Course description: In this programme, the speakers will focus on the following topics

1) Current Developments in Investment Arbitration

The speaker will discuss the UNCITRAL project on the use of the Mauritius Convention mechanism for the creation of a multilateral permanent investment court.

2) Good Faith and Implied Terms in Financial Contracts and Banking Relationships

The speaker will discuss updates of recent cases on the subject (in and also from other jurisdictions), followed by an analysis of the extent to which the principle of good faith has a particular relevance in these kinds of agreements.

This will be followed by a panel discussion where the moderator will be posing questions related to the topics, and the speakers will be providing their unique perspectives and insights based on their experiences with the various processes. The seminar will also end off with a short Q&A where the speakers will take on any burning questions from the audience.

About the Speakers:

Salim Moollan QC – Essex Court Chambers

Salim Moollan QC has been in private practice as a at Essex Court Chambers since 1998, specialising in international and commercial law, and in particular investment and commercial arbitration. He is a past Chairman of UNCITRAL and of the UNCITRAL Arbitration Working Group, a former Vice-President of the International Court of Arbitration of the ICC, a member of the LCIA Court, a Visiting Professor in International Arbitration Law at King's College , a member of the Editorial Boards of the ICSID Review, of the Revue de l’Arbitrage and of Arbitration International, and a member of the ICSID Panel of Arbitrators.

Joe Smouha QC – Essex Court Chambers

Joe Smouha is widely recognised as one of the leading silks at the Commercial Bar, “firmly established in the super league” as “one most complete QCs” and “a standout Silk”. His high profile practice spans a vast array of fields in international and domestic commercial law. He appears regularly in the High Court and appellate courts, international arbitrations conducted in the UK (including ICC and BIT panels) and abroad. In addition he appears before courts in offshore jurisdictions, such as the BVI and Cayman Islands. He also acts as arbitrator in commercial and investment treaty disputes. He is a former Chairman of the Commercial Bar Association (COMBAR), a Bencher of and sits on the Bar Council as the Middle Temple representative.

Adam Board – Essex Court Chambers

Adam Board is a junior barrister at Essex Court Chambers. He undertakes a broad range of commercial work with particular interests in international arbitration, shipping and civil fraud. He has appeared as counsel in the High Court of England and Wales and in international arbitrations seated in London and Singapore. Adam is frequently instructed by practitioners based in Asia and has worked closely with law firms in Singapore, Hong Kong, China, Pakistan and South Korea. His recent cases include several large shipbuilding arbitrations, chartering disputes, share purchase disputes (including allegations of fraud) and claims arising from bank guarantees. Adam has also been appointed as tribunal secretary in a large and high-value ICC arbitration. In 2014, Adam was an ambassador for the Bar Council of

England and Wales in its inaugural exchange programme in Seoul, South Korea. He has been a member of the organising committee for the ECC-SAL Mooting Competition for the past five years.
