Outlook – Online September 19, 2013 HC Relief for J&J, Can Restart Production at Mulund Unit

In a relief for the baby products maker Johnson and Johnson (J&J), the Bombay High Court today allowed the company to restart the manufacturing of baby powder at its Mulund unit, which had been stopped upon the order of Maharashtra Food and Drug Administration.

FDA had ordered shut down of the plant for not treating a batch of talcum powder for ethylene oxide residue in 2007.

The division bench of Justices S J Vazifdar and K R Shriram was hearing a petition filed by Johnson and Johnson challenging the June 24 order of FDA appellate authority.

While allowing resumption of production, court today referred the matter back to the appellate authority for a reconsideration, saying that "the proportionality (of the punishment vis a vis the offence) issue needs to be seen".

In March, FDA cancelled the licence of the Mulund factory after it found that 15 batches of baby talcum powder manufactured there in 2007 were sterilised using ethylene oxide, a chemical that is widely believed to be carcinogenic.

FDA alleged that the company did not register the process with it, and failed to conduct tests for traces of ethylene oxide in the powder.

The company challenged the order, but in June the cancellation of license was upheld by the FDA's appellate authority.

Senior counsel Rafiq Dada, appearing for the company, said the company was not using ethylene oxide treatment process anymore.

FDA counsel Ashutosh Kumbhakoni had, however, opposed the petition and said the company had not expressed any remorse even after the issue came to light. Headline: The ban on Johnson has been lifted

Mumbai: J&J used a sterilization process to reduce the chances of contracting cancer which could arise from strains of bacteria present in baby powder. But the ethylene oxide used for sterilization was above the permissible limits, which led to the FDA cancelling their Mulund Factory License. As per the High Court’s decision, they have given J&J the green signal to resume manufacturing operations. The High Court on Thursday, advised the FDA to again appear for the hearing. In the year 2007, J&J manufactured 1,60,000 batches of talcum powder using cancerous substance ethylene oxide without the prior permissions to sterilize the powder.

In return, the FDA had taken strict action against Johnson & Johnson and cancelled their manufacturing license for all products and took strict action against them. Post FDA’s decision, J&J had filed an appeal in the High Court against cancellation of their license. The hearing was done in front of Judges SJ Vazifdar and MS Sonak. Post the decision, the judges has asked to complete the case with the appellate authority. Senior Advocate Ashutosh Kumbhakoni appeared for FDA in this case.

Post receiving the directives from the High Court, J&J spokesperson informed, “we will soon start the production of all their products at their Mulund Plant. Nothing is more important to us than the health of our consumers and we shall strive to win their confidence again, this is a very important decision for us.”

OUR BUREAU

MUMBAI, SEP 24: The Bombay High Court has allowed Johnson & Johnson to resume its manufacturing activities at the Mulund plant in Mumbai. Johnson & Johnson (J&J) had lost its license to manufacture cosmetics at the plant, with the Maharashtra Food and Drug Administration finding the company guilty of using ethylene oxide in a limited number of batches of baby powder in 2007.

Ethylene oxide is known to be a chemical that causes cancer. On the basis of a complaint, the Maharashtra Food and Drug Administration (FDA) had cancelled the company's Mulund plant licence.

In 2007, 15 finished batches of Johnson baby powder were found to have higher pH levels than the prescribed limits. These batches were reprocessed for pH correction, to meet the quality specification. However, due to the excessive manual handling of these 15 batches during reprocessing, the batches at the finished goods stage were treated with ethylene oxide to reduce the anticipated increase in bio-burden. The product had an expiry date of 2010.

However, on April 10, 2013, J&J received an order from the Maharashtra FDA cancelling its Cosmetic Manufacturing license at the Mulund plant, with effect from June 24. The company said the FDA did not issue a show cause notice to J&J before cancellation of the license.

An appeal against the order was filed with the Ministry of FDA in Maharashtra, requesting for an immediate stay, but was rejected by the FDA Minister of Maharashtra. The company subsequently filed a writ petition on July 12, 2013 in the Bombay High Court challenging the FDA order.

With the Bombay High Court setting aside the Maharashtra FDA order, the company has said it would resume cosmetic manufacturing at its Mulund plant in Mumbai in due course. ``We will continue to work closely with Maharashtra FDA, and provide safe, high quality products,'' said a J&J India spokesperson.

The FDA action was specific to the cosmetics production at the Mulund plant in India and did not impact global manufacturing or any other plants in India, the company said.

Bombay HC allows production in J&J Mulund unit, company welcomes

(UNI) The Bombay High Court has quashed the Food and Drug Administration's (FDA) order which had cancelled the manufacturing licence of the Johnson & Johnson (J&J)'s unit situated in eastern suburb of Mulund. The decision of the court now allows the company's baby powder facility, which was shut since June 24, to resume production.

The division bench of Justices S J Vazifdar and M S Sonak, while quashing the FDA's order yesterday, took into account 'compensation and closure' expense for the company, and observed that the matter was serious and must be looked into and reconsidered by the FDA minister, who is the appellate authority.

The FDA had alleged that the company sterilized 15 batches of baby powder boxes in 2007 with 'carcinogenic' ethylene oxide and did not check for its residue.

J&J, on their part, said that as part of an audit conducted in 2009, they had checked samples of three batches and found no residue.

Reiterating their stand, they said, 'We will continue to work closely with Maharashtra FDA, and to provide India with safe, high quality products that help people care for themselves and their families.'

J&J told the High Court that the 15 batches were brought back to its facility and tested according to a validated process before release into the market.

Reacting to the High Court decision yesterday, J&J, in a statement released today, said, 'We are very pleased to inform you that the Bombay High Court has set aside the Maharashtra FDA order and we will be resuming cosmetic manufacturing at our Mulund plant in Mumbai in due course.'

'Nothing is more important to us than the well-being of consumers, and we see this outcome as a significant step in restoring their confidence,' it added. UNI
