Proceedings of the 11 th meeting of Karnataka State Coastal Zone Management Authority (KSCZMA) held on 15 th October, 2015 at Jungle Lodges and Resorts, Devbagh, Karwar, under the Chairmanship of Additional Chief Secretary to Government, Department of Forest, Ecology and Environment.

Members present: As per the list enclosed.

The Chairman welcomed the members present. All the files were placed before the Authority for perusal and the subjects were deliberated as per the Agenda.

11.1 Confirmation of the proceedings of the previous KSCZMA meeting held on 11.08.2015.

The proceedings of the previous KSCZMA meeting held on 11.08.2015 were read out. The proceedings were confirmed as there were no comments or amendments received from the members.

11.2 Action Taken Report on the proceedings of the previous KSCZMA meetings held on 11.08.2015. (Annexure-1).

Action Taken Report at Annexure – I was perused and the Authority noted the action taken.

11.3 Preparation of State Coastal Zone Management Plan:

Regarding preparation of Coastal Zone Management Plan (CZMP) by National Centre for Sustainable Coastal Management, Chennai, Special Director & Scientific Officer (Grade-1) concerned visited Chennai on 9 th and 10 th of September, 2015 along with the Regional Director (Environment). Demarcated HTL have been examined by the team and some doubts expressed by the institution were clarified by the state officers. Then the institution requested to furnish the following information needed to complete the work:

• Cadastral maps in Shapefile format (CAD format already submitted by the state) • Hard copies of 1991/1996 CZMP maps preferably on 1:25,000 scales, if available, otherwise on 1:50,000 scale. • Boundaries of Corporations / Municipalities / other urban bodies of all coastal districts of Karnataka, preferably in Shapefile format, otherwise, hard copy maps.

It was informed by the Regional Director (Env), Mangalore and Udupi that all the informations have been sent to Chennai. Whereas, Regional Director (Environment), Karwar have sent only concerned maps but yet to furnish other details to NCSCM, Chennai.

During the discussion prof. V. Sreedhara Scientist, Remote sensing application Centre informed the meeting that village maps in shape file format are available in Remote sensing application centre. Under the circumstance the Authority directed to Proceedings for the 11 th KSCZMA meeting

obtain the village maps in shape file format of all the villages coming under Coastal Districts of Mangalore, Udupi & Karwar from Remote sensing application centre and then to submit the same to NCSCM, Chennai at the earliest. The Chairman KSCZMA directed the Regional Director, Karwar to send all the information to NCSCM by 31.10.2015 without fail

11.4 Construction/ Re-construction and Conversion of Residential Buildings:

11.4.0 Mangalore District:

11.4.1 Request for issue of NOC from Sri. Mohammad Shabeer S/o L. C. Ummar and Smt. Mehroz Bhanu W/o Mohammad Mansoor for construction of residential Apartment at Sy. No. 1343/P of Kasbabazar Village. (FEE 433 CRZ 2015)

Sri. Mohammad Shabeer S/o L. C. Ummar and Smt. Mehroz Bhanu W/o Mohammad Mansoor has requested NOC for construction of residential apartment at Sy. No. 1343/P of Kasbabazar village, Mangalore Taluk. The Regional Director (Environment) has inspected the proposed site and reported that project site is at distance of 150 mts from river (as per CZMP approved 1996). It is classified as CRZ- II. The distance from HTL is 92 mts from HTL of River.

The Regional Director (Environment) has submitted application in the prescribed format, Survey map of the site, Letter of Mangalore City Corporation & Record of land ownership, site plan and building plan, estimate, commitment letter regarding liquid waste management, proof for the authorized building constructed prior to 1991, approved CZMP sheet, Google Map, inspection report of RD (Env) and proceeding of DCZMCC meeting held on 29.06.2015. The built up area is 660.25 Sqm. The DCZMC recommended the proposal in the DCZMC meeting held on 29.06.2015

As per the para 8 II CRZ II (i) & (ii) building shall be permitted only on the landward side of the existing road, or on the landward side of existing authorized structures building permitted on the landward side of the existing and proposed roads or existing authorized structures shall be subject to the existing local town and country planning regulations including the “existing” norms of Floor Space Index or Floor Area Ratio.

The Authority after discussion and deliberations decided to issue NOC for Construction, as per the recommendation of the DCZMC.

