As eaters, we love to dine out. But we don’t love that one of the largest and fastest growing sectors of the United States economy, the restaurant industry, has 6 of the 10 lowest paying jobs in the US, including the absolute lowest legally allowable wage. The federal minimum wage for tipped workers is a mere $2.13/hour. Tipped workers are more than twice as likely (with servers almost three times as likely) to fall under the federal poverty line. Worse yet, that’s just one of the many low-road business practices prevalent in the restaurant industry.

This guide was created to help eaters find the restaurants that reflect our values, our basic beliefs of how others should be treated, and our dreams of reimagining the US workplace. We are inspired to have found “High Road” restaurants that prove another world is possible and profitable. And we are grateful to be able to recognize them in this guide, which we hope you’ll use for a regular dose of dining inspiration!

Another important tidbit, pun intended! This guide was also created to show eaters how the Top 100 revenue-grossing restaurants in the United States fared. We don’t want you to use this list solely as a means to choose where not to eat. In fact, we encourage you to communicate whenever you eat out at a restaurant that’s not awarded in this guide that you, the consumer, care about the wages paid, benefits provided, and opportunities for advancement given to workers in the restaurants in which you dine. Don’t worry, we haven’t left you hanging. In the “How you can use this Guide” section we’ve provided some great and simple ways you can take action with your forks, your signatures, and pocketbooks.

1 Before you get to the good stuff, here’s a little more to put into your knowledgebank... Over the last twelve years, the Restaurant Opportunities Center has grown into a national restaurant worker’s organization seeking improved wages and working conditions for one of the nation’s largest and fastest growing sectors.

What we seek to change: 1 POVERTY WAGES More than half of all restaurant workers nationwide earn less than the federal poverty line. The Fair Minimum Wage Act which would raise the federal minimum wage from $7.25 to $10.10/hour over the next 3 years and the tipped minimum wage from $2.13 to 70% of the regular minimum wage. The Act would lift millions out of poverty and cost consumers at most an extra dime a day.

2 LACK OF EARNED SICK LEAVE 90% of restaurant workers surveyed nationally reported not having paid sick days, and two-thirds report , preparing, and serving our while sick. The Healthy Families Act would guarantee workers a minimum number of paid sick days, ensuring that workers are not sick while touching our food!

3 OCCUPATIONAL SEGREGATION People of color, women, and immigrants largely occupy the lower-paid positions in restaurants. Nearly 60% of restaurant workers surveyed nationally report lack of training for internal promotions. We’ve found a $4 wage gap between white workers and workers of color. ROC has won 17 campaigns winning over $8 million in back wages and policy changes to the restaurant companies, including internal promotions policies creating career paths and ladders based on merit and seniority. In these campaigns, we have found that consumer demand for racial equity in restaurants has significant impact on this 2 issue. How this Guide works

Before we tell you how it works, isn’t it important to know how we got all these restaurants on this guide? Here’s how we did it...

Working with students from Georgetown University and University of Denver*, we asked restaurants about their practices with regard to: a) wages for tipped workers and non-tipped workers, b) paid sick leave policy, c) advancement opportunities for workers to move up the ladder.

We asked this information from all of our ‘high road’ restaurant partners in our eleven current affiliate cities and from the top 100 highest revenue-grossing restaurants in the United States. Data was taken from the Nation’s Restaurant News’ Top 1001. Specifically we chose to use unit-level trends--a unit is identified as an individual restaurant--which ranks top 100 highest revenue-grossing restaurants in the United States².

Using this Top 100 list at the unit level, we first attempted to call corporate offices; in the case of companies that did not respond at the corporate level or companies that are franchised, we called individual restaurant locations about the lowest paid wages, paid sick days policy, and internal promotions policy**.

Some restaurants did not provide us with all requested information. If any of these restaurants -or any other in the United States- can provide us with this information, we would be happy to update the Guide.

