Statutory Notifications Order (S.R.O.)

Government of Pakistan MINISTRY OF FOREIGN AFFAIRS

ORDER

Islamabad, the 28th August, 2018

S.R.O. 1067(I)/2018 – WHEREAS the United Nations Security Council (“UNSC”) acting under Chapter VII of the United Nations Charter has passed various resolutions relating to the prevention, suppression and disruption of proliferation of weapons of mass destruction and its financing which require, inter alia, freezing without delay the funds or other assets of, and to ensure that no funds and other assets are made available, directly or indirectly, to or for the benefit of, any person or entity designated by, or under the authority of, the UNSC;

WHEREAS the UNSC has also imposed targeted sanctions on individuals and entities in the Islamic Republic of Iran and the Democratic People’s Republic of Korea through a series of resolutions;

WHEREAS section 2 of the United Nations (Security Council) Act, 1948 (XIV of 1948) empowers the Federal Government to take measures to give effect to the decisions of the UNSC and the Federal Government has been issuing S.R.Os from time to time in exercise of such powers;

AND WHEREAS the measures taken hereunder shall be in addition and without prejudice to those already in force through various S.R.Os issued from time to time, and any other legal,

Page 1 of 3 executive or administrative measure in place to enforce the resolutions / decision of the UNSC on countering proliferation;

NOW THEREFORE in exercise of the aforementioned powers, and to effectively implement, supervise and monitor the enforcement of UNSC resolutions / decision on countering the proliferation of weapons of mass destruction, the Federal Government decides as follows:-

Inter-Agency Committee for Coordination, Review and Monitoring of Implementation and Enforcement

1. An inter-agency committee namely Committee for Coordination, Review and Monitoring (hereinafter referred as the “CRM Committee”) is hereby established comprising of the following ex-officio members:-

(i) Ministry of Foreign Affairs (Chairman/Secretary); (ii) Strategic Export Control Division (Member); (iii) Ministry of Commerce (Member); (iv) Ministry of Finance (Member); (v) Financial Monitoring Unit (Member); (vi) (Customs) (Member); (vii) Federal Board of Revenue (Inland Revenue Service) (Member); (viii) Ministry of Interior (Member); (ix) National Command Authority/ Strategic Plans Division (Member); (x) Inter-Services Intelligence (Member); (xi) (Member); (xii) Securities & Exchange Commission of Pakistan (Member); (xiii) Central Depository Company of Pakistan (Member); (xiv) Pakistan Civil Aviation Authority (Member); (xv) Federation of Pakistan Chambers of Commerce & Industry (Member); (xvi) Ministry of Ports and Shipping (Member); (xvii) Federal Investigation Agency (FIA) (Member); (xviii) Ministry of Law and Justice (Member);

2. The Chairman/Secretary of the CRM Committee is authorized to include any member on as and when required basis.

3. The CRM Committee shall meet at least four times in one year for conduct of its business.

4. The powers and functions of the CRM Committee shall include the following:

(i) To coordinate, review and monitor the implementation and enforcement of the measures specified by the Federal Government from time to time in compliance of the UNSC resolutions on countering proliferation; (ii) To issue guidelines or operational procedures to be followed by all concerned for effective implementation and enforcement of the decisions of the Federal Government taken in compliance of the UNSC resolutions on countering proliferation; (iii) To exchange information amongst its members on regular basis in order to perform its functions under this Order; (iv) To seek assistance from or coordinate with any person within or outside Pakistan with respect to performance of its functions under this Order; (v) To conduct outreach to stakeholders for awareness and performance of its functions under this Order; and (vi) To do all acts incidental and ancillary to the performance of functions and exercise of its powers under this Order.

5. The CRM Committee shall periodically review the steps taken and activities performed by its members towards implementation and enforcement of the decisions of the Federal Government taken from time to time in compliance of the UNSC resolutions on countering proliferation, and any decision taken in consequence of such a review will be binding on all/any member(s) concerned.

6. In performance of its functions and exercise of its powers under this Order, the CRM Committee shall seek guidance from internationally recognized best practices.

7. The secretariat of the CRM Committee shall situate within the Ministry of Foreign Affairs.

8. The Federal Government shall remain actively seized of the matter.