11.4.2 Request for issue of NOC from Smt. Yogitha S Amin W/o Suchindra V Amin for construction of residential Apartment at Sy. No. 291/4P of Surathkal Village. ( FEE 434 CRZ 2015)

The Regional Director (Env) has inspected the proposed site and reported that project site is at distance of 500 mts from Sea (as per CZMP approved 1996). It is classified as CRZ-II. The distance from HTL is 260 mts from HTL of Sea.

The Regional Director (Env) has submitted application in the prescribed format, Survey map of the site, Letter of Mangalore City Corporation & Record of land ownership, site plan and building plan, estimate, commitment letter regarding liquid waste management, proof for the authorized building constructed prior to 1991, approved CZMP sheet, Google Map, inspection report of RD (Env) and proceeding of DCZMCC meeting held on 29.06.2015. The built up area is 248.73 Sqm. The DCZMC recommended the proposal in the DCZMC meeting held on 29.06.2015

The Authority after discussion and deliberations decided to issue NOC for Construction, as per the recommendation of the DCZMC.

11.4.3 Request for issue of NOC from Sri. Shashikanth G Nayak S/o L Gopalkrishna Nayak, “Maha Kripa”, Malpe Cross Road, Santhekatte, Udupi for construction of residential Apartment at Sy. No. 10/1A1AAP88 of Bolur Village. (FEE 435 CRZ 2015)

Sri. Shashikanth G Nayak S/o L Gopalkriskna Nayak has requested NOC for construction of residential apartment at Sy. No. 10/1A1AAP88 of Bolur Village, Mangalore Taluk. The Regional Director (Environment) has inspected the proposed site and reported that project site is at distance of 150 mts from River (as per CZMP approved 1996). It is classified as CRZ-II. The distance from HTL is 100 mts from HTL of River.

The Regional Director (Env) has submitted application in the prescribed format, Survey map of the site, Letter of Mangalore City Corporation & Record of land ownership, site plan and building plan, estimate, approved CZMP sheet, Google Map, inspection report of RD (Env) and proceeding of DCZMCC meeting held on 29.06.2015. The built up area is 391.82 Sqm. The DCZMC recommended the proposal in the DCZMC meeting held on 29.06.2015

As per the para 1 (ii) CRZ shall apply to the land area between HTL to 100 mts or width of the creek whichever is less on the landward side along the tidal influenced water bodies that are connected to the Sea. As per approved CZMP the proposed site falls in border line of CRZ.

The Authority after discussion and deliberations decided to issue NOC for Construction, as per the recommendation of the DCZMC. 11.4.4 Request for issue of NOC from Sri. Suchindra V Amin S/o Vishwanatha Amin for construction of residential Apartment at Sy. No. 22/10P of Surathkal Village. ( FEE 436 CRZ 2015)

Sri. Suchindra V Amin S/o Vishwanatha Amin has requested NOC for construction of residential apartment at Sy. No. 22/10P of Surathkal village, Mangalore Taluk. The Regional Director (Environment) has inspected the proposed site and reported that project site is at distance of 500 mts from Sea (as per CZMP approved 1996). It is classified as CRZ-II. The distance from HTL is 130 mts from HTL of Sea.

The Regional Director (Env) has submitted application in the prescribed format, Survey map of the site, Letter of Mangalore City Corporation & Record of land ownership, site plan and building plan, estimate, approved CZMP sheet, Google Map, inspection report of RD (Env) and proceeding of DCZMCC meeting held on 29.06.2015. The built up area is 362.44 Sqm. The DCZMC recommended the proposal in the DCZMC meeting held on 29.06.2015

The Authority after discussion and deliberations decided to issue NOC for Construction, as per the recommendation of the DCZMC.

11.4.5 Request for issue of NOC from Lakshadweep Administration, Lakshadweep Public Works Department, Circle Office, Kavaratti for construction of Lakshadweep Terminal at Sy. No. 52/1A1A, 52/1A2 and 491/1 of Mangaluru Thota Village. ( FEE 437CRZ 2015)

Lakshadweep Administration, Lakshadweep Public Works Department, Circle Office, Kavaratti has requested NOC for construction of residential apartment at Sy. No. 52/1A1A, 52/1A2 and 491/1 of Mangaluru Thota Village, Mangalore Taluk. The Regional Director (Environment) has inspected the proposed site and reported that Page 4 of 60

project site is at distance of 150 mts from River (as per CZMP approved 1996). It is classified as CRZ-II. Sy. No. 491/1 - The Distance from HTL is 96 mts from HTL of River and Sy. No. 52/1A1A and 52/1A2 - The distance from HTL is 100 mts from HTL of River.

