Behold, the fourth and final installment of the TMCEC Academic Schedule for Academic Year 2021 (June 1, 2021 - August 31, 2021).

What Are You Waiting For? In late February, TMCEC announced in a statewide e-blast that all TMCEC events will be virtual through at least July 31, 2021. All regional seminars and the vast majority of TMCEC summer programing will continue to be offered exclusively online. Online registration is now open for virtual events through the end of July. Register now!

A Different Kind of Stimulus Package On April 9, 2021, the TMCEC Board of Directors reduced registration fees to $50 for all TMCEC events in July and August. This is intended to increase participation throughout the summer.

Additionally, the Board authorized financial assistance to all judges and municipal court personnel from now through the end of summer. This means that even if you have already attended training this academic year, you are a judge, clerk, court administrator, juvenile case manager, or prosecutor, and your city does not have adequate training funds to participate in TMCEC summer events, please let us know.

Timing Is Everything. It has been more than one year since the beginning of the pandemic and TMCEC last conducted in-person training. If everything goes as planned, TMCEC will resume in-person training in August. Preparations are underway. However, the safety of participants, faculty, and staff remain our top priority. A decision regarding in-person training will be made by the end of June.

While Texas has made considerable progress in its efforts to decrease the spread of COVID-19 and increase vaccine distribution statewide, we are not out of the woods yet. COVID-19 variants are on the rise. Accordingly, it is important to emphasize that if we can resume in-person training in August, for logistical, public health, and other reasons, TMCEC will only be able to accommodate 50 to 100 people per event. This is potentially unwelcome news for people wanting to attend a Legislative Update in person. However, here is the good news: the Austin Legislative Update on August 24 will be simulcast live on the internet (there is no maximum seating capacity and no social distancing or mask is required).

No Retreat No Surrender We have remained true to our plan announced at the beginning of AY 21. To promote certainty even during uncertain times, scheduled events that were not able to be held in-person because of COVID-19 have been offered as live, synchronous virtual seminars on the same scheduled dates. The same will be true for the remaining events in August.

2 TMCEC Summer Academic Schedule (June - August 2021) RULES OF JUDICIAL EDUCATION Judicial Education Is Still Mandatory and More Important than Ever.

Judicial Education is still mandatory and more important than ever. According to the Rules of Judicial Education, all municipal judges (both attorney and non-attorney) must complete a minimum of 16 hours of judicial education every year. Newly appointed or elected attorney judges must satisfy their 16-hour requirements by attending an entire TMCEC regional conference within one year from appointment or election and another TMCEC regional conference in its entirety the following year. To qualify as an attorney judge, you must be licensed by the State Bar of Texas. Newly appointed or elected non-attorney judges must, within one year of the date of appointment or election, complete 32 hours of continuing judicial education from TMCEC before attending an entire regional conference the next year. After judges have completed at least two years of required judicial education through TMCEC, municipal judges must complete eight hours of judicial education through a live, continuous presentation from TMCEC, but may complete the remaining eight hours (often called flex-time) through live presentations, approved online education, or any combination of approved live events and online education (but see below for changes to the Rules of Judicial Education during the COVID-19 state of disaster).

The TMCEC academic year is September 1, 2020 through August 31, 2021. Judges who have been on the bench longer than one year must attend an approved program once per year for judicial education credit regardless of birth date or date of appointment. This is a different reporting period than the State Bar’s Minimum Continuing Legal Education (MCLE) rules for attorneys, which are based on birth date.

On March 30, 2020 the Court of Criminal Appeals issued an emergency order suspending all sections of the Rules of Judicial Education that require live, continuous hours of judicial education that would prevent a judge from completing his or her hours during the disaster.

Here is a summary of the order and its implications in AY 21: • All municipal judges are still required to complete 16 hours of judicial education by August 31, 2021. • Normally, each judge would need to satisfy at least eight of those hours (or all 16 for a judge completing a first or second year of education) through live, continuous training. Now, however, all 16 hours can be com- pleted by electronic means until thirty days after the Governor lifts the Declaration of State of Disaster. • The order only suspended required live, continuous training. It did not expand the list of approved online providers. (TMCEC is the only approved provider of online education for municipal judges.)

The Waiver Process If a judge is unable to complete the mandatory 16 hours of judicial education within the academic year (September 1, 2020 - August 31, 2021), he or she may request a waiver from the Municipal Courts Education Committee. A form to make this request can be obtained from TMCEC (800.252.3718) or online. The Committee typically reviews requests for waivers in September after the end of the academic year. If an emergency situation has occurred and is well-documented in the request for a waiver, the Committee may grant a conditional waiver that will require the judge to attend two conferences (one at his or her own expense) in the next year. Only in rare cases is an unconditional waiver granted. If a waiver is denied, the judge’s name is sent to the State Commission on Judicial Conduct. With all the programs being held this year, it is unlikely that the Committee will view requests for either unconditional or conditional waivers with any leniency.

