MEETING OF TOWN PLANNING COMMITTEE

Apologies for inability to attend were reported from Councillors Campbell, Hendron, McClenaghan and O’Neill.

Minutes

The minutes of the meeting of 21st August were taken as read and signed as correct. It was reported that those minutes together with the minutes of 26th June and 7th August, had been adopted by the Council at its meeting on 1st September, subject to the omission of matters in respect of which the Council had delegated its powers to the Committee.

Routine Correspondence

It was reported that correspondence had been received from various Statutory Bodies, Agencies and other organisations in respect of the undernoted items:

Notification from the Roads Service of its intention to create an Abandonment Order in relation to College Park/College Park East.

Notification from the Roads Service of its intention to create an Abandonment Order in relation to Donegall Quay.

Notification from the Roads Service of its intention to remove Disabled Parking Bays at:

(i) Cranmore Gardens; and

(ii) 19 Gibson Park Gardens.

Copies of the Orders, letters and maps relating to the above-mentioned matters were displayed at the meeting for the information of the Members.

Request for Deputations

The Committee noted that no request for deputations to attend had been received.

Shankill Road – Proposed Inbound Bus Lane

The Committee was advised that correspondence had been received from the Roads Service in relation to its plans to reintroduce a proposal to provide a new inbound bus lane approximately 1.3 km long on the Shankill Road, which would operate from 7.30 a.m. to 9.30 a.m. from Monday to Friday each week.

The Members’ Support Officer reminded the Committee that, at its meeting on 16th March, 2006, it had considered a similar proposal and had expressed concern that the Roads Service had not fully taken into account the views of the local Elected Representatives, who had expressed opposition to such a measure. Accordingly, the Committee had agreed to oppose the plan to introduce the bus lane and had suggested that further consultation should be undertaken with the local representatives.

The Roads Service’s correspondence indicated that the parking issues had been resolved following the decriminalisation of Parking Enforcement and the Roads Service would now seek to proceed to a full public consultation.

The Committee noted the information which had been provided.

Planning Applications

14 Deramore Park

The Committee was reminded that, at its meeting on 26th April, 2007, deputations had been received in respect of a planning application for an amendment to a previously approved application for a two-storey extension and associated works at 14 Deramore Park. Subsequently, the Committee, at its meeting on 17th May, 2007, had agreed unanimously that the matter be referred to the Planning Management Board for adjudication.

The Members’ Support Officer advised the Committee further that on 3rd August, 2007 correspondence had been received from the Director of Operations, Planning Service, indicating that the Management Board had considered the referral and decided that it had failed to meet the criteria outlined in the “Guidance for Council on the Operation of the Management Board Referral Procedures” which had been issued in September 2005. However, the proposal had been reassessed against all relevant policies and other material consideration and the Director of Operations had indicated, at that time, that she would direct the Divisional Planning Manager to seek advice on the application from the Department’s Conservation Architect and to discuss the matter with senior colleagues at Headquarters, prior to the issue of a decision. The Planning Officer highlighted the principal aspects of the application and advised the Members of the nature of the objections which had been lodged against the application. He informed the Committee that the instructions of the Director of Operations had been undertaken and, since the proposed amendments represented only a minor change from a pervious approval, the Divisional Planning Manager’s view remained to approve the application.

Resolved – That the Committee affirms its rejection of the opinion of the Divisional Planning Manager to approve the application in respect of amendments to a previous application for the construction of a two-storey rear extension to replace an existing extension, with the construction of a new rear balcony and alterations at 14 Deramore Park, on the grounds that such a development, if permitted, would:

(i) be unacceptable due to its scale, mass and design;

(ii) set an unacceptable precedent for further such developments within the area; and

(iii) be out of character with the surrounding area.

Arising from discussion in the aforementioned matter, a Member drew the Committee’s attention to the fact that on several occasions the Council has indicated its unanimous rejection of the recommendations of the Divisional Planning Manager. However, on very few occasions had the view of the Council prevailed, leading to a sense of frustration among the Elected Members that there was no democratic input into the planning process.

Accordingly, the Committee agreed to seek a meeting with the Chief Executive of the Planning Service, together with the Divisional Planning Manager in order to discuss the matter further.