The Regional Director (Environment) has submitted application in the prescribed format, Survey map of the site, Letter of Mangalore City Corporation & Record of land ownership, Site plan and building plan, estimate, prood for the authorized building constructed prior to 1991, Copy of Challan about Payment of processing fees, approved CZMP sheet, Google Map, inspection report of RD (Env) and proceeding of DCZMCC meeting held on 29.06.2015. The built up area is 16034.49 Sqm and the Net area is 11783.21 Sqm. The DCZMC recommended the proposal in the DCZMC meeting held on 29.06.2015

Sy. No. 491/1 - As per the para 8 II CRZ II (i) & (ii) building shall be permitted only on the landward side of the existing road, or on the landward side of existing authorized structures building permitted on the landward side of the existing and proposed roads or existing authorized structures shall be subject to the existing local town and country planning regulations including the “existing” norms of Floor Space Index or Floor Area Ratio. There are buildings prior to 1991 between this site and HTL of river.

Sy. No. 52/1A1A and 52/1A2 - As per the para 1 (ii) CRZ shall apply to the land area between HTL to 100 mts or width of the creek whichever is less on the landward side along the tidal influenced water bodies that are connected to the Sea. As per CRZ Notification 2011, the site falls outside CRZ area.

Since the Sy. No.491/1 fall within CRZ area, the Authority after discussion and deliberations decided to issue NOC for Construction as per the recommendation of the DCZMC.

11.4.6 Request of Environment and CRZ Clearance for the proposed Mounded Storage Project at Total Oil India Pvt., Ltd., No.62, Thokur Village, Jokatte Post, Mangalore. ( FEE 17 CRZ 2015)

Total Oil India Pvt., Ltd., No.62, Thokur Village, Jokatte Post, Mangalore has requested NOC for construction of Mounded storage project at KIADB Plot No. 89, 90, 91 & 92 of Thokur Village, Mangalore Taluk. Total Oil India Pvt., Ltd., is proposing to augment its storage capacity by installation of 8X1800 MT Mounded tanks for storage of LPG and Bottling.

The Regional Director (Environment) has submitted application in the prescribed format, Rapid Environmental Impact Assessment (REIA), Disaster Management Plan (DMP), Risk Assessment Report & Management Plan along with relevant documents. The built up area is 362.44 Sqm. The DCZMC recommended the proposal in the DCZMC meeting held on 29.06.2015

The area falls under CRZ III as per approved Coastal Zone Management Plan. According to para 8 III CRZ III (iii) (e) and (f) of the CRZ Notification, 2011 the above project is a permissible activity.

The Authority after discussion and deliberations decided to issue NOC for proposed Construction of Mounded Storage Project at Total Oil India Pvt., Ltd., as per the recommendation of the DCZMC for expansion/augmentation of storage capacity by adding 8 Nos Mounded Bulltes (1800X8=14400MT) and augmentation of tank lorry loading/unloading bays 2 nos in the existing TOIPL maritime terminal and bottling plant at Baikampady Industrial Estate, Plot no. 89, 90, 91 & 92 of Thokur Village,Jokatte Post, Mangalore Taluk, South Camara. Further, the proponent, should submit detailed on site -- and off site emergency plan, to the concerned Authorities and ensure the facilities are put in place. 11.4.7 Request for issue of CRZ Clearance for construction and improvement to road (cement concrete road) from chitrapu River side towards east up to highway (NH)

Department, Manglauru Division, Mangaluru for seeking CRZ Clearance for Construction and improvement to road from Chitrapu river side towards east up to highway (NH) Mulky Town Panchayath, Chitrapu village of Mangaluru Taluk, Dakshina Kannada District under National Cyclone Risk Mitigation Project (NCRMP). The Proposed site was inspected and it was found that the proposed area in patially CRZ-III as per Coastal Zone Management Plan. The size of the project is 0.873km.

The Regional Director (Env) has submitted the checklist and declaration, Form-I, executive summary of the project, Map depicting multipurpose linking roads, approved CRZ map, Google map, the proceeding of DCZMC meeting held on 01-10- 2015, inspection report of Regional Director (Env.) The DCZMC recommended the proposal for issue of NOC in the meeting held on 01-10-2015.