TMCEC Regional Seminars remain one of the best ways for judges to obtain their education hours. Texas is a big state (268,820 square miles). For more than 30 years, regional seminars have played a central role in how TMCEC provides continuing education to judges and clerks in cities of all sizes. This summer, TMCEC will host the final AY 21 Virtual Regional Judges Seminar featuring a focus on West Texas from June LAST REGIONAL IN 28-30, 2021. Registration is $100. AY 21! Each regional seminar features a common curriculum. However, each one has a distinct regional flair, making it a one-of-a-kind event. We will tailor the online regional seminars scheduled in June to judges in West Texas. 4 TMCEC Summer Academic Schedule (June - August 2021) VIRTUAL NEW JUDGES SEMINAR (NON-ATTORNEYS) Designed for new, non-attorney judges, this virtual seminar will be held from July 26-30, 2021 and will offer 32-35 hours of judicial education. The Rules of Judicial Education require that all municipal judges who are not licensed by the State Bar of Texas attend 32 hours of TMCEC judicial training within one year of the date of their appointment or election. Admission is limited to new, non-attorney municipal judges. Non-attorney municipal judges who have been inactive for two or more consecutive academic years are required to repeat the new judges program. Participants must be appointed to office prior to registration. Registration is $50 and registration is open now. DATES: Mayors are only eligible to attend if a general-law municipality has activated VIRTUAL NEW JUDGES its court but has not created the position of or appointed a municipal judge SEMINAR (including presiding, associate, alternate, or substitute judge). IMPAIRED DRIVING IMPAIRED DRIVING SYMPOSIUM SYMPOSIUM CORPUS CHRISTI This joint seminar is hosted by TMCEC, the Texas Association of Counties, the Texas Justice Court Training Center, and the Texas Center for the AUGUST 2-3, 2021 Judiciary, with funding from the Texas Department of Transportation. The symposium gives municipal judges the opportunity to converse and network with judges from other levels of the judiciary with the goal of streamlining impaired driving cases from arrest to disposition. The symposium will be particularly beneficial to judges who perform magistration. This conference features vibrant speakers on a wide range of impaired-driving-related topics. It will count for eight continuous hours of judicial education credit as well as CLE for attorneys. Registration is $50 and will open in June. More information will be available at that time.

VIRTUAL NEW CLERKS SEMINAR The New Clerks Seminar is for clerks that are either new to the role of court clerk or have never attended the seminar. The goal of the program is to introduce court clerks to the fundamental laws and processes involved in the operation of a municipal court. Individuals primarily working in other roles, such as bailiffs, prosecutors, and city staff, are not permitted to register for this event. Participants can earn 32-35 hours of clerk certification credit. Registration is $50. The seminar will be held July 26-30, 2021. Many cities are unaware that municipal court clerks are court officers and their actions can and do bear directly on proper court operations. If a clerk oversteps the bounds of his or her authority, the clerk, judge, and city may be subject to liability. Also, many clerks are unaware that the Code of Judicial Conduct requires them to observe similar standards of fidelity and diligence that are required of judges. This program helps clerks perform their jobs more effectively, accurately, and ethically.

VIRTUAL COURT ADMINISTRATORS CONFERENCE The Virtual Court Administrators Conference will be held on June 21-23, 2021. This conference is designed to develop the administrators' knowledge of both law and court management fundamentals. This conference is also integrated into the Level III requirements of the Court Clerks Certification Program. Court administrators who are not participating in the certification program may also attend. Registration is $100.

JUVENILE CASE MANAGERS SEMINAR REGISTER NOW! TMCEC is excited to offer three days of virtual training for juvenile case managers this summer, from June 9-11, 2021. The Virtual Juvenile Case Managers Seminar is designed to promote job consistency across court systems, enabling JCMs to be more professionally effective and to optimize their multifaceted role in the courtroom work group. The course provides a forum to discuss how to prevent children from further involvement in the justice system and how to curb juvenile crime at the local level. The curriculum includes topics mandated by the legislature for juvenile case managers. Registration is $100.

Since 1992, TMCEC has offered specialized continuing legal education to prosecuting attorneys in municipal courts across the state. Currently, more than 700 attorneys licensed in Texas prosecute in municipal courts. The TMCEC Prosecutors Seminar is uniquely designed to help prosecutors and other attorneys stay abreast of the information necessary to maintain professional competence. The second Virtual Prosecutors Seminar will be held June 21-23, 2021. The agenda is designed to address a broad range of issues applicable to courts of all sizes. This year, speakers will address changes authorized by emergency orders from the Texas Supreme Court and the Court of Criminal Appeals alongside practical issues and practice considerations for conducting eCourt. Attendees will also get highlights from the 87th Legislative Session, looking at legislation affecting municipalities. Registration is $100 ($200 with CLE). This conference will be submitted for approval for up to 13 hours of MCLE credit – including up to 2 hours of ethics from the State Bar of Texas and the Texas Board of Legal Specialization (credit towards the continuing legal education requirements for certification and recertification in Criminal Law). The Texas Municipal Courts Association (TMCA) Board of Directors has adopted a $100 CLE fee. The fee is voluntary, is deposited in the TMCA private fund account, and is used for expenditures designed to benefit municipal courts but not allowed by the Court of Criminal Appeals.

Following the 87th Legislative Session, TMCEC will offer four seven-hour Legislative Updates (including an optional one-hour Q&A session). These updates, to be held in August 2021, will cover new legislation enacted by the 87th that is most relevant to municipal judges, court personnel, prosecutors, and the communities they serve. Legislative Updates are tentatively scheduled as in-person events in various locations. How- ever, it is possible that these events will be held as virtual live events. Registration will open for these events in June. More information will be available at that time.

The registration fee is $50. For attorneys, there is a voluntary $50 CLE fee. This event will not be reported for TCOLE credit and should not be confused with the TCOLE State and Federal Law Update (Course #3187).

TMCEC will host a Virtual Magistrates Conference from July 7-8, 2021. This conference is part of the C3 Initiative (Councils, Courts, and Cities). C3 is a public information and education campaign created by TMCEC that aims to help fill the information gap between city halls and municipal courts in Texas. The purpose of C3 is to highlight issues and increase awareness and understanding of municipal courts in Texas for mayors, city council members, city attorneys, and other local officials. A practical method of obtaining additional knowledge about the municipal court and judicial process is to seek assistance from experienced courts in neighboring cities. Most municipal courts will be happy to assist others in need of help. When it is safe, an on-site visit to a neighboring court while in session may be particularly beneficial, especially for new judges and other new court employees.