*We thank the students of Professor Aaron Schneider from the University of Denver and Professor Sarah Stiles from Georgetown University for all their hard work on this project. Specifically, Julie Leebove, Hans Schaler, Erin Orsley, Julia Lopez, and Denise Recinos. **For restaurant chains with multiple locations, we asked about these practices from restaurants within the chain primarily in Alabama and Texas, Louisiana, Mississippi, South Carolina, Tennessee, 3 and Georgia. In all of those states, there is no state labor law and only federal labor law applies; thus, wages paid in establishments in those states would be the lowest wage paid by the restaurant chain anywhere in the country. Time for some grading... Restaurants can earn up to 5 points in the grading system. They receive one point for every criterion met.

If the restaurant receives 2 out of 5 points, they are awarded a silver STAR.

If the restaurant receives 3 out of 5 points, they are awarded a gold STAR.

Based on the information gathered, when a restaurant earns a point, it is indicated with the following symbols:

RAISE OR Restaurant Roundtable MEMBER A restaurant that belongs to RAISE or one of ROC’s Restaurant Industry Roundtables: a group of employers working to promote the high road to profitability in the industry.

Tipped worker wages – A restaurant receives a point if their lowest starting wage for a tipped worker is at least $5 an hour anywhere in the United States. Tipped workers include servers, runners, bussers, bartenders, barbacks, and expeditors. Although there are many states that do not have a tip penalty, this ROC National Diners’ Guide is based off increasing the federal wage of $2.13 for tipped workers. The $5 subminimum wage as a criterion is meant to highlight our goal of phasing in the Fair Minimum Wage Act over a 3-year period to 70% of the regular minimum wage, or eventually $7.

4 non-tipped worker wages - A restaurant receives a point if their lowest starting wage for a non-tipped workers at least $9. Non-tipped workers include host/ hostess, dishwashers, prep cooks, line cooks, and porters. There are a few cities with higher wages such as San Francisco, again, the premise is to raise the federal minimum wage currently at $7.25. The $9 wage as a criterion is meant to highlight our goal of phasing in the Fair Minimum Wage Act over a 3-year period to $10.10.

PAID SICK DAYS - A restaurant receives a point if it provides paid sick days to its part-time and full-time employees through a paid sick day policy or by policies allowing for paid time off to be used for sick days.

INTERNAL PROMOTION - A restaurant receives a point if at least 25% of all non-entry-level positions were filled by internal promotion and at least 10% of non- management employees have tenure of 4+ years

OR

50% of its current employees have been promoted internally.

0 DECLINED TO ANSWER Despite several attempts, this restaurant refused to report on this criterion or does not X know if they provide the benefit.

6 How you can use this Guide

You can make a difference for the 10 million plus restaurant workers across this nation in several simple ways. Your support of High Road restaurants is a great first step. Supporting our efforts to guide restaurants into the High Road is a great second step. The final and sometimes more difficult step is holding Low Road employers accountable and ensuring they see the light at the end of the tunnel. That light is one of dignity and respect by responsibly moving towards livable wages, providing benefits, and increasing internal promotions. So enough talk, here are real actions you can take today.

1 Eat Ethically at a High Road Restaurant! Support our High Road restaurants and don’t forget to remind them why you came in. High Road restaurants are listed in the “Awarded ROC Restaurant” section.

2 Join an EatUp! If you want to see more High Road restaurants in your neighbor- hood, join The Welcome Table, a national network of ethical eaters who EatUp! for change. Visit TheWelcomeTable.net or email [email protected] for more info.

3 Support the Fair Minimum Wage and Healthy Families Acts Sign onto our petitions demanding that Congress raise the federal minimum wage for tipped workers, currently at $2.13/ hour, and provide paid sick days for all workers. You can send these petitions by visiting our website, at www.rocunited.org.

4 Hold Low Road Employers Accountable You can help by supporting workers with charges against restaurant employers who are violating the law. You can call the company to let them know that you won’t support such illegal practices or call your local ROC office to see how you can hold employers accountable. If you are located in a city with an active campaign against Darden Restaurants, such as the Capital Grille, you can attend a local action in your city. Follow actions by 7 visiting the campaign website, www.dignityatdarden.org. 5 Give a Tip We’re talking about two kinds of tips here. First, always tip your servers well, they’ve been on their feet all day! Second, everywhere you dine, share the tip cards located at the end of this guide giving managment tips on how they can either be recognized as a High Road employer or how they can get in touch with ROC to help them create sustainable and equitable workplace practices.
