PROCEEDINGS OF 181st MEETING OF THE ERC-NCTE HELD ON 18th – 19th FEBRUARY, 2015

The 181st Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 18th-19th February, 2015 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 181st ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Shri Chandrapida Neelap (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision. Sl. The committee unanimously decided that the institution may reply in response to the decision of the committee uploaded on the ERC website without waiting formal letters from the office of ERC. The replies so received will also be considered by the committee.

1. The institution whose applications are pending and reached to the stage of 7(9) [7(13) as per New Regulation] including the institution already submitted the reply of 7(13) prior to publication/implementation of NCTE Regulations 2014 are advised to submit/re-submit their reply as per New Regulations alongwith other required documents at the earliest to enable to ERC to take appropriate decision.

2. The cut-off date for grant of recognition is 3rd March 2015 for the session 2015-16. Institution are personally responsible if they lose the session due to non-submission or late submission of replies.

3. The institutions which have not submitted the balance amount of Rs.4.00 Lacs towards Reserve Fund expected to submit the same.

4. The institution need to submit list of 10 schools for internship and school based activities duly approved by District Education Officer.

5. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier.

6. The institution must go through the Regulations 2014 about the number of teachers and accordingly they must send the list duly countersigned by the Concerned University /Affiliating Body.

The institution preferred appeal before the Appellate Authority and the Appellate Authority did not admit the appeal on the sole ground of delay in filing the appeal by 52 days and the appeal is not admitted vide its order dated 15.10.2013.

Being aggrieved by the decision of the ERC and Appeal Committee the institution has filed writ petition vide W.P. No 33782 (w) of 2013 in the Hon’ble High Court of Calcutta. The Hon’ble High Court of Calcutta disposed of the case on 27.01.2014 and directed inter alia

“Accordingly I set aside the order dated 15th October, 2013 and directed the respondent authority to re hear out the appeal on merit upon giving the parties an opportunity of hearing and to pass a reasoned order within eight weeks from the date of communication of this order and to communicate the reasoned order by two weeks from the date of passing such order”.

The Appellate Authority i.e NCTE Hqrs. heard the matter again in terms of the direction of the Hon’ble High Court at Calcutta on 11.04.2014 and confirm the ERC NCTE order dated 18.01.2013 vide its order dated 06.06.2014.

Accordingly, the order of the Hon’ble High Court has been complied. The same was not intimated to the ERC, NCTE by the institution. In the absence of the information regarding hearing of the Appellate Authority and passing a Reasoned Order, the ERC in its 171st meeting authorized the Regional Director to call the petitioner for hearing their case and thereafter a reasoned order communicate to the petitioner.

The Secretary/correspondent of the institution was called for hearing on 07.07.2014 at 10.00 AM vide letter dated 17.06.2014. The representatives of the institute attended during personal hearing on 07.07.2014. The Regional Director has apprised the facts on record in the light of the judgment of the Hon’ble Supreme Court “Those who are desirous of establishing teacher education colleges/institutions shall be free to make application in accordance with the new regulations. Their applications shall be decided by the competent authority keeping in view the relevant statutory provisions”.

Accordingly, the institution was advised to apply afresh during the personal hearing.

The petitioner institution without waiting for the notification by NCTE for submission of application for new Teacher Training Programme filed a Contempt Petition in the Hon’ble High Court of Calcutta vide C.P.A.N No 2514 of 2014.

In view of the above, the committee decided as under: The Regional Director is authorized to defend the case.

As per the record, the applicant for the M.Ed. course is the Principal, Lakshmi Narayan College, Vill/Po - Bhagwanpur, Dist - Vaishali, Bihar which has been given recognition for B.Ed. course from the academic session 2012-2013. As such, the institution is not eligible for M.Ed. course.

