The Board of County Commissioners met in continued session at 8:00 o'clock A.M. Chairman Gipe, Commissioners Hall and Watne, and Clerk Robinson were present.

FINAL PLAT: EAGLE RIDGE ESTATES

Present at the March 29, 2004 9:00 A.M. Meeting were Chairman Gipe, Commissioner Watne, Planner Peggy Goodrich, Joe Kauffman, Jim Etzler, and Clerk Eisenzimer.

Goodrich reviewed the final plat for Eagle Ridge Estates which is an application from West Ventures for approval of a forty nine (49) lot residential subdivision off Whalebone Drive in Section 14, Township 28 North, Range 22 West. The property is zoned R-1. Preliminary plat was approved on March 13, 2003 subject to 14. All conditions have been met or otherwise addressed by the applicant. Staff recommends approval of the final plat.

Commissioner Watne made a motion to approve Subdivision Improvement Agreement for $282,072.00 for the completion of pavement of 50 feet of the roadway per lot. Chairman Gipe seconded the motion. Aye - Watne and Gipe. Motion carried by quorum.

FINAL PLAT: VERNA’S NORTH FORK RETREAT

Present at the March 29, 2004 9:15 A.M. Meeting were Chairman Gipe, Commissioner Watne, Planner Tim Beck, Dawn Marquardt and Debbie Shoemaker of Marquardt & Marquardt Surveying, and Clerk Eisenzimer.

Beck reviewed the final plat for Verna’s North Fork Retreat which is an application from Paul Marotz and Thomas and Donna Marx for approval of a two lot residential subdivision. The property can be legally described as Assessor’s Tract 4 in Section 35, Township 37 North, Range 22 West, P.M.M. Flathead County, Montana Preliminary plat approval for this subdivision was granted on February 25, 2003 subject to five conditions. All conditions have been met or otherwise addressed by the applicant. Staff recommends approval of the final plat.

Present at the March 29, 2004 9:30 A.M. Meeting were Chairman Gipe, Commissioner Watne, Planner Tim Beck, Dawn Marquardt and Debbie Shoemaker of Marquardt & Marquardt Surveying, D. J. Walker and Clerk Eisenzimer.

Beck reviewed the preliminary plat for Osprey Business Park filed by Schnell Family Q-Tip Trust and Marquardt & Marquardt Surveying Inc. Osprey Business Park Subdivision creates a four lot commercial/industrial subdivision. The subdivision is located off of U.S. Highway 2 East, south of Jellison Lane and is situated approximately four miles southwest of Columbia Falls. Staff recommends approval of the Preliminary Plat.

Speed Limits

WHEREAS, the Board of Commissioners is authorized, pursuant to Sections 7-5-102 through 7-5-107, 7-14-2113, 61-8-306 and 61-8-310, M.C.A., to adopt an ordinance and to impose speed limits on certain public roads and highways;

WHEREAS, the Board of Commissioners has determined that all speed limits imposed by the Board since 1985 should be codified into a single ordinance.

NOW, THEREFORE, BE IT RESOLVED that, effective 30 days after the second and final adoption, the following Ordinance shall be in force and effect in Flathead County.

Section Three. Other County Roads.

The following speed limits are hereby imposed on all County roads and highways not previously named:

Thirty Five miles per hour on all County gravel roads.

Fifty Five miles per hour on all paved County roads and on Montana State Montana Highway 206 and Montana State Highway 209.

Section Four. Violation of Ordinance - Penalties (Section 61-8-711, M.C.A.)

A. It is a misdemeanor for any person to violate any of the speed limits set forth in this ordinance.

B. Every person convicted of a violation of this ordinance shall for a first conviction be punished by a fine of not less than $10 or more than $100 or by imprisonment for not more than 10 days. For a second conviction within 1 year thereafter, the person shall be punished by a fine of not less than $25 or more than $200 or by imprisonment for not more than 10 days or by both such fine and imprisonment. Upon a third or subsequent conviction within 1 year after the first conviction, he person shall be punished by a fine of not less than $50 or more than $500 or by imprisonment for not more than 6 months or by both such fine and imprisonment.

C. On failure of payment of a fine, the offender shall be imprisoned in the Flathead County Detention Center, and the imprisonment shall be computed upon the basis of 1 day's incarceration for each $25 of the fine.

D. Upon conviction, the court costs or any part thereof may be assessed against the Defendant in the discretion of the Court.

Section Five. Signage.

The Flathead County Road Department shall install and maintain speed limit and other appropriate signs in accordance with this Ordinance.

No speed limit enacted by this ordinance shall be enforced until the appropriate signage is installed. (Section 61-8-310(4), M.C.A.)

Section Six. Severability.

If any provision of this ordinance is held invalid, such invalidity shall not affect other provisions which can be given effect without the invalid provision. To this end the provisions of this ordinance are declared to be severable.

WHEREAS, the Board of Commissioners of Flathead County, Montana, held a public hearing on March 30, 2004, concerning the proposal, after publication and mailing of notice thereof on March 16, 2004, and March 23, 2004; and

WHEREAS, the Board of Commissioners of Flathead County, Montana, has determined that the road should be named Raven Lane.