The activity of construction and improvement to road work is permissible under para 3(iv) (a), and 8 CRZ-III (iii) (j) of CRZ Notification 2011.

11.4.8 Request for issue of CRZ Clearance for construction and improvement to road (cement concrete road) from Bandage hilt and Bandasale along the River towards east up to Bappanadu temple near high way Mulky Town Panchayath under National Cyclone Risk Mitigation Project (NCRMP) in Mangalore Taluk (FEE 452 CRZ 2015).

The Executive Engineer, P.W.P and I.W.T. Department, Manglauru Division, Mangaluru for seeking CRZ Clearance for construction and improvement to road from Bandage hilt and Bandasale along the river towards east up to Bappanadu temple near highway Mulky town Panchayath Bappanadu village of Mangaluru Taluk, Dakshina Kannada District under National Cyclone Risk Mitigation Project (NCRMP) . The Proposed site was inspected and it was found that the proposed area in CRZ-III as per Coastal Zone Management Plan. The size of the project is 0.620km

The proposed site was inspected and it was found that the proposed area in CRZ- I and CRZ-III as per Coastal Zone Management Plan. The size of the project is 0.900km

11.4.10 Request for issue of CRZ Clearance for construction and improvement to Mukka-Sashihithlu road (cement concrete road) in Mangalore north constituency under National Cyclone Risk Mitigation Project (NCRMP) in Mangalore Taluk (FEE 483 CRZ 2015).

The Executive Engineer, P.W.P and I.W.T. Department, Mangaluru Division, Mangaluru for seeking CRZ clearance for construction and improvement to Mukka- Sashihitlu road in Mangaluru North constituency in Mangaluru Taluk- Sashihitlu village of Mangaluru Taluk, Dakshina Kannada District under National Cyclone Risk Mitigation Project (NCRMP). The proposed site was inspected and it was found that the proposed area in CRZ-II as per coastal zone management plan. The size of the project is 3.250km

11.4.11 Request for issue of CRZ Clearance for construction and improvement to road (cement concrete road) from chandra Shanubogara Kudru to main (NH) Mulkytown Panchayath under National Cyclone Risk Mitigation Project (NCRMP) in Mangalore Taluk (FEE 484 CRZ 2015).

The Executive Engineer, P.W.P and I.W.T. Department, Manglauru Division, Mangaluru for seeking CRZ Clearance for Construction and improvement to road from chandra Shanubogara Kudru to main (NH) Mulky town Panchayath in Bappanadu village of Mangaluru Taluk, Dakshinakannada district under National Cyclone Risk Mitigation Project (NCRMP) . The proposed site was inspected and it was found that the proposed area in CRZ-III as per coastal zone management plan. The size of the project is 0.583km

The activity of construction and improvement to road work is permissible under para 3(iv) (a), and 8 CRZ-III (iii) (j) of CRZ Notification 2011.

The Authority after discussion and deliberations decided to issue NOC for construction, and improvement of road as per the recommendation of the DCZMC with a condition that the road should not pass through CRZ Zone -1 and Eco Sensitive Zone. 11.4.12 Request for issue of CRZ Clearance for construction and improvement to Guddekopla road (cement concrete road) in Mangalore north constituency under National Cyclone Risk Mitigation Project (NCRMP) in Mangalore Taluk (FEE 485 CRZ 2015).

Department, Manglauru Division, Mangaluru for seeking CRZ Clearance for construction and improvement to near Thannirbavi Fathima chourch road in Mangalore North constituency in Thannirbhavi and Kasbabengre village of Mangaluru Taluk Dakshina kannada district under National Cyclone Risk Mitigation Project (NCRMP) . The Proposed site was inspected and it was found that the proposed area in CRZ-I and CRZ-II as per coastal zone management plan. The size of the project is 0.50km.

Department, Manglauru Division, Mangaluru for seeking CRZ Clearance for CRZ Clearance for construction and improvement to Bykampady Meenakaliya road in Mangalore North constituency in Panambur village of Mangaluru Taluk Dakshina Kannada District under National Cyclone Risk Mitigation Project (NCRMP). The proposed site was inspected and it was found that the proposed area in CRZ-II as per coastal zone management plan. The size of the project is 0.40km.