The institution has submitted a letter of Babasaheb Bhimrao Ambedkar Bihar University, Muzaffarpur under the signature of the Registrar addressed to the Principal, Lakshmi Narayan College which revealed that the University has requested to the Higher Education Department, Govt. of Bihar, Patna for passing order for introduction of M.Ed. course and establishment of University Department of Education in Lakshmi Narayan College, Bhagwanpur.

If the proposal for establishment of Department of Education has been approved by the Department of Higher Education, only the University is eligible to apply for the M.Ed. course not by the Principal, Lakshmi Narayan College.

Programme from the annual system to semester system w.e.f July/August 2015. Then, the Principals of all Colleges of Teacher Education (CTEs) had requested the University to allow them to run simultaneously the B.Ed. one-year annual system from February to December 2015 as an interim arrangement for its smooth transition. This was done long before NCTE notified its new norms and standards which the University had approved in the 91st Academic Council meeting dated 3rd June 2014 vide the minutes of the 91st Academic Council meeting resolution No. AC: 2014:4:)(xiv):II(v)(a) & (b).

Since the process of admission in the CTEs had completed in September 2014 and classes had already commenced from February 2015, the one-year B.Ed. course will have to continue in the interest of the students, the college of Teacher Education and the University.

However, the University will ensure that all the CTEs are to start simultaneously the two-year B.Ed. programme from July/August 2015 as per the new regulations, norms and standards as notified by the NCTE.”

(i) Clarification letter was issued to the institution on 11.02.2014 on the following reasons: a. The plot No. mentioned in the LPC is 692 only which is not indicated in the application form & other related land document. It appears that the possessed land is different from the submitted land documents as the plot No. 692 is not tally with submitted land documents.

(ii) The institution vide representation dated 22.02.2014 requested to give 3 months time for submission of the corrected land possession certificate (LPC). (iii) The committee accepted the request of the institution to submit the LPC within 21 days. (iv) The institution has not submitted an affidavit and willingness to adhere to the new Regulation 2014 along with the balance amount of Rs. 4 lakhs towards Reserve fund.

VTR, the Committee discussed the matter in detail and decided as under:

Formal recognition/permission order under clause 7(16) of the NCTE Regulation 2014 for applied additional course B.Ed. with an intake 50 of one basic unit from the academic session 2015-2016 may be issued to the institution.

Sri Ramkrishna College of Education, Plot No.548, Vill.-Belun, P.O.-Ashudkola, 111. 181.12(ii).2 Tehsil/Taluka-Goghat, Town/City-Bengai, Dist.-Hooghly, West Bengal-712611 (B.Ed.) (Private) (The Burdwan University) (ERCAPP97/2012) After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs. VTR and reply dated 12.02.2014 in response to show cause notice issued after VT, the Committee discussed the matter in detail and observed as under:

(i) The institution has not submitted an affidavit and willingness to adhere to the new Regulation 2014.

In view of the above, the committee decided as under: VT be constituted after submission of inspection fee of Rs. 50,000/- along with an affidavit and willingness and the balance amount of Rs. 4 lakhs towards Reserve fund.

Presidency College Motbung, Plot No.-152, 151/246, 166/280, 167, St. No.-31, 112. 181.12(ii).3 Vill.-/Tehsil/Taluka-Kanglatongbi, Town/City-Imphal West, Dist.-Senapati, Manipur-795107 bearing (B.Ed.) (Code No. ERCAPP131/2012) After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and observed as under:

(i) The institution was summarily rejected under clause 7(1-A)(ii) on 05.04.2013. (ii) The Appellate Authority vide order dated 06.06.2014 remanded back the case to ERC with a direction to process the application further as per the new Regulations. (iii) The ERC in its 173rd meeting held on 26th June 2014 considered the appeal order and noted the decision of the Appellate Authority. (iv) Application and other documents have been returned to the institution along with rejection order.

In view of the above, the committee decided as under: (i) Institution be directed to re-submit the application along with required documents, as per new Regulation 2014. (ii) DL be issued to the institution with a direction to submit the reply within 60 days from the issue of the letter before the Committee takes final decision.
