Plaintiffs Alexis S. Geffin and Ryan J. Geffin, on behalf of a proposed Student Class, sue Governor Rick Scott and other officials and subdivisions of the State of Florida for reneging on the State of Florida’s obligations to request and appropriate money to match private donations to public colleges and universities—depriving Florida’s colleges, universities, and students of over $1 billion. 2. Four separate matching statutes require Defendants to match, through appropriations bills, private donations to colleges, universities, and their students for, among other things, facilities improvements, financial aid, and scholarships. Each of these statutes requires, absent a general revenue shortfall and to the extent matching will not cause a general revenue shortfall, matching private donations. 3. Defendants, by defunding the matching statutes through appropriations bills during years with large projected and realized budget surpluses, have violated the Florida Constitution. Article III, § 12 requires passing substantive legislation to amend each of the four matching statutes so that any amendments will be visible and open to debate in the Legislature, will require the Governor take a position on whether to veto the bill, and invite media and public scrutiny. Defendants failed to pass such substantive amendments, instead unconstitutionally using appropriations bills to defund the four matching statutes. 4. Rather than appropriate the over $600 million in State funds owed, the Governor and the Legislature have spent general revenue surpluses on multibillion dollar tax cuts and to set aside billions in reserves. 5. The fact that students in Florida’s colleges and universities have been harmed and are being harmed by this failure is established by the statements of Florida’s elected leaders. Governor Scott has said, for example: 1 • “If you think about what we all should expect out of our higher ed[ucation], we should expect it’s affordable, so that all Floridians, whether they’re rich or poor, can go to our universities and state colleges.”1 • “To maintain Florida’s spot as the top destination in the world for jobs and opportunities, we must continue to make the dream of earning a college education attainable for every student.”2 • “We know Florida families want the best value possible from our higher education system, which means we have to make advanced degrees more affordable.”3 • “It is incumbent upon state leaders to ensure the cost of higher education remains accessible to as many Floridians as possible.”4 • “Raising tuition is a tax on Florida families” and “[f]or many students, an increase in tuition means an increase in the debt burden they will carry.”5 • Increasing student loan payments “effectively kill the chance for many Florida families to live the American Dream.”6 • “We have budget surpluses. We ought to be funding education.”7 6.     2018 Legislative Scorecard 2018 Legislative Scorecard The LIBRE Scorecard includes nearly 3,501 individual votes among 29 separate legislative issues. While some of these issues had legislation filed in both the House and Senate, others were filed in one chamber only. In total, the 29 sepa- rate legislative issues were comprised of 49 different bills. Each of The LIBRE Initiative Florida’s legislative priorities is included on this scorecard, as well as additional issues we explicitly supported or opposed during the 2018 regular legislative session. Of the 49 different bills supported or opposed this session, votes were tallied in either the House or the Senate for 29 of them. The others have been included in the scorecard via positive or negative sponsorship points, as explained in the grading section below. Summaries of all 29 legislative issues and their results during the legisla- tive process are also included in the scorecard. "First, the 2008 risk assessment, used by the Army Corps of Engineers to determine the release schedules, needs to be reviewed. We need to take a look, reevaluate, regroup, make sure the assessment is based on the latest evidence, balancing the risk of overflow against the certainty of what has happened in our communities," said Chair Negron. "Second, I'm committed 100 percent to looking at where we can store water before it comes in to our community. Water storage is job number one we aren't waiting months or years. Let's see where we can store it and how much it will cost," continued Chair Negron. "Third, we will legally evaluate how the declaration of a state of emergency would impact Florida's ability to work with the federal government to address the ongoing releases," said Chair Negron.

    THE FLORIDA SENATE SENATOR JOE NEGRON President December 14, 2017 Director Ernie Marks South Florida Water Management District 3301 Gun Club Road West Palm Beach, Florida 33406 Dear Director Marks, First, let me thank you and your staff at the South Florida Water Management District for the efforts you have put into making the Everglades Agriculture Area (EAA) reservoir a reality. I am impressed by the commitment the District has made in planning the reservoir and the transparency the District has demonstrated by tracking its progress on its website and holding numerous public meetings. I was also heartened by your recent editorial in the TCPalm where you reiterated your commitment to see this project through completion. I have a concern that the initial modeling may be unnecessarily constrained by using a limited footprint or that utilizing the A-1 parcel might trigger the need to renegotiate the restoration strategies consent decrees. The bill, now law, anticipates use of the A-2 and potentially the A-1 parcel and lands to the west of the two parcels. The law also emphasizes termination of leases, land swaps, and land acquisition if additional land is necessary for the EAA reservoir project. What I hope to see from the District is a proposal that is workable, that we can make a reality as expeditiously as possible to decrease the need for harmful discharges to the estuaries. If the District needs to be flexible with the footprint to put an effective reservoir plan into action, I hope it will consider using any additional land available, if necessary.