The activity of construction and improvement to road work is permissible under para 3(iv) (a) of CRZ Notification 2011.

11.4.17 Request for issue of CRZ Clearance for construction and improvement to near Thota bengre primary school road (cement concrete road) in Mangalore north constituency under National Cyclone Risk Mitigation Project (NCRMP) in Mangalore Taluk (FEE 490 CRZ 2015).

It was found that the proposed area falls in CRZ-III as per coastal zone management plan. The extent of the project is 20mtr in length and located 32 mtr from HTL of the Sea.

As per the provisions under Para 3 (iv) (a), Para 8 CRZ-III A (iii) (j) of CRZ notification 2011.

11.4.90 Request for CRZ clearance for reconstruction/improvements of road from Mudga Fisheries Link Road in Karwar Taluk(FEE 411 CRZ 2015)

Issue of CRZ clearance for reconstruction/improvements of road from Mudga Fisheries Link Road in Karwar Taluk. The proposed site was inspected and the G.P.S readings are a) 14 0 44’ 52.7”N, 74 0 13’ 51.1”E b) 14 0 44’ 52.5”N, 74 0 14’ 9.6”E . It was found that the proposed area falls in CRZ-III as per coastal zone management plan. The extent of the project is 70mtr from HTL of river & 160mtr from sea in length and located 30 mtr from HTL of the Sea.

As per the provisions under Para 3 (iv) (a) and Para 8 CRZ-III A (iii) (j) of CRZ notification 2011.

It was found that the proposed area falls in CRZ-II as per coastal zone management plan. The extent of the project is 30mtr from river in length and located 390mtr from HTL of the Sea & 45mtr from HTL of River.

As per the provisions under under Para 3 (iv) (a) and Para 8 II.CRZ-II (i) & (ii) of CRZ notification 2011.

The Authority after discussion and deliberations decided to issue NOC for reconstruction/improvements of road from Alvewada River Bank Road, as per the recommendation of the DCZMC.

11.4.92 Request for CRZ clearance for reconstruction/improvements of road from Mudga colony to R.C colony Fisheries Link Road in Karwar Taluk (FEE 413 CRZ 2015)

Issue of CRZ clearance for Reconstruction/ Improvements of Road from Mudga colony to R.C colony Fisheries Link Road in Karwar Taluk. The proposed site was inspected and the G.P.S readings are 14 0 44’ 46.6”N, 74 0 14’ 24.7”E . It was found that the proposed area is CRZ-III as per coastal zone management plan. The extent of the project is 35 mtr Length from HTL of Sea.

As per the provisions under Para 3 (iv) (a), Para 8 CRZ-III A (iii) (j) of CRZ notification 2011.

The Authority after discussion and deliberations decided to issue NOC for Reconstruction/ Improvements of Road from Mudga colony to R.C colony Fisheries Link Road, as per the recommendation of the DCZMC.

11.5 1 Ratification of provisional NOC issued by the Regional Directors (ENV) with the approval of the DCZMCs.

The KSCZMA during the meeting held on 11.06.2014 had taken a decision to authorize the Regional Directors (Env) of the coastal districts to issue provisional NOC for construction/re-construction/repair of dwelling units in CRZ II and CRZ- III (200m – 500 m) and outside the CRZ limits with the approval of the concerned DCZMCs and then to submit proposal for ratification of the action taken. Proceedings for the 11 th KSCZMA meeting procedure in this regard have been issued vide the Government letter No. FEE 236 CRZ 2013, dated 18.08.2014. Accordingly, the Regional Directors (Env) of the coastal districts have submitted proposals for ratification of the provisional NOC issued. The details of proposals on which provisional NOC have been issued by the Regional Directors (Env), Udupi and Uttara Kaannda districts subject to ratification are enclosed as Annexure – I, and Annexure – II respectively.

