MELBOURNE CRICKET CLUB ‘Marvellous Creations’ PROMOTION (PROMOTION) TERMS AND CONDITIONS 1. Information on how to enter, mechanics of entry and prizes form part of these terms and conditions. Entry into the Promotion is deemed acceptance of these terms and conditions. 2. The promoter is the MELBOURNE CRICKET CLUB (ABN 92 871 871 964) of Brunton Avenue, Richmond, Victoria 3121 (Promoter). 3. The Promotion commences at 12:01am on 15/08/2015 on the day of the match between the Geelong Football Club and the Hawthorn Football Club. The Promotion closes once 1000 Cadbury Dairy Milk Marvellous Creations Jammy Donut 45g bars and 1000 Cadbury Dairy Milk Marvellous Creations Raspberry Lemonade 45g bars (Prize) have been redeemed (Promotional Period). 4. Prize redemption is open to Australian residents aged 18 years or over (Eligible Recipient). If recipients are under the age of 18 years of age, they must have their parent or guardians consent to enter. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies who are directly associated with the conduct of this Promotion; the directors, management and employees (and their immediate families) of the Australian Football League (AFL) and its related entities; and employees of media organisations who have access to data regarding crowd figures at the Melbourne Cricket Ground (MCG) are ineligible to redeem a Prize. 5. Eligible Recipients must purchase any Cadbury chocolate bar - Twirl 39g, Marvellous Creations 50g, Cherry Ripe 52g - (Mondelez Product) from participating Food Store/Coffee Shop outlets at the MCG during the Promotional Period to receive a free Cadbury Dairy Milk Marvellous Creations Jammy Donut 45g bar or Cadbury Dairy Milk Marvellous Creations Raspberry Lemonade 45g bar (1000 of each only available). The purchase of only one Mondelez product is necessary to be an Eligible Recipient. 6. Only one Prize may be redeemed by each Eligible Recipient. 7. If for any reason an Eligible Recipient does not collect their Prize during the Promotional Period, then the Prize will be forfeited. 8. Total maximum prize pool value is Cadbury Dairy Milk Marvellous Creations Jammy Donut and Marvellous Creations Raspberry Lemonade 45g bars, to the value of $3840 (incl. GST). 9. The prize value is based on the recommended retail price including GST (where applicable). The value of the prize is accurate at the date of commencement of the Promotional Period. The Promoter accepts no responsibility for any variation in prize value. 10. The Prize, or any unused portion of the prize, is not transferable, exchangeable or redeemable for cash. The Prize must be taken as offered and cannot be varied. 11. The Promoter does not guarantee any delivery time/date for prize delivery. The Promoter takes no responsibility for prizes damaged, destroyed, stolen or lost in transit. 12. Any ancillary costs associated with redeeming the prize, including travel costs, spending money, or meals, are not included. These costs are the sole responsibility of the winner. 13. It is a condition of acceptance of any prize that the winner consents to the Promoter and its related bodies corporate and their agents using the winner's name, image, likeness and/or voice in promotional and other material. Without limitation, winners consent to being filmed, photographed or otherwise recorded while taking or using any prize, and they consent to the Promoter copying, broadcasting or communicating to the public any such film or image anywhere in the world for an unlimited period, or allowing any third person to do so, including repeating any such broadcast, film or other recording, without compensation, for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 14. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to modify, suspend, terminate or cancel the Promotion, as appropriate. 15. By participating in this Promotion, entrants understand and agree that the Promoter may use and disclose the information provided by them in relation to this Promotion for the purpose of conducting this Promotion and for any of the purposes set out in the Promoter's privacy policy which is available at https://www.mcc.org.au/Privacy%20Policy.aspx. An Eligible Entrant can request to access, update or correct any personal information held about them by the Promoter by writing to the Customer Service Manager at PO Box 175, East Melbourne, Victoria 8002. 16. To the extent permitted by law, the Promoter (including each of their officers, employees and agents) will not be liable for any loss, damage or personal injury (including liability in negligence) or any loss of opportunity whether direct, indirect, special or consequential arising in any way out of the entrants participation in the Promotion or in connection with the prize. The Promoter accepts no responsibility for any tax liabilities that may arise from winning a prize. 17. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under any similar consumer protection laws in the State and Territories of Australia. .
