being generated from its kitchen as well as other necessary pollution control measures within 30­04­2012 as directed during the hearing held on 26­03­2012.

NOW THEREFORE, considering the total non­compliant attitude on the part of the unit in complying with the environmental statute, M/s Argeeleh, is hereby directed to close all kinds of operations and activities at the present location with immediate effect.

Electricity connection of the said unit is ordered to be disconnected forthwith.

The General Manager­Operation (C&M), CESC Ltd., is requested to take necessary steps to disconnect the electricity connection immediately.

Closure order will take immediate effect and the Officer­in­Charge, Phoolbagan Police Station, under Kolkata Police is requested to execute the closure order against the aforementioned unit and submit the compliance report to the State Board within seven days from the receipt of this memo.

This direction has been issued to the Officer­in­Charge, Phoolbagan Police Station and the General Manager­Operation (C&M), CESC Ltd., in conformity with the order of the Hon'ble High Court, Calcutta, dated 21­08­1998 and 28­04­1999 respectively.

The Environmental Engineer, Salt Lake Regional Office of the State Board is requested to take necessary steps for proper execution of the closure order and ensure the disconnection of electricity of the said unit. He is also requested to visit the unit involving the local police authority. ­2­

This direction has been issued in exercise of the powers conferred under the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981 and Environment (Protection) Act, 1986 and Rules made thereunder.

This order has the approval of the Competent Authority.