The Authority reviewed the provisional NOCs issued by the Regional Directors, Udupi and Uttara Kannada Districts and after discussion the Authority decided to accord ratification for the action taken by concerned RDs. Further, the Authority decided to issue proper CRZ NOC for the proposals listed in Annexure – I, and Annexure – II

11.6.0 The Additional Subject discussed with the permission of the Chair.

11.6.1 Request for CRZ clearance for construction of Beach Resort at Sy. No. 159, 160 and 264 of Paduvari Village, Kundapur Taluk, Udupi District by M/s. Byndoor Beach Resort (FEE 141 CRZ 2013)

The issue was discussed in the KSCZMA meeting held on 11/06/2014, and the KSCZMA had taken a decision to issue Show Cause Notice (SCN) to the project proponent M/s. Akkayya Consultancy Services, Bengaluru under section 5 read with Section 15 of Environment (Protection) Act, 1986 for not obtaining prior CRZ clearance for 11 structures which are operational in the project site (between 200 to 500m from the sea HTL) and to obtain the proponents reply in 2 months time from the date of issue of Show cause Notice ( date of issue 04/08/20114). For the following contravention of (i) Having under taken construction of buildings which are in operation as above without obtaining prior CRZ clearance as mandated in CRZ Notification No. S.O.19(E) dated 6 th January, 2011 and the amendments made thereon.

The proponent has submitted his reply for show cause notice on 27/09/2014, and has requested to give clearance to the proposal.

The Authority decide to verify is there any other order from Hon’ble National Green Tribunal (NGT) other then the direction issued by the Ministry of Environment Forest, (MoEF) on 04/06/2013. It was informed in the meeting that the NGT vide order dated 7/7/2015 has quashed office memorandum issued by MoEF on 12/12/2012 regarding action to be initiated in cases relating to the violations by the project proponents under section 19 and section 15 of the Environment (Protection) Act, 1986. The NGT by order dated 7/7/2015 has prohibited the MoEF from giving effect to the above Office Memorandum dated 12/12/2012. The State Government has issued show cause notice to proponent under section 5 read with section 15 of Environment (Protection) Act, 1986. The extract of the NGT order dated 7/7/2015 is reproduced below for information: 1) We hold and declare the Office Memoranda dated 12/12/2012 and 27/07/2013 as ultra vires the provisions of the Act of 1986 and the Notification of 2006. They suffer from Page 50 of 60

the infirmity of lack of inherent jurisdiction and authority. Resultantly, we quash both these Office Memoranda. 2) Consequently, the above Office Memoranda are held to be ineffective and we prohibit the MoEF and the SEIAA in the entire country from giving effect to these Office Memoranda in any manner, Whatsoever. 3) We hold and declare that the resolution/orders passed by the SEIAA, de-listing the applications of the Project Proponents, do not suffer from any legal infirmity. These orders are in conformity with the provisions of the Act of 1986 and the Notification of 2006 and do not call for interference.

Further the Authority, authorized the Regional Director, Udupi to conduct spot mahazar and to file a case in the Jurisdictional Court and obtain C.C No.

After discussion and deliberation, the Authority decided to take credible action as per sec. 19 of Environment (Protection) Act, 1986. The Authority also decided to intimate the credible action taken to MoEF for further necessary action.

11.6.2 Proposal of removal of Sand from Sand Bar of Kali River, Gangavali river- GA, Aghanashani river -AG and Sharavathi river- SH in Karwar Taluk of Uttar Kannada District for CRZ Clearance

District Sand Monitoring Committee (CRZ), Uttara Kannada district headed by the Deputy Commissioner as a proponent had submitted a proposal for CRZ clearance to Karnataka State coastal zone management authority (KSCZMA). For “Removal of Sand Bar Which are obstructing the movement of fishing vessels and domestic boats in CRZ areas in Kali, Saravathi, Gangavali and Aghanashani rivers in Karwar Taluk of Uttar Kannada District” The following points were placed before the Authority:

The MoEF, GoI has issued Office Memoranda dated 24.02.2011, 09.06.2011 and 08.11.2011 regarding removal of sand bars which are prohibiting free movement of fishing vessels, boats etc in the Coastal Regulation Zone (CRZ) area of rivers/estuaries.

1. Deputy Commissioner, Karwar vide letter dated 15.10.2015 has submitted the proposals for CRZ Clearance from KSCZMA and further environment clearance from SEIAA for removal of sand bars located in CRZ area in Uttara Kannada District based on report dated 28.09.2015 of Dr. S.G. Mayya Former Dean (P&D) & & Professor of Water Resources Engineering, National Institute of Technology Karatnatka, Surathkal.

2. The DC has reported that for want of Environment Clearance from SEIAA-Karnataka, removal of sand from sandbars in the district has been completely stopped and there is non- availability of sand even for development and construction activities in the District. DC has requested for issue of CRZ Clearance followed by EC from SEIAA, Karnataka.