NOW, THEREFORE, IT IS HEREBY RESOLVED, by the Board of Commissioners of Flathead County, that the private road generally running easterly off Montana Highway 206 and located in the Northeast ¼ of the Southeast ¼ in Section 21, Township 30 North, Range 20 West, P.M.M., Flathead County, Montana, should be, and it hereby is, named Raven Lane.

Morrison reviewed the final plat for Two Creek Estates which is an application from Leo Follmar for approval of a two lot residential subdivision at the intersection of Brown’s Meadow Road in the Kila area. Preliminary plat approval was waived on February 22, 2003, subject to seven conditions. All conditions have been met or otherwise addressed by the applicant. PRELIMINARY PLAT: NORTH HELENA FLATS

Present at the April 1, 2004 9:30 A.M. Meeting were Commissioners Hall and Watne, Planner BJ Grieve, John Korpi, Sherry Annalise Iavicoli, Jim Burton of Jackola Engineering, and Clerk Eisenzimer.

Grieve reviewed the preliminary plat for North Helena Flats Subdivision filed by Susan Panton and Jackola Engineering. North Helena Flats Subdivision creates a four lot residential subdivision on 6.566 acres. The subdivision is located on the east side of Helena Flats Road, and is in an unzoned portion of the county. Staff recommends approval of the Preliminary Plat.

Decision was made to continue meeting until 11:30 a.m. April 5, 2004.

CONSIDERATION OF PRESENTATION: RSID #138 (ROADS IN BIG MOUNTAIN VIEW #2 SUBDIVISION)

Present at the April 1, 2004 10:30 A.M. Meeting were Chairman Gipe, Commissioners Hall and Watne, Lyell Williams, Ken Larson, Jim Martin, Kevin Malloy, Clerk and Recorder Paula Robinson, Deputy County Attorney Jonathan Smith, and Clerk Eisenzimer.

Kevin Malloy began with I work for Carver Engineering. These gentlemen along with the other homeowners of the #2 Subdivision have hired our firm to hopefully create an RSID through you guys to basically improve their subdivision. It’s one of the original subdivisions up at the Big Mountain. The current roads up there are just dirt roads, they’re susceptible to frost, heat and what have you and basically become impassable in the spring time like a lot of roads around here. Mr. Malloy explained the location of this subdivision. He continued with the road being as it is, these homeowners have come together and would like to basically get this road paved and are willing to redo it according to county standards. And all that is a county road so it would have to be done that way. In addition to that, they realized that if they go forth with this new road, that they have an old water system and old water mains underneath the road and obviously it makes sense to address the older water lines and to replace them also. So that would also be part of this project, the way that we approached it was that basically when I did a cost estimate for these individuals, I did a cost estimate for the road section and for the water section. The way that we’re going to assess the property owners is such that all 39 of the lots will be charged equally and wholly for the road section, i.e. they’ll be paying 1/39th of the costs associated with the road. And then on the water side, of the cost estimate, there are 33 lots that will receive water services and will receive the benefit of the improved water system and therefore those 33 lots will pay for the costs associated with that construction, i.e. they’ll be paying for 1/33rd. Then we’ll take the two numbers and combine them and that’s how we come up with the total of $523,000 that we estimate that this project will cost. With that in mind, that’s basically the project in a nutshell and we are here to answer any questions that you might have. We do have Mane Ann Ellingson as our bond counsel and my understanding, I’ve never met her but I’ve heard lots of tremendous great things about her and she’s been a great help thus far.

Commissioner Watne asking, on this RSID like the water lines, is there any chance that that could be extended into another subdivision at a later date?

Mr. Malloy answered with actually, it already is. It’s already part of en existing network of water mains up there on Big Mountain. It just so happens that these existing water mains actually were some of the first ones up there and they were 4” water lines and I think that was built in 1965 so they’re fairly old so we would be connecting it to existing lines already in between so we’re just replacing what’s within that subdivision.

Commissioner Watne continued with would there be any liability to the other subdivision, parts of that other than just this one?

Mr. Malloy confirmed that there would be no liability and that system will be taken over by the Big Mountain Water Company once it’s complete, whereas right now it is not. These guys maintain that water system within their subdivision privately.

Commissioner Hall asking how many years the RSID is spread over. Mr. Malloy explains that it is a 20 year district. Commissioner Hall then asked Deputy County Attorney Jonathan Smith his advice.

Jonathan Smith then explained that years ago Flathead County agreed not to do maintenance districts with RSIDs due to expense and increased workload to bookkeepers and treasurer’s office.

Agreement was made to proceed with RSID excluding the Maintenance district. Maintenance service agreement for road will be set up by Big Mountain View #2 Subdivision Homeowner’s Association. Resolution of intent is being revised and a decision was continued until completion of document.

MEETING W/PAULA ROBINSON/CLERK & REC. RE: BUDGET

Present at the April 1, 2004 11:00 A.M. Meeting were Commissioners Hall and Watne, Clerk and Recorder Paula Robinson, Debbie Deist, and Clerk Eisenzimer.

Discussion was held relative to plans for the budget season and schedule as to when budgets must be submitted. Clerk Robinson and Deb Deist are to draft a letter outlining budgetary guidelines for the different departments.