3. Non-mechanized dinghies or small boats are being used for removal of sand by traditional coastal community without using any machinery by using bamboo poles, baskets/buckets by human beings. The removal of sand is completely manual by human efforts by hands and collected in baskets or by bamboos scoping and collected inside the mesh. Then it is loaded in the Nadadoni. The collected sand will be stocked at river bank owned by traditional communities/port land (dakke). The removal of sand will be continuing till the completion of Page 51 of 60

specified quantity which enables the smooth navigation at the demarcated place. During removal of sand following condition will be followed by the registered traditional communities:

a) Sand should not be removed to the depth beyond average bed level. b) If bank or bed erosion takes place sand should not be removed. c) Sand removal from the river bed other than the identified sand bar is prohibited. d) Sand should not be removed near nay vegetation or mangroves growth.

e) Use of any mechanical methods for removal of sand is strictly prohibited. f) If any damages to ecological system and the environment are observed, removal of sand should be stopped. g) Only day time (6am to 6pm) sand may be removed. h) No instruments/materials should be left behind in the river course. i) Minimum distance of 2 meter should be maintained from river bank for stocking of sand. j) In order to safe guard the river banks and roads sand removing/transportation along the river banks should be prohibited in monsoon season i.e. June 15 to August 15.

Further the District Sand Monitoring (CRZ) Committee has decided to dispose the sand through registered traditional community people by collecting Royalty and other statutory taxes through Department of Mines and Geology. Sand will be transported by using valid mineral dispatch permits (MDP) in order to regulate illegal sand transportation/mining activity in CRZ and non CRZ area.

The subject was placed before the Authority for discussion and the Authority after discussion and deliberations decided to issue CRZ clearance to all the proposals except the proposal at Sl. No. 21 above (SB-SH- 21) as per the recommendation of the DCZMC. Karwar

with the following conditions in addition to the condition enumerated in para - 3 above:

i) The Deputy Commissioner may permit removal of sand bars in the specified time period in a particular area alongwith specific quantity subject to such conditions, such as registration of local community persons permitted to remove the sand manually. ii) The Environmental Official at district level shall monitor the removal of sand and submit report to the Deputy Commissioner, as may be specified, say quantity of sand removed in the period concerned. iii) The above permit shall be renewed on yearly basis. iv) The agenda and the minutes of the Seven Member Committee, permits issued by Deputy Commissioner and monitoring reports of the removal of sand would be uploaded on the website of the Deputy Commissioner’ office and also made available hard copy to Zila Parishad etc., as may be directed by the Deputy Commissioner. v) The accumulation of sand bar, its removal the process etc., shall be monitored by Deputy Commissioner with the help of satellite imageries, GPS, etc. It shall be ensured that the permits are not accorded in such areas which are identified as eco-sensitive zones, fish migratory and breeding grounds. The permits shall be given taking into consideration the local circumstances and ecological settings. vi) Deposit in the sand bars above the level of river bed only shall be removed by way of bar skimming and no pit excavation shall be permitted. vii) The sand deposits within the buffer zone of 50 meters from the existing mangrove shall not be disturbed. viii) Sand bars in the known breeding and spawning grounds shall not be disturbed.Removal of sand bars during the monsoon season which is generally the breeding season for the aquatic fauna shall be avoided. ix) No pits in the river bed shall be formed as it tends to alter the entire river dynamics. x) Sand bars at the vicinity of bridges and other engineering structures and the river banks shall not be disturbed. xi) The project authorities shall ensure that removal of sand bars do not disturb the habitants in order to conserve benthic flora and fauna that inhabit the sandy substrata. xii) The project Authorities shall apply before SEIAA, Karnataka for Environmental Clearance for sand bar removal. xiii) The Authority reserves the right to cancel the NOC given under CRZ Notification for sand bar removal incase of any violation in the interest and conservation of coastal environment without giving any notice.

11.6.3 In the above KSCZMA meeting it was discussed to implement the submission of online application for proposals requiring CRZ clearance as adopted in the case of EC clearance and FC clearance in MoEF. It was decided to create a web portal by consulting experts. It was also decided to adopt the on-line application system from the next financial year. In this regard Special Director is directed to take action to consult e-Governance Department to take the help required to develop the web portal. The meeting ended with thanks to the Chair.
